    Proposed amendments to the Codified Rules for Student Regent Selection

    (CRSRS)

    Here is a summary of the proposed amendments of the CRSRS, as submitted to the Office:

    On qualifications

    Include a minimum academic requirement as a qualification for Student

    Regent nominees;

    On voting

    One Council, One Voteand One Student, One Vote in the Student

    Regent selection;

    On general provisions

    Three-year effectivity clause; and

    Other provisions

    Elective representatives per unit to the OSR, in lieu of appointments.

    Included herewith are the (1) updated and official copy of the Codified Rules for Student

    Regent Selection or CRSRS and (2) the official communications containing the proposed

    amendments to the CRSRS of UP Diliman College of Social Sciences and Philosophy

    Student Councils, UP Diliman University Student Council and UP Diliman Law Student

    Government, all received last 1 October 2014.

    Please be reminded of the deadline set for the proposed inclusions in the agenda as well

    as proposed resolutions for the Assemblys consideration set on 4 and 12 December, 5PM,

    respectively, so they may be included in the Agenda.

    CODIFIED RULES FOR STUDENT REGENT SELECTION

    The Student Councils of the University of the Philippines System hereby1

    promulgate the rules hereunder, governing the democratic selection process for2

    the Member, Representing the Student Body in the Board of Regents, hereinafter3 referred to as the Student Regent (SR) as mandated under Republic Act4

    Numbered Ninety-Five Hundred, otherwise known as the "University of the5

    Philippines Charter of 2008".[3]6

    ARTICLE I7

    Definition of Terms8

    SECTION 1.Any position of responsibility shall include officers and committee9

    chairpersons in any student or community organization as well as members,10

    officers and committee chairpersons in any University or College Student Council.11

    SEC 2. The General Assembly shall mean the University and College Student12

    Councils in the UP System.13

    SEC 3.The Regional Units (RU) of the UP System are the following:14

    UP Diliman Extension Program (UPDEP) in Pampanga15

    UP Manila School of Health Sciences (SHS) in Baler, Aurora16

    UP Manila SHS in Palo, Leyte17 UP Manila SHS in Koronadal, South Cotabato18

    UP Visayas Tacloban College19

    SEC 4.The Autonomous Units (AU) of the UP System are the following:20

    SEC 5.The Office of the Student Regent (OSR) refers to the incumbent Student28

    Regent, the secretariat and the OSR volunteers.29

    SEC 6. A bona fide student of the university means an individual taking up30

    academic units for bachelor's degree, master's degree, doctorate degree, non-31

    degree, or certificate courses in the university, including those who are in32

    residency status or on leave of absence (LOA).33

    SEC 7.Majority refers to the least whole number greater than 50% of all the34councils system-wide.35

    SEC 8.Majority vote refers to the least whole number greater than 50% of the36

    total votes of all the councils present and voting.37

    SEC 9.Protester refers to the party who files protest against a particular nominee,38

    or against the result of any deliberation or process.39

    SEC10.Protestee refers to the party being protested.40

    ARTICLE II41

    Statement of Principles and Policies42

    SEC. 1.The Student Regent must be democratically selected among all students43

    in the UP System through a peaceful and orderly process that ensures maximum44

    student participation.45

    SEC. 2.The selection process must be conducted in a manner consistent with46

    the principle of broad and open participation of students in all levels regardless47of race, gender and sexual orientation, political ideology and affiliation, academic48

    standing, social status, ethno-linguistic origin, age physical abilities and religious49

    affiliation.50

    SEC. 3.The selection of the Student Regent is exclusively a student affair. The51

    administration and other sectors in the University are prohibited from interfering52

    with the process by conducting interviews, administrative investigations or in any53

    other manner inconsistent with this principle.54

    SEC. 4. Consistent with the preceding section, the endorsement of the UP55

    President to the President of the Republic of the Philippines of the nominee/s56

    entertain nor endorse any name aside from those deliberated and selected by the58

    students in the manner consistent with these rules.59

    SEC. 5. Controversies and protests regarding the selection shall be resolved60

    through the internal mechanisms provided hereunder.61

    ARTICLE III62

    Qualifications of the Nominees63

    SEC 1.A nominee for the position of the Student Regent must meet the following64

    qualifications:65

    (a) S/he must be a student currently enrolled in the university at the time of66

    his/her nomination;67

    (b) S/he should have an accumulated residency of at least one year, which68

    would include periods of residency and/or leave of absence;69(c) S/he must be a Filipino citizen and;70

