Veterans from the Nottawaseppi Huron Band of the Potawatomi participated in the 59th Annual Armed Forces Day Luncheon, now renamed The Military Appreciation Luncheon and Awards, sponsored by the Battle Creek Chamber of Commerce, held Friday, November 13 at FireKeepers Casino Hotel.

Bodéwadmi drum family Southern Straight performed, as did the Cereal City Concert Band.

“Southern Straight added greatly to the events of the day,” Chamber Chair of Military Affairs, T.R. Shaw Jr. said. “I would like to see that group be an annual participant.”

“The event, which is usually held in May for Armed Forces Day was moved to November this year due to worldwide threats,” Shaw said. “Although the date was changed, we still had a great turnout of well over 300 people.”

Contract Health ServicesContract Health Services is funded through a grant from Indian Health Services. It is to help pay for medical services not offered through the NHBP Health Clinics.

What I should know: Contract Health is not a health insurance, it is a grant. Funds are limited and based on medical priorities. Contract Health does not guarantee payment.

Who is eligible for Contract Health Services? NHBP Tribal members living in the 7 county CHSDA; Allegan, Barry, Branch, Calhoun, Kalamazoo, Kent and Ottawa counties of Michigan. NHBP descendants under the age of 19. A non-Indian woman pregnant with an eligible Indian’s child for the duration of her pregnancy through postpartum (6 weeks).

What will CHS pay for? CHS may help pay for medical/dental services outside of the NHBP Health Clinics if referred by one of NHBP’s providers. CHS may help pay for vision services. CHS may help pay for prescriptions.

How do I get CHS to pay for these services? Provide notification through Contract Health prior to any service outside the NHBP Health Clinics. Notify contract health within 72 hours of an emergency room visit. Complete your CHS registration paperwork information yearly. A letter will be mailed to you when you need to update your information. If your yearly

registration requirements are not met, you will not be approved for funding. Apply for Medicaid or alternate resources if you do not have health insurance when applying for Contract Health. If you need help applying for Medicaid, please call Chris Woodring at 616.514.3638.

Enrollment for the Nottawaseppi Huron Band of the Potawatomi is currently closed to new Members. Pending applications will not be approved for Membership until enrollment is open. Also, at this time we are not accepting new applications.

High School Diploma or GED: If you have recently graduated from high school or received your GED from a certified test site, please send a copy of the document to the Enrollment Office. This information is used for per capita distributions.

Bereavement Benefits: The Bereavement Benefit program was adopted in January 2012. The Bereavement Benefit consists of $10,000 to pay funeral costs for enrolled NHBP Tribal Members. If you have not completed a Bereavement Beneficiary form or have questions, please contact the Enrollment Office. This form designates the beneficiary for your bereavement benefits.

The following is the Education Requirement from the NHBP Revenue Allocation Plan:

In order for an eligible Member between the ages of eighteen (18) and twenty-one (21) years of age to receive a per capita payment directly, such Member must submit to the Enrollment Office or Tribal Council, one of the following:

a copy of his/her high school diploma,

a copy of his/her degree or certificate equivalent to a high school diploma,

documentary proof of satisfactory completion of high school degree-equivalent home schooling requirements for the member’s state of residence, or

a certification from an accredited school or schools that the member has learning or other disabilities and has attended a full twelve years of school.

The appropriate diploma, degree, or certification must be submitted to the Enrollment Department before any particular eligible Member within this age group may have his/her per capita payment mailed to him/her. If such copy is not submitted in a timely manner, the per capita payment for such Members shall be deposited in the Member’s minor trust account.

Korbin TenBrink: Baseball All-StarSubmitted by Mark DeLap, Communications Specialist

Korbin TenBrink, son of Tribal Member Derek TenBrink, is a fifth grade baseball star from Muskegon and was selected to represent the GAMEDAY USA All-Star 10 and under team at the 2015 ESPN World Wide Sports Disney Classic held in Orlando, Florida, December 30 to January 2.

