If the matter involves damage to a ship or it's cargo, it should generally be referred as an 1800 (the lawyers who handle international trade generally also handle shipping and marine insurance matters). If it involves an injury to an individual, the lawyer must also be listed in 0800(personal injury & negligence) or the notes must say "injury."

Adoptions (agency) 301 Notes must say "handles agency adoptions."

Adoptions (kinship foster care)(special New York City Program)

302 This is a special program in which the adopting parent(s) will continue to receive payment for the child from the state after the adoption. These are referred as "Reduced Fee" referrals and it has to be clear that the caller was referred to us by the New York City department of adoptions. We waive the $25 consultation fee. The lawyer gets paid by The State at the conclusion of the adoption.

Adoptions (step parent) 301 This is a simple process if the natural parent who is giving up custody consents to the adoption, or has had no conduct with the child for a substantial period of time.

If call is from business this can be referred to 0200 (business & corporations) with notes about advertising or publishing. Look for a lawyer who is also listed in 0900 Intellectual Property. If the caller is a company that sells advertising and someone hasn=t paid the bill, consider 0103(collections) or 0205 (commercial litigation). Try to get information on what the caller really plans to do, if you are not sure who to recommend, take the caller's phone number and call back after checking with a

Alcohol Beverage Commission 1212 This may involve the obtaining of a Liquor License or a claimed violation which puts an existing license in jeopardy.

Alienation of Affections legal term

No longer recognized as a tort in New York & most other states. It dealt with the willful and malicious interference with the marriage relation by a third party such as the parents of one of the spouses.

Alimony 5306 Also called spousal support & maintenance. Either spouse can be ordered to pay support and maintenance for the other spouse based on length of time of the marriage, need for support and ability to pay.

Allen Charge legal term

An instruction by the court to a jury to keep trying to reach a verdict even though they have reported difficulty.

Amortization legal term

Reduction of a debt by gradual (usually monthly) payments

Annulment 0304 Section 140(a) of the NY Domestic Relations Law provides for the declaration of he nullity of a marriage on the ground that a former spouse of a marriage is still living and there was no valid divorce (bigamy). DRL 140(b) permits annulment on the ground that one or both of the parties were under the age of legal consent at the time of the marriage. DRL 1408 provides for annulment on the ground that one of the parties was mentally retarded. DRL 140(d) provides for annulment on the ground that one of the parties was physically incapable of entering the marital state. DRL 140(e) provides for annulment if the marriage was entered into as a result of force, duress or fraud. DRL 140(f) provides for an annulment in the event of an incurable mental illness for five years. The referral category is the general divorce category however, notes must include annulment. The grounds generally are: bigamy, fraud that goes to the essence of the marriage, lack of capacity to marry. Someone is not automatically entitled to an annulment just because the marriage was for a very short time.

Ante nuptial AgreementsPrenuptial Agreements

0312 There are often estate considerations to protect the interests of the children of a previous marriage. Also considered when there is a big difference in the income or assets or potential liabilities of the parties.

Anti-trust 0207 Laws against monopolies & restraint of trade. Under the Sherman Anti-trust Act treble damages are awarded. Check whether notes include just advice or litigation. A litigation referral in this area must also be listed in 0210 (complex litigation).

Apparent AuthorityOstensible Authority

Legal doctrine that a principal (boss, authority, company) is accountable for the acts of his/her agent if the principal has represented that the agent has authority.

Appearance, general legal term

A person comes to court personally or through their attorney for any purpose other than to attack the court's jurisdiction. They therefore submit to the jurisdiction of that court.

Appearance, special legal term

An appearance in court solely for the purpose of attacking the jurisdiction of the court. This is frequently an issue in divorce cases where each spouse is living in a different state. The special appearance should only be made by a lawyer, not by the client representing him/herself.

Arraignment legal term1100

The process in which the defendant in a criminal case is formally charged with an offense and pleads guilty or not guilty. If the caller asks for a lawyer "just for the arraignment" we do not refer lawyers for such a limited purpose partly because once a lawyer becomes "Attorney of Record" the judge may force that lawyer to continue on the case, whether paid or not.