    (d) S/he must have a track record reflective of his/her commitment to serve71

    the studentry.72

    SEC. 2.No disqualification on the basis of good academic status or standing or73

    performance shall be imposed on the nominees.74

    SEC. 3.Grounds for disqualification shall be imposed on nominees found guilty,75

    at any time within his/her stay in the university, including periods when the76 nominee is under leave of absence, prior to the proclamation of the Student77

    Regent, of any act involving gross misconduct or misbehavior, violence inflicted78

    towards another person or any property that is not his/hers, dishonesty, graft and79

    corruption, or any criminal offense involving moral turpitude.80

    SEC. 4.Questions against the qualification of a nominee shall be filed at the OSR,81

    or any officer and/or member of any UP student council. Such questions shall be82

    resolved before the deliberations when the system-wide process begins. The83

    decision of the GA is final.84

    ARTICLE IV85

    Nomination, Acceptance and Withdrawal86

    SEC. 1.Any student, group, or organization may nominate a student from any87

    college of any of the Autonomous or Regional Units of the UP System who has88

    the qualifications set forth above. Open nominations by any student or student89

    group/organization/council shall be held in every college in the UP System under90

    the supervision of the College Student Council (CSC) or, in the absence thereof,91

    the University Student Council (USC).92

    In cases wherein a CSC and USC nominate a candidate for SR93

    Committee (UC) which will be composed of students from different years95

    or courses or different year level or department as the case may be.96

    SEC. 2.Upon written notice of his/her nomination, a nominee must file and sign97

    the certificate of acceptance (CA) of the nomination with the CSC or USC within98

    two (2) weeks from the release of such notice or until the date set forth by the99 Search Committee.100

    SEC. 3.Each CA must be accompanied with a vision statement, curriculum vitae101

    or rsum and bio data. Any material misstatement of facts is a ground for102

    disqualification at any stage of the selection process.103

    SEC. 4.The nominee must furnish the Search Committee at each respective level104

    with his/her rsum and vision paper for the Office of the Student Regent at least105

    five (5) days before each respective deliberation except as otherwise provided106

    under these rules.107

    SEC. 5.The nominee of any student group / organization / council may not be108

    withdrawn at any level of the search without the consent of the nominee who has109

    validly accepted the nomination.110

    SEC. 6.In cases when a student is nominated in more than one unit, s/he must111

    undergo the search process in each of those units; otherwise, s/he must accept112

    only one of the nominations. The search committee concerned must furnish the113

    OSR a certification that such a nominee underwent the process as required.114

    ARTICLE V115

    Duties and Responsibilities116

    SEC. 1.The Office of the Student Regent will serve as the overall coordinating117

    body during the selection process. It shall have the following duties and118

    responsibilities:119

    (a) It shall inform all the student councils of all official communications120

    pertinent to the process through memoranda, personal orientation and121other similar means.122

    (b) Support information drive on the historical vision-mission of the Office and123

    the historical role of the students in the struggle to reestablish the OSR and124

    in the selection process;125

    (c) Serve as the General Assembly Secretariat during the system-wide126

    selection process for the SR. The Secretariat shall, among others, facilitate127

    and moderate the deliberations, provide all the student councils of the128

    minutes of the selection process and receive protests.129

    (d)

    Form the University Search Committee (USC) in the event that the USCs130 are unable to form the said committee in their respective unit.131