The steps that got him to Orlando were very difficult.

To be selected for such a prestigious opportunity, a player must be a participant in a GAMEDAY USA baseball tournament and then must be selected by the opposing team as a single-game Most Valuable Player. This qualifies the player to go on to play in the GAMEDAY USA All-Star game, where a GAMEDAY USA scout must personally select the player to represent GAMEDAY in the Disney Classic.

TenBrink played this past summer on a traveling baseball team called the West Michigan Riptide, which played in a GAMEDAY USA Super Regional baseball tournament in Holland, Michigan, where he received his MVP tag from the opposing team at the end of the championship game. TenBrink went 2-for-2 with a walk, and pitched the final four innings giving up only one hit, zero runs, and had 9 strikeouts to help his team hold on for a 6-4 victory.

TenBrink then went on to participate in the GAMEDAY USA All-star event at the Art Van Complex in Rockford, Michigan, where he performed very well in the skills competition and had one of his best weekends of hitting during tournament play. He went 11-for-12 with two walks.

“I believe this is what made him stand out,” Derek TenBrink said. “He is not the big homerun hitter, but makes solid contact with the ball almost all the time and got a few lucky breaks that helped.”

TenBrink worked out twice a week to get ready for the Disney tournament after being notified in September. As a serious athlete, he was very excited about the opportunity to focus and ready himself for the tournament, but as a serious 10-year-old, he was equally as excited to see Disney World for the first time.

Myra Day-Franklin Promoted to EVS ManagerSubmitted by Ruby Smith, FireKeepers Casino Hotel Tribal Development Coordinator

FireKeepers Casino Hotel is proud to share in the excitement of a recent promotion of Tribal Team Member, Myra Day-Franklin. Day-Franklin started her journey with FireKeepers more than six years ago as a Team Member who assisted in making the property the best in the Mid-West as an EVS Attendant. Day-Franklin has worked very hard and met each of her challenges with a great attitude, passion and perseverance to succeed. As an EVS Attendant, Day-Franklin put in extra time to receive her education in order to accept new responsibilities within FireKeepers and moved into a Lead position later followed by becoming an EVS Supervisor! Day-Franklin started her new role as an EVS Manager on December 1, and is happy to share her success story with our Tribal Membership.

“It’s been a six year journey working from entry-level to reaching my career goals. I have a passion for my job and if you have a passion in something, you will succeed,” Day-Franklin stated.

Myra has put in many hours into her development by completing the Track I and II Programs, became a Dale Carnegie Graduate, and most recently received her Competent Communicator award in ToastMasters on December 1 as well. Myra has always been respected by her peers and team and it was shown when she was selected as the Supervisor of the Quarter in 2014.

Day-Franklin stated that she could not have done this alone and she gives credit to her supportive team, training opportunities, great mentorships and the pride in furthering her Tribe. Not only did Day-Franklin thank those working with her on a daily basis, but also thanked those individuals from Human Resources that have helped her throughout

her career from day-one to those supporting her today.

On behalf of Human Resources Tribal Development Team, we would like to congratulate Myra on setting a great example to our Tribal Membership on what hard work, dedication, and determination to meet your goals can accomplish. On November 18, both the Northern and Southern NHBP Elders met in Grand Rapids to go to dinner and a movie. The day started with the Elders stopping at Logan’s Roadhouse in Grandville for lunch. The Elders enjoyed their meal at Logan’s Roadhouse and then it was off to Celebration! Cinema RiverTown. Once at the theater, the Elders selected a movie and some popcorn. It was a split decision as half of the Elders selected the family drama “War Room” while the other half chose the latest action packed James Bond film, “Spectre.”

The youth enjoyed the animated comedy, “Hotel Transylvania 2,” at the Celebration! Cinema Grand Rapids North. The Youth didn’t go out to dinner but were also treated to a full concession stand, which included personal flat bread pizzas that were delivered right to their seats in the movie theater. It was a great end to their long school week leading into their holiday break!

