ICCRC AND CAPIC TO COOPERATE ON STRENGTHENING CONSUMER PROTECTION

Memorandum of Understanding Signed to Collaborate on Obtaining Self-Regulation under Federal Statute

The Immigration Consultants of Canada Regulatory Council (ICCRC) and the Canadian Association of Professional Immigration Consultants (CAPIC) agreed to cooperate on obtaining statutory authority to allow for better regulation of the immigration consulting profession. The chair of ICCRC and president of CAPIC Board of Directors signed the MOU on November 3, 2016.

ICCRC is the national body mandated to protect the public by regulating immigration consultants, and welcomes the agreement with CAPIC. “It is important that we establish partnerships with stakeholders to achieve these vital goals,” said Chris Daw, newly elected Chair of ICCRC. “While our designated mandate by government is to protect consumers, and CAPIC’s mission is to advocate on behalf of its members, our objectives intersect with a common commitment to strengthen the immigration consulting profession.”

CAPIC believes that self-regulation under federal statute will improve consumer protection and provide a better legal framework. “I welcome the initiative,” said Donald Igbokwe, President of CAPIC. “I believe this is a precedent in the immigration consulting industry where both the regulatory body and the professional association identify consumer protection as their top priority and agree to work together to build it.”

Currently, the Immigration and Refugee Protection Act (IRPA) delegates the designation of regulating immigration consultants to the federal minister of immigration. By obtaining statutory authority, protecting the public would be significantly strengthened as ICCRC’s mandate would be written into an Act of Parliament. Statutory authority would grant legislative powers to regulating immigration consultants, and provide greater investigative parameters with more rigid rules for professional conduct and enforcement.
