Proposal for Statewide On‐Call Environmental Services for State and Local Federal‐Aid Projects    Dear Brad:  Since 2009, Felsburg Holt and Ullevig (FHU) has provided environmental consulting services to Nebraska Department of Roads (NDOR) through a wide range of on‐call contracts, including Environmental Documents, Wetlands Services, Air & Noise  Studies,  Stormwater  Management  Services,  and  Environmental  Program  Assistance.    Our  qualifications  and performance are demonstrated by the fact that NDOR has awarded us back‐to‐back renewals for these contracts.  Reliability of the Past.  NDOR’s repeat work and satisfaction are two of our most important objectives. Toward this end, FHU has been steadily staffing up to meet a consistently increasing work load—primarily provided to us by NDOR.    In order to provide NDOR with attentive service, our Nebraska staff now number seven full‐time scientists. This proposal includes  the same FHU staff  that NDOR has come  to know over seven years of working  together,  including  the same Contract Manager and Project Managers, including Allison Sambol, Tony Baumert, Carin Richardson and Jess Jurzenski.  We think their qualifications are exceptional, and their enthusiasm for NDOR projects is outstanding!    Looking Ahead.  For this submittal, FHU has teamed with three subconsultants to provide additional resource expertise and to address potential new directions.  These firms are:   

Historic Resources Group provides historic property evaluations and compliance in Section 106; the firm is Economically Disadvantaged Woman Owned Small Business (EDWOSB). 

FYRA Engineering is a water resource engineering firm and EDWOSB. 

University of Nebraska Bureau of Business Research conducts studies on the economy of Nebraska  including cost‐benefit analyses and transportation‐related economic impact studies.

2. Narrative on Evaluation Factors QUALIFICATIONS:  COMMITTED TO BEING A NEPA LEADER Firm Background:  Celebrating our 31st year, Felsburg Holt & Ullevig (FHU) is a transportation and environmental consulting firm dedicated to serving our clients’ needs through environmental analysis, transportation planning, traffic engineering and roadway design services.  Since opening our Nebraska offices in 2004, we have been committed to being a leader in National Environmental Policy Act (NEPA) consulting and permitting.  Our clients rely on our technical capabilities and regulatory knowledge to produce thorough and reliable documents. In addition to the preparation of compliance documents, FHU has recognized expertise in the development of NEPA protocol and tools.  The firm has been selected time after time by the NDOR and the Colorado Department of Transportation to assist in the preparation of guidance manuals, training programs, databases and other programmatic services. 

Our Team:  FHU’s full‐time staff of over 140 employees includes 27 environmental scientists.  Of these team members, eight are located in Nebraska.  Their multi‐disciplinary expertise includes biology, botany, aquatic and terrestrial ecology, wetlands, ornithology, entomology, hydrology, noise and air studies, computer technology, and many other technical fields. We take pride in helping NDOR and Nebraska communities stay environmentally compliant and we would appreciate the opportunity to continue to assist NDOR and LPA’s with their NEPA needs. 

 

Qualifications of PM and Key Team Members 

Amy Zlotsky, Principal – Contract Manager and Technical Specialist   Years with FHU: 7 / Total Years of Experience: 30+ 

Amy, the leader of our Environmental Services group in Nebraska, has spent the past 30 years helping communities and government agencies maintain environmental compliance.  A Certified Ecologist, her areas of expertise include wetlands, terrestrial habitat evaluation, endangered species, and the US Army Corps of Engineers (USACE) 404 permit program. She has been involved in wetland delineations, mitigation plans, and resolution of enforcement actions for hundreds of projects throughout the Midwest. She is currently the Contract Manager for the NDOR On‐Call contracts for Wetlands Services, Environmental Services, and Environmental Program Management. Over the past 7 years, Amy has led the FHU environmental group in preparation of more than 100 documents through the NDOR On‐Call Environmental Documents Contract.  She has also served as a Principal Author for the Environmental 

Assessments for Omaha’s 42nd & Q Street project and NDOR’s US 385, L62A to Alliance project, as well as the NDOR’s Final Wetland Mitigation Monitoring Report for Rose Southeast. Amy is also heavily involved in public participation, providing presentations at public hearings and meetings, and coordination of the public comment phase. 

