1. Introduction
1.1 Audience ThisguideisintendedtobeusedbymobileoperatorsinassistingthemtoestablishMobileNumberPortability(MNP)withothermobileoperatorsthusenablingsubscribersofeithernetworktoswitchtheirnetworkproviderandretaintheirtelephonenumber(MSISDN).
TheestablishmentofMNPisrequiredbymostmobileoperatorsinordertocomplywithTheGeneralConditionsofEntitlementNumber18–NumberPortability(“GC18”).
OperatorsshouldnotrelyonthisguidetodeterminewhetherornottheyarerequiredtocomplywithGC18.

2 TherequirementtoprovideMobileNumberPortability
2.1 BackgroundOn4thJanuary1999MobileNumberPortability(MNP)waslaunchedintheUK.Forthefirsttimemobilephoneuserswereabletotaketheirmobilenumberwiththemwhenchangingmobilecommunicationsprovider.
TheprocessthatmadeMNPpossibletookacrossindustryteamover18monthstodevelopandalthoughtechnicallysoundprovedcomplextoimplementthroughouttheNetworkOperatorsandServiceProviders(SP).
ThecrossindustryMNPgroupreviewedtheprocessinmid1999asaresultofthefeedbackreceived.ItwasagreedthattheproblemsencounteredsincelaunchcouldnotbeovercomewithoutafundamentalchangetotheMNPprocess.Asmallworkinggroupwassetuptodevelopanewportingprocessinordertoaddresstheseissues.
The new donor-led process aimed to more fully meet both customer and industry expectations byreducing the opportunities for the port action not to happen on the agreed day whilst reducingoperationalcostsbyusingInternetwebbasedsolutionsforcommunicatingbetweenSP’s.
On16November2006,Ofcompublisheda consultation–“ReviewofGeneralCondition18–NumberPortability” in which it noted that excessively long port lead times may discourage consumers fromswitchingproviderandthereforeproposedshorterportingleadtimesfortheConsumerprocess.
On17July2007,OfcomconcludeditsreviewbyreleasinganotificationofmodificationtotheGeneralCondition 18 (July Decision) which required the porting lead times of the Consumer process to bereducedto2businessdaysbynolaterthan31March2008.Thischangewasputintoeffecton18March2008.TherevisedProcessManualpreparedbytheOSGisavailableonthepublicpartoftheMNPOSGwebsite(http://www.mnposg.org.uk)
On 17 July 2007 Ofcom published another consultation – “Arrangements for porting phone numberswhen customers switch supplier - A review of General Condition 18” inwhich it considered a furtherreductionoftheportingleadtime(from2businessdays)tolessthan2hoursand,inrecognitionofthelowlevelsofconsumerawarenessoftherighttoport,aswitchfromthedonorledprocesstoarecipientledprocess.
On29November2007,Ofcom released its concluding statement–“Telephonenumberportability forconsumers switching suppliers” and a notification of modification to the General Condition 18(NovemberDecision) requiring the implementationofanear-instant (nomorethan2hours) recipientledConsumerportingprocessandestablishmentof a centraldatabaseofportedmobilenumbers fordirect routing of calls to mobile numbers as soon as reasonably practicable and, in any event, by 1September2009.
During2008,UKPortingmanagedthepreparationoftherecipient-lednewprocessneededtomeetthisnewrequirement.(seehttp://www.ukporting.org.uk).
VodafonesupportedbyBT,Telefonica-O2,OrangeandT-MobileappealedtotheCompetitionAppealTribunalagainstthedecisionoftheOfficeofCommunications(“OFCOM”)tomodifyPart1andGeneralCondition18ofPart2oftheGeneralConditionsregardingnumberportability,assetoutinAnnex2to

theconcludingstatemententitled“Telephonenumberportabilityforconsumersswitchingsuppliers”(“theDecision”),publishedon29November2007.
In Judgement 1094 on 18 September the CAT found in favour of the appeal and remitted thewholemattertoOFCOMforreconsideration.OFCOMiscurrentlyconsultingallinterestedparties.
Thecurrent legal requirement forMNP is therefore still theversionofGeneralCondition18with theamendment published on 17 July 2007 to require two day porting using the donor led system. AconsolidatedversionofGC18issetoutbelow.
Numberportability is alsounder reviewby theEuropeanCommission in the revisionof theUniversalServicesDirectiveandtheEuropeanCommissionisproposingthatthetimeforportingshouldbelimitedto one day. This requirementwill probably refer to the actions by the donor and allow the recipientmoreflexibilityoverthetiming.