Arrears 5307 A sum which is due and unpaid. Usually refers to child or spousal support that is past due. Brooklyn Law school and other groups listed in your source materials handle these matters without any "up-front" costs to the client. If they cannot afford the fees of a private lawyer they should be referred to an alternate source or to the

Articles of Incorporation 5201 The formal document that has to be filed with the Secretary of State to create a private corporation. The referral category is ANew Business Advice.@ A lawyer may suggest that a Limited Liability Company, a Limited Partnership, a Subchapter S corporation or some other business form would make more sense to the client. We are usually interested in finding out what the nature of the business is so that we can refer someone familiar with that type of business if possible.

Assault & Battery(Civil) 0802 This is an intentional act. The NY statute of limitations is one year against the person who actually hit the plaintiff. Keep in mind that although the time period is short against the actual batteror, potential defendants in a negligence (3 year SOL) action include: Defendant's employer (negligent hiring, training, supervision), defendant's parents (negligent entrustment of motor vehicle, guns, etc.) supplier's of liquor or drugs (dramshop), supplier/manufacturer/; pharmacist for prescription medication (inadequate warning, improper dosage, etc). For a lawyer to handle a tort (civil action for damages) on a contingency basis, there must be injury and a defendant who is not indigent or has some insurance that may at least apply to related causes of action, or is acting on behalf of an employer, or was negligently placed in a position to do harm by a financially responsible entity.

A proceeding to hold property usually for the payment of a judgment.

Attest legal term

Signing your name as a witness to the execution of a document.

Aviation Accidents 0811 If involving small planes a number of the people we have listed are pilots and some teach flying. Check notes.

Bad Debt legal term

A debt which is not collectible and is therefore worthless.

Bad Faith Breach of Contract 0500 The breach of a contract (usually an insurance contract) in a willful, dishonest way when the meaning of the contract is clear and the ability to comply with it is present.

Bad Faith Insurance Issues 0500 Failing to honor an insurance contract in bad faith. This may include refusal to represent the insured, refusal to settle when a reasonable offer has been made and the insured is likely to be personally liable for a larger amount if the case is not settled.

Bailment legal term

delivery of personal property in trust.

Bankruptcy 1500 Grouping

Legal process to allow debtor to start fresh by allowing him to keep certain property that is exempt and paying back creditors as much as possible from non-exempt property. Once debts have been "discharged in bankruptcy" they are no longer owed by the debtor. If the debtor is a person who has mainly unsecured debts such as credit cards, and little or no assets, the case should be referred as a Small Personal Bankruptcy (1504).

Includes discipline/termination. Make sure the client knows that the teacher's union is obligated to represent them and they should at least talk to their union representative. Private attorneys who handle these matters usually require a retainer which is applied against an hourly rate. If they still want the referral, okay. Sometimes (rarely) the union can be made to pay the attorneys fees for failure to represent the employee. Even, in such cases, the private lawyer will usually require a retainer and if successful against the union can reimburse the client.

Breach of Contract 0103 02050210

First, as always, find out what happened. Generally 0103(collections) is for cases against individuals and 0205 (commercial litigation is for disputes between businesses. If it is a very substantial matter and may involve remedies other than just the payment of money, refer as 0210 (complex litigation). If contract refers to an area of law with a more narrow listing, such as "employment contract (0209), Insurance, Entertainment Law (1400) or Intellectual Property (0900), Real Estate (1,000), Computer Law (0905) you should consider combining with, or making the

Broker's Commission Litigation 1010 RE Broker claims to have produced a ready, willing and able buyer and wants commission even if seller backed out of deal. Or, broker claims exclusive listing and seller found buyer without help of broker and broker is claiming commission.

Business Advice, GeneralBusiness Formation

201 Setting up corporations, partnerships, Limited Liability Companies, new businesses of any type. Both start-up and general advice. If problem is particular to a certain industry, check notes for knowledge about that industry or check secondary categories.

Business Bankruptcy Chapter 11 1501 This is the reorganization of a business under the bankruptcy code. It stays all lawsuits and collection activities for a period and the bankruptcy court can exercise jurisdiction over all lawsuits & claims. The lawyers we have listed who handle these matters are highly experienced and retainers can be $10,000 and up.