Allison Sambol – Project Manager and Technical Specialist Years with FHU: 8 / Total Years of Experience: 11 

Allison has been working in the environmental field for 11 years, focusing on management and preparation of NEPA documents.  Over the past 8 years, Allison has been a leader in the FHU environmental group in preparation of an estimated 60 Statewide and LPA CE documents through the NDOR On‐Call Environmental Documents Contract, including 22 CE documents for the ARRA projects, and 60 GIS desktop reviews completed within 2 months time.  She also provides senior technical review for CEs and Hazardous Materials specialty reports authored by other FHU staff. Proven capabilities include coordination with regulatory agencies, multi‐disciplinary site reconnaissance and appraisal of land‐use history; impacts analysis and hazardous materials reviews.

Tony Baumert – Project Manager and Technical Specialist Years with FHU: 3 / Total Years of Experience: 18 

Tony is one of FHU’s most seasoned field biologists and serves as Project Manager for wetlands and stream projects throughout Nebraska, including our On‐Call Wetlands Services contract with NDOR.  In addition to field delineations, he handles 404/401 permitting needs for our clients. Tony is experienced with stream assessments and restoration plans, T&E species surveys, wetland mitigation monitoring, invasive species management, and siting studies. He also manages NEPA projects, including the CE for the City of Lincoln’s 10th and Salt Creek bridge replacement, and Platte County’s Columbus East viaduct. Tony has experience working throughout the United States for land development, oil and gas, electric utilities, and wind energy clients.  

Carin Richardson – Project Manager and Technical Specialist Years with FHU: 3 / Total Years of Experience: 20+ 

Carin is an environmental biologist with 20 years of experience, with the last 10 years specializing in the National Environmental Policy Act (NEPA). She has served as Principal Author for dozens of CEs completed by FHU under the NDOR On‐Call Environmental Services contract, and has managed several multi‐project assignments.  She also provides senior technical review for CEs and resource specialty reports authored by other FHU staff.  Prior to joining FHU, Carin was a NDOR project coordinator, as well as a NEPA document and resource specialist. Carin is a skilled field biologist, adept at bird, small mammal, and vegetation identification, and wetland delineation.  She completed the ASTM E‐1527 ‐13 Standard Practice for Environmental Site Assessments: Phase I and Phase II Training.  Carin is also experienced in public relations, presentation styles and methods, and conflict resolution.   

Jessica Jurzenski, PhD – Project Manager and Technical Specialist Years with FHU: 2 / Total Years of Experience: 10 

Jessica joined the FHU team with four years of experience conducting survey work and researching conservation measures for the federally endangered American burying beetle (ABB), as well as a year of reintroduction and monitoring for the federally endangered Salt Creek tiger beetle. She worked closely with the USFWS and the NGPC to develop a habitat suitability model for ABBs and is currently on an ABB working group. Jessica also has experience with surveys for carrion beetles, tiger beetles, butterflies, ants, mosquitoes, and plains topminnow. At FHU, Jessica conducts threatened and endangered species reviews, wetland delineations, GIS mapping, and 404 permit applications to help provide quality wetland and NEPA services. 

 

Knowledge & Understanding of Required Services 

NEPA & CEs, NDOR Review Forms, Green Sheets.  Through preparation of over 100 CE documents, FHU has demonstrated experience in use of the NDOR Categorical Exclusion Form, and preparation of NDOR Review Forms and Green Sheets, as well as Re‐evaluations and Supplements. We have also prepared Re‐evaluations for EAs and EISs, including the EIS for Improvements to South Locust Street in Grand Island.  The following team members have completed NHI/FHWA NEPA training classes.  Amy, Allison, Tony, Carin and Stephanie have taken the recent NDOR/FHWA training for the Programmatic Categorical Exclusion.

  Section 4(f) Determinations.   Over the past seven years, FHU has been preparing 4(f) de minimis and programmatic determinations, and exceptions through our NDOR On‐Call Environmental Services contracts.