18.NUMBERPORTABILITY
18.1 TheCommunicationsProvidershallprovideNumberPortabilityassoonasitisreasonablypracticableonreasonableterms,includingcharges,toanyofitsSubscriberswhosorequests.
18.2 TheCommunicationsProvidershall,pursuanttoarequestfromanotherCommunications
Provider,providePortability(otherthanPagingPortability)assoonasisreasonablypracticableinrelationtothatrequestonreasonableterms.InthecaseofMobilePortability,wheretherequestisforportingatotaloflessthan25TelephoneNumbers,thetotalperiodforprovidingPortabilityinrespectofthoseTelephoneNumbersshallnotexceedtwobusinessdays.AnychargesfortheprovisionofsuchPortabilityshallbemadeinaccordancewiththefollowingprinciples:(a) subjectalwaystotherequirementofreasonableness,chargesshallbecostorientedand
basedontheincrementalcostsofprovidingPortabilityunless:(i) theDonorProviderandtheRecipientProviderhaveagreedanotherbasisforthe
charges,or(ii) theDirectorhasdirectedthatanotherbasisforchargesshouldbeused;
(b) theDonorProvidershallmakenochargeinrelationtoSystemSet-UpCostsorAdditionalConveyanceCosts;
(c) inrespectofMobilePortability,theDonorProvidershallmakenochargeorannualfeeforongoingcostsrelatingtoregistrationofaportedTelephoneNumberoraSubscriber;
(d) chargesleviedbytheDonorProvidershallbebasedonthereasonablecostsincurredbyitinprovidingPortabilitywithrespecttoeachTelephoneNumber.
18.3WheretheCommunicationsProviderprovidesPortabilityinaccordancewithparagraph18.2:
(a) theRecipientProvider;and(b) theTransitProvider,

shall,asappropriate,providePortability(otherthanPagingPortability)onreasonableterms. 18.4 TheCommunicationsProvidershall,onthewrittenrequestoftheDirector,providetheDirector
witharecordofeachTelephoneNumberinrelationtowhichitisprovidingPortability,specifyingtherelevantRecipientProviderineachcase.
18.5ForthepurposesofthisCondition:
(a) “AdditionalConveyanceCosts”meananycostsincurredbytheDonorProviderassociatedwithresourcesusedin:(i)effectingtheswitch-processingrequiredtosetupeachportedcall;and(ii)providingtheswitchandtransmissioncapacityforanypartofthedurationofeach
portedcall,additionaltothecostsofconveyanceofnon-portedcallsfromtheDonorProvider’snetworktotheRecipientProvider’snetwork;
(b) “CommunicationsProvider”meansapersonwhoprovidesanElectronicCommunicationsNetworkoranElectronicCommunicationsService;
(c) “DonorProvider”meansaCommunicationsProviderwhoseSubscriberNumbersareintheprocessofbeing,orhavebeenpassedorportedtoaRecipientProvider;
(d) “MobileCommunicationsService”meansanyPubliclyAvailableTelephoneServiceconsistingintheconveyanceofSignalsbymeansofaPublicTelephoneNetworkwhereeverySignalthathasbeenconveyedtherebyhasbeen,oristobe,conveyedthroughtheagencyofWirelessTelegraphytoorfromaPublicTelephoneNetworkwhichisdesignedoradaptedtobecapableofbeingusedinmotion;
(e) “MobilePortability”meansPortabilityrelatingtoTelephoneNumbersAllocatedforusewithMobileCommunicationsServices;
(f) “NumberPortability”meansafacilitywherebySubscriberswhosorequestcanretaintheirTelephoneNumberonaPublicTelephoneNetwork,independentlyofthepersonprovidingtheserviceattheNetworkTerminationPointofaSubscriberprovidedthatsuchretentionofaTelephoneNumberisinaccordancewiththeNationalTelephoneNumberingPlan;
(g) “PagingPortability”meansPortabilityrelatingtoTelephoneNumbersAllocatedforusewithRadiopagingServices;
(h) “PointofConnection”meansapointatwhichonePublicTelephoneNetworkisconnectedtoanother;
(i) “Portability”meansanyfacilitywhichmaybeprovidedbyaCommunicationsProvidertoanotherenablinganySubscriberwhorequestsNumberPortabilitytocontinuetobeprovidedwithanyPubliclyAvailableTelephoneServicebyreferencetothesameTelephoneNumberirrespectiveoftheidentityofthepersonprovidingsuchaservice;
(j) “PubliclyAvailableTelephoneService”:(a) inrelationtoaservicetobeusedwithaTelephoneNumberforreceivingcallsonly
underthecontractbetweenthepersonandtheproviderinquestion,meansaPublicElectronicCommunicationsServiceforonlyreceivingnationalandinternationaltelephonecallsthroughanumberornumbersinanationalorinternationaltelephonenumberingplan;
(b) inrelationtoaservicetobeusedwithaTelephoneNumberfororiginatingandreceivingcallsandaccesstoEmergencyOrganisationsunderthecontractbetweenthepersonandtheproviderinquestion,hasthemeaningascribedtoitunderparagraph1ofPart1ofthisSchedule;
(k) “RadiopagingService”meansElectronicCommunicationsServicesconsistingintheconveyanceofSignalsbymeansofWirelessTelegraphywhereeverySignal,apartfrom

