THE N .EATH PORT TALBOT COUNTY BOROUGH COUNCIL in exercise of its powers under Sections 1, 2, 32, 35, 45, 46, 53 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (hereinafter referred to as "The Act of 1984") and of all other powers it enabling and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 of the Act of 1984 hereby makes the following Order :- NEATH PORT TALBOT COUNTY BOROUGH COUNCIL 0,X__ CYNGOR BNY'RDEISTREF SIROL CASTELL-NEDD PORT TALBOT 1 . The Order shall come into operation on the 23 d day of June 2003 andmay be cited as the "heath Port Talbot County Borough Council(HEATH TRAFFIC MANAGEMENT) ORDER 2003

2 .

(1)

In this Order -

(HEATH TRAFFIC ~IANAGEN'IENT)

ORDER 2003

"Disabled Person's Badge" has the same meaning as in TheDisabled Persons (Badges for Motor Vehicles) (Wales) Regulations2000 ;

"Parking Disc" means a parking disc issued by a Local Authority,capable of showing the quartet hourperiod during--which a period ofwaiting begins ;

"Relevant Position" has the same meaning as in The DisabledPersons (Badges for Motor Vehicles) (Wales) Regulations 2000;

"Disabled Person's Vehicle" has the same meaning as in The LocalAuthorities' Traffic Orders (Exemptions for Disabled Persons)(Wales) Regulations 2000 ;

"Disabled Parking Place" means an area of highway designated as aparking place by Schedule 14 of this Order- for use by DisabledPersons Vehicles.

"Public Services `Vehicle" shall have the same meaning as inSection 1 of the Public Passenger Vehicles Act 1981 and "localservice" shall have the same meaning as in Section 1 of theTransport Act 1985 ;

East Side

Between points approximately 20 metres and 38 metres, and 53 metresand 80 metres north of its junction with the Cedar Link Road .

West Side

i)

Between points approximately 7 metres and 45 metres south of thesouthern kerbline of Glyn-y-Coed Road .

ii)

Between points approximately 12 metres and 45 metres .north of thenorthern kerbline of Glyn-y-Coed Road.

Gnoll Avenue - South Side

Between points approximately 6 metres and 31 metres south east of itsjunction with the'eastem kerbline ofEna Avenue.

East Side

West Side

Wenham Place - West Side

Greenway Road - North Side

6 .

London Road

From a point in line with the south west kerbline of Wenham Place for adistance of 20 metres in a south westerly direction (outside houses Nos .I to 3) .

Between points approximately 21 metres and 30 metres east of itsjunction with London Road.

Between points approximately 106 metres and 132 metres south of itsjunction with Geoffrey Street:

i)

Between points approximately 40 metres and 60 metres south of itsjunction with Alford Road.

Between points approximately 24 metres and 56 metres and 100 metresand 128 metres north of its junction with Alford Road.

"Taxi" shall mean a licensed hackney carriage .

".`Universal Service Providers" means those operators of postalservices who are licensed to provide all or part of a Universal PostalService under the provisions contained in the Postal Services Act2000 .

"School Contract Vehicles" means those vehicles which arecontracted by the Local Education Authority for the carriage ofchildren to and from schools whilst carrying out those contracts .

"Residents Parking Place" (hereinafter referred to as a "ParkingPlace") means an area of highway designated as a Parking Place bythis Order for the use of vehicles displaying on the front or nearside ,of the vehicle a valid Residents Parking Place Permit;

"Residents Parking Place Permit" (hereinafter referred to as a"Permit") means a Permit Issued by the Council for a period of up to12 months to ; a person who has satisfied the Council as beingentitled to the issue of a Residents Permit in accordance with theCouncil'.s policy as May be -determined from time to time ;. .

Each area on a highway referred to in Schedule 9 to - this Order andbounded on one side by the edge of the carriageway and on theother side by a broken white line is designated as a Parking Place.

(2)

Except where otherwise stated, any reference in this Order to anumbered Article or Schedule is a reference to the Article orSchedule bearing that number in this Order.

The Interpretation Act 1978 shall apply for the interpretation of thisOrder as it applies for the Interpretation of an Act of Parliament .

3 .