Hazardous Material Reviews and Site Assessments.  FHU team members have training and experience in Phase I and Phase II Environmental Site Assessments according to ASTM 1527 Standards and All Appropriate Inquiry for a variety of industrial, commercial, and agricultural properties, including heavy and light manufacturing facilities; DOD sites; agricultural sites – particularly grain storage facilities; Brownfields; and petroleum release sites. FHU has recently completed preparation of NDOR’s HazMat Guidance document and is slated to provide training to NDOR staff.  Allison Sambol is an ASTM/NDOR Environmental Professional; Carin Richardson and Adam Behmer are ASTM/NDOR Practitioners.  

Noise  and Air Quality Studies.  FHU’s qualifications in noise and air quality studies have resulted in the firm’s selection as one of NDOR’s On‐Call Services Contractors for Noise and Air Quality Studies.  FHU’s noise expert, Dale Tischmak, has 30 years of experience in environmental consulting and more than a decade specializing only in noise and air quality analyses for transportation projects.  Dale’s expertise is deep with the computer models used to evaluate impacts for noise and air quality, including TNM 2.5, CAL3QHC, CALINE 4, MOBILE 6.2 and MOVES 2010a, as well as STAMINA/OPTIMA.  FHU possesses all of the software required for these modeling studies.   

Threatened & Endangered Species Reviews.  The FHU team has extensive experience preparing T&E Biological Assessments for NDOR and LPAs, including BE forms and IPLEs.  We also have experience in conducting presence/absence surveys for listed species in Nebraska and Colorado; landscape design/mitigation design for ESA and 404 compliance, and habitat assessments for wildlife crossing structures. Jessica Jurzenski, PhD, is an expert on the American burying beetle and has conducted surveys for NDOR over the past two years. Prior to joining FHU, Kody Unstad and Adam Behmer reviewed biological assessments and T&E reviews for NGPC.  The NDOR NEPA On‐Call Consultant training in T&E Species has been attended over the years by the following FHU team members:

  Historic Properties Survey and Evaluation.  For this submittal, FHU has teamed with Historic Resources Group (HRG).  Melissa Dirr‐Gengler and her associate Stan Parks provide expertise in Section 106 consultation, and surveys for standing structures and archeological resources.  Melissa, Stan and and Amy Zlotsky have worked on many projects together since the mid 1990’s, including the Lincoln South and East Beltway; Antelope Valley; and Blair Bypass.  Melissa is currently working with FHU on the North Lincoln PEL Study.  

In addition to HRG, Amy has training in GSA’s Introduction to Federal Projects and Historic Preservation Law; and Jake, Carin and Adam have taken the NHI/NDOR Section 106 training.  Jake meets the Secretary of the Interior’s Standards for Cultural Resources Specialists and is experienced in Section 106/4(f) clearance and historic cultural resource surveys for NEPA projects. 

Other Related Environmental Services.  FHU has routinely handles many other environmental evaluations covering Section 6(f) of Land and Water Conservation Fund; Farmland Protection Policy Act, Wild & Scenic River Act, floodplain permitting, and socioeconomic studies.  Allison Sambol and Carin Richardson have training in the NHI/FHWA Fundamentals of Title VI/ Environmental Justice (EJ) training, and handle Title VI/EJ review, including relocation analysis for available and affordable housing.   

FHU’s technical staff includes Linda Stuchlik, Technical Editor; four GIS Specialists; and a graphics department.  With a talent for visualization and digital illustration, Jake Lloyd develops graphic exhibits for events and presentations to the public.  

Public Involvement.  FHU provides assistance with a wide range of public involvement services to NDOR and LPAs, and is experienced with NDOR procedures.  Our team brings experience and success managing public involvement activities for large projects of public interest which have hundreds of stakeholders and may generate hundreds of comments. We also handle small projects that may only require public postal outreach.   