simpleacknowledgement,isultimatelytransmittedfromastationforWirelessTelegraphycomprisedintheCommunicationsProvider’sElectronicCommunicationsNetworktoastationforWirelessTelegraphyorWirelessTelegraphyApparatusthatisnotcomprisedinthatnetwork;
(l) “RecipientProvider”meansaCommunicationsProvidertowhomSubscriberNumber(s)areintheprocessofbeing,orhavebeenpassedorportedfromaDonorProvider;
(m) “Subscriber”meansanypersonwhoispartytoacontractwiththeproviderofPubliclyAvailableTelephoneServicesforthesupplyofsuchservicesintheUnitedKingdom;
(n) “SubscriberNumber”meanstheTelephoneNumber(orTelephoneNumbers)whichanyCommunicationsProvider’sPublicTelephoneNetworkrecognisesasrelatingtoaparticularSubscriberofthatCommunicationsProvider;
(o) “SystemSet-UpCosts”meancostsoftheDonorProviderincurred―(i) inthecourseofmakingnetworkandsystemmodifications,configurationand
reconfiguration,includingadaptingorreplacingsoftware;(ii) inthecourseoftestingfunctionalitywithinthatprovider’snetworkandinconjunction
withanyRecipientProvider’snetwork,(iii) therebyestablishingthetechnicalandadministrativecapabilitytoprovidePortability;
(p) “TransitProvider”meansaCommunicationsProviderproviding,byagreement,InterconnectionbetweenaDonorProviderandRecipientProviderviaPointsofConnectionwithbothCommunicationsProviders.
3 ThecurrentarrangementsforMobileNumberPortability
3.1 OverviewThemarketisservedby:
• serviceproviders,
• mobilevirtualnetworkoperatorsand
• mobilenetworkoperators.
Numberportabilityisneutralastothetechnologyusedforcallsandisarrangedonabilateralbasisseparatelybythepartiesconcerned.ItisnotrestrictedtooperatorsthatuseGSM/3Gtechnology.
Callroutingandterminationpayments
Numbersareallocatedtooperatorsinblocks,suchthatparticularoperatorsholdparticular“numberranges”.Callsareroutedtothenumberrangeholderoftheparticularnumberdialled.
PursuanttoGC18,mobilenumbersmaybeportedbetweenoperators,andhenceaparticularnumbermaynolongerbelongtotheoriginalnumberrangeholder.However,thereisnocentraldatabaseofportednumberssettingoutwhichnumbersareonwhichnetworks.Consequently,operatorscannotroutecallsdirectlytoaportednumberbutmustinsteadsendittothenumberrangeholder.Thenumberrangeholderthenonwardroutescallstoportednumbertothecurrentrecipientnetwork.Ineffect,therearetwopartstothecall–originatingoperatortorangeholderoperator,andrangeholdertorecipientoperator.

