Nothing for Employees in Rail and General Budget

Dear comrade,

Employees get nothing in Railway and General Budget. Railwaymen were expecting a lot from the rail and general budget. The memorandum submitted to Hon’ble Minister for Railways and Railway Board as well as to Finance Minister has gone in vain.

Though Railway Minister has appreciated by saying that he has dedicated workforce of railwaymen but except these words there is nothing for motivation for railwaymen. I do complain about it to Hon’ble MR in person.

So for announcement of bonanzas to users may be a welcome step but how railway will be able to implement it, from where money will come that is not clear in the budget. The railway budget has also endorsed many recommendations of Dr. Vivek Debroy Committee and included them in the budget which will lead to privatization of Indian Railways.

From general budget salaried class in the country had been felt very much astonished because they could not get desired tax relief, on the other hand they slapped tax on PF which raised lot of agitation throughout the country, forced

AIRF’s views on Rail Budget 2016-17

Commenting upon Rail Budget for 2016-17 the General Secretary All India Railwaymen’s Federation Shri Shiva Gopal Mishra said that whatever new announcement has been made to improve upon the facilities for the rail-users like, new coaches for unreserved passengers, facilities of mobile charging in general coaches etc. are praiseworthy. However there is no clear roadmap about regulating the income of the Railway and it appears that a lot of things have been left for Corporate.

He further said that there is no any provision or announcement about improvement in socio-economic condition and working condition of the railway employees who are running this huge organization even by endangering their lives in all odd and climatic condition round the clock, which is disappointing and unfortunate and may generate sense of discontentment amongst them.

NJCA has postponed the strike date to 11th July, 2016 due to election

The NJCA met today and reviewed the discussion in the meeting of Empowered Committee of Secretaries presided by the Cabinet Secretary on 1st March, 2016 where-in the Cabinet Secretary had requested for more time to arrive at conclusions on the charter of demands raised by the Staff Side.

The meeting also considered the situation in the aftermath of the coming into effect of the code of Conduct with the declaration of election schedule in 5 State Assemblies and the fact that there will be polling on 11th April 2016 in West Bengal and Assam.

The meeting, therefore, came to the conclusion that it will not be feasible for us to stick to the date of strike as 11th April 2016. Considering the fact that as per section 22 of the Industrial Dispute Act, 1947 with regard to the validity of the strike notice which is not more than six weeks from the date of serving the strike notice, it was also felt that we may have to revisit the issue of serving the notice for strike afresh.

Considering all the above aspects, the meeting took the following decisions’’

1. The Indefinite Strike shall commence from 6 am on 11th July 2016.

2. The strike Notice would be served on 9th June 2016.

3. Massive demonstrations shall be held in all work place on 11th March, 2016 in support of the Charter of Demands and strike decision.

4. The decision of the NJCA would be communicated to the Cabinet Secretary.

NEWS FROM AIRF’s AFFILIATES

All India Running Staff Conference held in Mumbai

As desired and proposed by All Railwaymen’s Federation, NRMU Central Railway as taken responsibilities to hold the all India Running Staff Conference in Mumbai on 16-2-2016. An elaborate arrangement was done by NRMU to hold the Conference in Shanmukananda Hall. Delegates from affiliated Unions of AIRF reached from nook and corner of the Indian Railways. All the delegates were entertained occasionally by the drum beats of different traditional tunes such as Punjabi and Maharashtrian culture.

The distinguished guests Com. Shiva Gopal Mishra, General Secretary, AIRF, Com. J. R. Bhosle, General Secretary, WREU, Com. A.M. D’Cruze, General Secretary SWRMU, Com. Salil Lawrence, General Secretary, SCRMU Com. Nitin Pradhan, President, NRMU, Com. Arun Manore, Working President, NRMU, Com. P.J. Shinde, Zonal Treasurer NRMU were also present.

In commemoration with 150 birth anniversary of Dr. B.R.Ambedkar candles were lit by these dignitaries. Com. Nitin Pradhan, President of NRMU compiled the proceedings. Com. Venu P. Nair has given the introductory and welcome speech. He interacted the audience with his implacable style of presentation highlighted the issues of Running staff and might of NRMU/AIRF to meet the challenges like a head of the workers in general and Running staff in particular. He exhorted the Federation leadership and the whole audience that the whole Central Railway will stop the movement of trains from the proposed day of strike on 11-4-2016 from 6-00 a.m. as per the scheduled programme of strike. He also ensures that this Union will not bent upon the procedure tactics of the Govt. and Rly. Ministry and will give befitting reply if they try to withdraw the benefits presently enjoying by the Running Staff including Running allowances and mileage.

