1. Tender documents can be purchased only online from https://www.mpeproc.gov.in by making online payment of Rs. 2000 (Two Thousand). The last date of purchase of tender document is 23-11-2013 upto 17:30 and the last date of Bid Submission is 25-11-2013 up to 17:30.
2. The Bid Data should be filled and the documents which are to be uploaded by the Bidders should be submitted online up to as per time schedule (key Dates).
3. Intending bidders shall enroll online in the website http://mpeproc.gov.in.
4. The contractors shall submit the pre-qualification information in the prescribed pro-forma for assessment of eligibility in online procedure with price bid in form SBD.
5. Earnest Money Deposit is As per Schedule given in Annexure I, in the shape of BD issued by Nationalized / Scheduled Bank located in India in favor of M.P. State Livestock & Poultry Development Corporation, Bhopal should reach office of undersigned before 27-11-2013 alongwith other original documents which were uploaded online.
6. Since, the bids are required to be digitally signed using Class III digital certificate of the authorized representative of the firm, Contractors are advised to obtain the same at the earliest. Further information on the same may be obtained from e-Procurement Cell or from

INSTRUCTIONS TO TENDERERS (ITT)M.P.L.P.D.C .Will select an Agency among those who respond to our public notice on request for proposal, in accordance with the method of Selection Specified in the tender document,1. the Agencies are invited to submit a Technical bid and a Financial bid as specified in two separate
sealed online sheets "Technical Bid' and 'Commercial Bid' . Bidder should submit Technical Envelop and Original EMD in Hard copy. In any case if Price Bid / Financial Offer received manually then bid will be rejected.
2. The inner and outer envelopes shall be addressed to the competent authority at the following addressThe Managing Director M.P. State Livestock & Poultry Development Corporation Ltd.Boiler BhawanLink Road 3, Kotra Sultanabad,Bhopal
3. The Completed proposal must be uploaded online as per the key dates and time schedule mentioned in tender notice. The Pre-Qualification bid shall be accompanied by a Bank Draft as per the participation in tender for item/items, for category mentioned in Annexure I as Earnest Money Deposit (EMD). The EMD of the Agency contracting for the project Earnest Money Deposit shall be converted into security deposit for due Performance of the work and will be returned after the successful completion of the work. No interest will be paid at the time of return of EMD.
4. The Technical bid shall be opened online as per the key dates and the privilege will be given to the documents uploaded on line. Physically submitted documents are for reference purpose only, decisionwill be based on online uploaded documents. Parties or their representatives of the parties who wish to remain present at the time of opening are welcome. Preliminary Examination of bids will be carried out to determine they are complete, whether required sureties have been furnished, whether the documents have been properly signed and whether the bids are generally in order.
5. At any time before the submission of the proposal, MPLPDC may, for any reason, whether on its own initiative or in response to a clarification requested by an invited agency, amend the bid document. Any amendment shall be made available on the website i.e. http://mpeproc.gov.in through agenda. MPLPDC may, at his discretion extend the deadline for submission of the proposals.
6. The Agencies are expected to examine the document constituting this bid document in detail while preparing their Technical and Financial proposal Material deficiencies in providing the information may result in rejection of the proposal.
7. The tender and its enclosures should be signed digitally by the tenderer.8. Rates of the Instruments and equipments quoted should be in INR i.e. Rupees & F.O.R.9. Tender will be rejected on the following conditions-
i. If there is overwriting, cutting etc. on quoted rates.ii. If quoted rates are not illegible.iii. If samples/catalogues are not submitted by manufacturer as per quoted instruments and Equipments rates.
10. Rates once quoted in the tender will be final. There will be no negotiation with the manufacturer.

