Introduction • TAA Letter dated May 11, 2015 • Law is effective immediately

• Emergency commissioner rules amend graduation requirements (effective for 120 days)

• Establishes individual graduation committee (IGC)

• Available to students who failed EOC for no more than 2 courses

• Provisions expire September 1, 2017

• Proposed rule amendments filed and comment period is underway

SB 149 Provisions • Effective NOW

• Allows graduation path to those who have failed no more than 2 of 5 EOCs

• Student must otherwise satisfy all graduation requirements (completion of curriculum requirements for FHSP)

• For Algebra I or English II EOC, “proficient” score on a corresponding TSI can substitute

• Requires that districts convene individual graduation committees (IGCs)

SB 149 Provisions • Required IGC Members: • Principal or designee

• Teacher of the course for which the student failed the EOC

• Department chair or lead teacher supervising the teacher(s) of the relevant course(s)

• Either the student’s parent/guardian, a designated advocate if the parent/guardian is unable to attend, or the student (student’s option) if 18+ or emancipated minor

• Recommended Member: School Counselor

effort to provide timely notice to

parents about meeting

• Mail, e-mail or in person

• Provided in English, Spanish or other

language to extent practicable

• Translator required if parent unable

to speak English

SB 149 Provisions • District Procedures Required

(Superintendent): • Establish procedures for convening IGCs

• For SY 2014-15 only, establish procedures for appointing alternative committee members

• For SY 2014-15, establish time lines for the IGC process

• By SY 2015-16, commissioner must adopt rules establishing procedures

• School board may want to adopt resolution allowing graduation under new law despite what local policy might say

SB 149 Provisions • Additional Academic Requirements:

• IGCs must recommend additional requirements for each failed EOC

• Additional remediation AND

• Either

• Completion of a project that demonstrates proficiency in the subject area of each course where EOC failed OR

• Preparation of portfolio of work samples from each affected course that demonstrates proficiency in the subject area(s)

• Students may submit coursework previously completed to satisfy additional requirements

SB 149 Provisions • Committee must consider 15 factors

• Recommendation of the teacher in each course of failed EOC

• Grades in each of course of failed EOC

• Scores on relevant failed EOC

• Student performance on additional academic requirements

• Hours of remediation attended, including • Attendance in college prep course under 39.025

• Attendance and successful completion of transitional college courses in reading and math

• School attendance rate

• Satisfaction of any of the TSI college readiness benchmarks set by THECB (SAT, ACT, TSIA cut scores)

SB 149 Provisions • Committee must consider 15 factors

• Successful completion of dual credit course in 1 of 4 core subjects

• Successful completion of a Pre-AP, AP, or IB program course in 1 of 4 core subjects

• “Advanced High” rating on most recent HS administration of TELPAS

• Score of 50+ on CLEP

• Scores on ACT, SAT, or ASVAB

• Completion of sequence of CTE program courses required to attain industry-recognized credential or certificate

• Overall preparedness for postsecondary success

• Any other academic information that local school board requires IGCs to consider

SB 149 Provisions • IGC Decision • After consideration of 15 factors, IGC

may determine student eligible to graduate • Only if student successfully completes all

additional requirements recommended by IGC and curriculum requirements for HS graduation

• Decision of ICG must be unanimous

• IGC decision is final and may not be appealed

• Students may not graduate via IGC before their 12th grade year

• Retesting and Reporting: • Students must retake relevant EOCs

until graduation

• Districts held accountable for retest results according to state accountability system requirements

• By December 1, districts must report in PEIMS the number of students who had IGCs convened, and of those, number graduated by IGC each year