While concluding his speech he once again reminded about the strength of All India Railwaymen’s Federation and NRMU who got the legacy of struggle and requested them to be united with the Union and discard the activities of splendor groups or associations who does not have any role on formulating or achieving the demands of any category in Railways.

In the mean time, Shri Hemant Kumar, Member, Railway board, Mechanical and CME C. Rly. arrived at the venue was welcomed to the dias promptly felicitated him. Addressing the audience Member Mechanical Mr. Hemant Kumar admitted the strenuous nature of job of Running Staff and suggested to separate mechanism on the issues pertaining to running rooms should lodged in a register for necessary redressal with a time frame.

Thereafter, a motivational speech is given by Com. Rakhal Das Gupta, President/AIRF. He welcomed all the workers reached from different corners of Indian Railways and exhorted that every activist affiliated Unions of AIRF should prepare themselves for the proposed strike called from 6-00 hrs. on 11-4-2016. He shared his vast experiences and outcome of Rly. strike held in the 1960, 1968 and 1974. These are the struggle movements which had provided us the benefit of satisfied duty hours, bonus, DA and other benefits which the present generation enjoys. He further given light to the effects of recommendations given by Khanna Committee in the year 1998 was in certain type of immunity extended to the Running staff while dealing with SPAD cases. He also told about adverse effect of privatization, NPS and the regressive recommendations of 7

th CPC. He called upon the whole Railwaymen to get involved in the

preparation of the strike which has become inevitable in the present scenario.

Com. Shiv Gopal Mishra, General Secretary, AIRF was invited to give his speech. He complimented Com. Venu P. Nair, General Secretary of NRMU and his full team for this grand and successful conduct of All India Running Staff Conference in Mumbai. He appreciated all the convocations of Com. Venu P. Nair who over-ruled the apprehension of Com. Shiv Gopal Mishra about constrain of holding such a big event in the heart of Mumbai metropolitan city.

During his speech Com. Shiv Gopal Mishra has spoken about the vulnerability of the Running Staff as they are most aggrieved a lot. He expressed his dis-satisfaction on the way that deals with the issue of Running staff. They never deny the genuinity of their issues during the course of negotiation but do not

bring their positive attitude into effect by granting benefits to the Running Staff. He called upon the Running staff to stop trains without any notice if the Govt. take any step to withdrawn the insisting legitimate privilege of Running Allowance or mileage. He questioned the staff about the activities of the categorical issue /torpedoes collective bargaining power of Trade Union.

He also cited examples of the attitude shown by the 7th CPC during the preliminary meeting and therefore

during the course of presenting oral evidence in regard to the demands of Running Staff. The Chairman, 7

th CPC expressed positive response during the course of oral evidence but has not accepted vital

demands placed by the Federation in the report submitted by the CPC.

While commenting upon the inevitable situation which led the Federation to go for strike he explained unethical stand taken by the 7

th CPC in determining the minimum wage of staff against the norms of ILO

convention and criteria and formality adopted by the commission itself. The withdrawal of allowances and advances, scrapping of NPS, implementation of privatization and aggressive stand and infuse FDI as its catastrophic effect in the Railway system. He also stated the opinion of Kakodkar Committee report which states that almost 16000 staff grieved their live during their course of duty similar to the military persons and therefore demand of scrapping NPS in Railways is eminent. The issue of Running staff who are engaged to work in the most unhygienic working condition and tempest weather should be treated extraordinary and as to compensate with their earnings and social security.

While concluding his speech Com. Shiv Gopal Mishra Genl. Secretary reminded the staff to formulate aggressive Campaign schedules in all their working units and should prepare strategy for the successful culmination of the strike propose to be held from 11-4-2016.

Thereafter com. Shiv Gopal Mishra General Secretary AIRF instructed to place the draft resolutions. Total 5 resolutions were placed in the conference as under: Resolution 1. Improvement in duty hours, rest etc. of the Running Staff.

Resolution 4. Inclusion of all Running staff & Loco Inspectors in LARSGESS scheme. Proposed by Ch.Gandhi, President/ECoSU. Seconded by R C Sharma President /WREU

Resolution 5. Grant of 55 pay element to medically decategorized Running staff.

TRIBUTE TO LATE COM. UMRAOMAL PUROHITJI ON HIS 2nd DEATH

Our beloved leader Comrade Umrao Mal Purohit, Former President of AIRF, and Former President / ITF (LONDON) who left us on 27.02.2014. On 27.02.2014 great leader of trade union movement who showed path of light to working class of India particularly railwaymen left us leaving behind great legacy of him to follow.

