Kurt Bryantand wCfe, Cindy Briggs Bryant, are residentsofClarksville, TN; they havethreechildren — Paul, Will, and thelate Elizabeth Bryant, and three grandchildren — Hayden,Paxton and Clayton. Kurt and Cindy adopted Clayton inAugust2019;and

WHEREAS, Kun graduatedfrom ClarksvilleHigh School, attendedAustinPeayState Universitywherehe studiedmath beforereceivinghis bachelor and master’sdegreein mechanicalengineeringfrom TennesseeTechin 1976;and

WHEREAS, Kurt beganhis careerwith MontgomeryCountyasDirectorofInformation Systems in May 2011 after working as anetworkingcontractorfor Metro NashvilleSchoolsand wasemployedwith JBMfor34 years;and

Kurt hasservedon severalcounty boards andcommittees,andhas also dedicatedmanyhours to the Montgomery ~‘ouniyHistorical Societywherehe servedas Presidentfrom 2014 to2016 Kurt is very knowledgeableabout manyfamily andhistoricalcemeterieslocatedthroughoutthe county;and

WHEREAS, Kurt Bryan!has beena dedicatedemployeecommittedtopublicservice and his knowledge and expertise about informationtechnologyoperationshas beena valuableassetto this county;and

WHEREAS, MontgomeryCountyis fortunateto havehadhim as oneof itsoutstandingemployees. He will certainly be missedby hisfriendsandco-workers;and

WHEREAS, Judy’scareer hasspannedover 38yearsworkingfor the RPCoriginally hired asan Account Cle;* II, in July 1943 shewaspromotedto Office Manager where she remaineduntil herretirementin June2020;and

WHEREAS, throughhercareerat theRPCJudyhas workedunderjustfourdffferentdirectorsoverseeing456RPCmeetings;and

I liveand iii Boyer Farms Subdivision at 3152 Canie Taylor Circle, Clarksville, TN 37043. My husband and I are the ownersofthis home. We purchased our home in Clarksville, TN in an area oftown to provide a safe healthy environment for our4 children. We do not want to live in city conditions and do not want the noise, pollution, smells, smoke, and othernegative Impacts that switching agitulture land to industrial land will have on-our health, and property values. Pleaseconsider how you would feel if this was your family -neighborhood. I am concerned and would like to know more aboutwhat type of plant, industrial companies would be allowed to build on this land so close to neighborhoods. What would thetown do to ensure and the health of the residents living nearby. What research and precautions will be put in place toprotect the health of nearby residents if this change were to occur? Also to protect their financial health as homevalues will likely decrease.

Beloware my mainoblections.

1. Infrastructure - there are three-potential access points to this property Charles Bell, Hampton Station, and GuthrieHighway. Both Charles Bell and Hampton Station are small 2 lane roads lacking a shoulder. Its difficult just being able todrive two regularpassenger cars down the road at the same time safely. Increasing commercial traffic onto these roadsgreatly increases the risks to cyclist and pedestrian traffic. Additionally, Charles Bell has a significant blindspot betweenSteel Stock and Hartley Drive. For-several hundred -feet a car, pedestrian, orcyclist is not visible to motorists.

2. RunoffS the majority of the water that falls onto the property under consideration flows directly into the seasonal pondwest ofHartley Hills subdivision. For at least 1/3 of the year there is significantstanding water. The amount of water thatenters this area from the property often covers Charles Bell between Steelstock and Hartley Drive. I feel a largemanufacturing facility will only increase that flow into the seasonal pond and threaten ourcommunity with pollutants andmanufacturing byproducts.

3. Proximity to residents - Thesubdivisions Hartley Hills, Boyer Farms, and Beechgrove are filled-with growing families.These families chose this area for its proximity to 124, good schools, and commerce such asstores, restaurants, andentertainment Adding additional manufacturing real estate threatens the harmony of those residents by further boxingthem in. If the rezoning proposal is granted, residents will be living in -a small corridor virtually surrounded by potentialharmful manufacturing facilities. In fact the straight-line distance between the battery factory and the property underconsideration is less than one-mile.I urge you to consider my objections and recommend that the property not be rezoned for manufacturing purposes

4. Health of Residents: The increase of industrial use that close to the homes causes me to concern the health of mychildren and family. -

The risks of industrial zoning so close to our neighborhood poses toomany unknown risks to be considered safe. Mr. Spainhoward,lam a resident of the Boyer Farms subdivision. lam deeply concerned by the rezoning request currently underconsideration on Charles Bell Rd. My concerns focus primarily in three areas. First, the addition of heavy industrial in thearea closely adjacent to residential areas may cause health and air quality concems alongwith noise concerns. Iexpressed my concerns when the battery plant was proposed, but understood that the existing industrial park allowedsuch a plant. Expanding the heavy industrial area would further negatively impact this area and the quality of life ofthousands of residents. Secondly, the zoning change will negatively Impact the property values In the area. Noise andincreased trafficwould be undesirable for current and future residents. Finally, the infrastructure in the area is alreadyovertaxed with the addition of two large apartment complexes and expansion of existing subdivisions. Traffic in the areahas greatly increased with no improvements made. I do not believe this rezoning is in the best interest of the residents ofthe area.Thank you foryour consideration. i

After recently building and occupying a hou&e in Hartley Hills Subdivision, off Charles Bell, rezoning AG to M2 woulddrastically affect the surroundings for which we call home. Your website says it best, “could possibly have anadverse effect on surrounding.proflQ~jy~Suchuses are not properly associated with norcompatible withresidential, institutional, retail business, or light industrial uses. As such, these uses are intended to be confined to aspecific location or area where their existence will not adversely affect surrounding uses.”