Our services include preparation of citizen participation plans, agency coordination plans, newsletters, web sites, graphics and handouts.  We also prepare presentations, and facilitate public meetings and hearings. During the public comment phase, we categorize, manage, and respond to comments and prepare summary reports.  Comments are typically reviewed and grouped by similar topic, and responses are sent back in a Comment Analysis Document or Response Table that contains information such as how a comment will be addressed, if additional information is required, or options for how a comment could be handled. Changes to the document are not made until NDOR approves the new language or approach.

Wetland & WOUS Delineation, Permitting, Mitigation and Monitoring.  Our team has conducted wetland delineations and prepared 404 permit applications for hundreds of miles of Nebraska highways.  Services have included NWP and IP permits, and Section 401/Title 117 Water Quality Certification.   

The firm is also experienced in preparation of wetland and stream channel mitigation plans for the USACE, construction oversight, and long‐term monitoring of sites, including wetland mitigation banks.  NDOR has used our services to prepare the Final Wetland Mitigation Monitoring Report for Rose Southeast, and has recently hired us to evaluate the West Point Wetland Bank site.  FHU is currently working with Douglas County to develop a wetland mitigation bank in the Papillion Creek watershed.  The following FHU team members have Wetland Delineation training and experience with the most current US Army Corps of Engineers (USACE) Wetland Delineation Manual, and Regional Supplements for the Midwest and Great Plains.

Stormwater, MS4, NPDES, Floodplain Permitting and Water Quality Assessment.  FHU specializes in stormwater pollution prevention and compliance, including development of SWPPPs, NPDES permits and compliance documentation.  FHU has teamed with FYRA Engineering to assist with hydraulic and hydrologic evaluations, floodplain analysis, water quality assessment, and other water resource evaluations.  

Staffing Capacity 

FHU has been steadily staffing up to meet a consistently increasing work load—primarily provided to us by NDOR.  NDOR’s repeat work and satisfaction are two of our most important objectives.  In order to provide NDOR with attentive service, our Nebraska staff now number 7 full‐time scientists.  FHU is able to allocate sufficient staff resources by providing backup from Denver. Our Denver office has 20 environmental scientists – many who have worked on NDOR projects in the field and office. 

Knowledge of Regulations & Procedures for this Work 

Seven years of serving as an NDOR On‐Call consultant has made FHU very knowledgeable in the procedures and preferences of the NDOR environmental and local projects staff.  This knowledge has come from conducting project work under contracts for Environmental Documents, Wetland Services, Air and Noise Studies, Stormwater Management and Environmental Program Assistance.  In addition, FHU attends all of the NDOR consultant training classes to the maximum level of participation allowed.  Typically, we follow NDOR training with internal training to disseminate process and preference information.  Carin Richardson’s experience in the NDOR Environmental Unit has helped immensely with understanding NDOR needs, and conveying practices to the rest of our staff.

For this submittal, FHU has teamed with three subconsultants:

FYRA Engineering is a water resource engineering firm and EDWOSB known for responsiveness, agility and service that’s truly personal.  The firm designs storm water solutions, restores streams and lakes, analyzes floodplains, assesses water quality, and conducts hydraulic and hydrologic evaluations.  

University of Nebraska Bureau of Business Research conducts studies on the economy of Nebraska including cost‐benefit analyses of alternatives; economic and fiscal benefit analyses; and economic, fiscal, and demographic outlooks.  Transportation‐related studies have included evaluation of investments in high‐speed multilane roundabouts; a model for estimating the economic impact of Nebraska highway improvement projects; and alternative funding mechanisms for state transportation agencies in rural states.

PERFORMANCE DATA 

Cooperation, Communication & Timeliness 

FHU has a proven track record of simultaneously managing multiple projects of varying difficulty, and of meeting challenging schedules and vigorous workloads. Over the past seven years, FHU has completed more than 100 CE documents as part of NDOR’s obligation authority challenge to get local projects built. Project locations have extended across the state, and are shown in the map in Appendix A.  These have included: 

70+ state highway projects requiring CEs and/or wetland services 

22 CE documents for LPA stimulus projects 

35+ CEs and 2 Environmental Assessments contracted directly with LPAs or their project engineers 

Highlights from this experience involve our environmental staff conducting 21 wetland determinations or delineations over a two‐month period along with all the other required NEPA documents for 22 federally funded stimulus projects (ARRA). We completed a first round of 20 GIS desktop reviews in one month, and a second round of 60 reviews in 50 days. Our consultant review score for the reviews was 92 out of a possible 110 points.  We successfully completed the 42nd and Q Draft Environmental Assessment within 8 months of initiating work, despite delays associated with out of scope work.  

