Why do plans change?

• The Planning Act provides authority for applicants to submit development applications to amend the Official Plan or the Zoning By-law.

• The City is required to process applications.

• If Council does not make a decision on an application within a prescribed timeframe, the application can be appealed to the Ontario Municipal Board.

Preconsultation •Preconsultation takes place between the

applicant and City staff before a development application is submitted

•This is intended to identify what applications are required and what technical studies are needed to support an application

•There is no evaluation of a development proposal at the preconsultation stage.

•Application is submitted along with the required fees and background studies/information

•A sign is posted on the property describing the proposed development and providing a web link and phone number to contact for further information

•If you see a sign in your neighbourhood describing a proposed development, you can call and ask the planner for details.

•Visit the project web page for meeting dates, staff reports, or to view supporting materials submitted by the applicant.

• If you receive a notice about a proposed development, you can call the planner and ask for more information, or visit the Planning Department to view the file.

Agency Circulation/ Review

•The planner sends a letter describing the application to external agencies and City departments that may have an interest in the proposal. The technical studies are reviewed by these agencies.

•Agencies are asked for their comments and any conditions that must be imposed on the development

•Planner writes an information report to Council for the statutory public meeting

•Public comments received to date are attached to the report.

•The meeting is an opportunity for Councillors to learn about the proposed development without having to make a decision about it.

Statutory Public Meeting •Neighbouring property owners are sent a letter inviting them to the statutory public meeting before the Development and Infrastructure Committee (D&I) of Council.

•The statutory public meeting allows members of the public, as well as the applicant, to address the Councillors and provide opinions about the proposal.

•Questions can be raised at the statutory public meeting for the applicant and staff to address during the remainder of the application review process.

•Staff provide an overview of the application

•Members of the public can also speak to the Committee

•The Committee discusses the proposal but does not make a decision at this meeting

•You do not need to pre-register in order to speak at the statutory public meeting.

•Delegations are allowed 10 minutes to address the D&I Committee.

•Joint presentations are allowed, provided that each speaker has new information.

Review & Analysis •The Planner considers all public and technical input received, including the materials submitted with the application.

•The planner meets with the applicant to discuss the issues raised. The applicant may choose to amend the application to address these issues.

•The planner also evaluates the application in light of Provincial, Region and local planning policies

•The Planner writes an recommendation report for consideration by the D&I committee and Council

•The report summarizes the planning analysis and technical considerations and recommends: approval, approval with modification, or refusal of the application.

•Any public comments received after the statutory public meeting are attached to the report.

•Members of the public can also speak at a Council meeting if they have new information to provide. You must pre-register to speak at the Council meeting.

•The Clerk’s Department sends out notice of the Council’s decision

•The notice includes information on how to appeal the decision to the Ontario Municipal Board, if necessary

•Any individual has the ability to appeal Council’s decision to the Ontario Municipal Board

• The OMB is an independent tribunal with the authority to approve, change, or refuse planning applications. The decisions made at the OMB take the place of decisions made by City Council and are binding. • The OMB operates like a “planning court” for municipal planning matters and typically includes lawyers, planners, technical experts and witnesses in the proceedings.
