MONTGOMERY COUNTY COMPREHENSIVE WATER SUPPLY AND SEWERAGE SYSTEMS PLAN APPROVED 2003 - 2012 PLAN CHAPTER 1: OBJECTIVES AND POLICIES I. INTRODUCTION A. Plan Goals and Objectives – The overall goal of the Comprehensive Water Supply and Sewerage Systems Plan is to ensure that the existing and future water supply and sewerage system needs of Montgomery County are satisfied in a manner consistent with the following specific objectives: Community water supply and sewerage systems proposed in the plan shall emphasize service to the urbanized areas of the county, shall support the land-use recommendations adopted by the M-NCPPC in County Council-approved local area master plans, and shall be consistent with the provision of other public services. The Plan shall support the State of Maryland Smart Growth initiatives that direct State funding for public services and infrastructure to identified growth areas. The county’s water supply and sewerage system needs are satisfied in a cost-effective manner that protects or improves the quality of the water resources of the county, from both public health and environmental standpoints. The Plan shall address needs and solutions, including recommendations for capital projects, of the complete water supply and sewerage systems, from the point of withdrawal of the raw water supply to the point of final disposal or reuse of wastewater effluent, including the treatment or disposal of water and wastewater treatment by-products such as water filtration solids and sewage sludge or biosolids. Specific public health problems related to water supply and wastewater disposal in all areas of the County shall be identified in the plan and appropriate solutions, including community water and/or sewerage systems and capital projects if required, shall be recommended. The Plan shall address the variable soil and groundwater conditions within the county and attempt to protect or enhance groundwater resources where practical. Focus plan updates on comprehensive amendments--particularly for water and sewer service area categories--which implement master plan recommendations, rather than on individual requests for service area changes.

Specificpublichealthproblemsrelatedtowatersupplyandwastewaterdisposalinallareasofthe Countyshallbeidentifiedintheplanandappropriatesolutions,includingcommunitywaterand/or seweragesystemsandcapitalprojectsifrequired,shallberecommended. ThePlanshalladdressthevariablesoilandgroundwaterconditionswithinthecountyandattemptto protectorenhancegroundwaterresourceswherepractical. Focusplanupdatesoncomprehensiveamendmentsparticularlyforwaterandsewerservicearea categorieswhichimplementmasterplanrecommendations,ratherthanonindividualrequestsfor serviceareachanges.

TheseobjectivesareaccomplishedintheplanwiththesupportandcooperationoftheWashington SuburbanSanitaryCommission(WSSC),theMarylandNationalParkandPlanningCommission (MNCPPC),municipalgovernmentswithinMontgomeryCounty,andvariousCountyagencies.TheCounty alsoseeksthesupportandconcurrenceofPrinceGeorgesCountyinregardtobicountyissues.

B. PurposeThegeneralpurposeofChapter1oftheComprehensiveWaterSupplyandSewerage SystemsPlanistosetforththelaws,regulations,andpoliciesuponwhichtheplanisbased.Thischapter includesthegeneral,orcountywide,legalandpolicyissuespertinenttoMontgomeryCounty.Otherlegal andpolicyissuesthatareonlyrelevanttoaparticulartopic,suchasregionalwatersupplyplanningor biosolidsmanagement,aredeferredtothechapterofthePlanthataddressesthattopic. ThissectionChapter1presentsthelegalrequirementsforpreparationofthisplanandthe responsibilitiesofthegovernmentagenciesinvolvedinpreparingthisplanandinmanagingtheCounty's watersupplyandseweragefacilities.Theremainderofthischapterisdividedintosectionsdiscussingthe policiesandproceduresfortheprovisionofwatersupplyandsewerageservice,andthepoliciesforwater andseweragesystemsfacilities. C. LegalRequirementsEachCountyinMarylandisrequiredbyStatelawtohaveacomprehensive planthatdealswithwatersupplyandseweragesystemneedsforatleastatenyearperiodintothefuture. ThespecificlegalrequirementisembodiedinEnvironmentArticle,Subtitle5,"CountyWaterandSewerage Plans,"Sections9501through9521,oftheAnnotatedCodeofMarylandandtheCodeofMaryland Regulations,Title26,"Environment",Subtitle3,Chapter1,"PlanningWaterSupplyandSewerageSystems" (COMAR26.03.01.01.08).ThisComprehensiveWaterSupplyandSewerageSystemsPlanfulfillsthis legalrequirement. TheAnnotatedCodeestablishestheauthorityfortheWaterandSewerPlananddelegatesthatauthority tothecounties.TheAnnotatedCodealsoestablishestheproceduresbywhichthecountiesprepare,adopt, andamendtheirwaterandsewerplans.Sections9515through9518providepoliciesspecificto MontgomeryandPrinceGeorgesCountieswhichsupersedeotherrelatedsectionsoftheCode. MontgomeryCountyisrequiredtocomprehensivelyreviewandupdatethisplantriennially(onceeverythree years.)COMAR26.03.01.01,etseq.,specifiestherequirementsforformatandminimumcontentsforeach county'splan.Inadditiontothespecificlegalrequirementsforthisdocument,therearenumerousFederal, State,andlocallawsandregulationsthatapplytothewatersupply,sewerage,andruralsanitationneedsof theCountyaddressedinthisplan.Manyoftheseadditionallawsandregulationsarediscussedinthe chaptersofthisplanwheretheyaremostrelevant. D. GovernmentResponsibilitiesforWaterandSewerServiceTheresponsibilitiesofplanningfor theavailabilityofandprovidingwaterandsewerageserviceinMontgomeryCountyaremultijurisdictional anddependonthecooperativeeffortsofCounty,bicounty,municipal,State,andregionalagenciesand authorities. This is especially true with regard to the use of the Potomac River, a shared raw water source for several jurisdictions, and the Blue Plains Wastewater Treatment Plant (WWTP), a regional sewage treatment facility located in the District of Columbia. These governmental agencies, and their primary responsibilities, are described in the following sections.Figure1F1depictstheinterrelationshipsofthepublicandthegovernmentagenciesprimarily involvedinpreparingthisPlanandinmanagingthewatersupplyandseweragesystemsserving MontgomeryCounty. *TheCityofRockvilleandTownofPoolesvilleoperatecommunitywaterandseweragesystemslargelyseparatefrom WSSCssystems.Therefore,therelationshipbetweenthesemunicipalitiesandtheCountyCouncilislessdirectthanwith otherjurisdictions,andisfocusedprimarilyoncoordinationinthisWaterandSewerPlan.

Montgomery County Government -- Under State law, Montgomery County has

planning authority for the availability and adequacy of water and sewerage service and for land use in the county. The County government also maintains the countys land use planning and zoning authority. The County coordinates the planning and development of water supply and sewerage facilities with County land use, staging, adequate facilities, capital improvements, and environmental protection goals. The objective is to develop this Comprehensive Water Supply and Sewerage Systems Plan (CWSP) such that the water supply and sewerage systems are consistent with County land use planning. The CWSP incorporates all or part of subsidiary plans of the municipalities, sanitary districts, privately-owned facilities, and local, State, and federal agencies which have existing, planned, or programmed development within the county. The County reviews and adopts the Water and Sewer Plan on a triennial basis, and also reviews and acts on proposed plan amendments at intervals between mandated, triennial updates. a. County Council -- The Montgomery County Council consists of nine elected Council members, four elected at large and five elected from councilmanic districts. The Council establishes a set of broad objectives and policies (including master plans, staging plans, and fiscal policy) to be followed in preparing the Recommended Water and Sewer Plan. After receiving the triennial submission of the recommended plan from the County Executive and allowing a period for comments by public agencies and interested parties, the Council holds a public hearing on the Executives recommended Plan. Following worksessions, the Council amends and formally adopts the Plan. The Council also receives semi-annual transmittals of amendments to the plan from the Executive. Following a public hearing, the Council acts on the proposed amendments and incorporates them, as appropriate, into the

Plan. The Council similarly reviews and approves both the annual WSSC Capital Improvements Program (CIP) for water supply and sewerage projects and the annual WSSC operating budget. b. CountyExecutiveStatelawrequirestheCountyExecutivetoprepareacomprehensive updateoftheComprehensiveWaterSupplyandSewerageSystemsPlanforconsiderationbytheCounty Councileverythreeyears.TheExecutivealsopreparesandsubmitsrecommendedPlanamendmentstothe Council.Theseamendmentscanincludetextamendmentsandwater/sewercategorymapamendments whichareusuallyintheformofindividualrequestsforwaterandsewerageserviceareacategorychanges (seeSectionV.ProceduresforAdoptingandAmendingtheWaterandSewerPlan,below).TheExecutive transmitsproposedamendmentstothePlanfortheCouncil'sconsiderationandactionsemiannually.The ExecutivealsotransmitsrecommendationstotheCouncilontheproposedannualCapitalImprovements Program(CIP)WSSCsubmitsannuallyforitsmajorwatersupplyandsewerageprojects. WithintheExecutiveBranchofthecountygovernment,theExecutive'sresponsibilitiesare delegatedtothefollowingagencies: i. DepartmentofEnvironmentalProtection(DEP)TheDepartment'smissionisto

protectandenhancethequalityoflifeintheCountythroughconservation,preservation,andrestorationof theenvironmentguidedbyprinciplesofscience,resourcemanagement,sustainability,andstewardship.The DepartmentmaintainstheprimaryfunctionsofdevelopingandadministeringtheWaterandSewerPlan. (a) WaterandSewerPlanAdministrationDEPstaffdevelopupdatesand amendmentstothePlan,andreviewandpreparerecommendationsonPlanamendmentsproposedfrom outsidetheDepartmentsuchasindividualcategorychangerequests.DEPmaintainsmapsofthecountys waterandsewerserviceareacategories,issuinginterimupdatemapsasnecessary,basedonapproved Planamendments.TheCountyCouncilhasdelegatedtheauthoritytoactonPlanamendmentstothe DirectorofDEPunderlimitedcircumstances.Thepoliciesaddressingthisadministrativedelegationauthority areprovidedinSectionV.F.DEPstaffconductspublichearingsandmeetingsrelatedtoproposedplan amendments. DEPstaffcoordinatesthereviewoftheannualWSSCCIPwiththeCountysOfficeof ManagementandBudget.Inadministeringtheplan,staffisinvolvedinavarietyofprogramsincluding surfacewaterandgroundwaterprotection,watershedmanagement,waterandseweragecapitalfacilities planning,developmentplanreview,recordplatapproval,publichealthproblemrelief,andmasterplan development.DEPprovidestechnical,policy,andresearchsupportnotonlytotheExecutive,butalsoto localgovernmentagenciessuchastheWSSC,theMarylandNationalCapitalParkandPlanning Commission,andtheCountyCouncil,andtoregionalagenciessuchastheDistrictofColumbiaWaterand SewerAuthority,theMetropolitanWashingtonCouncilofGovernments,andtheInterstateCommissionon thePotomacRiverBasin. (b) RelatedWaterQualityandResourceProgramsDEPalsocarriesoutavariety ofprogramstoprotectthecounty'swaterresources.InadditiontotheWaterandSewerPlan,DEPhas preparedthreeothermajorstrategicplanswhichguideCountypolicyinenvironmentalmanagementand

