Ordinance - Second Reading.

1. Amending the Zoning Map of the City of Loudon, Tennessee, Pursuant to §13-7-

203 and §13-7-204 of the Tennessee Code Annotated, to Rezone Property Located

at Cedar Park Drive, Tax Map 040, Parcel 088.00, and a Portion of Parcel 085.01,

a Total of Approximately 21.5± Acres from C-4 (Interchange Commercial

District) to R-3 (Urban Residential District). The Loudon Regional Planning

Commission has recommended the rezoning of the property at Cedar Park Drive

from C-4 Interchange Commercial District to R-3 Urban Residential District.

Ordinance – First Reading.

1. Amending the 2019-2020 Fiscal Year Budget. As we do at the end of every year,

we present a list of budget amendments to move monies within the 2019-2020

fiscal year budget. Changes this year are primarily due to:

• Fire Department Overtime and Equipment Repairs - $17,700

• Grant Disbursements - $32,600

• Lump-sum Retirement Disbursements - $12,000

• Drug Fund Police Vehicle Purchase - $29,190

2. Providing for the Provision of Planning Support Services. The ordinance

provides for accepting the expiration of the previous agreement with Loudon

County and allows the City to assume the planning support services.

Resolution.

1. Authorizing Tree Removal at Lions Club Park. Parks & Recreation Department

Director Harrell reports the need for clean-up and removal of downed trees

around and across Sweetwater Creek at the Lions Club Park.

3. Authorizing Submission of a Tennessee Tourism Enhancement Grant

Application. After the success of restoration of the Historic Loudon Theatre we

would like to apply for another round of Tourism Grant Funds. This time we

would like to apply for attractive entrance sign to our community at two locations

(1) the entrance to Loudon Municipal Park; and (2) the intersection of Highways

72 & 11.

4. Authorizing 1993 Jeep Cherokee to be Considered Surplus. The Police

Department has one (1) vehicle, a 1993 Jeep Cherokee with approximately

116,886 miles and having VIN# 1J4FJ68S0PL601444, which Chief Webb desires

to be considered surplus and sold on GovDeals.com or as salvage.

Public hearings were held before the Loudon City Council on June 22, 2020 in the meeting room in the Loudon Municipal Building located at 2480 Highway 72 N. Those present were Mayor Jeff Harris and Council Members: Tammi Bivens, Tim Brewster, Tim Dixon, and Johnny James. Also present were City Manager Ty Ross, City Attorney Kris Frye, City Recorder Nicole Curtis, and Secretary Meghan Hull. The press was represented by Parker Wright with the Loudon County News Herald. Chip Lynn video recorded the meeting for redskinradio.com. There were approximately thirty-three (33) people present for the first public hearing, forty-one (41) people present for the second public hearing, forty-six (46) people present for the third public hearing. AN ORDINANCE OF THE CITY OF LOUDON, TENNESSEE ADOPTING THE ANNUAL BUDGET FOR THE FISCAL YEAR BEGINNING JULY 1, 2020 AND

