Rules and RegulationsMy Party Affair by LaShone, LLC dba My Party Affair Party Bus

• Trip balance is to be paid in full at the time service is rendered. My Party Affair by LaShone,LLC d/b/a My Party Affair Party Bus (hereinafter "MPA") accepts Money Order, Visa,MasterCard, Discover and American Express.

• Passenger is liable for any damages to the interior or exterior of MPA vehicle ("the vehicle").Damages include, but are not limited to, broken or defaced windows, lighting and handrails,broken or stained upholstery and any broken, defaced and/or stained property belonging to MPA.If damages occur, a minimum of $300.00 for repair and/or cleaning of the vehicle will becharged to the credit card used to make the trip reservation.

• Overage fees- MPA charges $150 per hour for going overtime on your reservation. Paymentmust be received before getting back on the bus. Additional hours may be added before your tripbegins after getting approval from MPA and its employees.

• Deposits are $100 non-refundable and must be paid to reserve your date. Cancellations must bemade 14 days prior to recieve a 50% refund of your remaining balance. Refunds will be forfeitedfor cancellations without 7 days notice for your reservation.

• The following are prohibited on all My Party Affair Party Bus vehicles: food, smoking, illegaldrugs/controlled substances, weapons, and sexual activity.

• The consumption of alcoholic beverages or tobacco products by a minor is unlawful. No oneunder the age of 21 is allowed to consume or transport alcoholic beverages on a My Party AffairParty Bus vehicle. MPA does not provide alcoholic beverages.

• MPA, its employees, agents and assigns have the right to refuse service to anyone at theirdiscretion. Rentals can be cancelled if the driver feels that he/she or the passengers are unsafe. Ifany passenger is behaving in a disorderly, unsafe or illegal manner, the driver of the vehicle canreturn the group to the first point of pick up or discharge the passengers at the point where theoffensive behavior occurs. In the event that MPA is forced to cancel the rental because ofbehavior of passenger(s), MPA's obligations under the charter contract will immediately becomenull and void, the trip deposit will be forfeited, and the entire trip balance will be charged to thecredit card used to make the trip reservation. No refund will be available. MPA, its employees,agents or assigns shall be the sole judge of the passengers' safety and condition and theappropriate measures to be taken. MPA, its employees, agents or assigns making suchdetermination shall not be liable for any mistake in judgment exercised in good faith.

• Passenger, by signing the trip sheet, (1) waives, releases and discharges MPA, its employees,agents and assigns from any and all claims relating to passenger's transportation via a MPAvehicle except for claims due to MPA's gross negligence or intentional acts; (2) assumes any andall risks of personal injury or property damage and releases and holds harmless MPA from any

and all liability for personal injury or damage to personal property except that caused by MPA'sgross negligence or intentional acts; and (3) indemnifies and holds MPA harmless from any loss,liability, damage, cost or expense, including litigation, which may occur as a result of anypersonal injury or property damage except that caused by MPA's gross negligence or intentionalacts. Passenger is aware that by signing the trip sheet, passenger is releasing MPA from theabove detailed liability as well as creating a contract between passenger and MPA.

• MPA is not responsible for any damage, loss, injury or death suffered by passenger in caseswhere (1) passenger's own fault or omission is involved; (2) unforeseeable or unavoidable faultof a third party unconnected with the provision of any services by MPA is involved; and (3)unusual and unforeseeable circumstances beyond the control of MPA occur.

• Passenger shall be liable to and indemnify MPA for any fines or penalties imposed on MPA byany authorities for passenger's failure to observe or comply with any local and/or federal laws orregulations. This indemnification shall include all costs and attorney's fees incurred by MPA inconnection with such actions.

• Passenger agrees that if MPA uses legal counsel, a collection agent or other person to enforcepayment of the trip balance or damages, passenger will pay the collection costs, attorney's fees,court costs and other expenses incurred by MPA in obtaining payment of amounts due andinterest at the highest rate allowed by law on any unpaid amounts due.

• Neither MPA nor the passenger will incur any liability to the other if either's performance isprevented or delayed by causes beyond its control and without the fault or negligence of eitherparty. Causes beyond MPA and the passenger's

• control include, but are not limited to, acts of God or war, changes in controlling law, regulations,orders or the requirements of any governmental entity, severe weather, civil disorders, technicalproblems with transport, natural disasters, fire, epidemics and quarantines.

• All terms, provisions, rates, conditions and other restrictions herein contained are subject tochange at any time with or without notice.