protection:theCountyWideStreamProtectionStrategy,theGroundwaterProtectionStrategy,andtheForest ProtectionStrategy. DEPconductsextensivewaterqualitymonitoring,watershedrestoration,stormwater facilitymaintenanceinspectionandenforcement,illicitdischargeinspectionandenforcement,andpublic outreachactivities.DEPregulatesillicitdischargestocountystreamsandstormdrainsundertheWater QualityDischargeLaw(MontgomeryCountyCode,Chapter19,ArticleIV).AsprovidedunderChapter19, ArticleVI,DEPprovidesgeneraloversightofsedimentcontrolandstormwatermanagementconceptplans approvedbytheCounty'sDepartmentofPermittingServices(DPS). UndertheCounty'sWaterQualityReviewlaw(MontgomeryCountyCode,Chapter19, ArticleV),DEPassistsDPSinsettingperformancegoalsfordevelopmentprojectswithinCountyCouncil designatedSPAs(presentlylocatedintheUpperPaintBranch,PineyBranch,andportionsoftheLittle SenecaCreekwatersheds).DEPconductsinstreammonitoringofdevelopmentimpactswithinSPAsand assistsDPSindefiningrequirementsfordevelopermonitoringoftheeffectivenessofsedimentcontrolsand stormwatermanagementcontrols.DEPandDPSalsoworkcloselywiththeMNCPPCinimplementingSPA requirementsandreportupondevelopmentimpactsandbestmanagementpractices(BMP)effectiveness withinSPA'stotheCountyExecutiveandCouncil. DEPdirectlyimplementsandcoordinatesotherCountyagencyprogramsasrequired undertheCounty'sfiveyearNationalPollutantDischargeEliminationSystem(NPDES)permitformunicipal stormwaterdischarges(issuedMarch15,1996).TohelpaddresstheNPDESpermitcompliance requirements,DEPmonitorsandinventoriesthebiological,physical,andchemicalwaterqualityconditionsin countystreamsandtracksdischargestostormdrains.Collectedmonitoringinformationisusedto:1)assess baselinewaterqualityandhabitatconditionsincountystreamsandwatersupplysources;2)evaluate impactsofspecificdevelopmentprojectsandwastewaterdischargesonstreams;and3)identify,locate,and takeenforcementactionagainstillicitpollutantdischargesasprovidedundertheCounty'sWaterQuality DischargeLaw(MontgomeryCountyCode,Chapter19,ArticleIV).DEPcoordinatesinCountymonitoring anddatamanagementactivitiesofotherFederal,State,localagency,andvolunteergroupsthroughthe County'sBiologicalMonitoringWorkgroup(BMW).DEPmonitorsgroundwaterqualitygenerallythroughout thecountyandspecificallyaroundcountylandfills.DEPalsoreviewsandcommentsontheState'swater appropriationandusepermitapplications,bothforwaterwithdrawalsandwastewaterdischarge. DEPconductswatershedwideresourceinventories,streamerosionsurveys,modeling, andfeasibilityplanningstudiestocomprehensivelyassesswatershedrestorationneedsandopportunitiesin largelydevelopedCountywatershedswhichhavedegradedstreamconditions.DEPthendevelops WatershedRestorationActionPlansfordegradedwatershedsandsubwatersheds.Theseplansidentify goalstoimprovestreamconditionsandspecificeducational,facilitiesmaintenance,volunteer,and enforcementinitiativesandcapitalprojectsnecessarytoachievethesegoalsoverafivetotenyeartime frame.Asbasicassessmentworkiscompletedforanindividualwatershedorsubwatershed,DEPorganizes interagencyandpublic/privatepartnershipstoimplementthespecificrestorationtasksidentifiedinthe WatershedRestorationActionPlans.Inadditiontospearheadingtargetedpublicoutreach,stream monitoring,andenforcementinitiatives,DEP'sworkincludesdesign,construction,maintenance,and monitoringeffectivenessofstormwatermanagement"retrofit"projectsandstreamrestorationfacilities neededtoupgradedamagedstreamhabitatandwaterqualityconditions.Stormwaterretrofitprojects improvecontrolofpeakrunoffflowsandrunoffqualityindevelopedareasofwatershedsthatpreviously

lackedsuchcontrols.Streamrestorationprojectscontrolstreambankerosionandimprovehabitat conditions. DEPadministerstheCountysnewWaterQualityProtectionChargeprogram,which assessesanannualchargetopropertyownersforthepurposeofprovidingCountymaintenanceofprivate stormwatermanagementfacilities. ii. DepartmentofPermittingServices(DPS)MontgomeryCounty'sDepartmentof PermittingServices(DPS)regulatesnewlanddevelopmentandbuildingconstructionactivitieswhichaffect stormflows,stormwaterinfiltration,streambaseflows,andwaterquality.Thisincludessedimentanderosion controlandstormwaterpermitting,andassociatedplanreview,inspection,andenforcementfunctions.DPS alsoissueswellandsepticsystempermits,streetandstormdrainpermits,andadministerstheCounty's floodplainprotectionlaws. WithinDPS,theWellandSepticSectionhastheresponsibilitydelegatedfromtheStateto regulateandpermitindividualwatersupplyandseweragesystems,usuallywellsandsepticsystems.The WellandSepticSectiondevelopsregulationsaddressingsiting,testing,andpermittingforthesesystems, currentlyExecutiveRegulation2893AM,"OnSiteWaterSystemsandOnSiteSewageDisposalSystemsin MontgomeryCounty".DPScoordinateswithDEPconcerningcasesinvolvingpublichealthproblemscaused byfailingindividual,onsitesystemswherearesolutionoftheprobleminvolvestheprovisionofcommunity waterand/orsewerservice. DPSstaffadministersaprogramwhichgrantsexemptionsfromWSSCsystems developmentchargesforbiotechnology,elderhousing,andcommunityrevitalizationprojects(seeSection IV.A.1.b.). DPScoordinatesstormwatermanagementrequirementsfornewdevelopmentswithDEP, MNCPPC,andotherappropriateagenciesthroughanestablishedinteragencyDevelopmentApproval Process.SpecialProtectionAreas(SPAs),designatedbytheCountyCouncilundertheCounty'sWater QualityReviewLaw(MontgomeryCountyCode,Chapter19,ArticleV)aredefinedasareaswhere:1) existingwaterresourcesorotherenvironmentalfeaturesdirectlyrelatingtothosewaterresourcesareofhigh qualityorunusuallysensitive;and2)proposedlanduseswouldthreatenthequalityofpreservationofthose resourcesorfeaturesintheabsenceofspecialwaterqualityprotectionmeasureswhichareclosely coordinatedwithappropriatelandusecontrols.InSpecialProtectionAreas,DPSsetsperformancegoals, approveswaterqualityplansandstormwatermanagementconceptplans,andspecifiesrequirementsfor developermonitoringandreportingontheeffectivenessofrequiredstormwatercontrolBMPs. iii.DepartmentofPublicWorksandTransportation(DPWT)DPWTdesignsand buildscapitalprojectsforpublicstormdrainagesystemsandspecifiesrequirementsforprivatelyconstructed drainagesystems.DPWTmaintainspublicstormdrainagefacilities.DPWTconstructsdrainagestructures suchascurbs,gutters,drainageinlets,pipes,andpavedchannels.Thesenetworksaredesignedtoconvey stormwaterfromdevelopedsurfacesintonaturaldrainageswalesandstreamchannels.Innew developments,largedrainagesystemsconveyrunofftostormwatermanagementfacilitiesbeforedischarging intothestreamsystem.DPWTalsoconstructsbridgesandroadcrossingswhichcanaffectstreamhabitat andfishmigration.DPWT'srequirementsfordrainagesystems,roadways,androadcrossingsforindividual developmentsarecoordinatedwithDPSandtheMNCPPCthroughtheDevelopmentApprovalProcess.

iv. DepartmentofHousingandCommunityAffairs(DCHA)ThisDepartment administersgrantandloanfundingprograms,generallyfromStateandFederalfunds,whichprovidefinancial assistancetopropertyownersandcommunitiesseekingtorepair,upgrade,ormodifytheirwaterandsewer systems. v. OfficeofManagementandBudget(OMB)ThisOfficeoverseestheoperatingand

capitalprogrambudgetsforCountyagencies,includingtheWSSC,withaprimaryemphasisonfiscal accountabilityandresponsibility.OMBstaffcoordinatescloselywithDEP,WSSC,andCountyCouncilstaff ontheirreviewofWSSC'sbudgetsubmissions. 2. MunicipalitiesStatelawrequiresthattheCountyincorporatethesubsidiarywaterandsewer plansofthemunicipalitiesintotheCountysPlan.ThemunicipalitiesprovidetheExecutivewithinformation neededforthepreparationoftherecommendedPlanandparticipateinreviewingtherecommendedPlan andanyamendments,asappropriate.Communitywaterandsewerserviceformostmunicipalitiesinthe countyisprovidedbytheWSSC.TheCityofRockvilleandtheTownofPoolesvilleareresponsibleforthe operationoftheirownwatersupplyandseweragesystems;somelimitedareaswithintheWSSDareserved bythesesystems.Accordingly,theplanning,design,andoperationoftheirsanitarysystemsislargely independentofWSSCandtheCounty.EspeciallybecauseofitsdependenceonWSSCsewermainsforthe transmissionofsewageflowstotheBluePlainsWastewaterTreatmentPlant,Rockvilledoescoordinatewith WSSCandtheCountyonwaterandsewerserviceissues. Thefollowingmunicipalitiesarealsoresponsiblefortheirownplanningand/orzoningauthority:

WashingtonSuburbanSanitaryCommission(WSSC)Establishedin1918under Statelegislation,WSSCprovidescommunity(public)waterandseweragesystemsthroughoutmostof MontgomeryandPrinceGeorgesCounties.TheStatescharterspecifiestheareaservedbytheWSSC:the WashingtonSuburbanSanitaryDistrict(WSSD).WSSCisresponsibleforthedesign,construction, operation,andmaintenanceofthecommunitywatersupplyandseweragesystemswithintheWSSD.The agencyconstructsandmaintainswatermains,pumpingstations,andwaterstoragefacilitiestodeliver treateddrinkingwaterfromthePotomacandPatuxentfiltrationplantstoconnectedhouseholdsand businesses.WSSCalsoconstructsandmaintainssanitarysewerlines,pumpingstations,andforcemainsto collectandtransportwastewatertoitswastewatertreatmentfacilitiesandtotrunksewersconnectingtothe regionalBluePlainswastewatertreatmentfacility.MontgomeryandPrinceGeorgesCountieseachappoint threeofthesixcommissionerswhoheadtheWSSC,subjecttoconfirmationbytherespectivecounty councils.Thecommissionersservestaggered,fouryearterms.TheWSSCGeneralManager,thechief executiveforallWSSCoperations,aswellastheInternalAuditManager/Secretary,reportdirectlytothe Commissioners. WSSCownsandoperatestwowatersupplyreservoirsonthePatuxentRiverandanother watersupplyreservoironLittleSenecaCreek.TheTriadelphiaandT.HowardDuckettReservoirsonthe PatuxentRiversupplyrawwatertoWSSCsPatuxentWaterFiltrationPlant.WSSCusestheLittleSeneca LakereservoirtosupplementflowsinthePotomacRivertothePotomacWaterFiltrationPlantduring droughts.Theagencyhaspermitstooperateandmaintainwaterintakesandfiltrationplants,towithdraw andtreatwaterfromthePotomacRiverandthePatuxentRiverreservoirsystemforpublicwatersupply purposes.WSSCconductsextensivewaterqualityanalysesforthecommunitywatersupplywithinthe WSSDandprovideswaterqualitytoitscustomersthroughfederallymandated,annualConsumer ConfidenceReports.ThesereportsmayalsobeobtainedthroughtheWSSCPublicCommunicationsOffice oronWSSCswebsiteatwww.wsscwater.com. WSSCoperatesandmaintainswastewatertreatmentfacilitiesonGreatSenecaCreeknear Darnestown,onMagruderBranchnearDamascus,andonLittleBennettCreekinHyattstown.Thesepoint sourcedischargesarecontrolledthroughNPDESpermitsissuedbyMDE.WSSCconductsinplantprocess monitoringofwaterfiltrationandwastewatertreatmentprocessesandmaintainsseveralwaterquality laboratoriestosupporttheseoperationsandalsoconductssomerawwatersupplymonitoringatitswater sourcesandinstreammonitoringimmediatelyupstreamanddownstreamofitswastewaterdischargepoints.

