Non-travelling:

U14 Spikes™ and U12/U13 JumpStart® teams

Non-travelling U14 Spikes™ and U12/U13 JumpStart® teams will be capped at 10 players

maximum and will practice twice a week for 90minutes each during the 8 months season

starting October 5th 2020 to May 21st 2021 (break between December 18th and January 6th)

These teams will be entered into: 2 Spikes™ Colorado Series tournaments, one to two Saturday

scrimmages with other club teams or another one to two Spikes™ Colorado Series tournament. Costs

include:

- 8 months of coaching, practice and training as per published Calendar/schedule on our website.

- Entry fees and coaching in 2 Spikes™ Colorado Series tournaments

- Entry fees and coaching in either: one to two Saturday scrimmages with other club teams or another one

to two Spikes™ Colorado Series tournament if available.

- 1 team practice t-shirt

- 1 team jerseys, 1 pair of team spandex shorts, 1 pair of team socks and 1 team bag.

Total: $1699 (includes $350 deposit – Balance due first practice day in October: $1349

Grand Total all-inclusive for the 8 months 2020/21 season: $1699*

*Existing players from the 2019/20 season re-registering for the 2020/21 season will

receive a 28% discount making the all-inclusive cost for the 8 months season at: $1224.

Additional discount of $50 for returning players keeping and using last season’s gear.

Replacement gear will be available for purchase if needed.

Travelling Spikes™ Z teams

Travelling Spikes™ teams will be capped at 14 players maximum and will practice twice a

week for 90 minutes each during the 9 months season starting October 5th 2020 to May 21st

2021 (break between December 17th and January 6th) .

local tournaments/scrimmages will serve as conditioning & prep. to the AAU 48th Girls Junior Nationals

tournament held in June 2021 at ESPN World of Sport & the Convention Center Orlando Fl. (dates TBA).

Costs include:

- 9 months of coaching, practice and training as per published Calendar/schedule on our website (October

to June incl.).

- Entry fees and coaching in 2 Spikes™ Colorado Series tournaments and one to two Saturday scrimmages

with other club teams or another one to two Spikes™ Colorado Series tournaments.

- 2 team practice t-shirts, 2 Team Jerseys, 2 pairs of team spandex shorts, 2 pairs of team socks and 1

team bag.*

Total: $1749* (includes $350 deposit – Balance due first practice day in October: $1399

ADD the 7 days trip to AAU National tournament (dates TBA) that includes team entry fees, flights,

transportation to and from airport, transportation to and from accommodation/venue, accommodation,

all meals: breakfast, lunch, diner, 1 to 2 team chaperone(s) and coach $1099.

Grand Total all-inclusive for the 9 months 2019/20 season: $2848 - players AAU membership

$16 will be required too.



Additional discount of $75 for returning players keeping last season’s gear. Replacement

gear will be available for purchase if needed.

2020/21 Season Agreement I/we understand that team selection is at the sole discretion of Spikes™ llc and JumpStart®

Volleyball Academy’s Director and that selection into one of the Spikes™ travelling team will

have added costs of $1099 associated with the June 2021 AAU 48th girls Junior Nationals held in

Orlando, FL.

Players will NOT be allowed to tryout nor enter

the gym on tryout dates without having provided

the academy with the following: NO EXCEPTIONS

1) A non-refundable deposit check payable to Spikes llc for the amount of

$350. Tryouts are free and this deposit is placed towards one of the slots available for

each team. Should your player make a team this deposit will be cashed in after July 2nd

and only the season fees less this deposit will be due at first practice day in October or

November. This check will of course be send back to you via mail at the latest on July

16th if your player is not selected in any of our teams.

2) The following Code of Conduct and Participation Agreement duly initialed and

signed by: player and both parent/guardians (mother and father).

3) The following waivers signed by both parents/guardians.

Important note:

trying out and making one of our teams requires full commitment from players and parents alike towards our coaching staff, team mates and other parents. We require therefore, from all players a minimum of 90% practice attendance outside of illness and/or injury. Falling below this practice attendance rate will result automatically in reduced game time participation at tournaments.

SPIKES™LLC AND THE JUMPSTART™ VOLLEYBALL ACADEMY

CODE OF CONDUCT & PARTICIPATION AGREEMENT

The Responsible parties (players and both parents/guardians) must initial each paragraphs. By placing your initials for each paragraph represents that you have read, agree, accept and understand the information provided in this Code of Conduct and participation agreement.

1. Participation Spikes™ and the Jumpstart® Volleyball Academy (JVA) accept participation applications from individuals without regard to race, creed or national origin. 1.1 Spikes & JVA will make the sole determination whether an athlete is accepted to play on a team (Participant), the amount of fees payable by the Participants of each team, the supervision or expulsion of Participants, and all other matters relating to being on a team at Spikes & JVA. Spikes & JVA reserves the exclusive right to assign a Participant to a team, to change a Participant from one team to another, to assign a coach to a team, and to change a coach from one team to another, as it sees fit.