On his Second Death Anniversary, All India Railwaymen’s Federation and its affiliates paid floral tribute to their great leader Purohit Ji. Com. Shiva Gopal Mishra General Secretary/All India Railwaymen’s Federation also paid homage to Com. Umrao Mal Purohit at Gonda, Faizabad. Com. Shiva Gopal Mishra highlighted his achievements and he also spoke about the contribution of Purohit ji in Trade Union Movements.

Special General Council held at Huballi

The South Western Railway Mazdoor Union held a Special General Council meeting at Hubballi from 3

This General Council discussed elaborately on the 26-Charter of Demands of the Railwaymen which is not at all negotiated for any settlement till date by the Cabinet Secretary under the Joint Consultative Machinery (JCM) scheme and unanimously resolved that, if the Government fails to fulfill the demands by negotiations through JCM scheme, it has been decided to conduct strike Ballot on 11

given by National Joint council of Action (NJCA) & All India Railwaymen’s Federation (AIRF). The meeting was presided over by Com. R. R. Naik, Zonal President. All the Divisional Office Bearers of Hubballi Division, Bengaluru Division, Mysuru Division and Workshop Division attended and railwaymen from all over the S.W.Rly participated. Slogan was given against the Central Government anti-labour attitude of the government.

On 3rd

February, 2016, more than 4000 employees gathered and held a rally. While addressing the rally on the Charter of Demands the

General Secretary Com. Dr. A. M. D’Cruz, said that discussion was taken at various levels, but nothing settled and also officially the JCM meeting was not held for last 7 years to negotiate various problems. The main demand elaborated by Com. Dr. A. M. D’Cruz, General Secretary, is that of the retrograde recommendations of VII Central Pay Commission, like the demand for minimum wage for Group-D staff was Rs. 26,000/- but the VII-CPC recommended Rs.18,000/-, whereas the Railwaymen already receiving the salary as on 31.12.2015 i.e. Before implementing pay commission recommendation is Rs. 17,000/-. There may be difference of about Rs. 1,000/- after a gap of 10 years and regarding other retrograde recommendations of the 7

th pay commission.

After the Rally, the delegate session of Special General Council was held, wherein the delegates deliberated on the pending demands and seriously taking note of the attitude of the Government of India, in light of which the NJCA & AIRF have taken decision to conduct strike ballot on 11

th &

12th Feb and commence Indefinite strike from first

week of March, 2016, the Special General Council unanimously expressed solidarity to go for Indefinite Strike and passed the Resolution. A memorandum was also submitted to the General Manager/SWR for forwarding to Ministry of Railways/Government of India.

REPORT OF INTERNATIONAL WOMEN’S DAY

Activists of AIRF - Women Wing celebrated International Women’s Day all over Indian Railway

on 8th March, 2016 with much enthusiasm and fanfare. As per ITF’s directives, the theme for this

year was to share stories of union success around the following 3 key issues, viz. (1) Winning on workplace issues for women transport workers; (2) Improving gender balance in the workplace; and (3) The increasing role of women in union leadership or industrial disputes. Various programmes were arranged in all the Divisions and Workshops and the participants shared their experiences on these issues and efforts made and to be made for improving the status of women in the society. The brief report of the functions/seminars /workshops and Sports conducted are as under:

Mumbai Division: Women Wing activists under the leadership of Sister N.S. Hiwale, Com. Milind Raut, Satpathy greeted indoor ladies patients and women employees working in J.R. Hospital with Rose Flowers and wished them on the occasion and the patients speedy recovery.

Parel /MX Workshop: In the meeting organized in front of the Union Office, more than 350 women workers working in PL-MX Workshop attended. Com. Vikas Gupte was the chief guest and Smt. Vandana Sawant, AMM/Stores Depot/Parel and Smt. Kishori Pednekar, Local Cooperator were guests of honour. Com. Gupte congratulated the women leaders of PL/MX Workshop Branch for their active participation in Union activities and also for their various achievements. He informed about the decision of NJCA in postponing indefinite strike to be commenced from 11th April to 11th July 2016. Com. Geeta Pandoria urged the participants to take lead role for achievement of just and legitimate demands. She also appreciated the women employees for their active role in all the fields of the organization. Smt. Vandana Sawant spoke on the contributions of women in all areas of the society. Smt. Pednekar emphasized the need for all round participation of women in social, educational and political fields for nation building. Thereafter, Prize Distribution ceremony was held, in which prizes were distributed to the Winners and Runner-ups of the various sports conducted by the Women Wing in first week of March, 2016. Com. S. A. Gupte was in chair and Com. Yashoda Hegde, W. C. Member/AIRF anchored the programe. Com. Dilip Jadhav and all other Office Bearers and activists of Youth Wing extended support for successful conduct of the meeting.

