(a) any living or dead animal plant or other organism

(b) a seed egg gamete or propagule or part of an animal p~nl or other organism capable ot propagation

(1) contain a derivative of an animal plant or other organism or

tags means a piece of material for the identffication of raw tanned andor finished skins entering

international trade from the countnes of origin

tranaft means the transit prooedures as defined by the customs regolations olthe Republic

transhipment means the transhipment procedures as defined by the customs regulations of the Republ~

unler controlled conlitlons means in a non-natural environment that is intensively manipulated by human

interventkln for the purpose of plant production which may include but are not lim~ed to tillage fertil~atkln

weed and pest control irrigatkm or nursery operations such as potting bedding or protection from weather

(2) The export re-export import introduction from the sea transit and transhipment of specimens of

species l~ted in the appendices to these regulations other than in accordance with the provisions of

CITES and these regulatklns is prohib~ed

(3) Recommendations included in Resolutions and Decisions of the Conference of the Parties to CITES

can serve as source of interpretation of the provisions of these regulations

(4) The burden of proof of the legal possession of any specimen of a species included in the Appendices

attached to these Regulations lies wlh the possessor of thai spec1men

GENERAL

2 (1) These regulations applies Ill all plants and animal speoies isted on Scheduks I II and Ill ol

(2) The lollowlng Schedules are attached to these Regulations

(a) Appendix I wh~h lists all species included in Appendix I ol CITES

(b) Appendix II which lists all species included in Appendix II or CITES

(c) Appendix Ill which lists all spooies iocluded in Appendix Ill ol CITES

(3) The Append~s to these Regulatbns are automat~lly amended when amendments to Appendices 1

3 Management Authotlty

PART3

AUTHORI11ES

(1) The Minister is the National Management Aulhortty for CITES related activHies

(2) The spooilic duties of the National Management Aulhonly includle but are not nmlled to I he followng


(a) to consider and grant pennis and ce~ificates in acconiance wnh the provisions of CITES and

regulation 9 and io attach to any parrott 01 cert~ate llffi condttion that 4 may deem

necessacy

(b) to commun~te with the Secretanat and other countoos on scientifiC administrative

enforcement and other issues related to ifllllernentalion of tile Convenoon

(c) to maintain rllCOnia of inlemational trade in spedmens and prepare an annual report

(6) The MEG is designated as an issuing authoiHy lor permits or cooi~tes relating to import export and

re-export of any species listed in IJpendiceS I II and Ill excluding permils or certil~tes referred to in

sullregulation (2)

(7) An oHiclat ol the Department or a provlnc~l department or organ ot Slate may exercise a power or

duty of an iSsuing authority in terms of these regulations to the extent that the power or duty has been

delegated or sub-delegated to that oHicial in lenms of sectiOn 42 or 42A of the National Environmental

Management Act t991l Act No 107 of t991l)

4 Sdenliflc Awtholily

(1) For the purposes ot these regulatiOns the specific duties otthe Scierltilic Authority include but are not

limited to--


(a) advise the Management Authority on whether 01 not a praposed export ot a specimen of

species ~ted in Apperdix 1 or 11 wiH be detrimental to the survival of the species Involved

(b) in lhe case of a proposed import of a specimen of a species in Appendix 1 adv~e the

Management Authority on whether or nol the purposes ot the import are detrimerrtalto the

survival ollhe species involved

(c) in the case ol a proposed import of a INe specimen of a species sfed in Append~ I advise

the Management Authority whemer or not n is satisfied that the proposed recipient of the

specimen is sulab~ equipped Ill house and care lor it

(d) monttor lhe export permis granted lor specimens ol species listed in Appendix II as well as

the actual expons of such specimens and advise tlle Management AuthOtity of surtabie

lleasures to be taken to limll the issue ol export permits when the population status ol a

species so requires

(e) advise the Management Authority on the disposal ol confiscated or oltieied specimens