Keeping women and babies safe and healthy has always been an honorable and expected way of life for Anishinabe people.

Maajtaag Mnobmaadzid is a program designed to assist women and their families in that journey.

What Does Maajtaag Mnobmaadzid Have To Offer? • Home or office visits by a Maternal Child Health Nurse and/or Family Health Worker.

• Services based on the particular needs of each family.

• Health and developmental assessments including vital signs, infant height and weight and infant growth and development.

• Assistance in obtaining needed infant supplies, housing, and community resources.

• Support, advocacy and referrals.

• Health and parenting education.

• Depression screening and referrals.

• Women, family and community events.

• Transportation to medical and social service related appointments when no other means are available.

Who Is Able To Participate? • Any NHBP Tribal member or Tribal member’s direct descendant, living within Allegan, Barry, Branch, Calhoun, Kalamazoo, Kent or Ottawa counties (Contract Health Services Delivery Area), and who is;

E Nearly 50 NHBP Tribal Members made the long trip to Washington, D.C., over the first weekend in December to participate in the Quilt Walk for Justice in front of the Supreme Court as the high court heard oral arguments in a case that threatens Tribal Sovereignty and the right of all Tribes to protect women and children on Tribal Land.

The case – Dollar General Corporation v. Mississippi Band of Choctaw Indians – concerns whether the Mississippi Band of Choctaw Indians’ Tribal Court may exercise its inherent civil jurisdiction over tort claims filed in Tribal Court against a non-Indian corporation. A Dollar General Employee Supervisor allegedly sexually assaulted a young Choctaw intern working in the store that Dollar General leases from the Tribe on Tribal lands.

By asking the Supreme Court to overturn the Fifth Circuit Court of Appeals’ decision affirming Tribal jurisdiction,

Dollar General is in essence asking for the end of all Tribes’ civil jurisdiction over non-Indian conduct on Tribal lands.

Native and women’s rights groups worry that a ruling for the Dollar General could end the last remaining legal protection that enables Native women to seek justice for sexual violence perpetrated by non-members in Tribal courts.

The Supreme Court is expected to issue a ruling on the case this summer.

After the Quilt Walk, many of the NHBP demonstrators traveled to FedEx Stadium to protest the offensive mascot name of the Washington football team.

Am I a Resident Tribal Member?A “Resident Tribal Member” defined in the Tax Agreement is a Tribal Member whose principal place of residence is located within his or her Tribe’s Agreement Area.

The Tax Agreement the Tribe negotiated with the State of Michigan designated sections of Calhoun County and Branch County as the “Tax Agreement Area”. Tribal Members whose principal place of residence is located within the “Tax Agreement Area” are eligible for certain tax exemptions that would typically only apply to Tribal Members who live on Reservation or “trust” lands. These Tribal Members are referred to as “Resident Tribal Members”. In order to qualify for Resident Tribal Member exemptions you must be on the official list of “Resident Tribal Members”. This means you must have a current address on file with the Tribe’s Enrollment Office that is within the Tax Agreement Area. The list of Resident Tribal Members on file with the Michigan Department of Treasury is updated by the Tribe every month. Please try to keep the Enrollment Department informed of any change in your address. Tax Benefits for Resident Tribal MembersThe following is a list of some of tax benefits that are available to Tribal Members who live in the Tax Agreement Area:

• Exempt from Michigan Income Tax for wages/salaries/per capita payments/dividends • Can apply for a refund of MI Income Tax withheld when you file your State Income Tax Return.

NOTE: Non-wage or salary income derived from business activities is subject to different treatment. Please consult your tax professional.

• Exempt from Michigan Sales/Use Tax on your home utility bills (i.e. gas, electric, cable, propane). • If Michigan Sales/Use taxes are showing up on your utility bills, please contact Rebecca Griffin at the Tribal Office. Provide Rebecca with a copy of your bill/invoice from your gas/electric/propane, telephone, cable/satellite, and cellular phone providers. We can then follow up with Michigan Treasury representatives to work to get the taxes off future bills.