Terminationfeesrelatetocalls,andaccordinglytherangeholderwillreceivetheinitialcallandchargeitsterminationratetotheoriginatingoperator.Therangeholderpassesthroughtheterminationratethatitreceivedontheinitialcallinsteadoftherecipientoperatorchargingitsownterminationratetotherangeholder.Asaconsequence,iftherangeholderandrecipientnetworkshavedifferentterminationrates,therecipientnetworkwillnotreceiveitsownterminationrate(whichmaybehigherorlowerthanthatoftherangeholder).
Attheretaillevelthecostofcallingaportednumberremainsthetariffapplicabletothenumberblockratherthanthenormaltariffforcallingtherecipientoperator.
PortingProcess
Theportingprocessis"donorled"andthesubscriberneedstoobtainaPortingAuthorisationCode(PAC)fromthedonor(theircurrentserviceprovider/operator)andpresentthiscodetotheirnewserviceprovider/operator-therecipientbeforeitsnumbercanbeported.
ThePACsareallocatedandmanagedbySyniverseonbehalfoftheoperators.TherecipientanddonorserviceprovidersauthoriseandarrangetheportingthroughtheSyniversesystem.
Theportingatthenetworklevelishandledthoughbilateralcommunicationsbetweenthenetworkoperatorsconcerned.
ThewholeprocesstakestwodaysafteraPAChasbeenobtained.Theprocessisdescribedinmoredetaillaterinthisdocument.
3.2 TheOSGTheadministrationofthecurrentmobilenumberportabilitysystemismanagedbyoperatorsthroughtheOperatorsSteeringGroup(OSG),whichisanon-incorporatedbodythatmeetsapproximatelyevery4-6weeksandhasanindependentchairman.ForhistoricalreasonstheOSGisnotincorporatedThereisnointentionofchangingthestatusoftheOSGunlessthereisaclearbenefitindoingso.Thissituationisonlylikelytoariseifmajornewprocurementshavetobeundertaken.
ServiceprovidersdonotparticipateintheOSGbutareinvolvedinportingandareabletousetheSyniversesystem.

TheAdministrativeCommitteetakesdecisionsonthemanagementofthecurrentsystemthroughmajorityvote,withbothExecutiveandParticipatingMembersvoting(ParticipatingMembersarerepresentedbyanumberofdelegatesthatincreasesinlinewithmembership).MeetingsoftheAdministrativeCommitteearechairedbyanindependentchairman.TheOSGalsohasaProductionManagerandadditionalsupportservicesareprovidedbytheFederationofCommunicationsServices(FCS).
BeneaththeAdministrativeCommitteesittwoworkinggroupsthatmeetregularlyto"manage"thepracticalitiesofportingbetweenthedifferentparties:
• OSGOperationalReviewGroup(ORG),whichhandlesday-to-dayplanningissues,practicalproblemsanddisputes
• OSGOperationalTechnicalGroup(OTG),whichrevisesandimprovestheprocesstakinginputsfromtheORG
ThecostsofthemanagingMNParesharedwithalltheOSGmembersthroughaformulalaiddownintheOSGConstitution.ThereisalsoaprocesswithintheOSGforallmemberstoagreeanychangestohowMNPoperate..
3.3 MoredetaileddescriptionoftheportingprocessTheindustryagreedMNPPortingProcessisdefinedinthe“MNPPortingProcessManual”andisavailableontheOSGwebsite.AllMNOsareexpectedtoadheretothisprocesswhenconductingMNP.
Thesameportingprocessisusedfor: - PortingofnumbersbetweenSPsthatusethesameMNO
- PortingofnumbersbetweenSPsthatusedifferentMNOs
TheMNPprocessmayormaynotbeusedforthetransferofnumbersbetweenNOswheretheSPremainsthesame.SPsarefreetoadministersuchtransfersaccordingtotheirowninternalprocesses.
TheportingofnumbersintheUKcanbeconsideredintwoparts.
• Firstly,theagreementbetweenMNOsorSPsthataMSISDNiseligibletoportandonwhatdatethatMSISDNshallportthen
• secondly,theactualportcutoverontheportday.

