The Facts
On June 8, 2001, Congress enacted Republic Act No. 9136, known as the Electric Power Industry Reform Act of 2001 (EPIRA). Among other reforms in the electric power industry, this law created the Energy Regulatory Commission (ERC), which superseded the Energy Regulatory Board. Section 36[1] of the EPIRA directed all distribution utilities to file with ERC an application for the approval of their unbundled rates.
