AN ACT of the Nairobi Citl' County Assemblyto providc for the various taxes, fees and charges forscrvices, and for other rcl'enue raising measures by thecounty government; and for matters incidental thereto

ENAC'I'ED by the County Assembly,' of the NairqbiCity County, as fbllows--

PART I-PRELIMINARY1.. This Act may be cited as the Finance Act, 2013

and shall come into operation on such a date as the countyexecutive committee member for finance, with theconcurrence of the Governor. rnay appoint and differentdates may be appointed for different provisions.

PART II_ TAXES, FEES AND CHARGESPAYABLE AND RATES APPLICABLE

2. (l) The taxes, fees and charges set out in the"New charges" column of the Schedule shall apply for therespective items listed in the "lterns Description" columnand at the rates set out therein.

(2) For greater certainty, the taxes, fees and chargesapplicable a payable to the government of the City Countyof Nairobi at the commencement of this Act, but which are

not included in the Schedule to this Act, shall continue toapply under the existing by-laws of the defunct CityCouncil of Nairobi until such by-laws are specificallyrepealed or replaced by county legislation.

3. ( I ) All directions, resolutiotts, orders and

authorizations on or or relating to financial management.including the collection and administration.of taxes, feesand charges given or issued by the defunct Nairobi CityCouncjl and subsisting or valid imrnediately before the

cessation of the applicatioh of the Local Government Act(now repealed) shall be deemed to have been given, issuedor made by or under the authority of the county assemblyuntil the expiry, amendment or repeal of those directions,resolutions, orders and authorizations on' financialmanagement and shall continue, with the necessarymodifications, apply to the payment and the administrationof the taxes, fees, charges and other levies under this Act.

(2) Subsection ('1) does not apply to the specificrespective amounts payable in respect of the taxes, fees,charges or other levies and, in that regard, the amountapplicable shall be as provided for in the "New Charges"column in the Schedule.

MEMORAIIDUM OF OBJECTS AND REASONS

This Bill is prepared pursuant to the Interim Standing Order of the Assembly, inparticular, Order 218 yhich requires the County Finance Bill to be presented to theAssembly as a legislative proposal.

The Bill seeks to provide for the various taxes, fees and other service charges that arepayable to the Nairobi City County Gov,ernment. These are s'et out in the Schedule. Thesaid Schedule also sets out the rates in Kenya shillings (Kshs.) currently payable to theCounty Government so that it is possible to assess the changes that take into account theneed to enhance the revenue payable.to the County Government for enhanced servicedelivery and to enable the County Government perform the increased functions bestowedon it by the Fourth Schedule of the Constitution.

Statement on delegated trrcwers to tegislate

The Executive Committee Member responsible for Finance is empowered to bring intooperation the various provisions of the Act or certain sections of the Schedule.This is toenable the putting in place.of the necessary physical, administrative and personnelinflastructure to would aid in the operaiionalisation the cotlection of the proposed taxes,fees and charges.

The operationalisation of certain provisions of the proposed law shall entail anexpenditure of public funds. The funds will be provided for in the estimates.