Appendix A also includes client commendations regarding our past performance on their NEPA projects.  

Technical Quality of Documents 

FHU strives to submit high quality documents requiring minimal revisions.  We make this happen through the multiple review levels of the FHU Total Quality Management Plan; honed experience of our Project Managers; and skilled eye of our Senior Document Editor.  Over the past seven years of producing environmental documents for NDOR, your experience with our deliverables is our proof.

This letter is in reference to NEPA efforts and environmental services provided by Felsburg Holt and Ullevig (FHU) for the City of Omaha on two recent bridge and roadway design projects.  FHU was selected via competitive quality based selection process requiring proposals and interviews.  These projects are both Federal Funded projects thereby requiring full NEPA Environmental Assessments prior to moving forward to final design.  FHU coordinated with FHWA and NDOR to provide the required documentation which included developing the Purpose and Need, Environmental Justice, Public Outreach and coordination of all presentations and recording of the information at the Public Meetings.  Following input from the public meetings the NEPA documentation was completed and submitted for formal review by NDOR and FHWA who ultimately approved the documents allowing us to move into final design. 

The FHU Staff provided excellent, professional representation of the City of Omaha for these services. Their staff is knowledgeable, accountable and responsive and both of the projects are scheduled for construction. The process for NEPA in Nebraska is very demanding and requires continuous follow up and responsiveness and FHU was up to the task.  We look forward to working with them on future efforts.

Ms. Zlotsky is a Principal/Senior Environmental Scientist responsible for managing FHU’s environmental group based in Lincoln and Omaha, Nebraska. She has been working in the environmental field for 30 years, including management and preparation of NEPA documents in Nebraska since 1990. Her areas of expertise include wetlands, NEPA, terrestrial habitat impact evaluation, threatened & endangered species, historic preservation compliance, and the US Corps of Engineers Section 404 permit program. Ms. Zlotsky is currently the Project Manager for the NDOR On-Call Wetlands Contract, NDOR On-Call Contract for Environmental Documents, and NDOR On-Call Contract for Environmental Program Management.

Ms. Sambol has been working in the environmental field for 11 years, focusing on management and preparation of NEPA documents. Over the past 8 years, Allison has been a leader in the FHU environmental group in preparation of an estimated 60 Statewide and LPA CE documents through the NDOR On-Call Environmental Documents Contract, including 22 CE documents for the ARRA projects, and 60 GIS desktop reviews completed within 2 months time. She also provides senior technical review for CEs and Hazardous Materials specialty reports authored by other FHU staff. Proven capabilities include coordination with regulatory agencies, multi-disciplinary site reconnaissance and appraisal of land-use history; impacts analysis and hazardous materials reviews.

Ms. Richardson is an environmental biologist with 20 years of experience, with the last 10 years specializing in NEPA. She has served as Principal Author for dozens of CEs completed by FHU over the past several years under the NDOR On-Call Environmental Services contract, and has managed several multi-project assignments. She also provides senior technical review for CEs and resource specialty reports authored by other FHU staff. Prior to joining FHU, Carin was a NDOR project coordinator, as well as a NEPA document and resource specialist. Carin is a skilled field biologist, adept at bird, small mammal, and vegetation identification, and wetland delineation. She completed the ASTM E-1527 -13 Standard Practice for Environmental Site Assessments: Phase I and Phase II Training.

