60. The issue involved is:-

NOC for employment in other department

(i.e. Captain with M/s Indigo Aviation), requested by

(i) Sr Capt J S Thind and (ii) Capt Dilbagh Singh of BSF

Air Wing.

61. During Sept 2006, Capt Dilbagh Singh submitted

notice for Voluntary Retirement from service due to no

scope for further promotion/domestic affairs, which was

not accepted by MHA on the recommendation of BSF- due

to acute shortage of Pilots and huge amount spent on

their trg at Paris/Brazil.

62. On 23.03.2007 Capt Dilbagh Singh submitted

another notice for Voluntary Retirement w.e.f.

30.04.2007 due to domestic affairs, which was not

recommended to MHA on the grounds mentioned at

Para 61/N above.

63. Capt Dilbagh Singh has again submitted an

application dated 10.02.2010 addressed to the President

of India for Voluntary Retirement w.e.f. 30 Apr 2010

due to certain domestic circumstances. The officer has

again not given minimum mandatory three months

notice, Disc/Vig Clearance, Service Verification

Certificate and Certificate of Advances etc.

64. IG (Air) has recommended that NOC can be

considered for Sr Capt J S Thind, but, not to Capt Dilbagh

Singh, as he is the only qualified Pilot for the Embraer

Aircraft. Sr Capt J S Thind was earlier flying Avro and

Embraer as a Co-Pilot. Now there are two cadre officers,

qualified on Embraer for the Co-Pilot duties. For Avro,

other two pilot, Sr Capt Dilbagh Singh and Wg Cdr A K

Yadav are available; and one Dy Comdt should become

available for Co-Pilot duties in about one month period.

65. In addition to above, Sr Capt J S Thind will not be

able to fly the Avro Aircrafts, till the completion of

proficiency check, which has become due and not yet

completed.

66. In view of above (Para 60 to 65/N), and

recommendation of IG (Air), following is suggested:-

(a) The NOC may be issued to Sr Capt J S Thind.

(b) Voluntary Retirement Notice of Capt Pilot

Dilbagh Singh be forwarded to MHA stating that it is not

recommended in view of the facts enumerated in

Para 61 & 64/N.

98. I have examined the case in detail and a statement including his GPF and loans is placed in the file at 57/C.

99. From the above statement, it appears that total amount of Rs. 2,99,000/= sent as 12 Bank Drafts is within his total receipts of Rs. 3,22,654/=( i.e. Salary + GPF + Loan amount). However, he has not been able to explain following points:-

a) 12 Bank Drafts have been sent in the name of his wife Smt Champa Devi through civilians.

b) He had withdrawn an amount of Rs. 2, 00,000/= from his GPF account and he intimated that he had not carried the amount of GPF to his home town during his leave period and kept the money in his Kit Box at BOP without informing his senior/superior authority. This is unbelievable besides being contrary to the instructions on the subject to keep money at BOP.

100. In view of above, it is concluded that the amount of Bank Drafts sent by him is disproportionate to his known source of income.

101. IG(pers) has recommended at NSP-51 that in view of his 19 years long service, DG may like to award compassionate allowance to him under Rule 41 CCS(Pension)Rule to the extent of 50% of pension.

102. The above indisciplined act of petitioner involves corruption/amount disproportionate to his known source of income, and invoking Rule-41 to allow the compassionate allowance in the instant case, would set wrong precedence and invite similar requests from other such pers dismissed on the same ground(as many as 25 pers as intimated vide HQ SB Bengal Ftr Sig No. A/4467 dated 25/03/2010 at Page 56/C). Hence the plea of petitioner deserves to be rejected.

The following needs to be further clarified:-

i) The amount of Rs. 2,00,000/= as per the

statement of the DDO which is marked as Exhibit P

in the link file, is shown to be credited to his

account in the month April 2005, whereas as per

NSP 94, it is given in June 2005.

ii) The amount of Rs, 20,000/= as per statement of

DDO have been credited during the month of Feb

2005, whereas, as per NSP/94 the amount was

given to him by HC Devnath during the month of

May 2005, which he had given him as loan in Oct

2004.

iii) Second amount of Rs. 20,000/= is credited to his

pay & Allowances Account in the month of Nov

2005, whereas, as per NSP 94, this money was

taken as loan from CT Somnath. The period has

not been mentioned.

2. In order to clarify the above points, the petitioner may

be asked to send certified copies of his Bank Statements for

the period from Oct 2004 to Feb 2006 of the banks, where his

pay allowances are remitted/relevant transactions made.

98. The following documents in respect of above trial may be called

from the Unit:-

i) Details of Monthly Mess Bill of petitioner from the period

from January 2005 to February 2006.

ii) Details of Monthly Expenditure on account of cell phone if

he was having any, during the period from January 2005 to

February 2006.

iii) The details of amount paid by petitioner as Bank Charges

for preparing 12 Bank Drafts amounting to Rs. 2,99,000/=

which was sent by him during the period from January 2005

to February 2006 through civilians.

May kindly see the Note from Para 1 above regarding the issue of

formal appointment order in favour of Vinod Mahadevi Kamble, candidate

selected for SI(DE) of CPOs examination 2007. Attention is invited in

particulars to Para 4/N at NSP-10 regarding the issue on which criminal case

was registered against him.