1.2 90% attendance to practice and training outside of injury or illness is required and strictly enforced. Failure to meet this requirement will automatically lead to dramatically reduced game and tournament playing time.

2. Fees and other charges 2.1 Responsible Party. The parent or guardian who signs this Participation Agreement (Responsible Party) is liable for any and all fees, dues, and charges for goods and services incurred by the Participant. By signing this Agreement, the Responsible Party accepts this liability and agrees to be bound by the terms of the Agreement The liabilities for all Participants having a same parent or guardian, regardless of which parent or guardian signs as the Responsible Party, will be treated as one account for the purposes of this Agreement.

2.2 Responsible Party understands, accepts and agrees that fees paid are solely for practices and training NOT for game play or tournament time. Game play and tournament time is provided as and when by Spikes & JVA free of charge.

2.2 Fees. JVA will determine the amount and payment terms for fees. The obligation to pay stated fees is not dependent on the availability of JVA's facilities or assignment to a specific team. Failure by JVA to conduct a specific number of practice sessions or to compete in a specific number of tournaments, for any reason whatsoever, will not reduce or suspend the Responsible Party's obligation to pay stated fees.

2.3 All fees are published at least 4 months before the season start date. Final payment of the

full remaining balance is due on the first day of team practice.

3. Termination of participation Spikes & JVA reserves the right to terminate this Agreement at any time that Spikes & JVA, in their sole discretion, determine the Participant or the Responsible Party has failed to comply with any of the rules, code of conduct and regulations adopted by Spikes & JVA, or for conduct Spikes & JVA determines to be improper or contrary to the fundamental purposes of Spikes & JVA or inimical to the best interests of Spikes & JVA.

4. Waiver of liability. 4.1 Assumption of Personal Risk. Participants, or Responsible Parties for a Participant, expressly agree that a Participant's use of Spikes & JVA facilities and involvement in Spikes & JVA sponsored activities and events are at the Participant's own risk. Neither Spikes nor JVA are liable for any injuries or any damages to any Participant arising out of such use, activities and events or subject to any claim, demand, injury, or damages whatsoever, except that which is the result of gross negligence or wanton misconduct by Spikes & JVA' its assigns, employees, directors, or officers.

4.2 Assumption of Property Risk. Spikes & JVA ae not responsible for or liable to a Participant for articles of personal property damaged, lost or stolen in or about Spikes & JVA facilities or during any activities or events. Neither Spikes nor JVA are responsible for or liable to a Participant for loss of or damages to any Participant's property including but not limited to automobiles and the contents thereof.

4.3 Agreement Not to Sue. Participants, or Responsible Parties for a Participant, expressly agree not to sue Spikes nor JVA or its assigns, employees, directors, or officers. Participants, or Responsible Parties for a Participant, expressly agree to indemnify and hold harmless Spikes & JVA, its assigns, employees, directors, and offices from any claims made or liabilities against them as a result of the Participant's actions.

5. Rules and regulations. The rules and regulations included in this Code of Conduct and Participation Agreement may not be all inclusive. Spikes & JVA may make amendments to its rules and regulations from time to time. On all questions regarding the interpretation of an application of Spikes & JVA rules and regulations, the decision of the Head of Spikes LLC is final.

6. Cancellation and refund policy. The Responsible party may cancel this Agreement if: a. Spikes & JVA goes out of business. b. The Participant becomes disabled or so severely injured while playing or practicing with Spikes & JVA that she cannot practice or compete for more than 5 months. (The Participant must provide proof of a disability by furnishing Spikes & JVA with a written statement from a medical doctor certifying the disability). c. In the event of the Participant's death. If Spikes & JVA receives a valid cancellation notice, Spikes & JVA will return any unused portion of paid fees to the Responsible Party within 14 days. Spikes & JVA may retain portion of the fees that is equal to the proportionate value of the services, use of facilities, equipment, registration, and travel fees the Participant has already received from Spikes & JVA. JVA will not cancel this agreement, refund tuition, or refund travel fees to any individual due to the individual voluntarily leaving a team for any reason.

7. Payment terms Fees are due in full prior to first team practice day, no exceptions. Spikes & JVA does not provide financing of any kind.

8. Code of Conduct. 8.1 Sportsmanship is MANDATORY at all times for ALL participants their parents, families and spectators. Any unsportsmanlike conduct as defined by Spikes™ llc and the JumpStart® Volleyball Academy is grounds for immediate and permanent dismissal from its programs, without notice or refunds.

8.2 I WILL display good sportsmanship at all times to all people.

8.3 I WILL bring any concerns or suggestions to the organization in a professional and respectful manner, NEVER approaching staff or management in a hostile or disrespectful manner.

8.4 I will NOT contact, harass and/or intimidate any official directly or indirectly, but instead I will take all concerns regarding officials to my team/club owner or head coach.

8.5 I will NOT speak to my child’s coach directly (in person, by phone or via email) within 24 hours of any games for ANY reason.

8.6 I will NOT criticize my child’s coach or his/her teammates whilst my child is enrolled in the academy.

8.7 I will NOT coach my child from the bleachers and/or sidelines, and I will always encourage my child and team, regardless of the outcome on the court.