Article 9 and Schedule 7 of the Neath Port Talbot County BoroughCouncil (Woodland Road and Dyfed Road, Neath) (Residents Parking)(No Waiting, Loading or Unloading) (No Waiting at Any Time) (LimitedWaiting) (Amendment) Order 2000 are hereby revolted .

4 .

The Orders set out in Schedule 1 of this Order are hereby revoked in sofar as they relate to the lengths of sides of roads and/or designatedparking places set out in Schedules 2 to 14 of this Order.

5 .

Save as provided in Articles 25 and 26 of this Order, no person except onthe direction of a Police Constable in uniform or a Parking Attendantshall cause or permit any vehicle to wait, load or unload at anytime onthe lengths of sides of roads set out in Schedule 2 of this Order.

Save as provided in Articles 6(2), 25 and 26 of this Order, no personexcept on the direction of Police Constable in uniform or a ParkingAttendant shall cause, or permit any vehicle to wait, load or unload atanytime on the lengths of sides of roads set out in

wait .,

10 ofthisOrder.

6(2)

Nothing in Article 6(1) of this Order shall apply to School ContractVehicles .

7.

Save as provided in Articles 21, 24, 25 and 26 of this Order no personexcept at the direction of a Police Constable in uniform or a ParkingAttendant shall cause or permit any vehicle to wait at anytime on thelengths of sides of roads set out in Schedule 3 of this Order.

8(1)

Save as provided in Articles 8(2), 23 and 25 of this .Order no vehicleshall stop at anytime on the lengths of sides ofroads specified inSchedule 13 of this Order.

`8(2)

Nothing in Article 8(1) of this Order shall apply to Taxis.

Save as provided in Articles 22, 24, 25 and 26 of this Order, no personexcept on the direction of.a Police Constable in uniform or a ParkingAttendant shallcause or permit any vehicle to wait for more°than 30minutes or to return within 1 hour to the same length of side ofroad onwhich that period of waiting began on"any day except Sunday betweenthe hours of 8.00 am and 6.00 pm on the lengths of sides of road set outin Schedule 4 of this Order.

10 .

Save as provided in Articles 22, 24, 25 and 26 of this Order, no personexcept on the direction of a Police Constable in uniform or a ParkingAttendant shall cause or permit any vehicle to wait for more than 1 _houronto return within 2 hours to the 'same length of side road on which thatperiod of waitingbegan on any day except Sunday between the hours of8.00 am and 6.00 pm on the lengths of sides of road set out in Schedule5 of this order.

11 .

Save as provided in Articles 14, 22, 24, 25 and 26 of this Order, noperson except on the direction'of a Police Constable in uniform or aParking Attendant shall cause or permit any vehicle to wait formorethan 1 hour or to return within 2 hours to the same length of side of roadon which that period of waiting began on any day except Sundaybetween the hours of 8.00 am and 6.00 pm on the lengths of sides ofroad set out in Schedule 6 of this Order.

Save as provided in Articles 14, 22, 24, 25 and 26 of this Order, noperson except on the direction of a Police Constable in uniform or aParking Attendant shall cause or permit any vehicle to wait for morethan 2 hours or to return within 4 hours to the same length of side ofroad on which that period of waiting began on any day except Sundaybetween the hours of 8.00 am and 6.00 pm on the lengths of sides ofroad set out in Schedule 8 of this Order .

13 .

Save as provided in Articles 14, 22, 24, 25 and 26 of this Order, noperson except on the direction of a Police Constable in uniform or aParking Attendant shall cause or permit any vehicle towait for morethan 2 hours or to return within 4 hours to the same length of side ofroad on which that period of waiting began on any day on the lengths ofsides of road set out in Schedule 7 of this Order.

14.

The prohibitions imposed by Articles 11, 12 and 13 of this Order shallnot apply to the holders of a Permit.

15 .

The Loading Bay set out in Schedule 11 of this Order is designated as aparkingplace between the hours of6.00 am -and 6.00 pin on any day

. .

except Sunday for vehicles which are being loaded or unloaded onlysubject to the proviso that any such vehicle using the Loading Bay forthe purpose of loading or unloading shall not .remain in the Loading Bayfor more than 30 minutes duration at any given time.

16.