Ms. Jurzenski joined the FHU team with four years of experience conducting survey work and researching conservation measures for the federally endangered American burying beetle (ABB), as well as a year of reintroduction and monitoring for the federally endangered Salt Creek tiger beetle. She worked closely with the USFWS and the NGPC to develop a habitat suitability model for ABBs and is currently on an ABB working group. Jessica also has experience with surveys for carrion beetles, tiger beetles, butterflies, ants, mosquitoes, and plains topminnow. At FHU, Jessica conducts threatened and endangered species reviews, wetland delineations, GIS mapping, and 404 permit applications to help provide quality wetland and NEPA services.

Mr. Behmer has more than nine years of experience in the natural resources disciplines, with an emphasis on terrestrial and aquatic sciences. In addition to his field experience, Mr. Behmer has an extensive background in environmental permitting, which includes Section 7 Threatened and Endangered Species, Section 404 and Wetland Mitigation, and Section 106 of the National Historic Preservation Act. Mr. Unstad is an environmental scientist with more than 14 years of experience in the natural resources disciplines, with an emphasis on life sciences and wildlife ecology. He has a broad background in ecology, and has worked in a variety of settings with prairie and wetland restorations, invasive plant management, grassland bird surveys, pronghorn radio-tracking, and aquatic Chinese mystery snail research. In the natural heritage department of the Nebraska Game & Parks Commission, he tracked occurrences of rare plants, animals, and ecological communities and assessed potential impacts to threatened and endangered species from road construction projects and water appropriation projects. He is skilled in the use of ArcGIS and GPS and has been active in creating biological evaluation packages for many Nebraska Department of Roads projects.

Mr. Lloyd is an environmental designer/planner with nearly nine years of professional experience in environmental design and planning. Mr. Lampe is a Water Resources Engineer whose nearly 20-year career includes project management and senior design work on a variety of public infrastructure, land development, and water quality projects. Mr. Tischmak has over 30 years of technical and management experience in the environmental field. He provides technical support to numerous transportation projects involving noise monitoring and modeling, and air quality assessments. Dale is familiar with the latest field data collection techniques and computer models predicting air and noise conditions for transportation projects, including CALINE3, CAL3QHC, AERMOD, TNM and MOVES. He has knowledge of the NEPA process for transportation projects and is also well versed in the GIS technology critical for performing corridor optimization studies. Ms. Mechtenberg has 9 years of professional experience in water resource consulting. She has been involved in a wide variety of projects including dam design, reservoir/fishery design, lake restoration, community-based watershed management planning, concept-level alternatives analysis, and stream/wetland restoration and mitigation. Previous involvement with an environmental sciences group provided her experience with jurisdictional wetland evaluations and permitting procedures. Her current responsibilities include design and modeling for projects ranging from initial concept development to final design.

Dr. Holz has over 20 years of experience in surface water quality/aquatic habitat management and research. While earning his PhD from the University of Nebraska-Lincoln (UNL), Dr. Holz’s research advanced our understanding of water resource issues and developed improved management tools for lakes, streams and watersheds, including assessing/interpreting/predicting the response of water bodies to pollutants and the effectiveness of restoration techniques. Specific areas of expertise include lake restoration and management, watershed management, fisheries management, biological indicators of water quality, phytoplankton ecology and management, nutrient inactivation, determination of appropriate water quality goals, nutrient criteria development, water quality monitoring, water quality modeling, internal phosphorus loading, and determining effectiveness of TMDL’s using water quality and biological information. As a faculty member at UNL, Dr. Holz served as a technical advisor to the U.S. Environmental Protection Agency (EPA) on water quality management issues in the Midwest.

Mr. Henkel has more than 10 years of experience in water resources engineering with a primary focus on groundwater resources. Mr. Henkel began his engineering career in Texas where he contributed to and managed a variety of water resources projects including groundwater flow modeling, water rights evaluations, well design, pumping test analysis, surface water modeling, geophysical log interpretation, stream flow analysis, reservoir operation analysis, water quality analysis, and water quality modeling. Mr. Henkel subsequently worked as the Groundwater Management Engineer for the Papio-Missouri River Natural Resources District based in Omaha, Nebraska where he was responsible for the implementation of the existing District groundwater programs as well as Project Manager on several surface water and groundwater related projects. Mr. Henkel has extensive knowledge of the groundwater resources of Nebraska.