Thesubscriberfirstneedstocontacttheirexistingserviceprovider(theDSP)inordertoauthenticatethemselvesandobtainaPAC.Contactmaybebytelephone,letteroremailbuttheDSPisentitledtoinsistonawrittenportingauthorisationrequestwiththecustomer’ssignaturebeforeissuingaPAC,ifitistheircurrentbusinesspolicytorequirethecustomer’ssignatureforconfirmationofaterminationrequest.
ThedifferentconditionsunderwhichaDSPcanrefusetoprovideaPACcodeare:
1. TheMSISDNisnotheldbyacustomeroftheDSP2. TheMSISDNhasbeenterminated3. Theaccountholderisdeceased4. TheDSPhasalreadyissuedaPACthatisstillvalid.5. The customer fails to provide adequate identification that he or she is the legitimate
accountholder.
TheDSPmustadvise:
• Post-paysubscribersofanyearlyterminationchargepayable
• Prepaycustomersthatanyexistingunusedcreditwillbelostwhenthenumberisported.
TheDSPwillaccesstheSyniversesystem,whichgeneratesaPACwhichisissuedtothesubscriber.ThePACconsistsof3lettersfollowedbysixdigits.The3letterswillidentifytheDSP,andthedigitswillidentifytheindividualport-outrequest.APACisvalidfromthedatethatitisgeneratedforaperiodof30calendardays,includingbankholidays.
DuringthePACvalidityperiod,theDSPmaytakewhateverstepsarenecessary(includingbarringcontinueduseofservice)tomanagebaddebtpriortothenumberbeingported.HowevertheymaynotrefusetoissueaPACbecauseofbaddebt.
AsinglePACmaybeusedwithupto25separatetelephonenumbers.
TheissueofthePACisnormallytakenasnoticetotheDSPthatthecontractwillbeterminatedandthePACdateisnormallyusedtocalculateanyearlyterminationcharges.
Thesubscriberthenchoosestheirnewserviceprovider(RSP)andrequestsanewaccountwithnumberporting,signsthenecessarycontractualdocumentsandgivestheRSPthefollowinginformation:
• Number(s)tobeported

• RNOidentity
TheRSPentersthePAC/numberpairingintotheSyniversesystemtogetherwiththedesiredportdateandthesystemchecksthevalidityofthepairing.Ifthepairingisvalid,theRSPisfreetoissuethecustomeranewhandsetorSIM,sincetheDSPisobligedtoactiontheport-outrequest.

TheRSPcancanceloramendtheportingdetailsontheMNPwebsystem,onrequestbythecustomer,atanypointuptothetimetheportingdetailsareprocessedbytheDSP.OncetheDSPhas“read”theportingdetailsandlockedtheentry,RSPaccesstotheentryonthewebsystemis“lockedout”.
TheDSP“polls”theMNPwebsystemdailytoidentifynumbersthathavereceivedport-outrequests.TheDSPshoulduseallreasonableendeavourstolockthereadPACsby0500hoursand,inanyevent,bynolaterthan1500hoursonthedaypriortotheportingday.
OnorbeforetheportdatetheRSPsetsupanewsubscriptionfortheportingMSISDNontheRNOtobeactiveontheagreedportingdate.TheRSPshouldensurethattheportingcustomerisinpossessionofanappropriateSIMandhandsetbeforetheportingdate.Thenumbershouldbeactiveby1100ontheportingday.
OnorbeforetheportdatetheDSPinitiatestheport-outofthenumberfromtheDNOandgivestheDNOthefollowinginformation:

TheDNOvalidatestheMSISDNtoconfirmthatitissupportedbyanactivecurrentsubscriptionandnotifiestheDSPofanyinvalidportingnumbers.

TheONOvalidatesthe“ownership”oftheportingMSISDN,andrejectsanyrequestssubmittedbyanoperatorthatisnottheDNOforthenumberbeingported.
TheONOmodifiestheresidualsubscriptiontore-routetraffictotheRNOduringtheperiod1100to1400ontheportingday,andconfirmsthemodificationoftheresidualsubscriptiontotheDNOandtheRNO.
Uponconfirmationthattheresidualsubscriptionhasbeenmodified,theDNOterminatesthecurrentsubscriptionfortheportingMSISDNbetween1600andtheendoftheportingday(i.e.nolaterthan2400hours).
ThecommunicationsbetweentheDNO,ONOandRNOuseExcelfilesthatareexchangedusingSFTPorISDN.

Weexplainfirstwhatyouneedtodoifyouaregoingtobecomeafullnetworkoperatorinyourownright.Wethenexplainwhatyouwillneedtodoifyouareonlygoingtobeaserviceprovider,iearesellerofairtimeonaseparateoperator'snetwork.TheroleofMVNOfallsinbetweenthesetwodependingonexactlywhatfunctionsyouundertakeyourselvesandwhatisdoneforyoubyanetworkoperator.
WearenowherestatingthateachMNO/MVNOwillhaveaBusinessAsusualprocess(BAU)(asinstructedbyOFCOM)andthenewMNO/MVNOneedstoproviderelevantinformationifstatedintheBAUprocess.ThiswilllayemphasisontheBAUprocesses&alingeveryonetofollowthesame.