WSSCprovidesdataandguidancetotheExecutivepertainingtocapacityofthewater supplyandseweragesystemsandtoengineeringandfiscalaspectsofsystemexpansion.Reviewingand commentingontheRecommendedComprehensiveWaterSupplyandSewerageSystemsPlanandon recommendedwaterandsewerserviceareacategorychangesarealsofunctionsoftheWSSC. WSSCsubmitsaSixYearCapitalImprovementsProgram(CIP)annuallytotheCountyfor interagencyreviewandformodificationandadoptionbytheCountyCouncil.WSSCpreparesandsubmits theCIPformajorcommunitywaterandsewerageprojectstotheCountyaspartofitsresponsibilitytoplan andfinancethewatersupplyandseweragesystem.WSSCandtheExecutiveworktogetherinthe preparationofrelevantportionsoftheWSSC'sproposedCIPandrelatedfacilityplans.TheCounty incorporatestheadoptedWSSCannualCIPandsubsequentamendmentsasupdatestotheWaterand SewerPlan,whichservetosubstantiallyfulfillthefiscalplanningrequirementsofstatelawandregulations. PublichearingadvertisementsshallindicatethattheCouncilsactiononWSSCsCIPisalsoanupdatetothe ComprehensiveWaterSupplyandSewerageSystemsPlan.WSSCimplementstheapprovedCountyCIPfor majorwaterandseweragefacilitiesbydesigning,constructing,operating,andmaintainingwatersystems andacquiringfacilitysitesandrightsofway.ThetwoCountyCouncilsannuallyreviewandadopttheWSSC CIPandoperatingbudgets. WSSCisresponsibleforidentifyingpotentialimpactsfromproposedwaterandsewerlines andrelatedinfrastructure.CooperatingwithotheragenciesthroughtheDevelopmentServicesProcess, WSSCworkstoavoidandminimizeimpactsofsewerline,waterline,andotherfacilityconstructionand maintenanceactivitiestostreams,floodplain,wetlands,parklands,andwoodlandbuffers. b. MarylandNationalCapitalParkandPlanningCommission(MNCPPC)State legislationcreatedMNCPPCin1927toprotectopenspaceandcontroldevelopmentinMontgomeryand PrinceGeorgesCounties.In1939,theMarylandDistrictActprovidedplanningandzoningauthoritytoM NCPPC.MNCPPCisresponsibleforparklandacquisitionanddevelopmentandmaintenanceofthe countysparksystem.MNCPPCisgovernedbytencommissioners,fiveeachappointedbyMontgomeryand PrinceGeorgesCounties.ThefivemembersofthecommissionforeachCountyalsoserveasaseparate PlanningBoardtofacilitate,review,andadministerthemattersaffectingonlytheirrespectivecounties.The MontgomeryCountyPlanningBoardadvisesandassiststheCountyCouncilinplanning,zoning,and subdivision.ThePlanningBoardpreparesmasterplansforExecutivereviewandCountyCouncil considerationandapproval.InsupportoftheCWSP,MNCPPCprovidestheCountywithdemographic informationandpopulationprojections. Incarryingoutitsbasiclanduseplanningmission,MNCPPCdevelopsmasterplans, functionalmasterplans,andtechnicalwatershedstudies.Masterplansarerequiredtoincorporatetheseven VisionsoftheMarylandEconomicGrowth,ResourceProtection,andPlanningActof1992.MNCPPCalso conductsstreamsurveysnecessarytosupportthedevelopmentoflanduseplans.Inexecutingits developmentreviewresponsibilities,MNCPPCevaluatesproposedsubdivisionsandsiteplansfor stormwaterandotherimpactsonfloodplain,trees,slopes,wetlands,streams,wildlife,fisheries,andother naturalfeatures.MNCPPCappliesitsenvironmentalguidelinestoreserveandprotectforestconservation areas,streambuffers,andothersensitivefeatures.InadministeringtheCounty'sForestConservation Program,MNCPPCensurescompliancewithrequirementsforbothforestprotectionandplantingby

developersforspecificsitesthroughthedevelopmentreviewprocess,andonacountywidebasis,through masterplansandanoverallforestconservationplan.Theagencyalsomaintainsresponsibilitiesfor developmentprojectsoccurringwithinSPAs,addressinglevelsofimperviousness,forestcreationand protection,andcompliancewithmasterplandirectives,environmentalguidelines,andcountyregulations. MNCPPCisresponsibleforprotecting,preserving,andmanagingnaturalresourcesin Countyparks,includingstreams,fish,wetlands,forests,andwildlife.Withintheparksystemthisis accomplishedthroughawidevarietyofongoingprogramsincluding:1)resourceinventoryfunctions;2) reforestation;3)wildlifeandfisheriesmanagement;4)aquaticandwetlandhabitatenhancement;5) environmentalandengineeringreviewofconstructionplans;6)directperformanceorparticipationindesign andconstruction,andconstructionmanagementofproposedstormwatermanagementfacilitieslocatedon parkland,includingstormwaterretrofitandstreamrestorationprojects;7)maintenanceofthesefacilities;and 8)waterqualitymonitoringactivitieswithinparkareasasnecessarytosupportthesespecificfunctions. 4. StateofMarylandTheStateofMarylandhasdelegatedtheresponsibilitytoplanforthe adequateprovisionofwaterandsewerservicetoMontgomeryCounty.ThefollowingStateagencies overseethatresponsibilityandother,relatedplanningandwaterqualityprograms: a. MarylandDepartmentoftheEnvironment(MDE)UnderStateLaw,theMaryland DepartmentoftheEnvironment(MDE)isresponsiblefortheStatesreviewandapprovalofthisWaterand SewerPlan.MDEadoptsandadministersregulationsthateachcountymustfollowinthepreparationofits comprehensiveplan,andactstoapprove,approvewithmodifications,ordisapprovethePlanoranyPlan amendmentsubmittedbytheCounty.MDEcoordinatesStategrantandloanprogramsformajorwaterand sewerinfrastructureimprovements.MDEalsoregulatesthedischargeoftreatedwastewaterintoState waters,throughitspermitissuingandmonitoringprograms. b. MarylandDepartmentofPlanning(MDP)TheState'sDepartmentofPlanning overseestheCounty'slanduseplanningandzoningprocesses.MDPmanagestheState'sSmartGrowth programswhich,inanefforttoreducesprawldevelopmentandmakemaximumuseofexistinginfrastructure, directStatefundingtoidentified,higherdensity,primaryfundingareas.Waterandsewerserviceplanningis anintegralpartofthelanduseplanningprocess,andMDPthereforereviewsandcommentsontheCounty's comprehensiveplanandanyamendmentsforconsistencywithStateandCountylanduseplanning, includingSmartGrowthobjectives. c. MontgomerySoilandWaterConservationDistrict(MSWCD)TheMSWCD promotestheeffectivemanagementandconservationofsoilandwaterandprovidestechnicalsupportand advicetofarmersconcerningtheeffectsofagriculturalactivitiesonsoilsandwaterquality.TheMSWCD workswithfarmersandotherlandownerstoencouragethedevelopmentandadoptionofSoilsConservation andWaterQualityPlans.MSCDprovidestechnicalassistancetodesignandimplementsstormwatercontrol BMPsthatreduceerosionandimprovewaterqualityonagriculturalland.InconjunctionwiththeMSWCD, theU.S.DepartmentofAgriculturesNaturalResourceConservationService(NRCS)isresponsiblefordam safetyreview,whenthisreviewisrequiredforcertainstormwaterponddesigns.MSWCDhasaMemoranda ofUnderstanding(MOU)withtheCountytoallowCountyreviewsofsedimentcontrol,stormwater management,anddamsafety.MSWCDandMDEadoptthelocalstandardsandspecificationsforsediment

control.MSWCDalsohasanMOUwiththeCityofRockvilletoallowtheCitytoreviewofsedimentcontrol andstormwatermanagementprojects.NRCS,viaMSCWD,reviewsandapprovestheCitysdamsafety plans.MSWCDperformssedimentcontrolreviewsandapprovalsfortheCityGaithersburg. 5. RegionalAgenciesMontgomeryCountyscommunitywaterandsewerneedsalsoinvolve agenciesandjurisdictionsoutsidetheStateofMaryland.TheCountyandWSSCcoordinatewiththe followingagenciesontheuseofregionalresources.Thesegovernmentalagencies,andtheirprimary responsibilities,aredescribedasfollows: a. DistrictofColumbiaWaterandSewerAuthority(WASA)WASAownsand operates,amongtheDistrictofColumbiaswaterandseweragefacilities,theBluePlainsWastewater TreatmentPlant(WWTP)wherethemajorityofMontgomeryCountyswastewateristreated.Anindependent authorityoftheDistrictgovernment,WASAwascreatedandbeganoperatingin1996underandpursuantto anactoftheCounciloftheDistrictentitledWaterandSewerAuthorityandDepartmentofPublicWorks ReorganizationActof1996".GovernedbyanelevenmemberBoardofDirectorswithsixrepresentatives fromtheDistrict,twofromPrinceGeorgesCounty,onefromFairfaxCounty,andtwofromMontgomery County,WASAsauthorizinglegislationprovides,inpart,forthetotalseparationandcontroloffundsfromthe DistrictGovernment. ThesewerserviceprovidedtoMontgomeryCountybytheBluePlainsWWTPis administeredbyavarietyofrelatedmanagementinterestsanddefinedinregionalagreementsandadopted legislation.TheseincludetheBiCountyAgreementof1983,theIntermunicipalAgreementof1985,the WASABoardofDirectorsandrelatedcommittees,theBluePlainsRegionalCommittee,andbythebudget approvalauthorityoftheCountyCouncil.Thedetailsoftheseagreementsandmanagementsystemsare presentedinChapter4. b. MetropolitanWashingtonCouncilofGovernments(COG)COGistheregional organizationoftheWashingtonarea'smajorlocalgovernmentsandtheirgoverningofficials.Foundedin 1957,COGprovidesaforumforcoordinatedactiononissuesofregionalconcern,includingwatersupplyand watershedprotection.Thisincludesupdatingtheregion'swateremergencyresponseplan,assistingthe waterutilitiesandlocalelectedgovernmentsincommunicatingconcernstoregulatoryagencies,and educatingtheregionthroughconferencesandpublicationsonregionaldrinkingwaterissues,suchaswater conservation.COGstaffalsocoordinatesandmaintainsregionaldatabasesonPotomacRiverwaterquality, watertreatmentplants,andwastewaterplantdischarges.COG'sEnvironmentalandPublicWorksDirectors CommitteeadvisestheCOGBoardonregionalpolicyissuesassociatedwithdrinkingwater,waterquality, andwastewatertreatment. c. InterstateCommissiononthePotomacRiverBasin(ICPRB)ICPRBwascreated byinterstatecompact,andapprovedbyCongressin1940.WithdrawalsfromthePotomacRiverprovidethe majorityofthecountyswatersupply.Amongitsresponsibilities,ICPRBhelpscontrolandpreventpollution ofthewaterswithinthePotomacdrainagearea;cooperateswith,supports,andcoordinatesactivitiesof publicandnonpublicentitiesconcernedwithwaterandassociatedlandresourcesinthePotomacRiver basin;promotespublicunderstandingoftheseissuesandactivities,andtheneedforenhancementofthe basin'sresources;conductsdroughtoperationsmanagementsupportforPotomacRiverwaterresources