(n advise he Management Authority on any maler the Sctentll~ Authorty considers relevant in

the sphere of species protection

(g) pertorm any tasks toreseen in the Resolutions olllle Conference of the Parrtas to CIFS

(2) For the pupOSeS of these regulations he SP9CH~ duties of the Scientihc Authority in terms olthe

NEMBA include

(a) advise the Minister on-

(i) the regis1raUon ol ranching operations nurseries captive breeding operations and

otner faciltties

(ii) whether an operation or facility meets the criteria tor producing speci9S considered to

be bred in captivity or artificial~ propagated

(iii) the choice of a rescue cerlre or other lacility for the ~isposal otlorteited soecimens

(v) the nomenclature ol specie~ or

(vi) any other matter of a spec~lised nature

(b) assist the Minisler or an environmental management inspector in the ident~ication of

specimens tor the purpose of enforcing the provisions of this 1cr

(c) issue cennicates in which the identilication ot a specimen is verified as being taxonomically

accurate

(d) pertonm eny other function tnat may be prescnbed or delegated to tt by the ttnlster and

(e) deal with eny other matter necessary for or reasonab~ incidental to tts

powers and duties

(3) In peflonming liS duties the Scientific Authortty must-

(a) base its i-dings recommendations and advice on a sClelltific and professional review ot

available information and

(b) consult when necessary organs of state the pnvate sector non-governmental organisations

bcal communtties and other slakehoklers before making any findings or recommendations or

giving any adviCe

PART4

CONDITIONS FOR INTERNATIONAL TRADE

5 General

(I) The Management Authority and enforcement authorities must as far as possible ensure that

specimens of CITESIisted species pass through any tonmaltties required for trade with a minimum ot

delay


(2) To facilllate such passage the Management Authority may designate ports of entry and ports of extt a)

which specimens must he presented tor clearance

(3) The Management Authority musl ensure that all living specimens durtng any peOOd of transit hOlding

or shipment are property cared for so as to minimize the rtsk of Injury damage to health or cruel

treatment

6 Export

(1) The export of any spoclmen of specieS included In AppendiCes I and II requires the prior grant and

presenlation of an export permit

(2) The export of any specimen of spocles Included In Append~ Ill requires the prior grant and

presentattm of an export permtt or a cert~icate of origin

(3) An export penni may on~ be granted ~the folloving condiions are mel

(a) The Management Authority musl be satisfied that the specimen concerned has been legally

acquired

(b) The Management Authorly is satisfied that any living specimen will he prepared and shllfled

tn accoraance wilh lhe most recent ed~oo ollhe Live Animals Regulations of the International

Air Tansport Association regardless of the mode of transport so as 10 mnimlze the rtsk ol

lnJulyen damage to health or cruel treatment

(c) In the case of a specimen of a species listed In Appendices I and II the Scientlftc Authority

has made a nonltJetrlment finding and adVised the Management Authorly accordin~ and

(d) In the case of specimens oi Species listed in Appendix I an Import permtt has been granted

by the competent authority of the countty of deslinatkln

7 Import

(1) The Import of any specimen Of Species Included in Appendix I requires the prklr grant and

presentatkm ol an impol1 permn and en her an export permrr or a re-expon certilicate

(2) An ifTIJOrt permH may only be gmnted rr the following oondltions are met

(a) The Scienlllic Authority has advised that the import will be lor purposes which are not

det~mantal to the survival ol the species and lS satislied that the proposed recipient ot a living

specimen lS sunablf equipped to house and care for H

(b) The Managemant AJthority is satiSfied thet lhe specmen concerned lS not to be used

pnmanty for commercial purposes

(c) The ifTIJOrt of any specimen ol species included in Appendix II requires the poor presentallon

ofeHher an expor1 penmrt or a re-export cert~cale

(d) The impol1 of any specimen of species included in Appendix Ill requires the poor presentatiOn

ol a certlicate of ongin or an expor1 permit where the irnpOO is from a State which has

included the species in Appendix Ill or a certrricate granted by the Stale of re-expon thai the

specimen was processed or is being re-exported to

(1) The re-export of any specimen of species ircluded In Appendices I II and Ill requires the pnor grant

and presentatiOn o1 a re-export certWicate

(2) A re-export certilicale may only be grented when the following conditions are met