    (d) Must conduct an open, public and college-wide deliberations with the173

    nominees and, at the discretion of the CC, at least one non-binding straw174

    poll among the constituents of the college;175

    (e) May promulgate rules and regulation supplemental but not inconsistent with176

    these rules for the smooth, orderly and peaceful conduct of the Search;177

    and178 (f) Conduct their deliberation(s) on the nominees and vote for at most two (2)179

    official nominee(s) for the college.180

    SEC. 3.The official nominee(s) of each college shall be decided upon by each181

    respective CC taking into consideration the result of the straw poll(s), if any, and182

    college-wide deliberations(s).183

    SEC. 4. The list of the nominees and the name(s) of the official college184

    nominee(s) shall be submitted to the University Student Council (USC) for the185

    Autonomous University-wide selection. In the absence of the USC and in the case186of colleges in the regional units, the list of nominees and the name/s of the official187

    nominee/s shall be submitted directly to the OSR for the System-Wide selection188

    without passing through their respective AU selection process. Each CSC shall189

    attach an official endorsement for their official nominee/s.190

    SEC. 5.All protests shall be made in writing stating the reasons therefor and filed191

    with the CC, and furnishing a copy thereof to the other party, within five (5)192

    working days upon receipt of notice of the result of the deliberations or elections,193

    as the case may be. The protester shall only be allowed to file once either before194 the College level or the Autonomous Unit level.195

    SEC. 6.Such protest shall be decided within five (5) working days after they are196

    received. Failure to resolve the matter within the required period resolves the197

    protest in favor of the protestee. The protest shall be resolved by a unanimous198

    decision of the CC, if possible. When the CC decides unanimously, such decision199

    is final and unappealable. In the case of non-unanimity, majority vote of those200

    present and voting in the CC shall decide on the matter. In such case, the protest201

    on the same ground may be evaluated as an appeal during the AU process. Such202

    appeal must be received by the USC and CC concerned two (2) working days203before the AU process provided no AU process can be held within two days after204

    College-Wide deliberations.205

    ARTICLE VII206

    Autonomous University-wide Process207

    SEC. 1.The USC shall be responsible for gathering pertinent data, such as bio-208

    data, rsum, Curriculum Vitae, and the like, regarding the nominees for the CC.209

    It may summon the college nominees for interview and for other purposes. No210 other nominee shall be considered except those nominated by each college211

    through the CC or the USC as the case may be212

    SEC. 2.The USC and CSC shall act as the University Search Committee for the213

    Student Regent, referred to as the University Committee (UC), which shall be214

    composed of the members of the respective USCs and the Chairpersons of the215

    CSCs or any other duly elected college representative in case they are not216

    constitutionally part of the CSC.217

    SEC. 3.The UC shall have the following powers and functions:218

    (a) Has control and supervision of the conduct of the Search in its level;219

    (b) Must conduct information drives and publicity campaigns on the Search;220

    (c) Must decide appeals from the CC decision concerning the college-wide221

    process, decide pre-deliberation or pre-election controversies, questions222

    of qualifications and other matters arising from the interpretation of these223

    rules and on the conduct of the Search in its level;224

    (d) Must conduct open, public and college-wide deliberations with the225

    nominees and at the discretion of the UC, at least one non-binding straw226poll among the constituents of the college;227

    (e) Shall conduct their own deliberation(s) on the nominees and vote for at228

    most two (2) official nominee(s) of the AU;229

    (f) Shall decide before the AU deliberations proper on the appeals from the230

    decisions of the CCs. Such decision is final and unappealable; and231

    (g) May promulgate rules and regulations supplemental but not inconsistent232

    with these rules for the smooth, orderly and peaceful conduct of the233

    Search.234

    SEC. 4.The two (2) official nominees of each AU shall be decided upon by the235

    UC taking into consideration the result of the straw polls, if any, and the AU-wide236