allocationfortheWashingtonMetropolitanArea;andconductsshortandlongtermwatersupplyplanning analyses.Incarryingoutitswork,ICPRBworksdirectlywithWSSC,FairfaxCounty(Virginia)Water Authority,andtheWashingtonAqueductDivisionoftheU.S.ArmyCorpsofEngineers. Inparticular,theICPRBSectionforCooperativeWaterSupplyOperationsonthePotomac (COOP)conductsdroughtoperationsmanagementsupportforPotomacRiverwaterresourcesallocationfor theWashingtonMetropolitanArea.Incarryingoutitswork,COOPworksdirectlywithWSSC,theFairfax County(Virginia)WaterAuthority,andtheWashingtonAqueductDivisionoftheCorpsofEngineers.TheCO OPSectionconductsmonthlyWaterSupplyOutlookanalyseswhichareprovidedtoWSSC,tootherwater suppliers,andtootherinterestedentities;conductsannualrealtimedroughtoperationsexercises;produces quintennialwaterdemandforecastsandresourceadequacyassessmentsfor20yearplanninghorizons; maintains24hourwaterresourceemergencycoordination;andoperatesreleasesfromtheregionswater supplyreservoirsduringdroughtconditions. E. PlanStructureandContentThestructureandminimumcontentofthisComprehensiveWater SupplyandSewerageSystemsPlanisspecifiedbytheStatelawsandregulationsreferencedinSectionI.C. ofthischapter.Thefollowingbrieflydescribesthestructureoftheplanandthecontentsofeachchapter: Chapter1:ObjectivesandPoliciesThischapterprovidesthelegalrequirementsfortheplan;the County'soverallobjectivesforwaterandsewerservice;thepoliciesaddressingtheprovisionof waterandsewerservicefromcommunity,multiuseandindividualsystems;andtheproceduresand organizationalrolesthroughwhichtheCountyandStateadopt,amend,andadministerthisPlan. Chapter3:WaterSupplySystemsThischapterprovidesinformationontheCounty'sexisting watersupplysystemsandonplanningeffortstoensurethattheCounty'smidandlongtermwater supplyneedsareandwillbesatisfiedinamannerconsistentwithpublicpolicyandtheplan's objectives.Regionalplanningissues,astheyrelatetothecounty,arealsoaddressed. Chapter4:SewerageSystemsThischapterprovidesinformationontheCounty'sexisting seweragesystemsandonplanningeffortstoensurethattheCounty'smidandlongtermsewerage needsareandwillbesatisfiedinamannerconsistentwithpublicpolicyandtheplan'sobjectives. II. POLICIESFORTHEPROVISIONOFWATERANDSEWERAGESERVICE ThewaterandsewerservicepoliciesaddressedinthissectionofthePlanprovidethebasisforestablishing whatareasofthecountywillreceivecommunityversusindividualsystemsservice.ThePlanuseswater andsewerserviceareacategoriesbothtodesignateareaseligibleforeithercommunityorprivateservice andtoprovideastagingelementfortheprovisionofcommunityservice.Thesepoliciesprovideguidance notonlyinevaluatingindividualandgeneralserviceareachangeamendments,butalsointhepreparationof developmentandwater/sewerservicerecommendationsintheCountyslandusemasterplans. TheCountyCouncilreliesprimarilyontheseservicepoliciesinevaluatingandactingonWaterandSewer Planamendments.However,thescopeoftheCouncilsresponsibilitiesgoesfarbeyondthisPlanand includesissuessuchasthecountywideeconomicgrowth,publichealthandsafety,transportation infrastructure,andpubliceducation.TheCouncilhastheauthorityandresponsibilitytoconsidersuchissues wheretheymayaffectitsactionswithrespecttothisPlan.Giventhis,theCouncilmayreachconclusions regardingthisPlanoritsamendmentswhichdonotnecessarilyfollowthepoliciesprovidedinthefollowing sections;insuchcases,theCouncilwillprovideanexplanationoftheissuesinvolvedandrationalefor actionsthatmayvaryfromthesestandardpolicies. A. WaterandSewerServiceAreaCategoriesInordertoprovidefortheorderlyextensionof communitywaterandsewerservice,Stateregulations(COMAR26.03.01.04)haveestablishedcategory designationsforwaterandsewerserviceareas.Thesecategoriesidentifythoseareasapprovedor proposedforcommunityserviceandthoseareaswheredevelopmentwilldependonindividualsystems.In addition,someareasofthecountyarenotedforspecialserviceconditionsorrestrictions,includingthose areawheretheCountyhasapprovedtheuseofmultiusesystems.Serviceareacategoriesareshownon thewaterandsewerserviceareacategorymapswhichareapartofthisplan. 1. Areas where improvements to or construction of new community systems will be given immediate priority and service will generally be provided within two years or as development and requests for community service are planned and W3andS3 scheduled. Areas where improvements to or construction of new community systems will be programmed for the three- through six-year period. This includes areas generally requiring the approval of CIP projects before service can be W4andS4 provided. Areas where improvements to or construction of new community systems are planned for the seven- through ten-year period. This category is frequently used to identify areas where land use plans recommend future service staged W5andS5 beyond the scope of the six-year CIP planning period. Areas where there is no planned community service either within the ten-year scope of this plan or beyond that time period. This includes all areas not designated as categories 1 through 5. Category 6 includes areas that are planned or staged for community service beyond the scope of the plans tenyear planning period, and areas that are not ever expected for community W6andS6 service on the basis of adopted plans.

2. ServiceAreaSpecialConditionsandRestrictionsInspecificcases,specialconditionsor restrictionsareincludedwiththeserviceareacategoryforapropertyaffectingtheprovisionofwaterand/or sewerservice.Forexample,theseconditionscanspecifythetypeofdevelopmentsuitableforcommunity waterandsewerservice,specifythenumberofwaterorsewerhookupsallowed,advisethatexisting communityserviceistheresultofpriorwaterandsewerpoliciesnolongerineffect,orexplainwhy communityserviceisprovidedtoasiteoutsidethecommunitywaterand/orsewerenvelope. Thefollowingspecialserviceconditionsareexamplesofthoseusedonthewaterandsewerservice areacategorymaps: Conditionalapprovalhasbeengrantedtochangetheserviceareacategoryforthisproperty.

CommunityserviceexistedpriortotheestablishmentoftheWaterandSewerPlanandthe serviceenvelope. Communityservicewascommittedpriortomasterplanrecommendationsand/orpolicy determinationstoexcludethegeneralareafromcommunityservice. Communityservicewasextendedinordertorelieveapublichealthproblemcausedbyafailing individualormultiusesystem. Communityservicewasextendedtoserveapublicfacilityoraprivateinstitutionalfacility. Communityservicewasextendedtolotswhichwerepreviouslyapprovedforindividualsystems butwhichareunabletoutilizethosesystemsduetochangesinindividualsystemsregulations. Communityserviceislimitedtospecificdevelopmentoptionsonlysuchasclusteroption developmentordevelopmentusingtransferrabledevelopmentrights(TDRs). Communityservicewasprovidedtopropertieswhichabutanexistingwaterorsewermain. Communityserviceisrestrictedtoasinglewaterand/orsewerhookuponly.(Thisusuallyoccurs inconnectionwithanotherspecialservicecondition.) Multiusesystemsareapprovedforthissite. Interimonsitesystemsareapprovedforthissite.

Newconditionsaresometimescreatedtoaddressspecificsituationsornewpoliciesinthisplan.The conditionsasappliedtoaparticularsitemaybegeneralinnatureanditisadvisabletoresearchspecific conditionsorrestrictionswiththeDepartmentofEnvironmentalProtection. B. WaterandSewerServiceDevelopmentPoliciesbyServiceAreaDesignationThefollowing policiesgoverntheprovisionofwaterandsewerserviceundereachoftheCountysserviceareacategories: 1. CategoriesW1andS1AreasdesignatedascategoriesW1andS1areintendedto developusingcommunitywatersupplyandseweragesystems.Asageneralrule,nonewindividual,on sitesystemswillbepermittedwhereanadequatecommunitywaterorseweragesystemisavailable.Ifan existingcommunitywaterorseweragesystemisinadequateorisnotavailableasdefinedbelow,thenan individualwaterorseweragesystemmaybeusedforaninterimperiod.Suchindividualsystemsshallbe subjecttotheconditionsestablishedinthisPlanastheGeneralConditionsforInterimIndividualSystems (seeSectionIII.B.1.). a.CommunityServiceisInadequateAnexistingcommunitywatersupplyorsewerage systemmaybeconsideredinadequatebyDEPwhenserviceisprohibitedbyanOrderofMDE,WSSC,or MontgomeryCounty,duetoinadequateconveyanceortreatmentcapacity.Individualsystemsarethen allowedsubjecttotheGeneralConditionsforInterimIndividualSystemsandthefollowingadditional conditions: i.Communitywaterserviceisavailableinareaswherecommunitysewerserviceis consideredinadequate;and ii.Allsubdivisionstobeinitiallydevelopedoninterimindividualsystemsshallconstructdry communitysystems,asspecifiedinSectionIII.A.4.,DryCommunitySystems.Nowaiverofthisconditionis allowed.

b.CommunityServiceisNotAvailableAnexistingcommunitywatersupplyorsewerage systemmaybeconsiderednotavailablebyDEPwhen,uponapplicationforservicetoautility,theutility makesadeterminationthatitisnotfeasibleforeconomicorengineeringreasonstoprovidecommunity serviceatthattime.Suchcasesmayinclude,butarenotlimitedto,projectswithexcessivedeficitcharges, projectswhereinterveningmainsaretoconstructedbyotherdevelopersorindividuals,orprojectswhere pumpedsewerserviceisnotfeasibleduetoexcessivegradesorsiteelevations.Interimindividualsystems approvedunderthisconditionshallbesubjecttotheGeneralConditionsforInterimIndividualSystems(see SectionIII.B.1.)below. Anexistingcommunitywatersupplyorseweragesystemmayalsobeconsiderednotavailable whenDEPmakesadeterminationthatitisasevereeconomichardshipforanindividualhouseorother structuretobeconnectedtothecommunitysystem.Thispolicyshallonlybeapplicabletosingleresidential hookupsortoindividualstructuresthataretheequivalentofsingleresidentialhookups.Interimindividual systemsapprovedunderthisconditionshallbesubjecttotheGeneralConditionsforInterimIndividual Systems(seeSectionIII.B.1.). c.PublicHealthHazardsUnderconditionsofanexistingoranticipatedhealthhazard,as certifiedbyDPS,DEPmayrequireconnectionsofexistingindividualstructurestoacommunitysystemif available,andmayrequireserviceextensionswheredeemeddesirable. 2. CategoriesW2andS2CategoriesW2andS2arenotusedinthisPlan(seeSection II.A.1.). 3. CategoriesW3andS3AreasdesignatedascategoriesW3andS3areintendedto developusingcommunitywatersupplyandseweragesystems.However,interimindividualwatersupplyand seweragesystemsmaybepermittedtobeinstalledintheW3andS3serviceareasconsistentwiththe GeneralConditionsforInterimIndividualSystemssetoutbelow(SectionIII.B.1.).Allsubdivisionstobe initiallydevelopedoninterimindividualsystemsshallconstructdrycommunitysystems,asspecifiedin SectionIII.A.4.,DryCommunitySystems.Nowaiverofthisconditionisallowed,exceptforsinglelot subdivisionsandsubdivisionsconsistingoflotsoftwoacresorlargerinsize. a.AreaWidePublicHealthHazardsUnderconditionsthatadefinedareaofthecountyhas anexistingoranticipatedhealthhazard,DPS,incoordinationwithDEP,mayrecommendtheconstruction ofacommunitysystemforwaterorsewerageservice.Anysuchcommunitysystemshallbeoperatedbya publicagencyandbeapprovedbytheCountyCouncilasaformalamendmenttotheplan. b.IndividualPublicHealthHazardsUnderconditionsofanexistingoranticipatedhealth hazard,ascertifiedbyDPS,DEPmayrequiretheconnectionofexistingindividualstructurestoacommunity system,ifavailable,andmayrequireserviceextensionswheredeemeddesirable. 4.CategoriesW4andS4Althoughprogrammedforwaterandsewerservicefromcommunity systems,individualwatersupplyandseweragesystemsmaybepermittedtobeinstalledinareasdesignated ascategoriesW4andS4consistentwiththeGeneralConditionsforInterimIndividualSystems(Section