Terms & Conditions of Tender
The M.P. State Livestock & Poultry Development Corporation (MPLPDC) Bhopal invites online sealed tenders from Manufacturers/ Suppliers for the Purchase of Equipments for M.P State Livestock and poultry Development Corporation Bhopal, Madhya Pradesh According to demand strictly in accordance with the detailed specification given in schedule Annexure -II of the tender document.
Managing Director M.P. State Livestock & Poultry Development Corporation (MPLPDC) Bhopal reserves the right to accept/reject any/all quotations without assigning any reasons thereof.
1. Tender Submission: The tender should be submitted online and other relevant documents except Price Bidshould be submitted in person or send by registered post, so as to reach the office of Managing Director, M.P. State Livestock & Poultry Development Corporation, Bhopal before 27.11.2013Tender will be opened from 27-11-2013 up to key dates in the presence of tenderers or their representative who choose to remain present.Tenders received by telegram / fax will not be considered. The tender will be accepted as per online key datesConditional tenders are liable to be rejected. The Managing Director, MPLPDC will have power for full, partial or split orders for supply of Equipments/ Articles in case rates of more than one party are lowest and same/ similar etc. If tender submitted by manufacturer, it must be signed separately by each partner and in event of absence of any partner it must be signed on his behalf of a person holding power of attorney which should be issued by the person who will be absent, authorizing him to do so which should be produced with the tender and it must disclose that the firm is registered under Indian partnership Act along with specification of No. of partners who constitute the firm with their names and address. The contractor shall not sublet the contract assigned to any other party or parties, the whole or any portion of the contract. Any amount due to the governor of M.P. from the manufacturer on any account in respect of this tender may be recovered from him as arrears of land revenue.
2. Earnest Money Deposit: As per the schedule given in Annexure I
2.1 The tenderers shall have to deposit Earnest Money of Rupees Indicated in Annexure- I as mentioned above in the form of crossed demand draft drawn in favor of "M.P. State Livestock & Poultry Development Corporation, Bhopal” submission of earnest money by any mode other than specified above shall not be acceptable and the related tender shall not be eligible for consideration. Scan Copy should be uploaded online and Original EMD should reach the office as per key dates.2.2 Earnest Money Deposit of unsuccessful tenderers will be returned after finalization of tender. The earnest money deposit of the successful tender will be released in completion of

supply of entire quantity, installation of equipments/consumables and commissioning of equipment successfully/allotted/ ordered within the stipulated period.2.3 No Interest will be paid on the earnest money for the period during which (The earnest money) it lies in deposit with the MPLPDC, Bhopal.
3. Prices: 3.1 Quote should be FOR in Indian rupees should be inclusive of all taxes and transportations.Lowest rates will be approved after matching prescribed specifications. Prices offered by the tenderers should be firm and free from all escalations. Rates once quoted in the tender will be final.3.2 The price offered should be valid at least for a period of one year from the date of tender Approval. 3.3 The tenderer should quote price inclusive of packing, forwarding, taxes, insurance, transportation charges, installation and commencement. The department shall grant certificate for total quantity of supply made but shall not entertain any claim on this account. Sale tax (Trade tax) and other. Govt. levies will be paid extra as applicable by the successful tenderer. If VAT is applicable it should be shown separately and will be deducted and deposited by the purchaser and certificate in prescribed form will be supplied to the supplier. If VAT is not shown separately then the same will be deducted as applicable from the payment due as VAT.3.4 C - Form and Form- 75 & Form 49 shall be provided as per rules.
4. Warranty A minimum of one year's comprehensive onsite warranty should be provided. May Also, Include proposal for extended warranty/AMC.Spare set - A complete set of spares and consumables should be supplied with the instrument as per requirement for trouble free operation. Availability of expert Service/ Vendor Support in India will be major criteria in evaluation.
5. Delivery period: Within one month from the receipt of PO. Clearly specify the installation requirements – such as space, power, frequency, etc.
6. Insurance: Transit insurance shall be arranged by the Suppliers.
7. Payment: Our normal terms of payment are full payment on acceptance of material after inspection, installation, demonstration and commencement within a period of 30 days after receipt. The payment shall be made in Indian Currency by A/c payee Cheque /DD only.
8. Status of Tender The acceptance of tender and award of the purchase order will be the sole right of the Managing Director, MPLPDC, and Bhopal, Who does not bind himself to accept a tender in whole or in part. He reserves the right to reject any or all the tenders or their parts without assigning any reason. No responsibility shall be attached for premature opening of tender if it is not properly addressed and identified.