(a) The Management 1ulhority is satisfied that any specimampn to be re-exported was inported in

acooroance with the provisions of this lei and of CITES

(b) The Managementllulhoflty is satisfied that any living specimen will be prepared and shipJed

in conformity wlh the most recent edHior ol the Live Animals Regulations of the lntemalional

Air Tmnspol Associanon regardless ollhe mode mlmnsport so as to rrnnimiZe lhe risk of

lnjUI damage to heaHh or cruel treatment

(c) In the case of any living specimen r1 species listed In Appendix I the Management Authority

Is satlslied thai an import penmn has been granted

(I) The lntroducl~n from the sea of a specimen of a species included Appendices I and II requires he

prior grant and presentation of a certificate of inlroducion from he sea

(2) A certHicate of irnroduclkJn from the sea may only be granted when the folloMng conatllons have been

met

(a) the Sdenlllic AUlhorlty advgtses lhalltle introductkJn of any specimen Mil n01 be detrimental io

the survival of the species

(b) the National Management Authonty is sallSiied that any specmen of a species listed in

AppendiX I IS ool to be used for pnmari~ commercial pup(lses and that the proposed

recipient of any liVing specimen is suhably equipped to house and care lor H

c) the National Management Authortty is sat~fiea that any living specimen of a species listed in

Appendix II Mil be so handled as to minimize the risk of injury damage to health or cruel

treatment

10 Permfts and certlflcales

(1) To be valid all permits and certificates must be in a lorm prescnbed in AppendiX 4

(2) Export permits and re-export certiticates are valid lor a penod of siX mon1hs from their date ot issue

(3) lroport permtts for specimens of species included in AppendiX I are valid tor a period of twelve months

from their date ol issue

( 4) A separate permil or c~rtificate is required for each consignment of specimens

(5] The Natkmal Management Authorny or Customs must cancel and retain used export perms andreshy

expo~ certnicates Issued by authorntes of toreign States and any corresponding iroport permits at the

point of entry into ltle country_

(6) Perm~s and certif~ates may not be transferrnd to a person other than the one named on the

dOClJment

(7) The Management Authonty may require appl~ants lor permits or certificates to provide any addnional

illlonnation that ~ may neW to decide whether to issue a penntt or certifiCate

(8) The Management Authority may at its discretion grant or refuse to grant a perm or cel1ificate or

grant a permit or certificate subject to certain condtons

(9) The Management Authorly may at any lime revoke or lrodify any permit or certificate it has issued H it

deems n necessary to do so and shall do so when the permrt or cenfficate has been issued as the

result of false or misleading statements by the appl~ant

(10) Only valid export permits re-expcrt ce11Hicates and certrricates of origin from expcriigtJ cowntriltls shall

be accepted to authorize the import of spocimens of spec~s ncluded in Appendices I II and Ill

(11) A pefl11 or a certificate issued in violalkm oi the law of a foreign coontry or in violaOOn of the

Convention is invalid

2007 and no addrrklnal pennit or certificate 1s required

REGISTRATION AND MARKNG

(I) All persons wishing to trade in specimens of any species llsled in Append~ I must be registered with

2) All persons WIShing 10 produce capllve bred animals and artij~ally propagated plants lor oommerctal

trade purposes of any epecles l~ted In Appendix I must be registered with the Management Auihorlly

and w~h the Secretariat In the case of caplive bred animals H these species are a~ listed In terms ol

seclon 56 of NEMBA snd are already registered under the awnltants name as Threatened or

Protected Species an Integrated registralion certificate may be Issued

(3) All peroons reg~tered with the Management Authority tor captive breeding ol animals or artilltial