III.B.1.).Allsubdivisionstobeinitiallydevelopedoninterimindividualsystemsshallconstructdrycommunity systems,asspecifiedinSectionIII.A.4,DryCommunitySystems.Nowaiverofthisconditionisallowed, exceptforsinglelotsubdivisionsandsubdivisionsconsistingoflotsoftwoacresorlargerinsize. a.AreaWidePublicHealthHazardsUnderconditionsthatadefinedareaofthecountyhas anexistingoranticipatedhealthhazard,DPS,incoordinationwithDEP,mayrecommendtheconstruction ofacommunitysystemforwaterorsewerageservice.Anysuchcommunitysystemshallbeoperatedbya publicagencyandbeapprovedbytheCountyCouncilasaformalamendmenttotheplan.Theissuesand alternativesrelativetosucharecommendationforpropertiesincategoriesW4orS4willbereviewedby DEPasaproposedcategorychangerequest,initiatedbytheCounty. b.IndividualPublicHealthHazardsUnderconditionsofanexistingoranticipatedhealth hazard,ascertifiedinwritingbyDPS,DEPmayrequiretheconnectionofexistingindividualstructurestoa communitysystem,ifavailable,andmayrequireserviceextensionswheredeemeddesirable.DEPwill coordinateacategorychangeforthesite,usuallythroughtheadministrativedelegationprocess,although WSSCneednotawaitapprovalofsuchanamendmentpriortoprovidingcommunityservice. 5.CategoriesW5andW6,andS5andS6Individualwatersupplyorseweragesystems,not ofaninterimnature,shallbepermittedtobeinstalledinanyportionoftheCountydesignatedascategories W5orW6andS5orS6,consistentwithCOMAR26.03.01,26.03.05,and26.04.02.04,andCounty ExecutiveRegulations2893AM,"OnSiteWaterSystemsandOnSiteSewageDisposalSystemsin MontgomeryCounty".Individualsystemsmaybeinstalledwithintheseareasonanindefinitebasiswithout firmobligationtoconnecttoacommunitysystem,whenandifitbecomesavailable. WithinareasdesignatedascategoriesW5andS5,theconstructionofdrycommunitysystems shallnotberequiredforsubdivisionsorindividualpropertieswhichdevelopusingindividualonsitesystems. DEPmayrecommendwaterand/orsewermapamendmentstodesignatesubdivisionsdevelopingon individualsystemsascategoriesW6and/orS6. a.AreaWidePublicHealthHazardsUnderconditionsthatadefinedareaofthecountyhas anexistingoranticipatedhealthhazard,DPS,incoordinationwithDEP,mayrecommendtheconstruction ofacommunitysystemforwaterorsewerageservice.Anysuchcommunitysystemshallbeoperatedbya publicagencyandbeapprovedbytheCountyCouncilasaformalamendmenttotheplan.Theissuesand alternativesrelativetosucharecommendationforpropertiesincategorieswillbereviewedbyDEPasa proposedcategorychangerequest,initiatedbytheCounty. b.IndividualPublicHealthHazardsUnderconditionsofanexistingoranticipatedhealth hazard,ascertifiedinwritingbyDPS,DEPmayrequireconnectionsofindividualstructurestoacommunity systemifavailable,andmayrequireserviceextensionswhendeemeddesirable.DEPwillcoordinatea categorychangeforthesite,usuallythroughtheadministrativedelegationprocess,althoughWSSCneednot awaitapprovalofsuchanamendmentpriortoprovidingcommunityservice.

C. WaterandSewerServicePlanningintheDevelopmentReviewProcessTheprovisionofwater andsewerservicefornewdevelopmentisanintegralpartoftheCounty'sevaluationofdevelopment proposals.DEPsprimaryinvolvementintheCountysdevelopmentreviewprocessincludesthefollowing: 1. DevelopmentPlanReviewTheMNCPPCDevelopmentReviewDivisionmanagesthe

County'sDevelopmentReviewCommittee(DRC),aninteragencygroupwhichmeetsregularlytoreviewand evaluateproposeddevelopmentplans.DEPistheleadagencyintheDRCwithregardtowaterandsewer serviceplanningissues.DEPstaffreporttotheDRContheconsistencyofthewaterandsewerservice componentsofdevelopmentproposalswithrespecttotheCounty'sWaterandSewerPlan.Inorderfora developmentproposaltoproceedtothePlanningBoardforconsideration,DEPandMNCPPCstaffneedto confirmtheconsistencyofthedevelopmentplanwiththepoliciesandserviceareadesignationsintheWater andSewerPlan.WSSCstaffalsoparticipatesinthisprocesswithafocusonwaterandsewersystems designandcapacity. 2. RecordPlatReviewandApprovalProcessRecordplatslegallyestablishsubdivided propertiesintheCounty'slandrecords.DEPstaffreviewrecordplatspriortorecordationtoensurethatthe typeofwaterandsewerserviceintendedtoservethedevelopmentproposedbytheplatisconsistentwith policiesandserviceareadesignationsinthisPlan.AsrequiredbyMDE,DEPstaffalsocalculatesasewage treatmentflowcommitmentforeachplatwhichdependsoncommunitysewerservice.MDEandWSSC tracktheseflowcommitmentsrelativetotheavailabletreatmentcapacityattheappropriatesewage treatmentplantinordertoensurethatadequatetreatmentcapacityisavailablefordevelopmentapprovedby theCounty. D. GeneralPoliciesforWaterandSewerServiceThewaterandsewerserviceareacategories designatedinthisplanservetwofunctions:1)theyidentifythoseareasofthecountyapprovedorplannedfor communitywaterand/orsewerserviceandthoseareasintendedforservicebyindividualsystems;and2) forthoseareasplannedforcommunityservice,theyidentifyamechanismforstagingcommunityservice consistingoftheapplicationoftheservicecategoriesW1throughW5andS1throughS5described abovetothepropertieswithinthecounty.TheCountyExecutive,throughtheDepartmentofEnvironmental Protection,recommendsserviceareacategoriesbasedonthefollowingpoliciesaddressingwaterandsewer service,landuse,staging,andinfrastructurepoliciesincludedinthisplan.Thefollowingpoliciesprovide general,countywideguidancefortheprovisionofcommunitywaterandsewerserviceandindividual,private waterandsewersystems. 1. GeneralPoliciesforCommunityWaterServiceLandzonedformoderatetohighresidential

developmentdensitiesoftwoormoreunitsperacre(R60,R90,R200,etc.)isintendedforwaterservice fromcommunitywatersupplysystems.IntheCounty'sZoningordinance,twoclusteroptionzonesalso specificallycallfortheprovisionofcommunitywaterservice:theLowDensityRuralCluster(LDRC)and RuralNeighborhoodCluster(RNC)Zones.Developmentoccurringwithinthesezonesusingtheappropriate clusteroptionisintendedtousecommunitywaterservice.UndertheLDRCZone,developersmaychooseto useindividualwellsifenvironmentalconditionsorconcernssupportthatdecision.Therequirementsofthe RNCZoneallowfortheconsiderationofcommunityserviceforlargerconservancylotswithintheclustered subdivisionwhereDEPandMNCPPCstaffconcurthatsuchserviceisappropriate,generallyduetoits proximitytocommunityservice.Wheretheprovisionofcommunitywaterserviceiscontingentupontheuse

ofaclusterdevelopmentoption,theapprovalofserviceareacategorychangeswillgenerallybeconditioned ontheapprovalofsubdivisionplansusingthoseclusteroptions. Inaddition,theprovisionofcommunitywaterservicetoareaszonedforlowerdensitydevelopment (RE1,RE2,etc.)maybeconsideredunderthefollowingcircumstances,providedthatdevelopmentwith communitywaterisconsistentwiththeprotectionofsurfaceandgroundwaters: a. Theprovisionofwaterservicetoareaszonedfor"largelot"residentialandrural developmentshouldbegenerallylimitedtothoseareaszonedRE1,RE2andRE2C/nonclusteroption, andRuralCluster(RC)/clusteroption;areaswithotherzonesmaybeconsideredupontherecommendation ofthePlanningBoard.ForsiteswithintheRCzone,theprovisionofcommunitywaterserviceshallgenerally requireapprovalofasubdivisionplanwhichusestheclusteroptionforthedevelopment;waterservicemay alsobeapprovedincaseswherezoningorsubdivisionregulationsdictatethatagivensitehasinsufficient acreagetousetheRCzoneclusteroption. b. Theprovisionofcommunitywaterservicemustconformtothelandusepoliciesofthe applicablemasterplan.Inordertoensureconsistencywiththemasterplans,allcategorychangerequests forcommunitywaterservicetolargelotareaswillbesubmittedtoMNCPPCforreviewandcommentona casebycasebasis.Thepolicyofprovidingcommunitywaterservicetolargelotareaswasfirstadoptedin theWaterandSewerPlaninJune1990(underCR111953);theCouncilreviewedandapprovedsome currentlocalareamasterplanspriortotheintroductionofthispolicy.Thedecisiontoextendorrestrictwater serviceshouldfocusonconformancewithmasterplanlanduseanddevelopmentrecommendations,rather thanongeneralizedwaterserviceareasidentifiedintheseoldermasterplans.Wheretheprovisionofwater servicetolargelotareaspromotesthelanduseanddevelopmentenvisionedbythemasterplanandmeets othereconomicandenvironmentalstandards,theapprovalofserviceand/ortimingofserviceis appropriatelyhandledbytheadoptionofwatercategorychangesaspartofthisplan.Requestsforwater servicetolargelotareasmaybeconsideredforadministrativeapprovalunderthe"ConsistentwithExisting Plans"policy(SectionV.F.1.a.)incaseswherethePlanningBoardconcursthattheextensionofserviceis consistentwiththelanduseanddevelopmentpoliciesofthemasterplan. c. Extensionsshouldgenerallybefromexistingorauthorizedwatermainstoalloworderlyand logicalextensionsofthewatersystem. d. Allcostsassociatedwithcommunitywaterservicetolargelotswillbepaidbythosedirectly benefitingfromtheextensionofservice.Toensurethisgoalisachieved,bothofthefollowingtwoconditions willapplytoextensionofwaterservicetolargelots: i. Whereinterveninglotsaresubjecttoapotentialfrontfootbenefitassessmentforawater

mainextension,theapprovingauthoritymayconditionacategorychangerequesttorequiretheapplicantto payallmainextensioncosts.UndertheSystemExtensionPermit(SEP)process,WSSCrequiresthe applicantand/ordevelopertoconstructmainextensionsattheirowncost,andthendedicatetheextensionto WSSC(seeSectionIV.A.2.).FormainsconstructedundertheSEPprocess,theinterveninglotswould thereforenotbeassessedfrontfootbenefitcharges.Thispolicywillpreventinterveninglotsfromsubsidizing lineextensionsbenefitingnewdevelopment.

ii. Fundingforlargediameterwaterlines(16inchesorgreater)and/orotherimprovements tolocalservicelineextensionscannotbeprovidedthroughwaterandseweragebondsfinancedbygeneral waterandsewerrates.Theseimprovementsmustbefundedeitherthroughthegeneralbondprogram(with allcostsretrievablethroughfrontfootbenefitassessmentsassociatedwiththeproposeddevelopmentand developercontributions),orthroughtheSEPprocessintheWSSCCapitalImprovementsProgramwith developercontributionscovering100percentofthecapitalcosts(asisnowrequiredforCIPprojectswhich supportonlynewgrowth).NotethatWSSCrequiresthatonlycapitalsizemainextensionsmorethan2,000 feetinlengthmustbeincludedintheCIP.Thesepolicieswillpreventextensionstolargelotareasfrom impactinginterveninglotsandgeneraluserrates. e. Theprovisionofcommunitywaterservicetolowerdensityareascanoccurwithoutthe provisionofcommunitysewerservice,requiringtheuseofindividualsepticsystems.Developmentwithonly communitywatermustbeconsistentwiththeprotectionofsurfaceandgroundwaters.Toassurethisgoalis achieved,DEPmayrequirehydrogeologicstudiesofproposeddevelopmenttoassesspotentialimpactsto groundandsurfacewaterqualityfromtheuseofindividualseweragesystems.Inordertoaddressconcerns abouttheclusteringofsepticsystemsinareaswherezoningpermitslotsizesoflessthan40,000square feet,DEPmay,uponconsultationwithDPSandMNCPPC,recommendminimumoraverageminimumlot sizesof40,000squarefeetfornewdevelopmentusingcommunitywaterserviceandindividualsewerage systems.(ThislotsizeistheminimumrequiredforRE1zone/nonclusterdevelopment.)