Vadodara Division : On this occasion, a Health Check-up Camp was organized at Railway Hospital at PRTN, which was inaugurated by Shri

Ashutosh Gangal, DRM-BRC followed by Smt. Verma, ADRM, Smt. Kamaljot Brar, Sr.DSC, Dr. Talwar, CMS, Dr. Chakravarty, ACMS, Smt. Padmini Pillai, DFM, Smt. Kalpana Naidu, ADFM & other lady officers. Apart from general check-up such as Blood Pressure, Diabetes, etc., Eye check-up, Bone Density check-up, Pep test were also done. Dr. Mona Singh, Gynecologist from Ahmedabad was also invited to guide and advise working women how to take care of health. One day Training programme was arranged exclusively for women employees on 8th March, 2016 under the aegis of Central Board for Workers Education, Regional Directorate, Vadodara. Shri J.J. Patel from Workers’ Education Board imparted training. Around 200 women employees from BRC Division participated in the Training programme. After lunch, cultural programme was arranged at Officers Club. Women Wing activists enthusiastically participated in all the programmes and made its successful. Smt. Sadhana Trivedi with the support of other Divisional office bearers and Youth & Women Wing activists made excellent arrangements for all the programmes.

Ahmedabad Division: A grand function was organised in the specious auditorium of DRM office. The programme was attended by more than 300 women. Shri Ashutosh, ADRM, Smt. Heena Kewalramani, ACM, Dr. Jivisha Joshi, AOM, Smt. Kanta Chatwani, Hindi Officer and Smt. Kanta Parmar, ANO were present. Com. R. C. Sharma, President/WREU, inaugurated the function by garlanding the portrait of Late Com. Maniben Kara and lighting lamp before the portrait by lady officers. Com. Sharma in his speech mentioned about the Life sketch of Com. Maniben Kara and narrated the efforts of WREU for improving the working conditions of women employees and stated that union is committed for the same in future also. Smt. Neha Lal, GM-Adm. & HR of Gujarat Cancer Society Medical College & Hospital delivered a lecturer on women empowerment. Smt. Shreya Bundela, Dietician, gave important tips for working women to maintain their health. Two short video clips on women empowerment were also shown. Thereafter, a magic show was presented by Smt. Alpa, Magician. Shri H.S. Pal, Div. Secretary spoke about gender equality. A new Women Committee with Smt. WREU DHD Workshop Branch: On the occasion of International Women’s Day, various cultural programmes were organized by Women Wing of WREU DHD Workshop Branch in which women employees working in various Departments in Dahod area participated. Smt. Parvatiben, DPO-DHD and Smt. Alka Agnihotri, Convener, Women’s Wing/DHD inaugurated the programme by lighting lamp before the portrait of Late Com. Maniben Kara. Smt. Snehalata Sharma, Principal, St. Stephan School, talked on Gender Equality. Various sports activities, viz. Musical Chair, Shake your hand, Ball Bucket Game, Message Passing, Fruit Decoration, Bridal Make-up, etc. were also organized and winners of these games were given attractive gifts. Smt. Tilotia G. 3. Self Defence workshop on women safety was conducted by Sh. Bharat, Sonakshi and Jitender Taekwondo and self defence educator and demonstrators by giving live actions to how to protect yourself in these situations.

4. On the occasion Dy.CAO/T Tarika Rai said that women are multitasker, innovators, creators with loads of power just need to recognize it and prove it.

5. Ms Nishi Kapahi Asia Pacific coordinator and educator ITF, said that now time is changing, Women are proving and societies are accepting but needs more, don't stop here miles to go.

6. Zonal Treasurer com. Sonia Hasija shared the fact story she experienced few days before through which she she gave a strong message of use of presence of mind in the situation.

7. Hon. Shiv Gopal Mishra, Genl Secy. AIRF wished good luck to women fraternity and asked to move shoulder to shoulder along with Men and youth for future fights and campaigns ahead, also mentioned that our affiliates left no stone unturned to give the all opportunity and equality. AIRF’S REFERENCES TO RLY. BOARD ON STAFF MATTERS

Sub: Implementation of recommendations of D.P.Tripathi Committee in regard to working hours of Running Staff and other Safety Categories Staff.

We are in receipt of minutes of the Full Board meeting held on 06.10.2015 and 08.12.2015 on the recommendations of High Power committee, constituted to review duty hours of Running Staff and other Safety Categories Staff.

From the minutes, it is revealed that, many positive recommendations of the committee have not been accepted by the Railway Board, however, one of the recommendations in para 9.25, “Guards in rear cab be replaced by the Motorman in suburban section”, is accepted and it is proposed as a pilot Project on Western Railway. This is not accepted to All India Railwaymen’s Federation.