Negligence on the part of tenderer in filling the tender confers no right to withdraw the tender after it has been opened. No persons or firm is permitted to submit more than one tender under different names. Tender will be rejected if there is over writing, cutting or corrections etc. on quoted rates, ifsamples, catalogues are not submitted by manufacturer as per quoted instruments and equipments rates.
9. Custom ClearanceThe custom clearance of the equipments and its transportation to site Bhopal shall be the
responsibility of the successful tenderer. Necessary custom clearance documents if any required shall be provided by the corporation.
10. InspectionThe entire equipment with accessories shall be received by the M.P State Livestock &
Poultry Development Corporation at Bhopal (INDIA) on said to contain basis and shall be inspected by the corporation authorities in presence of the authorized representative of the successful tenderer if desired so. Any shortage/damage/discrepancy etc. noticed at the time of such inspection shall be replenished by the Successful tenderer within a period of 30 days from the date of intimation to them, free of cost.
11. Installation of the EquipmentAll pre-installation requirements of Civil, Electrical mechanical including drawings and
plans for the equipment shall have to be finalized by the successful tenderers with the authorities of Livestock Dev. Corporation prior to the dispatch/receipt of the equipment. The equipment after receipt shall have to be installed by the trained/ qualified engineer of the successful tenderer within a period of 30 days from the date of the intimation from the Corporation.
12. Testing & Quality of the EquipmentThe equipment to be supplied should be of the latest State of Art & Technology
conforming to the highest standards of manufacturing technology in respect of durability, strength and engineering practices.
In case any equipment/ accessory or part thereof develops any defect which could not be detected at the time of its installation at Corporation within 6 months from the date of acceptance of the equipment, it shall be promptly replaced by the successful tenderers free of charges and all expenses of transportation, custom clearance and installation shall be borne by the successful tenderers.
13. PenaltiesIn the event of the successful tenderer failing, declining, delaying or neglecting the supply
of the goods as per the order or in the event of any damage occurring or being caused by the successful tenderer or in the event of any default by the successful tenderer in complying with any of the terms and conditions of the contract or a default or failure in completion with any of the terms and conditions of the contract.
The Managing Director M.P State Livestock & Poultry Dev. Corporation will be at liberty to resort to other remedies in force in Madhya Pradesh State:a) Terminate the contract after 30 days notice and / or

b) Recover the amount of the loss caused by the damage, failure or default including the consequential damages or a default or failure as may be determined by The Managing Director M.P State Livestock & Poultry Dev. Corporation c) Forfeit EMDd) Impose penalty equivalent to 5% of the total unsupplied value of the ordere) Penalty shall however be subject to force Majeure and arbitration clause at this NITf) Other provision of penalty shall be as per Guarantee/Warrantee, of this NIT
It should be clearly understood that in the event of tenderer failing to accept and execute the supply order, decision of the Managing Director, MPLPDC for imposing penalty etc. shall be final and binding on the tenderer. In matters of interpretation of the above clauses the decision of Managing Director, MPLPDC shall be final and binding on all concerned.For all disputes the jurisdiction shall be Bhopal. No court outside Bhopal will have any jurisdiction.
14. Regulatory Clearance CertificatesIt will be the responsibility of the successful tenderers to obtain necessary regulatory
clearance Certificate as may be required for import/ installation and working of the equipment.
15. Wharf Age / Demurrage: Wharf age/ demurrage etc. on account of incorrect or delayed dispatch of material or document shall be the responsibility of supplier and cost shall be recovered from his bill.
16. Termination of Contract: For any breach of the terms and conditions of contract shall render the contract liable for termination / black listing of the firm in addition to payment for damage etc.
17. Drawing and Specification: Rates should be quoted for the specification given in Annexure - III, wherever no specifications are given in tender document, detailed specification of the articles and its components should be mentioned by the tenderer giving reference to ISI/ISO certification.
18. Arbitration: In case of any dispute if arises between the parties relating to any terms and conditions of the tenderer/ agreement before and after the filling of tender and/ or execution of the agreement any party may refer the dispute to a sole arbitrator who will be the principal Secretary Govt. of M.P. Dep’t. Of Animal Husbandry, or a person nominated by him whose decision and award shall be final and binding on both the parties. Venue of arbitration will be at Bhopal and Arbitrator's fees shall be shared by both the parties equally. The arbitration proceeding shall be under and in accordance with the provision of Arbitration and Conciliation Act. 1996.

Managing Director MPLPDC, Bhopal is authorized to change the terms and conditions mentioned above without prior intimation.
19. Catalogue and Samples Complete set of manuals for the operations and servicing of equipment should be given. All circuit diagrams, other mechanical and electrical schematics must be provided to main unit, sub systems, and accessories. Clearly specify the installation requirements – such as space, power, frequency, environment etc