ThisPlanrecognizesthatsomeruralareasofthecountywithmoderatedensityzoning(R200, RMH200,etc.)maybebeyondthelogicalandeconomicalreachofexistingorplannedcommunityservice. Theseareaswillbeservedbyindividualsystems. Localareamasterandsectorplansmayrecommendexceptionstothegeneralpoliciescontainedin thisSection(seeSectionII.E.1.). Thisplanintendsthatcommunitywaterserviceshallbeextendedinconcertwithcommunity sewerageservice,unlessspecificlimitationsofthecommunitywatersystemmakeitunreasonabletoprovide suchservice.Theprovisionofcommunitywaterservicewithoutcommunitysewerservicetoareaszonedfor twoormoreunitsperacre(R200)densityisdiscouragedwhereverpossible;incaseswheresuchserviceis approved,thedevelopmentplanmustprovideadequateprotectionforgroundandsurfacewatersas discussedinSubsectione.ofthispolicy. 2. GeneralPoliciesforCommunitySewerServiceLandzonedformoderatetohigh developmentdensitiesoftwoormoreunitsperacre(R60,R90,R200,etc.)isintendedforsewerservice fromcommunityseweragesystems.Wherelocalareamasterplansrecommendclusteroptiondevelopment inzoneswithloweraveragelotyields(i.e.,RE1orRE2CZones),andwhereclusteredlotsizesare generallycomparabletothoseinmoderateandhighdensityzones,theprovisionofcommunitysewer serviceisconsistentwiththisplan.IntheCounty'sZoningordinance,twoclusteroptionzonesalso specificallycallfortheprovisionofcommunitysewerservice:theLowDensityRuralCluster(LDRC)and RuralNeighborhoodCluster(RNC)Zones.Developmentoccurringwithinthesezonesusingtheappropriate clusteroptionisintendedtousecommunitysewerservice.TherequirementsoftheRNCZoneallowforthe

considerationofcommunityserviceforlargerconservancylotswithintheclusteredsubdivisionwhereDEP andMNCPPCstaffconcurthatsuchserviceisappropriate,generallyduetoitsproximitytocommunity service.Wheretheprovisionofcommunitysewerserviceiscontingentupontheuseofacluster developmentoption,serviceareachangeswillgenerallybeconditionedontheapprovalofsubdivisionplans usingthoseclusteroptions. ThisplanrecognizesthatsomeruralareasoftheCountywithmoderatedensityzoning(R200, RMH200,etc.)maybebeyondthelogicalandeconomicalreachofexistingorplannedcommunityservice. Theseareaswillbeservedbyindividualsystems.Areaszonedforlowerdensityresidentialdevelopment (RE1,RE2,etc.)arealsointendedtobeservedbyindividualsystems. Localareamasterandsectorplansmayrecommendexceptionstothegeneralpoliciescontainedin thisSection(seeSectionII.E.1.). 3. WaterandSewerServicePoliciesforNonResidentialZonedAreasThepreceding sectionsfocusedonpoliciesrelatedtoresidentialzoninganddevelopmentdensities.Forareaszonedfor commercialandindustrialdevelopment,theprovisionofcommunitywaterandsewerserviceortheuseof individualonsitesystemsshallbegenerallyconsistentwiththetypeofserviceusedforadjacentornearby residentialdevelopment. Areaszonedforruraldevelopment,thefiveacre(RuralorRC/noncluster)andtwentyfiveacre (RuralDensityTransfer(RDT)zones,aregenerallynotintendedtobeservedbycommunitysystems. However,casebycaseexceptionscanbeconsideredwherecommunityserviceislogical,economical, environmentallyacceptable,anddoesnotriskextendingservicetononeligibleproperties.Subsequent policiesincludedinSectionII.F.identifytheconditionsunderwhichtheseexceptionscanbeconsidered, includingpublichealthproblems,publicfacilities,propertiesabuttingexistingmains,etc.. 4. ConsistencywithComprehensivePlanningPolicyWaterand/orsewerserviceshouldbe extendedsystematicallyinconcertwithotherpublicfacilitiesalongthecorridorsasdefinedintheGeneral Plan,toaccommodategrowthonlyinareascoveredbyadoptedlocalareamasterorsectorplans.Guidance forthetype,amount,locationandsequenceofgrowthiscontainedinthecomprehensiveplanningpoliciesof theCountyasadoptedbytheCountyCouncil.ThesepoliciesareexpressedindetailintheGeneralPlan andthevariousmasterandsectorplanswhichconstituteamendmentstotheGeneralPlan.Various functionalplans,suchastheWaterandSewerPlan,shouldbeconsistentwiththesecomprehensive planningpolicies.Inaddition,theWaterandSewerPlanshouldconsiderotheradoptedorproposedpolicies ofvariousagenciesaffectinglanduse,includingguidelinesfortheadministrationoftheAdequatePublic FacilitiesOrdinance. ThisPlanintendsthatwaterandsewerservicedecisionsshouldfollowandimplementthelanduse anddevelopmentguidanceestablishedintheCountysGeneralPlanandlocalareamasterplans.Avariety offactorsinfluencepolicydecisionsconcerningthedensityortypeofdevelopmentforaparticulararea: overalllanduseguidance;transportationandschoolcapacity;environmentalprotection;localandcounty widehousingandcommercialdemand;compatibilitywithexistingdevelopment;andsuitabilityforindividual, onsitesystems.Theproximityofwaterand/orsewermainstoanareaofthecounty,alsooneofthese

factors,shouldnotserveastheprimarydriverofthesepolicydecisions.Theavailabilityofcommunity servicecanprovidefordevelopmentoptions,suchascluster,whichmightnotbepossiblewiththeuseof individualsystems. Recommendationsforserviceareacategoryactionsthatareinconsistentwiththepoliciesdescribed inthecomprehensiveplanningpoliciesoranyotherpolicieslistedinthisPlanwillbeaccompaniedby explanationsshowingwhatfactorshavechangedsignificantlysincetheadoptionoftheoriginalpolicies, and/orwhatelementsofthecomprehensiveplanningpoliciesshouldbeamendedtomoreappropriately reflectcurrentconditionsorconcerns.Suchexplanationswillidentifywhatspecificconsiderationsare relevanttotheindividualrecommendations,includingasappropriate:economicandfiscalconcerns; populationestimates;planning;zoningandsubdivisionrequirements;federal,state,regional,county,and municipalplanningefforts;residentialcommercialandindustrialneeds;availabilityandadequacyofpublic facilities;energyconservation;waterandsewagetreatmentcapacity;engineeringconstraints;environmental protection;andthealleviationofpublichealthproblems. DEPstaffparticipatesinthemasterplandevelopment,reviewandapprovalprocess,toaddress waterandsewerserviceissues.Masterplansmakerecommendationsconcerningtheuseofcommunity andindividualwatersupplyandseweragesystemstosupportzoningrecommendationsandtoimplement specificdevelopmentproposals.TheserecommendationsaremadewithanunderstandingoftheCounty's generalwaterandsewerservicepolicies,asadoptedinthisPlan.Wheremasterplansmakewaterand/or sewerservicerecommendationswhicharenotinagreementwiththegeneralpoliciesofthisplan,an explanationandjustificationofthoserecommendationsisprovidedinthemasterplanandsubsequently incorporatedinfutureWaterandSewerPlanupdates(seeSectionII.E.1.). Acategorychangerequestforapropertyinanareawhereanewmasterorsectorplanisin preparationshallbedeferreduntiltheCouncilhasadoptedaplanforthearea.DEPmayrecommend exceptionstothisrequirementwheretheCountyCouncilandthePlanningBoardconcurthatamore expedientreviewandactionsprocessisappropriateforaparticularamendment,andtheproposedactionis 1)consistentwithexistingmasterplanrecommendation,2)consistentwithwaterandsewerplanningpolicies and3)thatthemasterplanupdateisnotexpectedtochangethesepolicies.Amasterorsectorplanis considered"inpreparation"atthetimetheMNCPPCstaffdraftoftheplaniscomplete.TheCouncilshall alsodeferactiononPlanamendmentstoallowanotherprocesstoproceedwithoutbiasbeforemakinga decisionontheamendment.Oftentheotherprocessinvolvesalanduseorzoningdecisionwhichis relevanttothedecisiononwaterandsewerservice,orwhichcouldbepotentiallyinfluencedbytheCouncils actionontheissueofwaterandsewerservice.Commonly,theseactionsincluderezoningandspecial exceptionrequestsaddressedbytheCouncilandtheCountyBoardofAppeals,respectively. IndividualserviceareacategorychangerequestswhichDEPfindstobeconsistentwiththegeneral communitywaterandsewerservicepoliciesofthisPlanandwithrelevantmasterplanrecommendations maybeconsideredforapprovalunderadministrativedelegationpolicy,SectionV.F.1.a.:Consistentwith ExistingPlans. E. SpecialPoliciesforWaterandSewerServiceInadditiontotheprecedinggeneralservice policies,theCountyCouncilhasadoptedspecificpoliciesfortheprovisionofcommunitywaterand/orsewer

servicewhichcreateexceptionstothegeneralservicepolicies.TheCouncilhasalsoadoptedservice recommendationsinlocalareamasterplanswhichcreateexceptionstothegeneralservicepolicies. 1. MasterPlanRecommendedExceptionsTheprecedingsectionsdiscussinggeneralwater