    deliberation/s.237

    SEC. 5.The list of the nominees and the name/s of the official AU nominee/s238

    shall be submitted to the OSR for the System-Wide selection. Each USC shall239

    attach an official endorsement for their official nominee/s.240

    SEC. 6.All protest shall be made in writing stating the reasons therefor and filed241

    with the UC, and furnishing a copy thereof to the protestee, within five (5) working242days upon receipt of notice of the result of the deliberation or elections, as the243

    case may be.244

    SEC. 7.Such protests shall be decided within five (5) working days after they are245

    received. Failure to resolve the matter within the required period resolves the246

    protest in favor of the protestee. The protest shall be resolved by a unanimous247

    decision of the UC, if possible. When the UC decides unanimously, such decision248

    is final and unappealable. In the case of non-unanimity, a majority vote of those249

    present and voting in the UC shall decide on the matter. In such case, the protest250 on the same ground may be revived as an appeal during the System-wide251

    process Such appeal must be received both by the OSR and the USC concerned252

    prescribed period for appeal, the same can no longer be entertained at any level.254

    SEC. 8.The nominees must submit their Vision Paper and GPOA to the Office of255

    the Student Regent fourteen (14) calendar days before the System-wide selection256

    provided no system-wide deliberations shall be held within fourteen (14) days257

    after the AU/RU process.258

    SEC. 9.The OSR and the USCs shall provide the Vision Paper and GPOA to all259

    SCs at least ten (10) working days before the System-Wide process, including all260

    protests pertaining to the nominees that were forwarded to the OSR.261

    ARTICLE VIII262

    System-wide Process263

    SEC. 1.A majority of all student councils system-wide shall constitute the quorum264

    of the GA, sanctioning the system-wide process of the Student Regent selection.265

    SEC. 2.The General Assembly (GA) of all UP University and College Student266

    Councils of all Autonomous and Regional Units shall deliberate on the AU and RU267

    nominees, with the incumbent Student Regent as the Presiding Officer.268

    SEC. 3.The first order of business for the said deliberation shall be the reading269

    of the Codified Rules for Student Regent Selection by the incumbent Student270

    Regent, subsequent vote of reaffirmation thereof by the majority of the GA, and271

    the deliberation on the protests and appeals elevated to the system-wide level, if272 any.273

    SEC. 3.1The college representatives who are not officially part of the CSC274

    must be recognized to be part of the CSC and may vote in behalf of the275

    CSC provided that they have written authorization.276

    SEC. 4.All the protests and/or appeals shall be read by the presiding officer and277

    immediately be resolved by the majority of the GASC after a deliberation thereon.278

    The GA shall resolve protests and/or appeals from the decisions of the UC. Such279

    decision shall be final and unappealable.280

    SEC. 5.After the individual presentation of the nominees with their vision paper,281

    GPOA and an open forum following such, the GA shall vote for the final three (3)282

    nominees by raising of hands or secret balloting depending on the prerogative of283

    the assembly. The presiding officer shall declare the final three nominees who284

    received the highest number of votes from the AUs and RUs present and voting.285

    SEC. 6.The three nominees shall then be subjected to further questioning by the286

    GA.287

    Consensus building shall take priority over division of the house in288

    SEC. 8.In the event that no consensus is reached, the three nominees shall be290

    subjected to further deliberation/s until a nominee garners two-thirds vote of all291

    AUs and RUs present and voting. After which, s/he shall be subjected to a final292

    deliberation to receive the mandate of the GASC.293

    SEC. 9.The incumbent Student Regent shall declare the selected nominee of the294

    GASC in the UP System for the Student Regent.295

    SEC. 10.The votes during the System-wide selection shall be allotted as follows:296

    SEC. 11.No individual student or group or student council is allowed to nominate309 any student directly to the Office of the UP President or the Office of the President310

    of the Republic of the Philippines. All nominations must be submitted and311

    deliberated in the process as herein provided.312

    ARTICLE IX313

    General Provisions314

    SEC. 1.The Student Regent-select must resign from any position of responsibility315

    in any student or community organization and/or student council and student316

    publication.317

    SEC. 2.The Student Regent-select must not be permanently disqualified from318

    the University. However, the Student Regent-select is advised to file a leave of319

    absence (LOA) to devote his/her time in the fulfillment of his/her duties and320

    responsibilities.321

    SEC. 3.The dates and periods pertinent to the selection process in the college,322

