Giving immigration adviceWhat is immigration advice?Immigration advice is:

• Using your knowledge of or experience in immigration to advise, direct, assist or represent another person in regard to a New Zealand immigration matter (whether or not you get paid)

Immigration advice is not:

• providing information that is publicly available or that is prepared or made available by Immigration New Zealand

• carrying out clerical work, translation or interpreting services, or settlement services

• Helping the student complete the form, as long as they are answering the questions themselves

Giving immigration advice Who can give immigration advice? Only licensed immigration advisors, unless exempt

As an education agent you are exempt and can give advice only if:

• You are outside New Zealand and you advise on student visas only

As an education agent you are not exempt, and therefore must be licensed if:

• You are in New Zealand, even if you only advise on student visas or

• You advise on work, visitor, residence, or any other immigration matters, in or outside New Zealand.

Student Visa Requirements Offer of place: Include evidence of English language ability to demonstrate the student meets entry requirements (not applicable to some courses like English language or school students)

Bona fides: INZ needs to be satisfied that study is the primary purpose of applying for a student visa; that the student will not breach the conditions of their visa and will depart NZ at the expiry of their visa if required (some may apply for, and be granted further visas)

Health: chest x-ray is required from some students intending a stay in NZ of six months or more (if they could have been exposed to TB by nationality or travel history). All students must hold appropriate insurance while they are in NZ

Character: police certificates from the home country (and any other countries they have lived in for more than five years since turning 17) if the student will be studying in NZ for 2 or more years

Student Visa Requirements Tuition fees: Tuition fees need to be paid in order to have the visa granted. For students applying from overseas, they can pay these after the visa is Approved in Principle (AIP) but this does add time to the visa process.

Funds: a flight ticket out of New Zealand (or extra funds to buy one) and funds to look after themselves while studying (NZD $15,000 per year or NZ$1,250 per month if the programme is less than 36 weeks).

IMPORTANT: INZ must be satisfied that the funds are genuine, stable and will be available to the student. INZ does assess the source of the funds and the history of funds.

Translations: ALL financial documentation (except bank transaction records) that are not in English must be provided with English translations.

Student Visa ProcessingStudent visas are now processed in three main locations:Mumbai, Palmerston North (NZ) and Beijing.

INZ is receiving a high volume of applications Students should apply at least 8 weeks ahead of the date they want to travel. Don’t leave it until the last minute!

Complete applications submitted Online will be processed faster

Below are the percentage of visa decisions we have made within 10/30/60 days. These are for applications submitted out of NZ

Student Visa Application TipsApply online using the Immigration Online systemSubmit complete applications INZ still receives a lot of incomplete applications. Make sure the documentation is complete and all sections are filled out – such as the education and work historyGive us evidence and translated informationProvide evidence to back up information. If there is work history declared, include evidence such as pay slips or a letter from the employer. Make sure documentation is in English or if it is in a foreign language, it must be translated to EnglishStatement of Purpose/Cover letter The student should be explaining why they want to study the course and what their plans are for the future. Include any relevant evidence.

Student Visa Application TipsFundsEvidence of funds and explaining the source of funds as well as relationship of the applicant with the sponsors (if relevant). Recent deposits or credits, to be explained with supporting documentation.

If studying for more than one year – details around payment plan for the other years, how does the student’s family plan to fund year 2 or 3 ?

Immigration history If a student has been declined a visa from another country this must be declared and they should include the decline letter so that INZ can view this information

Education/work gapsIf there are gaps, explain these. Do not create false records to fill gaps.

Working while studyingPart time work – 20 hours per weekMost students are allowed to work for up to 20 hours each week

Students cannot “bank” their hours. They cannot work 10 hours one week and 30 hours the next week

Work during vacationStudents on longer courses can also work full time during vacations throughout the year

Work during summer Many students will also be able to work full time over the summer vacation

Working after study – post study work visaChanges were made in November 2018, which make post study work visas easier to understand and use. No job offer is required.

* As a transitional arrangement, students who study their full qualification outside of Auckland will be eligible for a two year open work visa if they complete their studies before 31 December 2021.

Applying for a Post Study Work VisaStudents need to apply within 3 months of the student visa expiry (or 6 months if they are a PhD)

They will need to prove $4200 funds (include evidence of any lump sums)

They will need to complete full medicals, which they can do in NZ

They may have additional police certificates to apply for

They will need to have been awarded their qualification, or have evidence from the education provider that they have met the requirements of the qualificationhttps://www.immigration.govt.nz/new-zealand-visas/apply-for-a-visa/visa-factsheet/post-study-work-visa

If a student has completed a course that does not make them eligible for a PSWV, such as a level 5 certificate in cookery, they can apply for other types of work visas; for example an Essential Skills work visa but there are other requirements that they must meet.

Electronic Travel Authority (ETA)ETA

On 1 October 2019, visa waiver (visa free) travellers who previously just boarded a plane to travel to New Zealand, will now need to hold an ETA before they travel to New Zealand.

The ETA will cost NZD$9 for mobile app requests and NZD$12 for website requests

An ETA will last for two years and can be linked at the time of application to multiple passports

An ETA should be applied for at least 72 hours before travel

There are some people who wont need an ETA – such as NZ or Australian citizens or people who already hold a NZ visa.

International Visitor Conservation and Tourism Levy (IVL)IVL

From 1 July 2019, the IVL will be payable at the same time as people pay for their visa or ETA

The IVL will cost NZD$35 and will be automatically added to the ETA or visa cost

Travellers only pay the IVL when they apply for a visa or ETA. If their visa allows multiple entry, they won’t need to pay an IVL each time they travel on that visa.

There are some exemptions, particularly for Australians and people from most Pacific Island countries

The money raised by the IVL will be invested in key landscapes/destinations to redevelop congested areas and/or unlock new sustainable opportunities (both for tourism and conservation)

The ETA or visa application will automatically assess if someone has to the pay the IVL

• International students should continue to enrol at any of New Zealand’s ITPs with confidence, knowing that our education and immigration systems will continue to support them with their study – whatever form our ITPs take.
