The meeting of the Approval Committee of Noida SEZ was held on 12/11/2013

at 11:30 AM in the Conference Hall of NSEZ, Noida. The meeting was chaired by Shri

Jayant Misra, Development Commissioner, Noida SEZ. Following members were

present:

Besides, Shri Rakesh Kumar, Dy. Development Commissioner, NSEZ, Shri Prakash

Development Commissioner, NSEZ, Shri Praveen Kumar, AEE, U.P.P.C.B. Noida and

GIST OF THE MEETING:

Ratification of Minutes of last meeting of the Approval Committee:

The Approval Committee ratified the minutes of the last meeting held on 26/09/2013.

Decisions on Proposals:

The Approval Committee considered the proposal at length and noted that the··

manufacturing process flow chart as submitted by the applicant for the proposed activities

does not properly describe the proposed activities. The Committee viewed that the

proposal appears to be more of 'trading' activity than 'manufacturing'. Hence the

Committee deferred the proposal with the directions to the applicant to submit detailed

manufacturing step-by-step process flow chart and year wise schedule of employment

generation for appropriate consideration of the proposal by the Committee.

1. Application of MIs. Integrated Wireless Solutions Pvt. Ltd. for setting up a unit il;1

NSEZ.

2. Application of MIs. Electro Crown Global for setting up a unit in NSEZ.

The Approval Committee deliberated on the proposal in detail. The Committee, however,

did not find the process flow charts, submitted by the applicant, to be convincing to treat the

proposed activities as 'manufacturing', as it appeared to be 'trading' only. Hence theI "

3. Application of MIs. Futronics World for setting up a unit in NSEZ.

4. Application of MIs. Encore Crafts for setting up a unit in NSEZ.

The Approval Committee considered the proposal and deferred the same with the directions

to the applicant to expedite their reply to this office letter dated 05/09/2013, for further

consideration of the proposal.

5. Proposal for review of issuance of Letter of Approval to MIs Futuristic Internet

Services Pvt. Ltd.

6. Application of MIs Ansh Ventures Pvt. Ltd. for setting up a unit in NSEZ.

The Approval Committee deferred the proposal with the directions to the applicant to

urgently comply with the directions of the Approval Committee held on 30/07/2013 as

conveyed vide letter dt. 16/08/2013.

7. Application of MIs. Maya Crafts Pvt. Ltd. for setting up a unit in NSEZ

Committee directed the applicant to recast the project application giving justifiable and

elaborate details of proposed processes and trading activities separately so that the same

can be put before the Committee for further consideration.

The Approval Committee considered the proposal and deferred the same with the

directions to the applicant to expedite their reply to this office letter dated 11/10/2013 and

reminder letter dated 30/10/2013, for further consideration of the proposal.

The Approval Committee directed the Joint Development Commissioner to send a reminder

to the Commissioner of Income Tax, Noida to expedite reply on the issue in order to take

the matter to its logical conclusion.

The Approval Committee deferred the proposal with the directions to the applicant to

urgently submit their reply with reference to this office letter dt. 23/08/2013, for further

consideration of the proposal.

The representative of the applicant company informed the Approval Committee that they

have started manufacturing activities w.e.f. 25/10/2013. The Committee deferred the

proposal with the directions to verify the same from the Audit Report of the company and

put up the facts before the Committee' in its next meeting.I IlLl~

9. Application of MIs. Stable Packaging Pvt. Ltd. for setting up a second Unit in NSEZ.

The Approval Committee deliberated on the proposal and approved the same with the

condition that the applicant shall achieve the export projections through physical exports of

the manufactured products from the unit, as assured. The performance shall be monitored

every six months.

12. Proposal for Review of performance of MIs Jagat Gems & Jewellery, plot no.

129G/33-35.

13. MIs. Usha Global Corporation, Plot No. 118 - Review of performance.

10. Application of MIs. Trimurti Fragrances Pvt. Ltd. for setting up a Unit in NSEZ.

The Approval Committee deliberated on the proposal in great details and decided that since

there is ban on Gutkha Industries in the State of Uttar Pradesh, the said proposal cannot be

accepted in its present form. Hence the Committee decided that the applicant may be

asked to modify the proposal accordingly for further consideration.

11. Proposal of MIs Popular Card Technology Pvt. Ltd. for inclusion of Additional items

in LOA.

The Approval Committee considered the proposal and approved inclusion of 'manufacturing

of plastic card body & smart card' in the LOA of the unit. Trading of these items was

however not allowed by the Committee.