    AU and system levels shall be fixed by the OSR with the consent of all the USCs323

    and regional units.324

    These rules shall be amended or repealed through the majority vote of all325

    to the OSR not later than the first (1st) day of October.327

    SEC. 5.These rules shall take effect immediately upon approval by at least a328

    majority of all student councils present and voting.329

    SEC. 6.Failure to attend or to send a representative with written authorization to330 the GASC for the presentation of proposed amendments during the system-wide331

    selection forfeits the right to vote in the processes of amendment and selection,332

    respectively. However, they shall still be bound by the results of the said process.333

    SEC. 7.Upon vacancy of the position of the SR-select or the incumbent SR due334

    to permanent disqualification from the university, incapacity to enroll or file an335

    LOA the following semester, death, illness or any other cause which prevents336

    him/her from discharging functions, the position shall be filled by the second337

    selected nominee, or the third nominee if the latter cannot assume the position.338

    Article VIII: System-wide Process

    Section 5. After the individual presentation of the nominees with their vision paper, GPOA an

    hands or secret balloting depending on the prerogative of the assembly. The presiding officer

    shall declare the final three nominees who received the highest number of votes from the

    Section 8. In the event that no consensus is reached, the three nominees shall be subjected to

    further deliberation/s until a nominee garners two-thirds vote of all UNIVERSITY STUDENT

    COUNCILS AND COLLEGE STUDENT COUNCILS OF THEAUs and RUs present andvoting. After which, s/he shall be subjected to a final deliberation to receive the mandate of the

    GASC.

    SECTION 9. IN THE EVENT THAT NO NOMINEE GARNERS TWO-THIRDS OF TH

    VOTES CAST, THE TWO NOMINEES WITH THE HIGHEST NUMBER OF VOTES

    SHALL BE SUBJECTED TO FURTHER DELIBERATIONS. IF THERE SHOULD BE

    NO CONSENSUS AS TO WHO SHALL BE SELECTED, VOTES SHALL BE CAST

    AND THE NOMINEE GARNERING THE HIGHER NUMBER OF VOTES SHALL BE

    PROCLAIMED AS THE NEXT STUDENT REGENT.

    SECTION 10. THE INCUMBENT STUDENT REGENT SHALL DECLARE THE

    SELECTED NOMINEE OF THE GASC IN THE UP SYSTEM FOR THE STUDENT

    REGENT.

    SECTION 11. THE VOTES DURING THE SYSTEM-WIDE SELECTION SHALL BE

    ALLOTTED AS FOLLOWS:

    PRACTICABLE ITS CONSTITUENT COLLEGE/S AND/OR DEGREE-GRANTING

    INSTITUTE/S WITHOUT EXISTING RESPECTIVE STUDENT COUNCIL/S, IF

    THERE BE ANY SUCH CONSTITUENT COLLEGE/S AND/OR DEGREE-GRANTIN

    INSTITUTE/S, AND THEREBY CARRY ITS/THEIR ONE (1) BASE VOTE EACH

    DURING THE GASC FOR SR SELECTION.

    SECTION 12. NO INDIVIDUAL STUDENT OR GROUP OR STUDENT COUNCIL IS

    ALLOWED TO NOMINATE ANY STUDENT DIRECTLY TO THE OFFICE OF THE

    UP PRESIDENT OR THE OFFICE OF THE PRESIDENT OF THE REPUBLIC OF TH

    PHILIPPINES. ALL NOMINATIONS MUST BE SUBMITTED AND DELIBERATED

    In line with Article IX Section 4 of the Codified Rules for Student Regent Selection (CRSR

    the College of Social Sciences and Philosophy (CSSP) Student Council of the University of

    Article II: Statement of Principles and Policies

    Section 2. The selection process must be conducted in a manner consistent with the principle o

    broad and open participation of students in all levels regardless of race, gender, and sexual

    orientation, political ideology and affiliation, [academic standing,] social status, ethno-linguis

    origin, age, physical abilities and religious affiliation.