Full Board have not considered any of the favourable recommendations, for instance, para 9.12, which states, not to award punishment of “Removal from service” in case of SPAD, and paras 9.12, 9.35 to 9.47 in respect of improvement in working and reduction in working hours of Safety Category Staff other than Running Staff have been overlooked.

In view of the above, AIRF demands a meeting with the Full Board to discuss the issue in detail before implementation of recommendations of D.P.Tripathi Committee.

Sub: Screening and absorption of staff working in quasi-administrative units/offices/organizations – reg.

The above issue is figuring as agenda item No.27/2006 of DC/JCM Forum as also an item under discussion in the “Fast Track Committee” and has been deliberated at length with the Railway Board at various levels a number of times. Lastly this issue was discussed with your good-self on 04.02.2016;

accordingly AIRF is furnishing certain important points for your kind consideration in the enclosed Annexure.

This being an important issue enlisted in the “26 charter of demands” of AIRF for “Indefinite Strike” was also discussed in the Full Board Meeting held on 04.02.2014 under the chairmanship of CRB, minutes of which were also issued by the Railway Board.

It would be highly appreciated, if the issue is resolved without much loss of time. ANNEXURE

1. A policy was formulated by the Railway Board(Ministry of Railways) way back in the year 1997 in consultation with organized labour for screening and absorption of quasi-administrative units/ offices/organizations connected with the Railways. 2. This issue was also being implemented for quite some time, and the quasi-administrative units/ offices/organizations connected with the Railways was being absorbed against Group `D’ posts in the Railways without any problem.

3. Above policy was, however, arbitrarily withdrawn by the Railway Board in June 1997 without taking organized labour into confidence. As such, federations protested this move of the Railway Board, whereupon orders were issued for screening and absorption of those quasi-administrative units/ offices/organizations staff who were on roll as on 10.06.1997.

4. While federations have been persistently demanding to continue with policy decision, taken in the year 1977, quasi-administrative units/offices/organizations connected with the Railways be absorbed in the Railways under this policy. But unfortunately, Railway Board have processed the case for obtaining legal opinion from the Learned Addl. Solicitor General of India.

5. The Learned ASG in para 4 of his legal opinion has stated, “a relaxation/or modification of an earlier policy should only be made in rare cases, and any action taken by the Railways should be just, fair and reasonable and in public interest. No relaxation can be given for mere asking”.

6. The legal opinion of the Learned ASG, vide Point No.5 above, establishes the position that, cancellation of earlier policy decision of 1977, that too without prior consultation with the federations, was unjustified, unfair and unreasonable.

7. Federations are accordingly, regularly demanding for continuation of policy decision, taken in the year 1977 in consultation with the federations, which has been in vogue for over four decades, as withdrawal of the said policy is unjust and arbitrary. 8. As regards Point No.5 of legal opinion of the Learned ASG, it may be appreciated that, federations have never demanded for dilution of educational qualification for absorption of quasi-administrative units/offices/organizations staff in the Railways in GP Rs.1800, PB-I while age relaxation need to be granted as is already permitted in the case of Ex. Servicemen, SC/ST and OBC candidates.

9. In Board’s letter No.E (NG)II/2006/RR-4/3 dated 06.08.2013, addressed to both the recognized federations(AIRF & NFIR), it was stated, “Legal Directorate on the issue has opined that, in view of Hon’ble Supreme Court’s orders, any scheme of regularization of persons irregularly appointed earlier is permissible as a one-time measure only and there should be no further by passing of the Constitutional requirement”. In this connection, AIRF desires the Railway Board to appreciate that quasi-administrative staff are being appointed by various institutions, i.e. Railway Institutes, Co-operative Societies, Recognized Unions etc. Railway Institutes are headed by Railway Officers of the rank of JA Grade as Chairman and under his/her control, Managing Committee of these institute functions. In this connection, para 2208-2217 of the IREM Vol. II(1990 edition) may be referred to. So far as staff of the recognized unions are concerned, they are granted medical and Pass/PTOs facilities by the Railway Board, which are equally allowed to those working in the Railway Institutes, Clubs, Co-operative Societies etc. This provision of the IREM clearly indicates that, quasi-administrative staff are Railway related staff and not outsiders. Thus, federation’s contention that the staff working in the quasi-administrative unit/ offices/organizations are “not irregularly appointed staff” is valid.

10. Railway Board had laid down policy in the year 1977, recognizing the fact that, quasi-administrative railway staff are serving institutes etc. for the welfare of railway employees. So far as

recognized unions are concerned, Railway Board had accorded approval for granting medical and Pass/PTO facilities to their staff with ceiling on such number.

11. Hon’ble Supreme Court of India’s orders stipulate that, where irregular appointments are made, such staff may be considered for absorption if the persons have put in more than 10 years service without break. In the instant case referred to by the federations, appointments made were not irregular and the staff has been continuously working since several years. Therefore, their absorption would not fall foul of the intent and the spirit of the judgment of the apex court.