The Loading Bay set out in Schedule 12 ofthis Order is designated as aparking place between the hours of 8.00 am and 6.00 pm on any dayexcept Sunday for vehicles which are being loaded or unloaded onlysubject to the proviso that any such vehicle using the Loading Bay forthe purpose of loading or unloading shall not remain in the Loading Bayfor more. than 30 minutes duration at any given time.

Save as provided by articles 25 and 26 of this Order no person excepton the direction of a Police Constable in uniform or a Parking Attendantshall cause or permit any vehicle (including a Disabled PersonsVehicle) to use the Loading Bays referred to in Articles 15 and 16above other than for the purpose of loading or unloading vehiclessubject to the proviso specified in that Article .

Save as provide by articles 24, 25 and 26 of this Order or upon directionor permission of a Police Constable in uniform or a Parking Attendant,no person shall cause or permit any vehicle to park in the DisabledParking Place designated in Schedule 14 of this order between the hoursof 8.00 am and 6.00 pm on Mondays to Saturdays unless that vehicle isa Disabled Person's Vehicle which displays in the relevant position aDisabled Persons Badge .

19.

Residents Parking Places

Except as provided by Articles 19(2), 24, 25 and 26 of this Order orupon the direction or with the permission of a Police Constable inuniform or a Parking Attendant no person shall cause or permit anyvehicle to wait in a Parking Place designated by Schedule 9 to thisOrder.

(2)

The provisions of Article 19(1) to this Order shall not apply to theholder of a Permit when parking a vehicle in a Parking Place asdescribed in Schedule 9 to this Order and the vehicle is displaying avalid Permit (on the front or nearside of the vehicle) .

Regulation of Resident's Parking Place

The holder of a Permit shall not park in any Parking Placeother than in the street named on the Permit ;

(ii)

where a Police Constable in uniform or a Parking Attendant isof the opinion that the provisions contained in Article 19(l) ofthis Order have been contravened he may remove or cause tobe removed the vehicle from the Parking Place andwhere it isso removed shall provide for the safe custody ofthe vehicle;

(iii)

a Police Constable in uniform or a Parking Attendant maymove or cause to be moved in the case of emergency to any

. place he thinks fit any vehicle left in the Parking Place;(iv)

the Permit shall be valid only for the vehicle in respect ofwhich it is issued and no permit holder shall cause or permit

_

anyPermit issued, to . him by the_ Council. . to be displayed onany vehicle bearing a different registration number to thatcontained on that Permit;

(v)

every vehicle in the Parking Place shall stop so that every partof the vehicle is within the limits of the Parking Place .

A Police Constable in uniform or a Parking Attendant or a personduly authorised by the Council may suspend the use of the ParkingPlace or any part thereofwhenever he considers such suspension isreasonably necessary:-

for the purposes of facilitating the movement of traffic orpromoting its safety ;

(ii)

for the purposes of any building operation, the maintenance,improvement or reconstruction of the highway, or the cleansingof gullies in or adjacent to the Parking Place, the laying,erection, alteration or repair in or adjacent to the Parking Placeof any sewer or of any main pipe or apparatus for the supply ofgas, water, or electricity or of anytelegraphic line or theplacing maintenance or removal of any traffic sign ;

(iii)

for the convenience of occupiers of premises adjacent to theParking Place on any occasion of the delivery or removal offurniture to or from any office or dwelling house adjacent tothe Parking Place ;

on any occasion on which- it is .likely by reason ofsome specialattraction that any streets will be thronged or obstructed ;

(v),

for the convenience of occupiers of premises adjacent to theParking Place at times of weddings or funerals ;

(vi)

anyperson or Police Constable in uniform or a ParkingAttendant suspending the use of the,Parking Place or any partthereof, in accordance with the provisions of this Article shall .thereupon place or cause to be placed in< that Parking Place oras the case may be that part thereof the use ofwhich issuspended a traffic sign of any size, colour and type prescribedor authorised under Section 64 of the Act of 1984 indicatingthat the waiting by vehicles is prohibited .

C .

No person shall cause or permit any vehicle to wait in any part of theParking Place during such period as there is in or adjacent to that partof the Parking Place a traffic sign placed in pursuance of ParagraphB(vi)

of this Article,

Provided that nothing in this Article shall apply: -

in respect of any vehicle being used for fire brigade, ambulanceor police purposes or any vehicle which is waiting for any otherreason specified in this Order;

(ii)

to anything done with the permission of a Police Constable inuniform, Parking Attendant or the person suspending the use ofthe Parking Place or part thereof in pursuance of this Order.