    Article III. Qualifications of the Nominees

    Section 1. A nominee for the position of the Student Regent must meet the following

    qualifications:

    a) S/he must be a student currently enrolled in the university at the time of his/her nomination;

    b) S/he should have an accumulated residency of at least one year which would include period

    of residency and/or leave of absence;

    c) S/he must be a Filipino citizen [and];

    d) S/he must have a track record reflective of his/her commitment to serve the studentry

    The University Student Council (USC) stands as the highest representative

    institution of students of the University of the Philippines-Diliman. The USC

    represents the students within and outside the university and has the proud and

    historic tradition of active involvement in the struggle to defend the rights and

    interests of the students and the Filipino people.

    Having been informed of the deadline of the submission of proposedammendements for the Codified Rules on the Student Regent Selection, the UPD

    USC has decieded to forward three proposals. Attached is the document

    containing our proposals with the rationale behind them.

    Looking forward for the discussion of these during the General Assembly of

    Student Councils.

    UP DILIMAN UNIVERSITY STUDENT COUNCIL

    The UP Diliman University Student Council, standing as the highest elected representatives of thestudents of the University of the Philippines Diliman, highly proposes ammendments for the

    Codified Rules on Student Regent Selection (CRSRS). The overaraching rationale behind these

    proposals is to democratize the process of the selection and maximize the power of true

    representation. As the USC, we see that these measures should be taken for the Office of Student

    Regent to be able to maximize its power backed by by support from the student body it supposed to

    represent.

    Proposed Ammendments of the UP Diliman University Student Council:

    1.One Council, One Vote

    The CRSRS, in its current form, employs the selection process where votes are distributed in

    a certain manner across autonomous and regional units. We see that this is in no way democratic.

    The worth of every student being represented is not proportional across the UP system. To provide

    solution for this, we are proposing that a One Council, One Vote selection process be observed as

    opposed to the old mechanism. We see that the presence of the student councils in the General

    Assemmbly of Student Councils (GASC) should be maximized and this is one way to do that.

    To say that this measure would give rise to Diliman-centrism when it comes to the selection

    of the Student Regent is an act of undermining and underestimating the capacity of the elected

    student-leaders from the Diliman campus. History would show us that implementation of such

    proposal does not entail a Diliman SR automatically.

    2.Minimum Academic Requirement

    At present, no academic requirement is required of any SR nominee. As Iskolars ng Bayan,

    we should give due priority to our studies. We see that in the pursuit of progressive changes the SR

    wants, academic excellence should not be forgotten. We reiterate that the academic requirement

    we propose is the bare minimum a student should be able to fulfill --basic retention rules -- prior

    his/her nomination. We see, too, that this proposal would eliminate the chance of having an SR

    removed from office due to academic delinquency. College councils and University Student Councils

    have this similar requirement prior to being allowed to run for office and we see that the SR should

    not be exempted of such policy being the true representative of the student body.

    3.Three-year Effectivity Clause

    Ultimately, we want a clause that will secure the ammendments that will be adopted. This isto test the effectivity of such policies. A period of three years would guard the CRSRS from being

    Codified Rules For Student Regents Selection (CRSRS), wishes to submit to your

    office, its proposals for amendment to the current CRSRS. Enumerated below are the

    intended amendments we wish to propose:

    1. The addition of an elected unit representative to the Office of the Student

    Regent, in lieu of appointments

    2. Amendment to Article VIII (Procedure for voting)One student, one vote

    system in the election of the Student Regent and other elective officials.

    This proposed amendments are to be discussed and elaborated further by our

    representatives during the delibration process at the upcoming GASC.