andsewerservicepoliciesnotedthatlocalareamasterplansmayrecommendexceptionstothosegeneral servicepolicies.Inordertoimplementspecificdevelopmentandlandusestrategies,amasterplanmay recommendpoliciesforcommunitywaterand/orsewerservicewhichcanbeeitherlessrestrictiveormore restrictivethanthisPlan'sgeneralservicepolicies.Whenamasterplanmakessucharecommendation,it mustalsoincludeanappropriatejustificationfortherecommendeddeparturefromthegeneralpolicies.DEP staffcoordinatecloselywithMNCPPCstaffwithregardtothewaterandsewerservicerecommendations developedinlocalareamasterplans. 2. CommunityServicetoRelievePublicHealthProblemsCommunitywaterand/orsewer servicemaybeextendedtoexistingstructurestoalleviateoreliminateexistingoranticipatedpublichealth problems,uponcertificationofsuchbytheDirectoroftheDepartmentofPermittingServices(DPS)orhisor herdesignee.DEP,incoordinationwithWSSC,shallevaluatewhethertheprovisionofcommunityserviceis reasonable.Ifappropriate,DEPwilldirectWSSCtoexpeditetheprovisionofcommunitywaterand/orsewer serviceeitherbyaconnectiontoexistingmainsorbytheextensionofnewmainsinordertorelievethe publichealthproblem.Underthesecircumstances,communityservicewillbeprovidedregardlessofthe existingserviceareacategory,andWSSCneednotwaitforaserviceareachangeapprovalinordertoplan, design,orimplementtheservice.DEPmayacttoapproverelatedserviceareachangesthroughthe administrativedelegationprocess,SectionV.F.2.a.:PublicHealthProblems.Insuchcases,community servicewillgenerallybelimitedtoasinglewaterand/orsewerhookupforexistingproperties.Theprovision ofcommunityserviceunderthispolicyshallnotbeusedasjustificationfortheconnectionofinterveningor nearbylotsorparcelsiftheywouldnototherwisebeentitledtoconnecttocommunitysystems.Inaddition, DEPwillcoordinatewithDPStoidentify,asnecessary,largerscale,chronicpublichealthproblemareasand torecommendsolutionsforthoseproblemsinthisplan.Adecisiontoextendcommunityservicewilldepend onthenumberofpropertiesaffected,thefeasibilityofservice,andtheviabilityofalternativereliefmethods. 3. CommunityServiceforPropertiesAbuttingExistingMainsUnderspecificandlimited circumstances,communitywaterandorsewerservicemaybeprovidedtopropertieswhichabutanexisting orapprovedwaterand/orsewermain.Theprovisionofcommunityservicerequiresthattheproperty,ora structureonthepropertymusthavebeenestablishedpriortotheextensionoftheabuttingmain.A residence,business,orinstitution(church,school,etc.)qualifiesasanexistingstructure;abarn,garage,or othertypeofoutbuildingdoesnotqualify.Theprovisionsofthispolicydonotincludecommunityservicefor privateinstitutionalfacilities(PIFs),whichmustbeaddressedthroughthePIFpolicy(seeSectionII.E.4.). Communityservicemustbetechnicallyfeasiblefromtheabuttingmain.Majorwaterandsewer transmissionmainsandsewerforcemainscannotsupportindividualserviceconnectionsandhookups,and thereforedonotqualifyabuttingpropertiesforcommunityserviceunderthispolicy.

Thispolicymaybeusedincaseswhereapropertyisnototherwiseeligibleforsuchserviceunder thegeneralpoliciesofthisPlan.Underthispolicy,theprovisionofcommunityserviceisallowedunderthe followingcircumstances: a. SingleHookupsOnlyAsinglewaterand/orsewerhookuponlyisallowedforan individualpropertyorforastructurewhichabutsanexistingorapprovedwaterand/orsewermain.The subjectpropertyorstructuremustpredatetheabuttingmain.Achangeinthepropertyconfigurationdueto thededicationoflandforapublicusesuchasaroadrightofwayorparklandshallnotinvalidatethis allowedsinglehookup.Neithershallanexchangeoflandbetweenadjacent,qualifyingpropertiesinvalidate thisallowedhookup,providedtheoverallnumberofqualifyinglotsandthereforeallowedhookupsremains thesame.DEPmaygrantapprovalforthissinglehookupundertheadministrativedelegationpolicies includedinthischapter(SectionV.F.2.b.:PropertiesAbuttingExistingMains). DEPmaydirectWSSCtoprovideanallowedsingle,residentialwaterand/orsewerhookupupon 1)staffconfirmationthatthepropertyqualifiesforserviceunderthispolicy,and2)DEP'sreceiptofa categorychangerequestfortheproperty.OnlyinsuchcasesmayDEPapproveservicefromanabutting maininadvanceofgrantingtheactualserviceareacategoryapproval.Commercialandinstitutionaluses mustfirstreceivetherequiredserviceareachange. b. SingleHookupsforResidualPropertiesTheallowedsinglehookupmaybeassignedto anexistingorproposedremainderorresidualofapropertyprovidedthatthefollowingconditionsare satisfied: i. theoriginalpropertywouldhavequalifiedforasinglehookupunderSectionII.E.3.a.

above,andtheresidualsitestillabutstheexistingmain;and ii. theallowedhookuphasnotbeenusedelsewhereontheproperty;communityservice providedelsewhereonthesubjectpropertyconsistentwithbothWaterandSewerPlanpoliciesandmaster planrecommendationsshallnotbeconsideredtohaveusedthisoneallowedhookup. DEPmaygrantapprovalforthissinglehookupundertheadministrativedelegationpolicies includedinthischapter(SectionV.F.2.b.:PropertiesAbuttingExistingMains)providedthat: alloftheresidualpropertiesinvolvedarestillundercommonownership,or noneoftheotherresidualpropertiesfromtheoriginalabuttingpropertycouldqualify underthispolicyfortheallowedhookupbecausetheydonotabutthesubjectwateror sewermain.

Incaseswherethepropertyreceivingwaterand/orsewerhookupispartofapending subdivisionplan,DEPwillconditionthefinalcategorychangeapprovalonapprovalofthesubdivisionplan whichspecifiesthelotreceivingtheallowedwaterand/orsewerhookup.DEPshallrefercaseswherethe residualqualifyingpropertiesareunderdifferentownershiptotheCountyCouncil.DEPshallmakeevery

reasonableattempttonotifytheownersofthosequalifyingpropertiesofthependingcategorychange requestamendmentandoftheCouncilshearingforthatamendment. c. SingleHookupsforCombinedPropertiesAsingleallowedwaterand/orsewerservice hookupforaqualifyingpropertymaybealsoappliedtoadditionalcontiguous,commonlyownedpropertiesif thosepropertiesaresubdividedintoasinglequalifyingproperty.Onlyonesinglewaterand/orsewerhookup fortheentiretyofthecombinedpropertiesshallbeapprovedinsuchcases,sothattheprovisionof communityservicedoesnotpromotethefurthersubdivisionofadditionallots.DEPwillconditionthefinal categorychangeapprovalonapprovalofthesubdivisionplancombiningtheproperties.DEPmaygrant approvalforthissinglehookupundertheadministrativedelegationpoliciesincludedinthischapter(Section V.F.2.b.:PropertiesAbuttingExistingMains). d. MultipleSewerHookupsInordertoprotectandpreservesensitiveenvironmental featuresonthesite(e.g.standsoftrees/forest,wetlands,etc.)thatwouldbepotentiallyharmedbythe installationofsepticsystems,whilealsolimitingtheeffectsofsewersupporteddevelopment,community sewerservicemaybeprovidedtoapropertyabuttinganexistingsewermainprovidedallthefollowing conditionsaresatisfied: i. Thesitewouldqualifyforasinglesewerhookupundersection3.a.above;

ii. ThesitecontainssensitiveenvironmentalfeaturesthatDEP,inconsultationwithM NCPPC,determineswouldbepreservedtoagreaterextentbytheprovisionofcommunitysewerservice ratherthantheconstructionofsepticsystems; iii. Thenumberofsewerhookupsallowedshallnotexceedthenumberoflotswhichcould havebeenapprovedforsepticsystems,basedonareviewofthesiteconditions(soils,groundwater conditions,localhistory,etc.)byDEPinconsultationwithDPSandMNCPPC,andassumingthatatleast onesewerhookupisallowed; iv. Thatalltheproposedsewerhookupscanbeprovidedfromtheabuttingmains:no onsitemainextensionsarerequired,nooffsitemainextensionsorhookups(specialconnections)are required,andnorightsofwayfromotherpropertiesarerequired. ThispolicycannotbeappliedincaseswheretheCountyCouncilhasexpresslyrestrictedaccessto theabuttingmainasspecifiedundertheLimitedAccessWaterandSewerMainspolicy(seeSectionIII.A.2.). Theprovisionofcommunityserviceunderthispolicyshallnotbeusedasjustificationfortheconnectionof interveningornearbylotsorparcelsiftheywouldnototherwisebeentitledtoconnecttocommunitysystems. e. AbuttingMainsLandUsePolicyIssuesMNCPPCstaffandthePlanningBoardhave raisedconcernsaboutthelanduseimplicationsoftheabuttingmainspolicy,whichcanallowforthe developmentofapropertywhichwouldnothaveotherwiseoccurredwithouttheprovisionofcommunity service,especiallycommunitysewerservice.Ofparticularconcernarecommercialandinstitutionaluses whichmayhavesubstantiallymoreimperviousnessthanasingleresidentialuse.Inthisregard,theBoard hasrecommendedrestrictionsforthispolicy,includingwastewaterflowrestrictions,withtheintentthatthey

functionwithinthisPlanascontrolsovercommercialandinstitutionallanduses.However,thisisatodds witheffortsinitiatedbyDEPoverthepastdecade,andapprovedbytheCountyCouncil,toremovelanduse controlfunctionsfromtheabuttingmainspolicy,preferringtoallowthatcontroltooccurmoreappropriatelyin theCountyszoningandsubdivisionregulations. WaterandSewerPlanRecommendation TheCouncilrecommendsthatMNCPPCandCountyagencystaffpursueappropriateland userestrictions,suchasimperviousnesslimits,inthezoningordinanceand/orsubdivision regulations,ratherthanusewastewaterfloworotherrestrictionsintheabuttingmainspolicy asameansofcontrollinglanduse.

4. CommunityServiceforPrivateInstitutionalFacilitiesThisPlandefinesprivateinstitutional facilities(PIFs)asbuildingsconstructedforanorganizationwhichqualifiesforafederaltaxexemptionunder theprovisionsofSection501ofTitle26oftheUnitedStatesCode(InternalRevenueService).Theprovision ofcommunitywaterand/orsewerservicetosuchfacilitiesshallbeaddressedonacasebycasebasisbythe followingpolicies: a. FacilitiesLocatedWithintheCommunityServiceEnvelopesForprivateinstitutional facilitieslocatedwithintheacknowledgedwaterand/orsewerenvelopes,serviceareacategorychangesmay beapprovedbyDEPthroughtheadministrativedelegationprocess(SectionV.F.1.a.:ConsistentwithExisting Plans).Foraspecificsite,theacknowledgedwaterandsewerserviceenvelopesmaydifferduetothe generalwaterandsewerservicepolicies(SectionII.D.)includedinthisPlan. b. FacilitiesLocatedOutsidetheCommunityServiceEnvelopesForexistingorproposed PIFuseslocatedoutsidetheacknowledgedwaterand/orsewerenvelopes,theCountyCouncilshallconsider requestsfortheprovisionofcommunityserviceforPIFusesaccordingtothefollowingcriteria: i. SitesAbuttingExistingWaterand/orSewerMainsForcaseswhereexistingor

approvedwaterorsewermainsabutorwillabutaproperty,serviceareacategoryamendmentsmaybe approvedforsiteswithanexistingPIFuseandforsitesproposedforaneworrelocatingPIFuse. ii. SitesRequiringNewWaterand/orSewerMainsExtensionsForcaseswherethe provisionofcommunityserviceforaPIFuserequiresnewwaterand/orsewermains,thefollowingcriteria shallapply: ForexistingPIFuses,serviceareacategoryamendmentsmaybeapprovedforsites onlywhererequiredwaterand/orsewermainextensionsdonotthreatentoopen undevelopedlandtodevelopmentcontrarytotheintentoftherelevantlocalareamaster plan. ForneworrelocatingPIFuses,serviceareacategoryamendmentsmaybeapprovedfor sitesonlywhererequiredwaterand/orsewermainextensionswillabutonlyproperties

whichareotherwiseeligibleforcommunityserviceunderthegeneralpoliciesofthis plan.

