Once the permanent sources of revenue are obtained the Discreationary Fund fund balance advance shatl revert to its original source.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHARLOITE, NORTH CAROLINA, THAT:

Section 15-3 of the Clty Code shall be rewritten to read as follows:

"Sec. 15-3. Same--C&oq possession of open container; disposal of containers.

(a) Defnitiw. The following detinitions shall apply for the purposes of this section and section 15-2:

Public street &dl meaa any highway, road, street, avenue, bouIevard, or other way within and under the hecontrol of the city and open to public use, including the sidewalks of any such street.

Beer shall have the same meaning as the tenn "malt beverage" as defined by Chapter 183 of the North Cataha General Statutes.

Wine shall have the same meaning as the term Wortifled wine" as defined by Chapter 18B of the North Caroih Q e n d Statntes.

Open container shall mean a contahz that has a broken seal or a container other than the manufbtuds unopened original container.

(b) Consumption inpublic. Except as pmitb3 in subsection (f) herder, no person shall consume any beer or wine upon or within the limits of my public street or s i d e d in the hecity.

(c) Conrumption onprivat~premises. It shall be unlawhl for any person to consume qny wine or beer upon theprivate business premises of another without permission of the oowner or person in control of such premises.
