    D R A F T .

    A N ORDINANCE TO AMEND THE CULTIVATORS (PROTECTION) ORDINANCE.

    B E IT ENACTED by the High Commissioner for Palestine, with the advice of the Advisory Council thereof : —

    1. This Ordinance may be cited as the Cultivators (Protection) Short title. (Amendment) Ordinance, 1941, and shall be read as one with the Cultivators (Protection) Ordinance, hereinafter referred to as the Cap. 40. principal Ordinance.

    2. Section 21 of the principal Ordinance shall be renumbered as section 21(1), and shall be amended by the addition of the fol-lowing subsection thereto, as subsection (2) :—

    "(2) Nothing in this Ordinance shall apply to State Domain land or to any holding situated thereon."

    Amendment of section 21 of the principal Ordinance.

    O B J E C T S A N D R E A S O N S .

    This B i l l excludes Government owned land (State Domain) from the provisions of the principal Ordinance (Cap. 40). There are over one million dunums of State Domain in Palestine, and (unlike the case of privately owned land) it is virtually impossible for Government to prevent the acquisition of rights of cultivation, graz-ing, etc. under the principal Ordinance by trespassers, — rights which, though acquired after a brief occupation without the knowledge or consent of Government, are acquired for all time (unless compensated for) and may seriously interfere with the development of the land to its best productive capacity (an important factor in war-time) or, in the case of forest land, with its effective afforestation. It is the object of Government to utilise its land in the best interests of the community as a whole, and the exclusion of State Domain from the provisions of the principal Ordinance will enable this to be done, as the main object will no longer have to be subordinated to the necessity of protecting rights of trespassers which have been artificially acquired by unauthorised occupation of the land for so short a period as one year. Recognition, however, will continue to be given to claims which Govern-ment considers to be reasonable, where the rights claimed are being exercised in good faith.

    Communication with Prisoners of War Interned I Abroad. I

    I It is notified for information that parcels I

    cannot be despatched by members of the Public , direct to prisoners of war.

    2. Parcels of food, clothing, soap and tobacco weighing ten pounds (approximately four and a half kilogrammes) are despatched from the United Kingdom regularly to every British, Colonial, Dominion and Palestinian prisoner of war by the Prisoners of War Department of the British Red Cross Organisation, London.

    3. These parcels are sent at the cost of ten shillings (five hundred mils) per parcel, and contributions towards defraying this expen-diture will be gratefully accepted. Such con-tributions should be sent to the Accountant, Prisoners of War Department, St. James Palace, London, S.W.I., or to the British Red Cross, 206 Bath Street, Glasgow, C.2.

    4. In addition, " N e x t of K i n " parcels for prisoners of war may be sent not more fre-quently than once quarterly through _ the medium of the Joint Organisation of the British Red Cross and Order of St. John in Jerusalem. Ful l particulars of this service can be obtained on application to: —