• EstablishacontractwithSyniverseforaccesstoPACsandcompletetestingwithSyniverse
• EstablishandtestSFTPcommunicationswitheachotherMNOforthemessagessentduringtheportingprocessaftertheuseofthePAC.InthecaseofO2,OrangeandVodafoneitmayalsobenecessarytouseISDNatleastforthenearfutureuntiltheseMNOsimplementSFTP.

• UndertakeandcompletesignallingtestingwitheachotherMNO

Theseactionsarenotallsequentialandinthecaseofanewnetworksomewillbeundertakeninparallel.
4.2 Numberportabilityforaserviceproviderthatusesanotheroperator'snetwork
Ifyouplantoactonlyasaserviceprovider,orifyouplantooperateyournetwork"behind"anothermobilenetworksothatyouuse,onacommercialbasis,thearrangementsthattheyhavealreadyestablishedwithotheroperators,thenthereismuchlesstodotoestablishmobilenumberportabilityandyoudonotneedtojointheOSG.
Themaintasksthatyouneedtodoare:
• DemonstratetotheMNPProductionManagerthatyouhaveanagreementwithoneormoreMNOsallowingyoutoresellservicesontheirnetwork.ThiscanbeintheformaletterfromtheaccountmanageroftheMNOstatingthatanagreementisinplace;
• DemonstratetotheMNPProductionManagerthatadequatetraininghasbeenorisabouttobeundertakenintheuseoftheSyniversesystem.ThiscanalsobeintheformofaletterfromtheMNO;

• EstablishconnectivitywithSyniverseallowingaccesstotheMNPsystemforthegenerationofPACsandcompletetestingwithSyniverse;

4.3 JoiningtheOSG(MNOsonly)TheprocessforjoiningtheOSGislaiddownintheOSGConstitution.
ThenewentrantneedstoprovidesomebasicinformationaboutitsserviceandplanstotheOSGChairmanusinganApplicationForm(seeAnnex).UponcompletionofthisApplicationform,andiftheMembershipCriteriaarefulfilled,theChairmanthenrecommendstheapplicationtotheAdministrativeCommitteeandthemembersoftheAdministrativeCommitteevoteontheapplication.
Themainconcernofthemembersisthatthenewentrantisproperlyentitledtomobilenumberportability.Thisentitlementisbasedon:
• HavingobtainedanallocationofmobilenumbersfromOfcom
• Havingclearplansfortheprovisionofaccesstoemergencyservices(becausethisqualifiesthemasaproviderofPATSandhencebringsthemundertheobligationtoprovidenumberportability).
ThemembersoftheOSGacceptthatanewentrantmaywishtojoinbeforeitsnetworkisfullyestablishedandthatitsplansmaynotbefinalisedwhenitjoins.
IftheApplicationFormcanbecompletedsatisfactorilytheprocessshouldtakeapproximatelyonetotwomonths.
OncethepositivevotehasbeenachievedthenewentrantneedstopayitsjoiningfeethroughtheFCS.
ThenewentrantmaythenstarttoattendParticipatingMembermeetingsandtheOTG/ORGmeetingsandestablishportabilitywiththeotheroperators.
4.4 NegotiatingcontractswiththeotherMNOs(MNOsonly)MembershipoftheOSGwillgainanoperatoraccesstotheSyniversesystem,necessaryfortheprovisionandprocessingofPACsto/fromcustomers.However,inordertoestablishportingandensuretheroutingofcallstoportednumbers,newmembersmustalsoestablishcontractswitheachoftheotherMNOs(notalltheserviceproviders).
EachMNOhasdevelopedatemplatecontractbutthereisthepossibilitythatyouwillwishtonegotiateindividualarrangementsbasedonthetemplate.Attemptsweremadeinthepasttoestablishacommontemplateforalloperatorsbuttheywereunsuccessful.
Theneedfortheindividualcontractsarisesbecause:

• Theoperatorsneedtomakemutualundertakingstoportnumbersandtoonwardroutcallswheretheyaretheblockoperator/numberrangeholder.
• Therecipientoperatorneedstopaytheblockoperatorforonwardroutingthecall.ThechargeforthisisregulatedbyOfcomandiscurrently0.1ppm3.
• Theblockoperator/numberrangeholderneedstoagreetopassthroughterminationchargestotherecipientnetwork.
ThecontactpointsforthecontractsaregiveninAnnexC.
Experiencehasshownthatthisisatimeconsumingprocedureandwillprobablytakeatleast3months.
4.5 EstablishingacontractwithSyniverseandundertakingtesting(MNOs)OnlyMNOsarerequiredtoenterintoacontractualrelationshipwithSyniverseinestablishingMNP.SPsmaybesetupontheMNPsystemoncetheyhavedemonstratedacontractualrelationshipwiththeirMNO(s)inaccordancewithsection4.3above.
InordertofollowtheMNPprocess,MNOswillneedtobesetupontheSyniverseSystem.OncesetuponthissystemMNOsmayaccessitviatheGUIortheAPI.EachofthesemaybearrangedbytheMNPProductionManager.Aseparatesystemisavailablefortesting,trainingandproduction.TheSyniverseSystemfacilitatestheagreementbetweenthepartiesinvolvedinaportthattheportiseligibletotakeplaceandthedatethatisshalltakeplace.
OncemembershipoftheOSGhasbeenestablishedthenewMNOmayapproachSyniverseandrequesttobesetuponthesystemasanewMNO.Thiswillresultintemplatecontractsbeingprovidedforreviewandtheissuingoftestdocumentation.

4.6.2 ISDNThreeoperators(O2,OrangeandVodafone)stillexchangefilesusingISDNratherthanSFTP.
5 ThecostsofimplementingnumberportabilityThefollowingprovidesasummaryofthecosts.
5.1 PaymentstootherMNOs(MNOsonly)Therearenochargesorpaymentsforestablishingportabilitywiththeotheroperatorsorfornegotiatingandarrangingthecontracts.
ParticipatingmembersarerequiredtopayamonthlyminimumchargetoSyniverseofaround£400tobeactiveontheMNPsystemasanMNO.
Foreachcompletedportpaidforbyaparticipatingmember,Syniversewithholds£0.075whichbecomespayabletotheExecutiveMembers
Foreachcallminuteofcallstoportednumbers,therecipientoperatorpaystheblockoperator0.1ppmforonwardroutingthecall.Hence,whereyouportincustomers,youwillreceivetheblockoperator’sterminationrate–0.1ppm(seefurther5.4below).
normalinterconnectionchargesapplyinrespectofcalls(voiceandvideo),SMSandMMS.
ServiceprovidersdonothavetomakeanypaymentsdirectlytootherMNOsbutmaybechargedbytheirsupportingMNOforanychargesthattheMNOhastopayormaybecreditedforanychargesthatitreceivesasaresultoftheserviceprovider'sportings.
5.2 PaymentstoOSG(MNOsonly)ThefollowingsummarisesthecostsofjoiningOSGasaParticipatingMember.
EachnewparticipatingmemberhastopayitsshareoftheAllMembers’CapitalExpenditure(seeSchedule2Article3).ThisisthecostofupgradingtheSyniversesystemtoenableittosupportnewentrants.Thispaymentissharedamongstexistingmemberswhohavealreadypaidfortheworkconcerned.Thecurrent(end2008)levelofthischargeis£4109.81+VAT.
EachnewparticipatingmemberhastopayitsshareoftheongoingOSGcostsfromthedateofjoining.Thesecostsarecurrentlyapproximately£475+VATpermonth.
PaymentstotheOSGaremadetoFCSandFCSwillproducethenecessaryinvoices.Paymentsaremadeonceortwiceayearandadjustmentsaremadebetweenthebudgetsandtheactualexpenditureattheendoftheyear.
5.3 PaymentstoSyniverse(MNOs)EachnewMNOwillhavetopaySyniversefortheuseoftheMNPsystem.SPsdonothavetopaySyniverseastheiruseofthesystemiscoveredbythepaymentsmadebytheirhostMNO.
Theinitialone-offSystemAccessionChargeisoftheorderof£4,000.
ThiscoverstheestablishmentofsecureGUIaccessandinitialbasictraining.

InestablishingtheconnectivitywithSyniverseMNOsmayobtaintestingandconsultancyservicesfromSyniverseatanadditionalchargetobeagreedwithSyniverse.
Onceportinghascommenced,theMNOischarged£0.25perportsubjecttoaminimumof£400permonth.
5.4 InterconnectionchargesAttheinterconnectionlevel,thecallterminationchargepaidtotherecipientoperatorremainsthecallterminationchargeapplicabletothenumberblockratherthanthecallterminationchargeoftherecipientoperator.
5.5 RetailchargesAttheretaillevelthecostofcallingaportednumberremainsthetariffapplicabletothenumberblockratherthanthenormaltariffforcallingtherecipientoperator.