I undersland the need of growth, and the financial gains to both the City and County, and again to the currentproposed sellers. I also assume a piece of real estate that large is almost a done deal, but we urge you to think aboutthe repercussions of building such a Facility as M2 (based on the city’s description).

Thank you for taking my call yesterday and explaining the rezoning process.

In reference to CZ-09-2020 I would like to take this opportunity to oppose any rezoning for manufacturing purposes.Below are my main objections.

1. Infrastructure - there are three potential access points to this property: Charles Bell, Hampton Station, and GuthrieHighway. Both Charles Bell and Hampton Station are small 2 lane roads lacking a shoulder. Increasing commercial trafficonto these roads greatly increases the risks to cyclist and pedestrian traffic. Additionally, Charles Bell has a significantblindspot between Steel Stock and Hartley Drive. For several hundred feet a car, pedestrian, or cyclist is not visible tomotorists.

2. Runoff - the majority of the water that falls onto the property under consideration flows directly into the seasonal pondwest of Hartley Hills subdivision. For at least I !3 of the year there is significant standing water. The amountofwater thatenters this area from the property often covers Charles Bell between Steelstock and Hartley Drive. 1 feel a largemanufacturing facility willorily Increase that flow into the seasonal pond and threaten ourcommunity with pollutants andmanufacturing byproducts. -

3. Proximity to residents - The subdivisions Hartley Hills, Boyer Farms, and Beechgrove are filled with growing families.These families chose this area for its proximity to i24, good schools, and commerce such as stores, reëtaurants, andentertainment. Adding additional manufacturing real estate threatens the harmony of those residents by further boxingthem in. If the rezoning proposal is granted, residents will be living in a small corridor virtually surrounded by potentialharmful manufacturingfacilities. In fact the straight-line distance between the battery factory and the property underconsideration is less than one-mile.

I urge you to consider my objections and recommend that the property not be rezoned formanufacturing purposes.

We are residents of the Hartley Hills Subdivision and we are writing in opposition to this rezoning action for the followingreasons:

1. The road network adjacent to the parcels to berezoned are clearly notcapable of accommodating the heavy trafficthat a manufacturing facility will likely bring. Specifically, Charles Bell and Hampton Station Ro~dsare too narrow.Charles Bell Road, forexample, is barelywide enough for two passenger vehicles to pass in some places. Blindspots on both roads will present significant hazards to bicyclists. motorcyclists, and pedestrians if commercialtraffic is introduced.

2. A seasonal pond (4-6 months out of the year) develops directly across from our home and across the street. Weare deeply concerned that the runoff that creates that pond could be Significantly increased by manufacturingacross Charles Bell Road and that pollutants might be added to that runoff.

3. After a 36-year military career, we chose Ciarksville to be our “foreve?’ hometown, having never been stationedhere or visited here. On our first house hunting trip to Middle Tennessee, we looked at this cOmmunity and fell Inlove with it. We chose Hartley Hills because it was one of a handful of adjacent or nearbyresidentialcommunities. We recognized that there was someindustry close by. but that we had a buffer created by thesurrounding farms. We fear that If this rezoning goes forward, we will lose that buffer and we will ultimately betightly surrounded by industry. That would completely negate one of our most important reasons forchoosing thiscommunity as our forever home.

Ordinance

Section 9. Dangerous Dog — Appeal

A. The owner of a dog found to be a dangerous dog or potentially dangerous dog, pursuantto this regulation by the Director or his or her authorized representative may, within 5business days of receipt of notification of the determination, request an administrativehearing to appeal the determination. The administrative hearing shall be conductedpursuant to this section.

B. A mandatory $50.00 deposit is required upon submission of an appeal request. The

$50.00 deposit must be paid in full at the Montgomery County Animal Care and Controlfacility at the time of the appeal. request. All deposits are refundable upon the appellantappearing before the Montgomery County Animal Care and Control Committee at thetime of the appeal hearing. Any failure by the appellant to appear at the date, time, andlocation of the assigned Appeal Hearing shall forfeit all deposits made to MontgomeryCounty Animal Care and Control.

C. An owner desiring a hearing appeal shall make his or her request for a hearing to the

reviewing committee comprised of members of the Animal Care and ControlCommittee, which will be reviewed and discussed in open committee session where allparties to the case may present their appeal to overturn the dangerous dogdetermination set forth by the Director.

