1NOTICE OF MOTION AND MOTION FOR AWARD OF ATTORNEY FEES AND LITIGATION EXPENSES
Case No. 30-2009-00317275
TO ALL PARTIES AND THEIR RESPECTIVE ATTORNEYS OF RECORD:
YOU ARE HEREBY NOTIFIED THAT at 8:30 a.m. on December 1, 2010, or as soon
thereafter as the matter can be heard, in Department CX105 of the above entitled Court, Plaintiff
Nimet Behar (“Plaintiff”) will move for an order awarding attorneys’ fees, litigation expenses and
service award. This Motion is brought in accordance with the Order Granting Preliminary
Approval dated July 23, 2010. Said Motion will be based on this notice, the accompanying
memorandum of points and authorities, the declaration of Norman Blumenthal, the Settlement
Agreement between the parties, and the complete files and records in this action.
Because all parties have agreed to the proposed class settlement, and there have been no
objections to the class settlement or the award of attorneys’ fees, Plaintiff does not anticipate any
opposition to the motion.