12. AIRF, is therefore, of considered opinion that, the policy formulated in consultation with the federations way back in the year 1977 for screening and absorption of quasi-administrative units/ offices/organizations staff be restored and continued to facilitate absorption of quasi-administrative staff against vacancies in GP Rs.1800, PB-I.

Railway board orders

Sub: Training on fire safety to Railway Staff.

Ref: Rly.Board’s letter No.E(MPP)98/3/8 dated: 11.02.2003 & E(MPP)2009/3/44 dated 14.10.2009.

C&AG, vide paras 1.1.19 & 1.6.10 of the report of Corporate Safety Plan (2003-13), has inter alia recommended that:

“the maintenance staff also needed to be trained on fire fighting/use of fire extinguishers like running staff (TTE, Coach attendant, catering staff etc.) Railways should also intensify awareness of staff through mock drills and training on fire fighting.”

In view of the above recommendation, Board has now decided that the initial and periodic refresher training course for all employees (both safety & non-safety and Maintenance Staff) of Indian Railways should have a programme on fire-fighting/use of fire extinguishers. Railways should also have periodic mock drills towards fire fighting and use of fire extinguishers for their staff.

Railways are requested to reiterate Board’s instructions in regard to fire fighting to all the training centres falling within their jurisdiction and ensure, and report compliance thereof.

ADVANCE CORRECTION SLIP TO THE INDIAN RAILWAY ESTABLISHMENT CODE, VOLUME-I, 1985 EDITION- (THIRD REPRINT EDITION - 2008) Advance Correction Slip No. 129 The following amendments may be made to rule 510 of the Indian Railway Establishment Code, Volume - I, 1985 Edition (Reprint Edition - 2008):- Rule 510 may be substituted as under:- 510 – Maximum amount of continuous leave.

(1) No Railway servant shall be granted leave of any kind for a continuous period exceeding five years.

(2) Unless the President, in view of the exceptional circumstances of the case otherwise determines, a

Railway servant who remains absent from duty for a continuous period exceeding five years other than

on foreign service, with or without leave, shall be deemed to have resigned from the Railway Service;

Provided that a reasonable opportunity to explain the reasons for such absence shall be given to that Railway servant before provisions of sub-rule (2) are invoked. Railway Ministry’s Decisions:–

1. In the case of all Group ‘C’ including erstwhile Group ‘D’ railway employees, the power to grant the leave beyond

maximum period of 5 years is delegated to concern GMs. However, the leave should be sanctioned only with financial

concurrence of FA&CAO and personal recommendation of CPO with the rider this power shall not be delegated further

down below.

2. The power be exercised in rare and exceptional cases only, for which a speaking

order clearly bringing out the circumstances as to why it is being proposed are brought out.

3. In case of other Groups, the existing provisions will continue.

Sub: Inter-Divisional/ Inter- Railway transfer of Staff on administrative/Vigilance ground. Reference this Ministry’s letter of even number dated 23.10.2006 laying down certain instructions/guidelines for entertaining the request for transfer of Commercial staff, back to their parent Division/ Railway, who were earlier shifted to another Division/Railway on administrative ground /vigilance ground. 2. The matter has been reviewed by Board. It has been decided that the instructions/guidelines contained in Board’s letter referred to above shall apply to staff of all Departments. However, for cases culminating in exoneration, such request may be considered at the level of General Manager without applying these guidelines. (RBE No.16/2016. Sub: Posting of Traffic Apprentices as Station Masters without Aptitude Test. The Railways are aware that in terms of Board’s letter no. E (NG)I-2002/PM1/31 dated 22.08.2003, staff are subjected to Aptitude Test when they are directly recruited or promoted as ASMs, ALPs and Motorman and at the stage of deployment of Drivers on High Speed Trains, running above 110 kmph; however, it has been brought to the notice of the Board that on some of the Railways, Traffic Apprentices, recruited through LDCE and DR quota, are utilized as Section Controllers, Station Masters, Yard Masters and Traffic Inspectors without being subjected to the Aptitude Test. The General Secretary/AIRF has also raised this issue as PNM/AIRF item on the ground that posting of Traffic Apprentices without Aptitude Test is in violation of safety norms.

2. The matter has since been examined in consultation with AIRF, Zonal Railways and concerned directorates of Railway Board and it has been decided that henceforth Aptitude Test will be mandatory for those Traffic Apprentices who opt for the Station Master category, meaning thereby that those Traffic Apprentices, who do not qualify in the Aptitude Test, may not be posted in SM/ASM category.