D. The restrictions placed on a dog that has been declared dangerous and to which anappeal has been filed, shall remain in effect until said determination has beenoverturned by the Animal Care and Control Committee.

WHEREAS, MontgomeryCounty hasfaced specialchallengeswith preventingthe spreadof~infectious diseasewhile carryingout all the constitutional,statutory,and other obligationsand servicesprovidedby CountyGovernment;and

WHEREAS, the Centersfor DiseaseControl haspublishedbest practicesfor the purposesofscreeningpersonsto include, but not limited to thecheckingfor, certainsymptoms,closecontactwithinfectedpersons,andtemperaturechecks;and

WHEREAS,theCountyhastakenpossessionofThermalTemperatureCamerasystemspurchasedpursuantto appropriationsmadein MontgomeryCountyResolution20-6-10forthepurposesofscreeningfor temperaturesin certaindesignatedcountyfacilitiesandcertaindesignatedcountyfunctions;and

Thermal Camera Operations

Section 1 Purpose

This policy establishes procedures for the use of the Thermal Temperature Camera system in designatedfacilities owned by Montgomery County Government. This policy applies to Montgomery Countyemployees and visitors.

Section 2 Policy

This policy shall dictate proper usage of thermal temperature camera scanners in accordance with CDCand/or FDA recommendations in order to reduce and limit the spread of COVID-19, or other known orunknown infectious disease. The use of the cameras will be used at certain locations and buildingsregularly or as needs determine as is necessary to protect the public health, safety, and welfare in light ofall contagious diseases that spread from person to person, and based upon anticipated size of gatheringsthat within its discretion, Montgomery County believes warrant the screening so provided. The use of theCameras will be posted as provided for herein.

Section 3 Definitions

Thermal Temperature Camera System — A dual camera system consisting of multiple parts including, butnot limited to the following:

Dual Camera with a standard camera and a thermal camera

Computer System with monitoring softwareMonitor(s)

Tripod Mounting Stand or Mounting hardware

Connector cables and additional wiring

Section 4 Procedures

A. Approved Users

a. Only employees of Montgomery County, TN government are authorized to use thethermal temperature camera scanner.

b. Users must be trained in the use of the system. All trained operators will be required tosign a non-disclosure agreement (NDA) regarding dissemination of data collected by thescanner. Training and the NDA will be documented and retained by the employee’sdepartment or Office.

c. Maintenance and troubleshooting will be conducted by designated personnel from theagency responsible for the camera system and/or through the manufacturer ordistributors customer support.

B. Disclosurea. Use of thermal temperature camera systems will be displayed on appropriate signage in

all locations where the system is operational. This will service as an acknowledgement ofinformed consent and must be easily visible to persons entering the building.

b. Manufacturer information relating to alternative performance specifications shall beposted in accordance with FDA recommendations pertaining to medical devicesdistributed without premarket notifications under 510(k) of the FD&C but otherwisedeemed to not create an undue risk in light of the public health emergency.

C. Approved Usea. Thermal Temperature Camera Scanners shall be used to take a measurement of the self-

emanating infrared radiation that reveals the relative temperature variations on thesurface of the body.

b. These devices shall be used at the entrances to buildings to pre-screen persons prior toentrance to the main parts of the building in an effort to limit the potential for the spreadof COVID-19 or other infectious diseases as determined by CDC, FDA, or othergovernment guidelines.

c. Information obtained by the software will be stored temporarily for screening purposesbut will not be saved or distributed. Data space is limited, and new data will overwriteexisting data when space is needed.

d. Information obtained by the device shall not be shared by use of 3”~party devices

(phones, cameras, etc.)e. Monitoring devices for the system shall be out of view of the public or those personnel

not trained in the operation of the device.D. Daily Operations

a. Operators shall follow manufacturers recommendations for system preparation prior tothe start of normal operating hours.

b. Operators shall ensure that disclosure notice signage is serviceable and unobstructed.c. Operators shall monitor all persons entering their facilityd. Any persons RED flagged by the system with a skin temperature of 100.4 or higher shall

not be allowed to enter the facility. Those persons will be asked to remain in a cool areafor at least 5 minutes and then rescanned by the system. Any persons flagged twice bythe system will be prohibited from entering the facility.

e. County Employees shall notify their supervisors of the system RED flag and follow theiragency’s procedures relating to illness.

f. Visitors shall be notified that theyare prohibited from entry due to a temperature flaggingby the system. They shall be informed that this is due to the scanner reading theirtemperature at 100.4 degrees or greater. They should not be told that they have a feveror given any medical diagnosis or advice.

g. Operators will coordinate notification to the appropriate party that the visitor was notallowed entry in the case of an appointment, court appearance, or similar circumstance.

E. Responsibilitya. All Montgomery County employees trained in the operation of the device shall comply

with all aspects of this policy.b. Supervisory personnel are responsible for ensuring that operators comply with the

provisions of this document.c. Agencies operating and maintaining these devices are responsible forupdating this policy

in accordance with any changes in CDC, FDA, or other government guidelines.