The Committee also monitored the performance of the unit on the basis of APRs and noted

achievement of positive NFE by the unit as on 31/03/2013.

No one from the unit appeared. The Committee, however, reviewed the performance of the

unit as per agenda and decided to issue a show cause notice to the unit in failing to carry

out approved authorised operations and achieve NFE after renewal of LOA. The

Committee empowered the DC, NSEZ to issue the SCN and take further necessary action

as per statutory provisions.

No one from the unit appeared. The Committee, however, reviewed the performance of the

unit as per agenda and decided to issue a show cause notice to the unit in failing to carry

out approved authorised operations and achieve NFE after renewal of LOA. The

15. Review of performance of MIs. 8ackbay Clothing.

16. Proposal for change of Management/Shareholders of MIs Lister Moessner (India) Pvt.

Ltd.

17. MIs. Lingo Impex - Review of Authorised Operations.

18. MIs. La Moda Eleganza - Amendment in LOA.

19. MIs Indeutsch Industries Pvt. Ltd. (Unit-II) - proposal for inclusion of Trading

Activities in LOA.

14. Review of compliance with Pollution Control Norms by SEZ units - Reg.

Representative from UPPCB informed the Committee that MIs Indeutsch Industries Pvt.

Ltd. has now been complying with the pollution control norms. However MIs Nano

Electrotech Pvt. Ltd. has been granted some more time by the Hon'ble National Green

Tribunal for ensuring necessary compliances.

The Committee deferred the review of performance of the unit for the next meeting.

The Committee took note of the proposal for change of management/shareholding of the

unit and approved the same with the directions to the Estate Section, NSEZ to examine the

case with respect to applicability of transfer charges so as to take further necessary action

on file accordingly.

The Committee also monitored the performance of the unit on the basis of APRs and noted

achievement of positive NFE by the unit as on 31/03/2013.

The Committee deferred the proposal with the directions to the unit to submit specific list of

items to be traded, for further consideration of request of the unit.

The Committee took note of submission of the unit and approved LOA amendment as

requested by the unit.

20. MIs Goldwyn Ltd., Plot No. 15-16 - Proposal for review of performance and

ratification of one time permission of Import of Embedded Runway Light, Taxiway

Edge Light and Approach Light - reg.

21. Proposal for Review of performance and Renewal of LOA (for next five years) of MIs

Aksasia Creations Pvt. Ltd.

22. Review of performance of MIS VISHWAAS

23. Review of Implementation of LOA by MIs. Samsung Overseas Ltd.

24. Change of Entrepreneur by way of Transfer of Assets of MIs Gold Craft International

Plot No. 86, NSEZ to MIs VKM Exports.

25. Monitoring of APRs/Performance:

The Committee ratified the one time import permission granted by DC to the unit. The

Committee also monitored the performance of the unit on the basis of APRs and noted

achievement of positive NFE by the unit as on 31/03/2013.

The Committee discussed the agenda and reviewed the performance of the unit in respect

of LOA dt. 21/02/2005. It was decided by the Committee to issue a show cause notice to

the unit for failure to carry out any activities and lying non-operational for the last more than

three years. The Committee empowered the DC, NSEZ to issue the SCN and take further

necessary action as per statutory provisions.

Besides, the Committee noted that the Company has also been issued another LOA dated

03/07/2012 for ITIITES activities, however, the unit has even not submitted the acceptance

of terms & conditions of the said LOA. The Committee, therefore, took note about the lapse

of LOA dated 03/07/2012 and decided to treat the same as 'cancelled'.

The Committee noted that the possession of the allotted space has already been taken

over by the Estate Division. The Committee directed the Estate Section to make all out

efforts for recovery of outstanding Govt. dues from the' unit.

The Committee reviewed the case and took note of commencement of operations by the

unit.

The Committee directed M/s Gold Craft International to comply with the exit formalities.

The Committee monitored the performance of the following units as per details below:

1. Furniture for USA: The Committee monitored the performance of the unit on the

basis of APRs and noted achievement of positive NFE by the unit as on 31/03/2013.

However. the Committee decided to issue a show cause notice to the unit for dismal

and decreasing performance vis-a-vis the area of space allotted to the unit.

2. Panna Jewellery: The Committee monitored the performance of the unit on the

basis of APRs and noted achievement of positive NFE by the unit as on 31/03/2013.

3. Om Nanotech Pvt. Ltd (Mfg. unit): The Committee monitored the performance of

the unit on the basis of APRs and noted achievement of positive NFE by the unit

during first five years of operations and as on 31/0312013 as well.