23. As mentioned in previous Paras, the individual has not obtained

Discharge Certificate from Karnataka Police and did not divulge the facts of

the case registered against him while joining BSF. The opinion of DIG(CLO)

is at Para 12/N and he has opined as under:-

“ The facts reveal that Shri Vinod Mahadevi Kamble is involved in a

criminal case; his parent department i.e., Karnataka Police has not given

him NOC to join training in BSF and has also declared him deserter. In

such a situation, no appointment order should be issued in his favour

at this stage. It would be rather advisable that Karnataka Police is

asked to take him back for initiating suitable action against him under

the relevant Rules.”

24. In view of above, following is recommended:

(a) No formal Appointment Order be issued in favour of Roll No.

6240185 Shri Vinod Mahadevi Kamble in BSDF as SI(GD).

(b) STC BSF, Tekanpur may be asked to approach Karnataka Police

to take him back for initiating suitable action against him under the

relevant Rules.

122. I have examined the case from NSP 52(Note Sheet Page 9) to NSP 120(Note Sheet Page 18 and sought the additional information to examine the case in totality. I have also examined the statement submitted by the DDO, 105 Bn BSF during the course of SSFC which is marked as exhibit-P (page 45/C in the Link File-SSFC Proceedings).

123. From the above statement, it appears that petitioner had sent total 12 bank Drafts of Rs. 2,99,000/= (one Bank Draft amounting Rs. 9,000/= from March 2005 to May 2005, five Bank Drafts amounting to Rs. 1,12,000/= from June to Aug 2005 and Six Bank Drafts amounting to Rs. 1,78,000 from Dec 2005 to Feb 2006). His messing expenditure during the period was Rs. 7035/=(as intimated by 51 Bn BSF placed at Page 60/C and Rs. 3250/ (Rs.250x13 months) as self maintenance (as per the statement

of PW2 recorded in the ROE placed at Page 65/C in the link file), making total expenditure to Rs. 3,09,285/= His total receipts during this period is Rs. 3,17,654/=( Total Salary Rs. 77,654/=, GPF withdrawal Rs. 2,00,000/=, Loan of Rs. 20,000/= + Rs. 20,000/=) . Though the amount of (Rs. 2,99,000/=) remitted to his wife Smt Champa Devi by Bank Drafts and his messing and his personal expenditure is apparently within his total receipts, yet his he has not been able to justify the following points:-

a) 12 Bank Drafts have been sent in the name of his wife Smt Champa Devi through civilians.

b) He had withdrawn an amount of Rs. 2, 00,000/= from his GPF account and intimated that he had not carried the amount of GPF to his home town during his leave period (15 days C/leave from 13/10/05 to 06/11/05 and 30 days E/leave from 08/11/05 to 07/12/05) and kept the money in his Kit Box at BOP without informing his senior/superior authority. This is not corroborated by any credible evidence besides being

contrary to the instructions on the subject to keep money at BOP.

(c) In the absence of the any credible evidence to believe that GPF amount was kept in his Kit Box at the BOP, the source of 06 Bank Drafts amounting to Rs. 1,78,000/= from Dec 2005 to Feb 2006, has not been established beyond any shadow of the doubt by the petitioner.

(a) COI has assessed his monthly expenditure for self-maintenance as Rs. 250/= per month which appears to be on lower side and the actual amount spent by him apart from his mess bill of Rs. 7035/= (which was not taken into account by the COI) must have been significantly more than this amount. Thus, the total expenditure for the period has to be more than Rs. 3,09,285/= as calculated by the COI and after including his messing bill for the period.

124. In view of above, he has not been able to give any fresh reason for reversing the order of the SSFC.

125. IG (pers) has recommended at NSP-51 that in view of his 19 years long service, DG may like to award compassionate allowance to him under Rule 41 CCS (Pension)Rule to the extent of 50% of pension.

May kindly see the proceedings of the Board of officers, headed by Shri Alexander Daniel, ADG(Ops) on the theme “The proposed organization chart of BSF Air Wing within available resources and connected matters therewith”.

2. The proceedings of the Board are broadly under the following categories:-

(a) The proposed organization chart of BSF Air Wing within available resources and in future to take care of the

regulatory control of BSF Air Wing.

(b) The Board has recommended that ADG(HR) should head the BSF Air Wing with the Fixed Wing and Rotary Wing divided in two separate parts to be headed by one IG(Air) each.

3. MHA has recently signed MoU with MOD, under which one AVM will be responsible for the BSF Air Wing. It is desirable that IG (Air) should have command experience of both Fixed and Rotary Wing fleet, and, accordingly, AVM A P Garud has joined the BSF.

4. ADG (HR) is not a technical qualified person and in the overall interest of the organization, as well as the Air Wing, it is necessary that the entire Air Wing which includes Fixed and Rotary Wing should be under the overall command of one Commander who can give proper technical guidance for the growth, development and maintenance of the BSF Air Wing.

5. The BSF Air Wing has a very small cadre of officers and recommendations of the Board of Officers is for creation of a large number of officers in the DIG and Commandant ranks. This will lead to an imbalance cadre having large number of

senior officers, and, it will not be possible to give promotion to such a large number of senior officers, which will result in stagnation among the officers. In the overall interest of the cadre management, it is essential to have a balanced cadre of officers, for which drafts RRs have been sent to MHA, keeping the above aspects in mind.

6. In view of the above, the recommendations for the organizational structure of the BSF Air Wing may be finalized in consultation with new IG (Air), AVM A P Garud, for proper utilization of the available resources.