Permits

Nothing in Article 19(1) of this Order shall apply to : -

(a)

legally qualified medical practitioners as defined in Section 52of the Medical Act 1956, community nurses or registeredveterinary surgeons while visiting premises adjacent to theParking Place provided that the vehicle is displaying anappropriate worded notice to the effect that it is being used "oncall";

(b)

a maximum oftwo. vehicles being used in connection with awedding;

(c)

vehicles being used for building and maintenance purposes inproperties adjacent to a Parking Place;

(d)

to enable any hearse or anyvehicle owned by a funeral directoror owner of funeral vehicles to be used as part of a funeralcortege or otherwise in connection with a funeral;

(e)

to enable Support Officers of a bona fide care organisation topark in the Parking Place whilst visiting, a Community .Caredwelling in pursuit of their duties, providing the special permitissued by the Council is displayed in the correct position on thefront windscreen of their vehicle.

E.

(i)

The Council may at any time require an applicant for a Permitor the holder of a Permit to produce to an Officer of the Councilsuch evidence in respect of an application for a Permit made tothem as theymay reasonably require to . verify_any particulars orinformation given td them or in respect of any Permit issued bythem as they may reasonably require to verify that the Permit isvalid;

(ii)

On receipt of an application for a Permit the Council uponbeing satisfied that : -

` (a)

the applicant is a person who resides in a road referred toin Schedule 9 to this Order or is a person who fallswithin the categories of persons eligible for the grantingof a Permit as may be determined from time to time bythe Council ;

(b)

the application is made in respect of an eligible vehicleas defined in paragraph E (iii) of this Article;

shall issue to the applicant a Permit in respect of that vehicle,subject to no more than two Permits being issued in respect ofany particular residence .

(iii)

For the purposes of this Article "eligible vehicle" means : -

(a)

a passenger vehicle which is a motor vehicle constructedsolely for the carriage of passengers and their effects andadapted to carry not more than twelve passengersexclusive of the driver and not drawing a trailer;

(b)

solo motor cycle or moped.

(iv)

(a)

No person shall be entitled to hold a Permit for more thanone vehicle at any one time;

,(b)

The Permit shall be valid only for the vehicle in respectof which it is issued and no permit holder shall cause'orpermit any Permit issued to him by the Council to bedisplayed on any vehicle bearing a different registrationnumber to that contained on that Permit .

(v) -

Apermit holder may surrender a Permit to the Council at anytime and shall surrender it to the Council on the occurrence ofany one of the following events : -

(a)

the permit holder ceasing to be a resident in the street forwhich the Permit was issued;

save_.as provided in paragraph E (viii)(a) of this Articlethe permit holder ceasing to be the owner of the vehiclein respect of which the Permit was issued;

(c)

the vehicle in respect of which the Permit was issuedbeing adapted or used in such a manner that it ceases tobe an eligible vehicle as defined in paragraph E (iii) ofthis Article;

(d)

the issue by the Council of a duplicate Permit;

(e)

the expiry of the Pennit pursuant to paragraph E (vi) ofthis Article;

(f)

the withdrawal of the Permit by the Council .

Charges

(vi)

A Permit shall cease to be valid at the expiration of the datestated thereon or on the occurrence of any of the events set outin paragraph E (v) of this Article whichever is the earlier .

(vii)

The Council may by notice in writing served on a permit holderby sending the same by recorded delivery service to the permitholder at the address shown by that person on the applicationfor the Permit or at any other address believed to be thatperson's abode withdraw a Permit if it appears to the Councilthat any of the events set out in paragraph E (v) ofthis Articlehas occurred and the permit holder shall surrender the Permit tothe Council within forty eight hours of the receipt of theaforementioned notice .

(viii)

APermit shall be in writing and shall include the followingparticulars : -

.,

(a)

the registration mark of the vehicle in respect of whichthe. Permit was issued except when such Permit is issuedto a resident whose vehicle is owned by a bona fidemotor trader and in such cases the registration mark willbe replaced with the words "MOTOR TRADER";

(b)

the expiry date of the Permit pursuant to paragraph E (vi)of this Article;

an indication that the Permit was issued by the Council ;

(d)

the name of the street in which the applicant resides .