Sub: Grant of House Rent Allowance to Railway employees posted to new Zones /New Divisions – Reg.

Attention is invited to the instructions contained in Board’s letters of even number dated 9.3.2004, 9.8.2005, 12.12.2007, 24.10.2008, 10.12.2009, 01.07.2013 and 24.07.2014 on the above subject.

2. The matter has been considered by the Board subsequent to issue of letter No. E(G)2009QR 1-2 dated 20.10.2014 and it has been decided that railway employees posted to ECR and NWR may be allowed house rent allowance upto 31.12.2015 on the same terms and conditions laid down in the letter of even number dated 09.03.2004 ibid and as amended /clarified from time to time.

3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

(RBE No. 20/2016. No. E (P&A) II-98/HRA-6 dt: 17.02.2016)

Sub: Consideration of appeal of non-Gazetted candidates selected for Railway employment – Cases of candidates declared unfit upon medical examination.

Detailed provisions for reconsideration of adverse reports of medical examination of candidates selected for employment in various non-Gazetted posts in Railway Services and procedure for making an appeal and its disposal have been laid in Para 522 (I) of IRMM, Third, Edition, 2000. However, it was not clear from the said provisions as to who would act as the appellate authority and what would be the maximum number of appeals that are permitted resulting into a number of appeals for reconsideration of the cases even though they have been declared unfit during initial medical examination. Some of the candidates have also been approaching Railway Board for reconsideration of decision of the Zonal Railways on their earlier appeals.

There have also been instances where the candidate was declared unfit by the initial medical examiner due to the candidate being hypertensive /diabetic or visual activity problems. Some such candidates have taken treatment and then, within the stipulated time frame, submitted an appeal for reconsideration. In such cases, it becomes really difficult for the appellate authorities to come to a conclusion with regard to the candidate’s original condition which was prevailing at the time of initial medical examination. The appellate authority will be in no position to disprove that the person has been administered medicines or has undergone surgical treatment for refractive error etc. This situation calls for a permanent remedy by laying down a specific procedure for examination of candidates, consideration of their appeal in case they are declared unfit in the initial medical examination as also disposal of subsequent appeals by higher authorities. In view of this, a detailed policy guideline was issued to the Zones vide this office letter No. dated 05.06.2014 (Copy enclosed). Though the clarification given by this of as helped the Zone to a great extent in deciding the cases, some issues relating to the subject need further elaboration.

The matter has been considered at length in Board’s office and in supersession to Board’s letters of even no dated 05.06.2014 the following guidelines are laid down for medical examination of candidates for non-Gazetted Posts, disposal of their appeals and other representations submitted to higher authorities:

1.Medical Examination – Medical examination of candidates will be done by a Medical Officer with adequate experience in doing medical examination who will be specially nominated by the CMO/CMS/MD/ACMS in charge for this purpose.

II. If a candidate has been found to be unfit on grounds of acuity of vision/ defective colour vision/hypertension/ diabetes or any other condition/ disease, the medical examiner will not issue any certificate and will put up his/her findings to the CMO/MD/CMS/ACMS in charge of the Unit/ Division Sub-division/ Production Unit.

III. The candidate, without having to submit any appeal, will then be immediately examined by a three member standing medical Board consisting of 1) a specialist in the field; however if the specialist is not available within the Unit/Division/Production Unit, a senior doctor would be nominated in place of a specialist 2) the medical officer who has conducted the first medical examination and 3) the third being a senior medical officer specially nominated and 3) the third being a senior medical officer specially nominated by the CMO/CMS/MD/ACMs in charge for this purpose.

IV. This three member Board will examine the candidate at the earliest after the first medical examination report is put up to the CMO/MD/CMS/ ACMS in charge of the Unit/ Division / Sub-division. If necessary, the candidate would be kept under observation in bed, the accommodation charges etc. in this regard will be borne by the Railway Administration except for such investigations and/or consultation, which is not available in-house, for which the charges will be borne by the candidate concerned.

IV (A) If the initial medical authority or the Three Member Board are of the view that the medical deficiency of the candidate is treatable, except for cause of unfitness like Diabetes, Hypertension, defective colour perception, Disturbance in visual acuity the candidate should be declared as “TEMPORARY UNFIT’ and should be advised to get treated within a time frame not exceeding six months, with a written advice & endorsing a copy to the memo issuing authority. should also include that the candidate should report either initial medical authority or to the three members Board specified (as the case may be), after completion of treatment within the specified time frame. After completion of treatment, re-examination report should be put up to CMS/CMO/ACMS/MD I/C of Unit/Division/Sub-Division for final decision.

V. In case the candidate absconds or absent himself willfully prior to/ during examination by the three member medical Board, this fact should be recorded and the decision of the first medical examiner would prevail and no further appeal shall lie with any higher authority including Railway Board.