• Refunds of Sales/Use Tax for Certain Purchases: • If you have purchased a new/used vehicle, boat, snowmobile, trailer, you are eligible for a refund of all or 50% of the Michigan Sales/Use Tax paid when you purchased/registered the title. In order to qualify, the car/truck, boat, snowmobile must be used for

If a non-NHBP Member spouse or other person is listed as co-owner on either your Title or in your financing documents, you will only be entitled to receive a refund of 50% of the tax paid. • Additionally, if you are planning to build a new home, addition to your home or perform other significant repairs/improvements to your home, you may be eligible to apply to receive a refund of the sales/use taxes paid on building materials and fixtures (i.e. windows; water heaters; furnaces). ♦If one of these situations applies to you, or if you are contemplating making one of these purchases/undertaking one of these projects, please contact Rebeca Griffin and she can assist you in determining whether you do/will qualify for a refund and how to apply.

• Motor Fuels/Tobacco Tax Purchases: • Motor Fuels: Just a reminder: If you have not registered the vehicles in your household (the ones you fill up with tax exempt motor fuels) or if you have purchased a new vehicle, please remember to get a Registration for Tribal Member Tax Exemption Form to Rebecca. If you no longer own a vehicle that was registered for tax exempt fuel purchases, please contact Rebecca to have the vehicle removed from the list. The Registration for Tribal Member Tax Exemption Form is available online at www.nhbpi.com in the pull down menu under “For Our Support” in the “Legal” section (bottom of page). ♦The Tax Agreement requires the Tribe (and the cashiers at gas stations) to maintain the log book that has your name, Tribal ID, license plate number and signature. Please cooperate with station personnel in completing the log and be respectful. They are doing what is legally required and the Folk Oil/Convenience King station owners, and their staff, are providing this service to the Tribe and its Members. If their staff is disrespected, they have every right to suspend/terminate this service and Tribal Members may lose the ability to purchase tax exempt motor fuels. • Tobacco Products: Finally, a number of Tribal Members appear to be purchasing cigarettes for

others. Please be aware that exempt tobacco products can only be purchased for personal use by Tribal Members. Purchasing tax-free cigarettes for non-Tribal Members is illegal. If you are purchasing cigarettes for another Tribal Member relative, please contact Rebecca Griffin to obtain a Limited Power of Attorney form. ♦The Tribe is obligated to monitor and enforce the restrictions on sales of tax exempt tobacco products and tax exempt motor fuels. If abuses are occurring and allowed to continue, the State of Michigan could terminate the Tax Agreement and all of these benefits could be lost.

On February 21, 2013, NHBP Tribal Council approved an Enforcement Program on the Tax Exempt Motor Fuel and Tax Exempt Tobacco Products Purchases. Tribal Members making purchases that are in violation of the NHBP Title X-03 - Sale of Tobacco Products Code and NHBP Title X-04 - Motor Fuels Sales Code, may have their purchasing privileges suspended and/or penalties assessed.

The Tribal Council is seeking input from NHBP Tribal Members to determine if a request should be made to the State of Michigan to make changes to the Tax Exempt areas (the “Tax Agreement Area”) located in portions of Branch and Calhoun counties. NHBP Tribal Members whose permanent residence is located within a tax exempt area of Branch County or Calhoun County are eligible to qualify for Resident Tribal Member status per the Tribal/State Tax Agreement.

Charts on the opposite page represent Tribal Member’s residences in both tax exempt and non-tax exempt areas in Calhoun and Branch counties as of April 28, 2015. Since there are a number of areas currently included in the Tax Exempt area that have no Tribal Member residences, the Tribal Council is considering making a request to the State of Michigan to “trade out” those areas for survey sections where Tribal Members currently reside or areas to which Tribal Members are interested in moving to.

Waséyabek Development Company, LLC (WDC) is proud to announce James (Jimmy) A. TenBrink as Director of Operations. TenBrink previously served on the Waséyabek Board of Directors and acted as the board liaison to Skasgé Power, LLC (Skasgé).