F .

(1)

The issue of a Permit, shall be subject to the successfulapplicant for a Permit paying a charge of £ 10 .00 to the Councilfor the issue and use of the Permit, such payment to be paid tothe Council prior to the issue of the Permit .

(ix)

In the event that a permit holder requires a duplicate Permit toreplace a Permit which has been lost or destroyed, the issue ofsuch a Permit shall be subject to a fee of £5 .00 being paid tothe Council prior to the issue of the duplicate Permit.

Nothing in Article 7 of this Order shall render it unlawful to cause or permita disabled person's vehicle which displays in the relevant position aDisabled Person's Badge and a parking disc (on which the driver, or otherperson in charge of the vehicle, has marked the time at which the period of

Nothing in Articles 9, 10, 11, 12 and 13 of this Order shall render itunlawful to cause or permit a disabled person's vehicle which displaysin the relevant position a disabled person's badge to wait on the lengthsof sides of roads referred to in the said Article .

23 .

Nothing in Article 8(1) of this Order shall render it unlawful to cause orpermit any vehicle to wait on the lengths of sides of roads specifiedtherein for-so long as may be necessary to enable : -(A)

The vehicle, if it cannot conveniently . be used for such purpose inany other road, to be used in connection with any of thefollowing operations namely: -

waiting began) to wait on the lengths of sides of roads referred to in theArticle for a period not exceeding 3 hours (not being a period separated byan interval of less than l hour from a previous period of waitingby the samevehicle on the same length of side of road on which that vehicle hadpreviously been waiting) .

. (i)

Building, industrial or demolition operations ;

-(ii) _

The removal of any obstruction to traffic;

(iii)

The laying, erection, alteration or repair in or on landadjacent to the said lengths of sides of road of any sewer orany main pipe or apparatus for the supply of gas water orelectricity or any telecommunications apparatus defined inthe Telecommunications Act 1984;

(B)

The vehicle, if it cannot conveniently be used for such purpose inany other road, to be used in the service of a Local Authority or aWater Authority in pursuance of statutory powers or duties;

(C)

The vehicle to be used by a Universal Service Provider for thepurpose of delivering or collecting postal packets ;

24.

Nothing in Articles 7, 9, 10, 11, 12, 13, 18 and 19(1) of this Order shallrender it unlawful to cause or permit any vehicle to wait on the lengthsof sides of roads specified therein for so long as may be necessary toenable goods to be loaded and unloaded from the vehicle .

25 .

The prohibitions imposed by Articles 5, 6(1), 7, 8(1), 9, 10, 11, 12, 13,15, 16, 17, 18 and 19(1) of this Order shall not apply to Police, Fire,Ambulance or other Emergency Service vehicles or to Local Authorityvehicles when in pursuance of statutory duties or powers.

Nothing in Articles 5, 6(l), 7, 9, 10, 11, 12, 13, 15, 16, 17, 18 and 19(1)of this Order shall render it unlawful to cause or permit any vehicle towait on the lengths of sides of roads specified therein for so long as maybe necessary to enable : -

(A)

Aperson to board or alight from a vehicle ;

(B)

The vehicle, if it cannot conveniently be used for such purpose inany other road, to be used in connection with any of thefollowing operations namely: -

(i)

Building, industrial or demolition operations ;(ii)

The removal ofany obstruction to traffic ; .

(iii)

The laying, erection, alteration or repair in or on landadjacent to the said lengths of sides of road of any sewer orany main pipe or apparatus for the supply of gas water orelectricity or any telecommunications apparatus defined inthe Telecommunications Act 1984 ;

(C)

The vehicle, if it .-cannot conveniently be used for .such purpose inany other road, to be used in the service of a Local Authority or a.Water Authority in pursuance of statutory powers or duties ;

(D)

The vehicle to be used by a Universal Service Provider for thepurpose of delivering or collecting postal packets ;

(E)

Public Services Vehicles operating a local service when waitingat an authorised bus stop to set down or pick up passengers, or toschool buses ;

(F)

_The vehicle to take in petrol, oil, water or air from any garagesituated on or adjacent to the said length of road.
