RULES OF WAR

MUN CONVENTION

DONE AT BRISBANE ON 1 APRIL 2013ENTERED INTO FORCE ON 5 APRIL 2013

The States Parties to the present Convention,

Considering the fundamental role of consistent diplomacy in the effective operation of BrizMUN,

Recognizing the ever-increasing importance of Model United Nations activities that

closely mirror real world operation of the United Nations,

Noting that the principles of free consent and of good faith and the pacta sunt servanda rule are universally recognised,

Affirming that disputes concerning treaties and other international disputes should be settled by peaceful means and in conformity with the principles of justice and

international law,

Recalling the determination of the peoples of the United Nations to establish conditions under which justice and respect for the obligations arising from BrizMUN committee

negotiations can be maintained,

Having in mind the principles of international law embodied in the Charter of the United Nations, such as the principles of the equal rights and self-determination of peoples, of the sovereign equality and independence of all States, of non-interference in the domestic affairs of States, of the prohibition of the threat or use of force and of universal respect for, and observance of, human rights and fundamental freedoms

for all,

Believing that the codification and progressive development of the law of treaties achieved in the present Convention will promote the purposes of the United Nations set forth in the Charter, namely, the maintenance of international peace and security, the development of friendly relations and the achievement of cooperation among

nations,

Affirming that the rules of customary international law will continue to govern questions not regulated by the provisions of the present Convention,

Have agreed as follows:

PART 1INTRODUCTION

Article 1

Scope of the present ConventionThis Convention applies to all activities occurring at and relating to the Brisbane Model United Nations Conference including ceremonies, committees, bloc meetings or

extracurricular events.

Article 2Conduct not within the scope of this treaty

The present Convention does not affect or seek to regulate conduct not occurring at or in relation to the Brisbane Model United Nations.

Article 3

Non-retroactivity of the present ConventionWithout prejudice to the application of any rules set forth in the present Convention, the Convention shall apply only to acts that are concluded by States after entry into

force of the present Convention.

PART 2REGULATION OF CONDUCT DURING COMMITTEES

Article 4

Conduct in violation of the ConventionGeneral conduct shall violate the present Convention where:a) It is not in keeping with the spirit of the United Nations;

b) It is not performed in good faith;c) It is in direct or indirect contravention to a States’ already existing policy

Prohibited conduct prima facie violates the present Convention.

Article 5

General ConductGeneral conduct means conduct that is not prohibited conduct but satisfies the criteria

listed in Article 5.

Article 6Prohibited conduct

Prohibited conduct means the following conduct:a) Inconsistent conduct of delegates representing the same country in different

committees;b) Egregious violations of the Rules of Procedure;

c) Failure to consult all delegates during bloc meetings

d) Failure to consult bloc representatives for relevant decisions

PART 3CONSEQUENCES FOR VIOLATIONS OF THE PRESENT CONVENTION

Article 7

Consequences for minor violations of the ConventionConsequences for minor violations of the Convention shall be determined by the

Secretariat.

Article 8Consequences for serious violations of the Convention

The Secretaries-General and the International Court of Justice shall determine consequences for serious violations of the present convention.

PART 4

MISCELLANEOUS PROVISIONS

Article 9Application of the Convention to conduct at social events

Without prejudice to the application of any rules set forth, the present Convention in no way seeks to regulate drunk and disorderly behaviour of delegates while at social

events.

For clarity, “social events” refers both to official and unofficial social events being:a) Committee dinners on the evening of the 4thb) The themed party on the evening of the 5th

c) Casual drinks on the evening of the 6thd) The Finale Ball on the evening of the 7th