TenBrink will be responsible for day-to-day company operations and implementation of strategic and annual operational plans, with a special focus on its subsidiary, Skasgé. After an open solicitation, review and interview process, TenBrink was selected as the most qualified applicant, and as a Tribal Member, was the only tier one candidate. We are very excited to have someone of his caliber join our team.

TenBrink brings a long history of entrepreneurship and business experience to WDC. After graduating from Michigan State University, he purchased his first company in 2005 and the small distribution business grew into four other businesses. After successfully selling three of them, Jimmy focused his time on mentoring young professionals and continuing to operate his manufacturing business.

“The opportunity to serve my fellow Tribal Members, doing something I absolutely believe in and love, is amazing,” TenBrink said. “As a Member of this Tribe and father of three Tribal Members, creating opportunities now and for the next seven generations is very important to me. Our Tribe has overcome so much; it is truly special to continue to add to our rich history.”

Skasgé, in conjunction with FireKeepers Casino Hotel recently completed the installation of a 35,000-gallon water storage tank. This tank increases the hotel’s ability to provide solar heated water to its guests, as well as its laundry service during the nighttime hours. During this project, Skasgé provided general contracting services on a brine system upgrade, allowing FireKeepers to soften their water more efficiently.

“Although we have lost a thoughtful, articulate Board Member, we have gained a committed leader with extensive business experience who has a vested interest in the successful performance and growth of the company,” WDC Board Chair Terri Fitzpatrick commented.

On December 5 and 6, female NHBP Members and employees, and community members had the opportunity to participate in R.A.D. – Rape Aggression Defense Systems – Basic Physical Defense for Women at the Pine Creek Community Center.

Sponsored for the last three years by the NHBP Tribal Police Department, the class is taught by Sergeant Kristen Main and Officer Ryan Pedley. The pair volunteered for their R.A.D. instructor training to bring this valuable course to the Tribe.

“The class provides the Tribal Community with an education-based program that helps develop skills in preventing sexual assault,” Pedley said. “I volunteered because it was an opportunity to give back to the community.”

The course began with bookwork, outlining the definitions of self-defense and covering topics important to self-defense and the law. The four risks of personal safety – risk awareness, risk reduction, risk recognition, and risk avoidance were covered with tips and tricks that can be put into place by anyone.

The physical part of the program calls for practice of blocking, striking back with hands and feet, and

techniques to break an aggressor’s hold. The final part of the program built confidence by allowing participants to suit up and practice all the techniques in lifelike simulations.

“I feel more confident just going through the program,” NHBP youth McKenna Burlingham said. “I could avoid a bad situation now and get out of it if I can’t.”

“I think every single female, from our young women to our elderly women, should go through this class,” NHBP Member Robyn Burlingham said.

NHBP’s commitment to the safety of its Membership is evidenced by the fact that this class is the only R.A.D. session in the state of Michigan that is available to participants free of charge.

“I think self-defense for women is incredibly important,” Main said. “I am pleased that we are given the opportunity to offer this class to our community. We are the only police department in Calhoun County that does so.”

During the enrollment audit, Sandy Blair provided strong support to the Enrollment Committee by following up with Tribal Members on all requested documents. She provided constructive suggestions and anticipated challenges.

Blair demonstrates a great deal of care for Tribal Members. She makes every effort to accommodate their schedules whenever they ask for a notary public or a replacement Tribal ID card.

Blair is flexible and cooperative and is always willing to assist when needed. She often covers the front desk, assists the Communications Department with mass mailings, and volunteers for various NHBP events.

Blair not only responds in a very timely manner to requests from other departments and agencies, but also is versatile in her duties, which can include the preparation of mailing labels, spreadsheets, demographic information reports and ICWA enrollment verifications.

Sandy Blair handles her responsibilities well, and should be recognized and congratulated for her hard work and dedication.