c. MainExtensionsforPIFUsesMainextensionsoutsidetheacknowledgedcommunity serviceenvelopes,whererequired,shallbedesignated"LimitedAccess"consistentwiththeLimitedAccess WaterandSewerMainspolicy(seeSectionIII.A.2).WherecommunitysewerserviceforaPIFusewillbe providedbylowpressuremains,thosemainsshallbededicatedonlytothatPIFuseandgenerallynot eligibleforadditionalserviceconnections.TheCountyandWSSCmaymakelimitedexceptionstothis requirementtoallowforthereliefoffailedsepticsystems,wheresuchserviceistechnicallyfeasible. PIFusesmayreceiveservicefromlimitedaccesswaterorsewermainswheretheCouncilhas specificallyapprovedaccesstothosemains.Theprovisionofcommunityserviceunderthispolicyshallnot beusedasjustificationfortheconnectionofinterveningornearbylotsorparcelsiftheywouldnototherwise beentitledtoconnecttocommunitysystems. UnderitsSystemsExtensionPermit(SEP)process,WSSCnowrequiresthatallcommercialand institutionalserviceapplicantsconstructandpayforthecommunitysystemsmainextensionsneededto servetheirprojects.IncaseswheremorethanonePIFuseproposestolocateonasiterequiringapump andlowpressuremainextension,WSSCrequiresthateachinstitutionalfacilityhaveaseparatepumpand pressuremainsystem.TheCountyandWSSCshallnotsupporttheprovisionofcommunitysewerservice foraPIFusewherethatservicewillrequireaWSSCownedandoperatedwastewaterpumpingstationwhich doesnotalsosupportcommunitysewerserviceforothernonPIFusesconsistentwiththeservicepoliciesof thisPlan. d. PIFUsesinExistingResidentialStructuresTheCouncilmaydenyservicearea categoryamendmentsforPIFuseslocatedoutsidetheacknowledgedwaterand/orsewerenvelopeswhere mainextensionsarerequiredforprivateinstitutionalfacilitiesseekingcommunityserviceforexisting residentialstructures.Thiscouldresultintheextensionofcommunitywaterand/orsewerservicefor structureswhichwouldnototherwisebeeligibleforsuchservice,andwhichcouldreturntoresidentialuse. e. PIFPolicyDirectionsTheCounciloriginallyadoptedaWaterandSewerPlanservice policyaddressingPIFuseswiththreeprimarygoalsinmind: Tocontinuetosupport,wheretheprovisionofcommunityserviceisreasonable,thecountys privateinstitutionalfacilities,whichtheCouncilrecognizedashavinganimportantrolein theircommunitiesandfortheirresidents; ToprovidemoreobjectiveandconsistentcriteriainevaluatingPIFcases;and Tolimitthepotentialimpactofwaterandsewermainextensionsoutsidethecommunity serviceenvelopestosupportPIFuses.

ThePIFpolicyhasaccomplishedtheprecedinggoals,atleasttosomeextent.However,ithas alsocreatedunintendedconcerns,involvingcomplexrelationshipsbetweendifferingpublicpoliciesand affectingprivateinstitutionsneedingspacetolocateandgrowwithinanoftenfiercelycompetitiveRealEstate market.Thismakeslesscostlyland,usuallylocatedoutsideofthecommunitywaterandsewerservice envelopesandzonedforlowerdensitydevelopment,moreattractivetoinstitutionaluses.Amongthe concernswhichhavecometotheattentionofboththeCountyCouncilandCountyagencystaffarethe following: ThepolicyhasresultedintheclusteringofPIFusesattheedgeandoutsideofthe acknowledgedcommunitywaterand/orsewerserviceenvelopes. ThepolicyhasfacilitatedthesitingofPIFusesonpropertieswheretheinstitutionaluseand itsancillaryneeds,especiallyparking,cancreateimperviousnessfarinexcessofthat normallyresultingfromresidentialuses,leavinglittleopenspaceandcreatingwaterquality problems. ThepolicyhasfacilitatedthesitingofPIFuseswithinthecountysRDTzonedagricultural preserveareas. Thepolicyhaspromotedspeculativeinterestinsitesbecauseoftheirpotentialabilityto satisfythePIFpolicyrequirements,notbecauseaspecificprivateinstitutionhasaneedfor thatsite. Thepolicydoesnotprovideguidanceconcerninginstitutionalsubdivisions,wheretwoor morePIFusessubdivideandlocateonanexistingpropertyapprovedforcommunityservice. ThepolicycannotaddressissuesbeyondthescopeoftheWaterandSewerPlan,suchas communitycompatibility,trafficcongestion,andalternatefacilityuses.

DEP,otherCountyagency,andCountyCouncilstaffrepresentativeshavebegunareviewofthe PIFpolicy,withparticularattentiontotheprecedingissues.ThePIFpolicyadoptedinthisWaterandSewer PlancontainschangesfromtheoriginalPIFpolicywhichaddresssomeoftheseconcerns.Amongtheseare restrictionspreventingpublicsupportforcommunityservicetoPIFuseswhereWSSCpumpingfacilities wouldberequired,andpoliciesrequiringprivateinstitutionstoactastheapplicantsforPIFbasedservice areachangerequests(seesubsectionc.,above.)However,furtherinteragencyworkontheimpactofPIF usesisneedednotonlyinthecontextoftheWaterandSewerPlan,butalsoinotherCountyplansand policies. WaterandSewerPlanRecommendation TheCountycannotaddressalloftheissuesaffectingprivateinstitutionalusesonlywithin thecontextoftheWaterandSewerPlan.Addressingtheseissueswillinvolveconsidering changestootheraspectsoftheCountyslanduseplanning,zoningandwaterquality protectionprocesses.TheCountywilllikelyneedtoaddresstheseinstitutionalusesinthe contextofitsmasterplans,zoningandsubdivisionordinances,andwaterquality

regulations.MNCPPCstaffandthePlanningBoardareurgedtopursueoptionsfor establishingimperviousnesslimitsforinstitutionalfacilitieslocatinginruralandruralestate zones.

5. CommunityServiceforPublicFacilitiesPublicfacilitiesaredefinedasgovernmentowned buildingsorfacilities;thisincludesmunicipal,county,state,andfederalgovernments.Communitywaterand sewerservicemaybeprovidedtoserveexistingpublicfacilitiesandtosupportthedevelopmentofapproved newpublicfacilities,includingthosefacilitieswhicharelocatedoutsideoftheacknowledgedcommunity waterand/orsewerserviceareas.DEPmayacttoapproveserviceareachangesforpublicfacilitiesthrough theadministrativedelegationprocess,SectionV.F.1.c.:PublicFacilities.Theprovisionofcommunityservice underthispolicyshallnotbeusedasjustificationfortheconnectionofinterveningornearbylotsorparcelsif theywouldnototherwisebeentitledtoconnecttocommunitysystems. 6. CommunityServiceforPropertiesAffectedbyPublicImprovementsCommunitywater and/orsewerservicemaybeapprovedforapropertywherepublicinfrastructureimprovementssuchasroad constructionwilldirectlyremove,damage,orotherwiseadverselyaffectthatpropertysindividual,onsitewell orsepticsystem.DEPshallcoordinatethereviewoftheserequests,asappropriate,withtheCountys DepartmentofPublicWorksandTransportation(DPWT).DEPmayacttoapproveserviceareachangesfor thesepropertiesthroughtheadministrativedelegationprocess,SectionV.F.1.c.:PublicFacilities.The provisionofcommunityserviceunderthispolicyshallnotbeusedasjustificationfortheconnectionof interveningornearbylotsorparcelsiftheywouldnototherwisebeentitledtoconnecttocommunitysystems. 7. CommunityServiceforCommunityDevelopmentProjectsCommunitywaterandsewer

maybeprovidedinsupportofcommunitydevelopmentprojectswhichhavepreviouslybeenapproved followingapublichearing.Suchprojectsmayincludeofficiallydesignatedrenewalandredevelopment areas,neighborhoodandcommunityimprovementprograms,projectsapprovedforproductivityhousing, ruralvillageprograms,historicpreservationprojects,andhousingsubsidizedbyFederal,Stateorlocal government,upontherecommendationoftheDirectoroftheCountyDepartmentofHousingandCommunity Affairs.DEPmayacttoapproveserviceareachangesinthesecasesthroughtheadministrativedelegation process,SectionV.F.1.e.:CommunityDevelopment.Theprovisionofcommunityserviceunderthispolicy shallnotbeusedasjustificationfortheconnectionofinterveningornearbylotsorparcelsiftheywouldnot otherwisebeentitledtoconnecttocommunitysystems. 8. CommunityServiceforTransferableDevelopmentRightReceivingAreasGiventhe developmentdensitiesproposed,theprovisionofcommunitywaterandsewerserviceisgenerallyrequired forareaszonedastransferabledevelopmentright(TDR)receivingareas.Incaseswherethebasezoningof thepropertyisnotsuitablefortheprovisionofcommunitywaterand/orsewerservice(RE1,RE2,etc.),the provisionofcommunityserviceshallrequirePlanningBoardapprovalofapreliminarysubdivisionplanwhich usestheTDRdevelopmentoption.DEPmayacttoapproveserviceareachangesinthesecasesthrough theadministrativedelegationprocess,SectionV.F.1.a.:ConsistentwithExistingPlans.Thatpolicyincludes anoptionforholdingajointpublichearingfortheserviceareachangeandtheTDRoptionpreliminaryplan. Theprovisionofcommunityserviceunderthispolicyshallnotbeusedasjustificationfortheconnectionof interveningornearbylotsorparcelsiftheywouldnototherwisebeentitledtoconnecttocommunitysystems.

9. CommunityWaterServiceforChildLotsCommunitywaterservicemaybeprovidedto supportthesubdivisionoflotsforthechildrenoftheownersofqualifyingproperties.MontgomeryCountys zoningandsubdivisionregulationsmakespecialprovisionsforthecreationoftheselotswhicharegenerally locatedinthemoreruralareasofthecounty,primarilyintheRuralCluster,RuralandRuralDensityTransfer Zones.Thesizeofthelotstobeconsideredforserviceunderthispolicyisintendedtobeintherangeof thoseincludedinthewaterserviceforlargelotprovisionsinSectionII.D.1.:between1and5acres.Approval ofaserviceareachangetoallowcommunitywaterservicemustbedependentonPlanningBoardapproval ofapreliminaryplanfortheproposedchildlot.InareaszonedRDT,wherechildlotcasesarehandledas minorsubdivisionswithoutthepreparationofapreliminaryplan;serviceareachangeswilldependonanM NCPPCnoticetoDEPthatthesubdivisionplatisreadyforPlanningBoardapproval.DEPmayactto approveserviceareachangesinthesecasesthroughtheadministrativedelegationprocess,SectionV.F.1.f.: ChildLots. Waterserviceinthesecasesisgenerallyintendedtobeprovidedfromabuttingwatermains, althoughwatermainextensionscanbeconsideredwherethoseextensionsareconsistentwiththe requirementsforlargelotdevelopment,aspreviouslycited.Theprovisionofcommunityserviceunderthis policyshallnotbeusedasjustificationfortheconnectionofinterveningornearbylotsorparcelsiftheywould nototherwisebeentitledtoconnecttocommunitysystems. 10. CommunityServiceDuetoIndividualOnSiteSystemsRegulationsChangesCommunity waterand/orsewerservice,restrictedtoasinglewaterand/orsewerhookup,maybeprovidedtoaparcelor arecordedlotthatmeetsbothofthefollowingconditions: a.