8.8 I WILL direct any issues to the Head of the Jumpstart® Volleyball Academy ONLY and I accept without reservation that comments to others in or outside gyms or other venues whilst my child is enrolled in any of the academy’s program (including officials, coaches, and other spectators) is violation of the Spikes™ and Jumpstart® Volleyball Academy Code of Conduct.

8.9 I WILL clean up my trash, spills, containers, and belongings before I leave Spikes & JVA’s facility or any venues hosting my child and I WILL keep children who come with me SUPERVISED at all times.

8.10 I understand and accept that volleyball is a team sport where players’ individual skills are used and called upon for the benefit of the team and therefore play time is varied, mostly fair fair but NEVER equal.

8.11 I WILL NOT criticize or comment on my child’s coaching with anyone whilst my child is enrolled at the academy furthermore I understand and agree that this would be ground for my child immediate dismissal from team and academy without notice or refund.

8.12 I understand and accept that any meeting I request about my child’s team role or play time will be responded to by Spikes & the JVA’s Head and/or Head coach only to decide whether my child remains in the academy program or not.

8.13 I understand and hereby agree that unsportsmanlike conduct of any type as defined by Spikes™ and the JumpStart® Volleyball Academy is grounds for immediate and permanent dismissal from its programs, without notice and without remuneration.

8.14 Other than a “force majeure” situation, I understand that missing practice the week prior to a tournament will forfeit participation in that tournament, NO exceptions.

WAIVER AND RELEASE OF LIABILITY AGREEMENT FOR MINOR PARTICIPANTS

READ BEFORE SIGNING!!

In consideration of my child/ward being allowed to participate in any way in the Spikes™ and JumpStart® Volleyball Academy programs and its related events and activities, the undersigned acknowledges, appreciates, and agrees that:

The risk of injury to my child/ward from the activities involved in these programs is significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and I FOR MYSELF, SPOUSE, AND CHILD/WARD, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my child/ward’s participation; and, I willingly agree to comply with the program’s stated and customary terms and conditions for participation. If I observe any unusual significant concern in my child/ward’s readiness for participation and/or in the program itself, I will remove my child/ward from the participation and bring such attention of the nearest official immediately; and, I for myself, my spouse, my child/ward, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS the Jump Start™ Volleyball Academy, its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“Releases”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property incident to my child/ward’s involvement or participation in these programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. I, for myself, my spouse, my child’s/ward, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releases from any and all liabilities incident to my child’s/ward involvement or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

CONSENT TO TREAT AGREEMENT

Your child’s participation in this special activity is voluntary, and there are some special considerations and procedures which apply. Your written consent at the bottom of this form is necessary for your child to participate. Participation in activities away from home may potentially involve risks and responsibilities for you and your child that are beyond the scope of those normally associated with traditional functions under your supervision. These may include, for example, personal injury or damage to personal property. We encourage you to inquire in advance concerning the nature and details of any potential risks which will be assumed through participation. By signing below, you acknowledge that you have made yourself aware of any potential risk associated with these activities and that you voluntarily and knowingly assume all such risk.

I hereby give my permission for my child to participate in this athletic activity. I hereby release and hold harmless Spikes™ llc and the JumpStart® Volleyball Academy, it’s director, Board Members, officers, agents, employees, teachers and authorized volunteers from any and all liability, liens, claims, demands, actions or cases of action, whatsoever arising from my child’s participation in the above references athletic activity. I understand that the organization has not purchased any medical/dental/hospitalization or accident insurance covering player for injuries incurred during these activities, and that I must obtain medical insurance coverage for my child.

I, being the parent or legal guardian of my child, give my consent to emergency transportation and the administration of first aid, medical and/or dental treatment. I accept sole responsibility for the payment of any emergency transportation, treatment expenses and any related or subsequent medical and/or dental bills. I also give my consent for emergency medical and surgical treatment in a licensed medical facility by a licensed physician should my child’s condition require it in my absence. I understand that in such a case, reasonable attempts would first be made to contact me, time and conditions permitting. I confirm that my child is in good health and that his/her participation does not pose a hazard to his/her health or that of other participants. As long as the medical or surgical treatment considered necessary in the situation is in accordance with generally accepted standards of medical practice for the particular type of injury or illness involved, I impose no specific prohibitions regarding treatment.

PHOTO RELEASE AGREEMENT

I hereby grant Spikes™ llc and the JumpStart® Volleyball Academy permission to use my child’s likeness in a photograph for the following purposes, without payment or any other consideration: promotional brochures, promotions or showcase of programs on the website/Facebook page, and/or showcase of activities in local newspapers. I understand and agree that these materials will become the property of Spikes and the JumpStart® Volleyball Academy and will not be returned. I hereby irrevocably authorize Spikes™ llc and the JumpStart® Volleyball Academy to edit, alter, copy, exhibit, publish or distribute my child’s photo for purposes of publicizing programs and offerings and other lawful purposes. In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my child’s likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photograph.
