NDIDA Online A web-based publication of the North Dakota Implement Dealers Association June 7, 2013 63 rd ND Legislative Session Successful for NDIDA On May 4, 2013, the 63 rd Legislative Assembly adjourned sine die. With the excellent involvement of our dealer members, the session was challenging but highly successful for NDIDA. Linked below is a summary of the major pieces of legislation that were followed during the session, the NDIDA position on each bill, and the final outcome. Particular focus was placed on two important bills this year: the Farm Equipment Lease Tax Bill (HB 1236), which will become effective July 1, and the Repairman’s Lien Bill (HB 1251), which will become effective August 1. NDIDA is working with the tax department to develop formal correspondence that will educate dealers concerning the new tax collection requirements. We will communicate that information to you as soon as it is approved by the tax department. On May 4, 2013, the 63rd Legislative Assembly adjourned sine die. With the excellent involvement of our dealer members, the session was challenging but highly successful for NDIDA. A new rule by the U.S. Department of Transportation's Federal Motor Carrier Safety Administration (FMCSA) revises the hours-of-service (HOS) safety requirements for commercial truck drivers in an effort to further address the issue of driver fatigue. Reminder: Dealers Must Display New FMLA Poster

All dealers covered under the Family Medical Leave Act (FMLA) — those with 50 or more employees — should have on display the new version of the FMLA poster, linked here: http://www.dol.gov/whd/regs/compliance/posters/fmlaen.pdf

Reminder: Dealerships Must Use New Form I-9

As of May 7, 2013, dealerships must use a new Employment Eligibility Verification I-9 form (linked here: http://www.uscis.gov/files/form/i-9.pdf) when making new hires or re-verifying existing employees. Changes to the I-9 form include extra data fields in Section 1 for foreign passport information (if applicable), telephone numbers, email addresses, etc. Extra space also was added for completion of “List A” documentation information. The form has expanded from one page to two. For more information, visit the Department of Homeland Security’s web page at www.uscis.gov. (Type “New I-9 Form 2013” in the search box.)

Contamination of R-134a Refrigerant Found in U.S.

Mobile A/C refrigerant contamination has become a heightened concern with the discovery in the U.S. of R-134a contaminated with R-40. Unlike CFC-12 or R-134a, R-40 can pose a risk to technicians, shops and equipment. To avoid cross contamination, it is recommended that techs identify the refrigerant in a mobile unit before evacuating it into a recycler. Note too that R-134a offered for sale well below its current market price may not be R-134a. Chamber of Commerce recently released its fourth annual Enterprising States report, showing North Dakota at the top of overall performance rankings. The report measures state performance overall and across five policy areas important for job growth and economic prosperity: exports and international trade; entrepreneurship and innovation; business climate; talent pipeline; and infrastructure. The report shows ND’s gross state product (GSP) up 59% over the past decade, and job growth of 11% over the past two years, fueled in large part by the oil and gas boom. The Chamber report also states that North Dakota has the fastest growing per capita personal income, and ranks 7th in median family income.

Teenagers can be a wonderful source of help during the busy season, and summer jobs can also help dealers scout for long-term employees. NDIDA is deeply saddened to report the passing of association member and Past Chairman Brian Rensch, of Makoti, ND. Brian died Monday, June 3, in a Minot hospital following a courageous battle with cancer. He was 44.

Brian Joel Rensch, was born on February 18, 1969 in Minot, the son of Gerald and Vivian (Lampert) Rensch. He was raised in Makoti and graduated from North Shore High School in 1987. He attended the University of North Dakota where he graduated in 1991 with a Bachelor of Science Degree in Aviation/Air Traffic Control and a minor in Business Management. He then moved to Fargo and worked at Wallworks and Selland Motors. On July 29, 1995, Brian was united in marriage to Melissa Malstrom in Pelican Rapids, MN. They made their home in Fargo before moving to Makoti to own and operate the family business, Rensch Garage. Recently, he partnered with the Malstrom family and opened a liquor store in Detroit Lakes, MN called Seven Sister Spirits.

Brian enjoyed hunting, golfing and caring for his home and yard. He loved farming, going to the lake and looked forward to the annual family deer hunting trip in the Badlands. He cherished spending time with his family, especially his daughter, Josie, and twin sons Jack and Sam. He looked forward to family gatherings and always made time for his nephews, nieces, cousins and many friends. Brian was an important and integral part of the Makoti community. He was always willing to lend a hand and filled in whenever needed. He volunteered on the Ryder Makoti Ambulance and Fire Department and served on the boards of the Ryder Coop Credit Union and Lakeside State Bank. He was a member of the Hiddenwood Sportsman Club and St. Elizabeth Catholic Church. Brian served on the North Dakota Implement Dealers Board of Directors for many years and then served as President in 2010. He also served on the Association Services Inc. board, the North Region New Holland Advertising board, and the Versatile Dealer board. Brian is survived by: his wife, Melissa; daughter, Josie and sons, Jack and Sam, all of Makoti; father, Jerry of Makoti; brother, Thomas of Mandan; sisters, Joan Stafslien (Wes Sherven) of Makoti, Cathy Klabunde (Bruce) of Garrison, Carole Lee (Kendell Merritt) of Minot and Marcia Steffen (Donn) of Hazen; numerous nephews, nieces, cousins, and his work family at Rensch Garage. He was preceded in death by his grandparents; mother; and infant sister, Angela. NDIDA extends its sincere sympathy to Brian's wife Melissa and their children Josie, Jack, and Sam, as well as to his extended family and many friends. He will be greatly missed by us all.