0205 (commercial litigation is for disputes between businesses. If it is a very substantial matter and may involve remedies other than just the payment of money, refer as 0210 (complex litigation). Buying & Selling Businesses 0504 Get some idea of the type of business and the amount involved to make an appropriate referral. Everyone on this panel has handled at least 5 such transactions. Keyword search can identify particular businesses

Car Accidents 0801 Find out whether there has been a physical injury and whether there is a likelihood that such injury will exceed No-Fault limits. To bring a case that is not prohibited by the No-Fault Statute (NY Ins... Law '5102(d) plaintiff must show that s/he has suffered a serious injury. Serious injury id defined as: (1) death; (2) dismemberment; (3) significant disfigurement; (4) fracture; (5) loss of a fetus; (6) permanent loss of use of a body organ, member, function or system; (7) permanent consequential limitation of use of a body organ or member; (8) significant limitation of use of a body function or system; and (9) a medically determined injury or impairment of a nonpermanent nature which prevents the injured person from substantially all of the material acts that constitute such person=s usual and customary daily activities, for not less than 90 days during the 180 days immediately following the occurrence of the injury or impairment.

1003 The difference between a co-op and a condo is that in a co-op the buyer is buying shares in the co-op corporation and gets a proprietary lease to the apartment. Co-op boards have an almost absolute right to reject a potential buyer, unless the rejection is based on a constitutionally or statutorily protected class (race, religion, age, disability).

Consider whether the situation sounds like a consumer matter, bankruptcy or straight collection or commercial litigation. Is there a defense or is it just a financial problem?

Commercial Paper 0101 A negotiable instrument. A signed, unconditional promise or order to pay a certain sum on demand or at a specific time, made payable to order or to the bearer. A check, certificate of deposit, etc.

Commodities 2000 The cases we refer include broker/customer disputes, fraud, RICO & similar investment loss matters.

Computer Law 0905 Review, preparation or breach of contracts for sale or development of software and hi-tech equipment

Condemnation 1011 The process of taking property by the government for public use. The property owner is entitled to the fair market value. Similar issues arise when the government changes zoning laws that restrict the use or access to property and may render it valueless.

Condominium (buying & selling) 1003 The owner of a condominium has a property right in that apartment and is therefore free to sell it to anyone. No board of directors has to approve the sale the way they would for shares in a cooperative apartment.

Conservatorship 0405 A proceeding, usually in surrogates court that appoints a person to manage thee affairs of someone with property who is incapable of managing their own affairs.

Construction Contracts 0102 The lawyers on this subpanel are also very familiar with mechanic's lien issues and remodeling contracts.

Constructive eviction 3201 A tenant may be considered constructively evicted if the property is substantially unfit for occupancy and this is in the control of the landlord. Creditors' Rights (Bankruptcy) 1505 This refers to people who are owed money by a person or business that files bankruptcy. A claim must be filed with the bankruptcy court. To file the claim, a lawyer is not required. To oppose the discharge of the debt because of fraud, a lawyer is usually needed.

Customs & Tariffs 1802 Extra costs on goods being imported or exported according to the classification of the goods and the countries involved. Notes must say "customs & tariffs"

Defamation (Libel or Slander) 0803 False remarks that tend to damage the reputation of someone. The questions for the referral counselor are related to damages and whether there is a viable defendant (i.e., one with money). Full Faith & Credit legal term

Trade Secret Litigation 0906 A trade secret is any formula, pattern, machine or process of manufacturing used in a business which may give the user an advantage over its competitors who do not know or use it. This includes confidential business information and customer lists. The owner must prove that the idea or item was held in strict secrecy and that it was obtained by others through fraud or other unfair means. Once a trade secret is discovered by analysis or any other proper method, the discoverer is free to use it.

Trademark 0901 Any word, name, symbol or devise used by a merchant or manufacturer to identify his or her goods and to distinguish them from goods manufactured or sold by others. This category is for registration and monitoring of the trademark. Refer under 0906 for infringement or unfair competition. A trademark may be protected without federal registration, but it is more difficult and proving damages are a problem.