6.1 OSGPMWGParticipatingMembersarerepresentedatmeetingsoftheAdministrativeCommitteebydelegates,whorepresenttheagreedviewofParticipatingMembersandvoteontheirbehalf.JoiningtheOSGentitlesaParticipatingMembertojointhe ParticipatingMembersWorkingGroup(PMWG).ThisgroupholdsmonthlyphoneconferencesamongParticipatingMembersinorderthattheycanagreetheirfeedbackonagendaitemsandinstructtheirchosenDelegatedMembers.
NewmembersshouldasktobeaddedtotheemailexploderforthePMWG.
6.2 ORGMembershipoftheORGisopentoSPsandMNOs.ForMNOs,membershipisobtainedautomaticallywithOSGmembership.ForSPsmembershipisobtainedthroughapplicationtotheMNPProductionManager.
Thisgroupismadeupofindividualsthatcarryoutportingactivitiesonbehalfofthecustomer.Themonthlymeetingsserveasaplacetoraiseanyoperationalissuesthatmayarise.WhereissuesariseintheORGthatareunabletoberesolved,theOSGACmaybeaskedtointervene.
NewmembersshouldasktobeaddedtotheemailexploderfortheORG.
6.3 OTGMembershipoftheOTGisopentoMNOsandisautomaticallyobtainedwithmembershiptotheOSG.
Thisgroupisresponsibleforensuringthetechnicalplatformsthatsupporttheportingprocessareinorder.CurrentlytherearenomajortheissuestheOTGareworkingon.
NewmembersshouldasktobeaddedtotheemailexploderfortheOTG.

AnnexA:EmergencyaccessrequirementsTherequirementsforaccesstotheemergencyservicesarecontainedinGC4onEmergencyCallNumbersasfollows:
4.1 The Communications Provider shall ensure that any End-User can access Emergency Organisations by using the emergency call numbers “112” and “999 or 112” at no charge and, in the case of a Pay Telephone, without having to use coins or cards.
4.2 The Communications Provider shall, to the extent technically feasible, make Caller Location
Information for all calls to the emergency call numbers “112” and “999 or 112” available to the Emergency Organisations handling those calls.
4.3 For the purposes of this Condition,
(a)“CallerLocationInformation”meansanydataorinformationprocessedinanElectronicCommunicationsNetworkindicatingthegeographicpositionoftheterminalequipmentofapersoninitiatingacall;

5.39Regardingtherequirement,totheextenttechnicallyfeasible,tomakecallerlocationinformationforallcallsto999/112availabletotheemergencyorganisationshandlingthosecalls,atpresentOfcomconsidersthetechnicallyfeasiblesolutionisfortheVoIPprovidersconcernedtoprovidetheregisteredaddressoftheirVoIPcustomerstotheESDB,accompaniedbyaVoIPflagtoalerttheemergencycallhandlingoperatortoaskthecallertoconfirmtheirlocation.
5.40WhereaVoIPserviceismainlyusedinanomadicwayorismobileanditwouldbeunhelpfulfortheemergencyservicescallhandlertohavetheregisteredaddressbecausethecallerisunlikelytobethere,weconsiderthetestof“totheextenttechnicallyfeasible”maybemetbyprovidingaVoIPflagonlyforall999/112calls.Thatwouldalerttheemergencycallhandlingoperatortoaskthecallerfortheirlocation.AnexamplewouldbeamobilebusinessVoIPserviceusedatseparatepremisesfromthecompany’sregisteredaddress/PBX.
5.41Wemuststressthatthesolutionsin5.29and5.30aredraftedinthecurrentenvironmentandweexpectthemeaningof“technicallyfeasible”tochangeastechnologyprogresses.WestronglyencourageandexpectindustrytostrivetoagreeandimplementastandardisedsolutionforprovidingautomaticcallerlocationinformationandCLIfortype2andtype4VoIPservices,forexampleinthecontextoftheNICC’swork.
5.42Wewillcontinuetomonitortechnicalprogress.Weexpecttoconductaformalreviewinearly2009withaviewidentifyingnew“technicallyfeasible”standardsandsettingadeadlineformeetingthem.
5.43Ofcomconsiders“technicallyfeasible”mayincludecoststotheextentthatthecallerlocationinformationsolutionmustbefeasible,orreasonable.Inconsideringwhatisreasonable,Ofcomwillplaceparticularweightontheimportanceofproviding999/112accessforpublicsafety.
Thusaccordingto5.40,therequirementissatisfiedformobileservicesbytheprovisionofaVoIPflag.