VI. This three member Board will, write their detailed findings and will either endorse the first examination findings or differ and record their recommendations in the form of speaking orders, based upon which a fit/unfit certificate will be issued by the doctor who examined the candidate at the first instance. This three member Board’s decisions as accepted by the respected. CMO/MD/CMS/ACMS in charge of the Unit/Division/Sub division will be final and no appeal will be entertained.

VII. Once a decision has been taken at the level of the Divisional/Production Unit In charge and the candidate has been declared fit/unfit by three member Board, no further appeal shall normally lie with any higher authority.

VIII. Consideration of specific cases:-

a) Once, the 03 member Board has taken a decision on the grounds of conditions like hypertension, sub-standard vision and defective colour perception ·diabetes and the same has been accepted by the respective CMO /MD/ CMS/ ACMS in charge of the Unit/Division/ Sub-division, any representation/ appeal shall be dealt with on the basis of the records; and findings of the Committee and the candidate will not be subjected to re-examination.

b) Only in specific and exceptional cases in which there is an objective record of an X-ray finding, ECG record, Echo or a permanent defect/deformity, there can be an appeal in regard to the interpretation of such a finding and such cases can be entertained as an appeal by the CMD. CMD of the Zone may order for re-medical examination of such candidates if he is satisfied that there are genuine grounds for consideration of such an appeal. Such evidence should be submitted within one month of the date of communication of the decision of the CMO/MD/CMS/ACMS in charge of the Unit/Division/Sub-division/Production Unit to the candidate such an appeal shall be entertained only if the candidate produces a certificate from a Government/Private doctor of the speciality /specialities in which the candidate has been found unfit. Such a certificate should also contain a note that the Government/ Private specialist was aware of the fact that the candidate has already been declared unfit during medical examination conducted by an appropriate medical examination conducted by an appropriate medical committee appointed by the Government in this regard. The government / private specialist should also certify that he is fully aware of the physical & vision standards set by the railways, and that he is aware that the candidate has already been certified as unfit according to the standards.

In all cases of appeal to CMD, charges will however be payable by candidate and towards this end a candidate will be required to pay Rs.1000/– through DD. In case of production unit such powers for consideration of appeal shall be vested in the CMD of neighboring/parent zone where the production unit belonged to earlier or currently situated.

IX. Where CMD is of the opinion that there should be re-examination of the case of appeal, he may nominate a separate Three-Member Medical Board comprising of Sr. Specialist including the specialty concerned (of the area of deficiency pointed out), for reconsideration. If CMD feels that the decision given by the Appellate Medical Board is justified, he will accept the same.

X. In case the decision at this stage changes from Unfit to fit, the DD submitted to Rly, will be returned. In all other case, this DP will be credited to Railway in same head, where medical examination fee is being deposited.

Sub: Fitness of candidates including cases of compassionate ground appointments, PWD (non-gazetted) & land losers etc. found diabetic in first medical examination.

In the recent past, it was observed that in a number of cases, especially in cases of compassionate ground appointment, Hon’ble Courts have ordered that the candidates suffering from Diabetes Mellitus are to be taken in Railway Service even though they were declared unfit for Railway services by the Competent Medical Authorities. The Hon’ble Courts in their various judgments have held that Diabetic Mellitus is not a disease. Keeping in view the persistent observations coming from Hon’ble Courts, a three member committee was constituted to examine the issue. The Committee has recommended the following parameter for diagnosing Diabetes Mellitus and deciding of fitness candidates:-

1. Fasting Plasma Glucose level More than or equal to 126mg/dl.

2. Two-Hours Post-Prandial Plasma Glucose level More than or equal to 200mg/dl.

3. Hb A 1 C More than or equal to 6.5% In view of the above established facts the following procedure for deciding medical fitness of candidates suffering from diabetic conditions (diagnosed as per above parameters) is laid down:- 1. For different types of appointments including compassionate, PwD (Non-gazetted) etc., candidate if

found diabetic in first examination (as per above parameters) should be re-examined. Re-examination would be done by a “THREE MEMBER MEDICAL COMMITTEE” comprising of one physician of P.G. Qualification/Endocrinologist if available; one ophthalmologist & headed by a SAG medical officer of the divisional/zonal hospital.

2. Purpose of re-examination will be the thorough clinical evaluation and investigation to rule out any complication of Diabetes or involvement of any End Organ.

3. If some investigations are to be performed for which the facility is not available in-house, the same should be arranged from recognized private labs/clinic & the charges for the same are to be paid by the candidate only.

4. If there is no complication or involvement of End organ, the candidate will be declared “FIT IN CEY ONE OR BELOW”.
