    State Legislation Opposing Certain Health Reforms, 2009-2010

    States have an extensive andcomplicatedsharedpowerrelationshipwith the federalgovernmentin regulatingvarious aspectsof the

    health insurance market andin enacting health reforms.

    Aspartof state-basedresponsesto federal health reformlegislation,individualmembersof atleast36statelegislatures are using

    the legislative processtoseektolimit, alteroroppose selectedstate or federal actions,includingsingle-payerprovisions andmandatesthat

    wouldrequire purchase of insurance. In generalthe measuresseektomake orkeep health insurance optional, and allowpeople topurchase

    anytype of coverage theymaychoose. The individualstate language varies.

    Constitutionalamendments: In 29of the states,the proposalsinclude a proposedconstitutional amendmentbyballotquestion. In a

    majorityof these states,theirconstitution includes an additional "hurdle" forpassage - requiring either a "supermajorityof 60% or67%

    forpassage,orrequiringtwo affirmative votesin twoseprate years,such as2010 and2011.

    Changingstatelaw: In 13statesproposedbillswould amendstate law, notthe state constitution. These require a simple majorityvote

    and action bythe governor; they alsocan be re-amendedorrepealedby a future state law.So farin 2010, Virginiabecame the firstin

    the nation to enact a newstatute section titled, " Health insurance coverage notrequired." ItpassedMarch 4 andbecame lawon March 10,

    2010; see SB283 andrelatedbillsbelow. Idahoisthe secondstate to enact a similarstatute > Seeactivestatuslistbelow.

    Basedon actionsinitiallyin Arizona,

    severalstatespropose ormaypropose state constitutional amendments,

    Arizona voters are scheduledtocastballotson thisconstitutional amendmentin November2010. If adoptedbyvoters,

    itcouldblock future state health reforms and atleastraise questions aboutsome featureswithin future federal health

    reforms.

    Accordingto TheNewYorkTimes , "Conservatives andlibertarians,

    mostly, have been advancingthe theorylatelythatthe individualmandate,in which the governmentwouldcompel

    everyone tobuyinsurance orpay a penalty,is unconstitutional." (NYTimes,

    9/26/09) AcurrentMassachusettslaw,passedin 2006,includes an individualmandate,

    although itwaswritten tobe consistentwith both state and federalconstitutions. Tothe extentthatcongressional

    proposalsprovide forstate opt-outoropt-in features,these proposalstorestrict "reform" couldwellbecome more

    widelydiscussed.