REGULAR MEETING

LOUDON CITY COUNCIL June 22, 2020

The regular meeting of the Loudon City Council was held on June 22, 2020 in the meeting room at Loudon Municipal Building located at 2480 Highway 72 N. Those present were Mayor Jeff Harris and Council Members: Tammi Bivens, Tim Brewster, Tim Dixon, and Johnny James. Others present were City Manager Ty Ross, Attorney Kris Frye, Chairman Don P. Campbell, City Recorder Nicole Curtis, and Secretary Meghan Hull. The press was represented by Parker Wright with the Loudon County News Herald. Chip Lynn video recorded the meeting for redskinradio.com. Also present or attending by videoconference were approximately seventy-one (71) people. Mayor Harris called the meeting to order at 6:30 p.m. Harris read a statement defining the meeting being held by videoconference pursuant to Executive Order No. 16 to protect the safety and health of the residents of the City of Loudon from the coronavirus outbreak. Mayor Harris asked Pastor Jon Henson of Blairland Baptist Church, to hold the invocation and United States Army Sergeant Veteran Gary Norman to lead the Pledge of Allegiance to the Flag of the United States of America. Mayor Harris requested a roll call of attendance. Mayor Harris and Councilmembers Dixon, Bivens, Brewster, and James were in attendance. Mayor Harris welcomed everyone and explained the format of the meeting. Harris then asked for official approval of the written agenda. Councilmember Brewster inquired to the purpose of the first two (2) resolutions. Manager Ross spoke of the Planning Office request of additional funding. A motion was made by Councilmember Brewster, seconded by Councilmember Bivens, and unanimously agreed to postpone the resolution regarding the East Tennessee Development District to July. Ross and Attorney Frye explained the Tennessee Comptroller’s Office requirements for LUB funding transfers. A motion was made by Councilmember Dixon, seconded by Councilmember Brewster and unanimously agreed to adopt the revised agenda. Mayor Harris said that two (2) people had signed up to speak for citizen input. Mr. John Evans, Committee of 100, read a statement from the Committee of 100 in support of continued community growth outlining the future benefits from developers. Mr. Bo Carey gave a brief presentation of the celebration of Loudon County’s 150 years. There will be a time capsule “buried” in sight to be opened in 50 years and all residents are encouraged to participate in putting something in the time capsule to be opened in 2070. Mayor Harris stated that all videoconference attendees were unmuted at that time and anyone wishing to address Council could state their intent. There was no response. Mayor Harris asked if councilmembers had a chance to review the minutes of the regular meeting held on Tuesday, May 26, 2020. A motion was made by Councilmember Dixon, seconded by Councilmember Bivens and unanimously passed to approve as written, the minutes of the regular meeting held on May 26, 2020.

Council next considered the budget ordinance for fiscal year beginning July 1, 2020 for second and final reading. A motion was made by Councilmember Dixon, seconded by Councilmember James that the following ordinance be passed on second reading:

ADOPTING THE ANNUAL BUDGET FOR THE FISCAL YEAR BEGINNING JULY 1, 2020 AND ENDING JUNE 30, 2021

Upon a roll call vote, the AYES were: Dixon, James, and Harris. The NAY votes were: Bivens, and Brewster. Mayor Harris declared the ordinance passed 3-2 on final reading. Mayor Harris presented an ordinance for second reading to set the tax rate for the 2020 tax year at $1.2367. A motion was made by Councilmember Dixon, seconded by Councilmember Brewster that the following ordinance be passed on second reading:

ORDINANCE NO. 2020-05 SETTING THE TAX RATE FOR TAX YEAR 2020

Upon a roll call vote, the AYES were: Dixon, Brewster, Bivens, James, and Harris. There were no NAY votes. Mayor Harris declared the ordinance passed on final reading. Mayor Harris introduced an ordinance for second reading to better clarify requirements on refuse and trash disposal for collection. Director Ellis Scruggs outlined the changes proposed with a ninety (90) day notice to the residents on the new policies. A motion was made by Councilmember Bivens, seconded by Councilmember Brewster that the following ordinance be passed on second reading:

TITLE 17 CHAPTER 1 REGARDING REFUSE AND TRASH DISPOSAL Upon a roll call vote, the AYES were: Bivens, Brewster, Dixon, James, and Harris. There were no NAY votes. Mayor Harris declared the ordinance passed on final reading. Mayor Harris presented an ordinance to approve a rezoning request for property on Cedar Park Drive. Councilmember Brewster restated concerns on traffic issues in the future. A motion was made by Councilmember Brewster, seconded by Councilmember Dixon that the following ordinance be passed on first reading:

Council considered a resolution to allow LUB to transfer funds under the approval of the Tennessee Comptroller’s Office. Attorney Frye explained that no monies would be spent without Board pre-approval allowing for a better financial situation for the Gas and Water Departments. A motion was made by Councilmember Dixon, seconded by Councilmember James that the following resolution be passed:

RESOLUTION NO. 2020-20 RATIFYING THE CONTRIBUTION AND ECONOMIC DEVELOPMENT

AGREEMENT FOR THE EXPANSION AND IMPROVEMENT OF PUBLIC WORKS FACILITIES OF THE WATER SYSTEM

APPROVED BY LOUDON UTILITIES BOARD Upon a vote, the resolution unanimously passed. Mayor Harris presented a resolution amending the pay classification effective July 1, 2020. The resolution includes an increase for the fire and police employees and a 1% pay increase for all full-time employees. Councilmember Bivens recused herself saying that she had a personal interest that would affect her household. A motion was made by councilmember Dixon, seconded by Councilmember Brewster that the following resolution be passed:

Upon a vote, the resolution unanimously passed. Next Council considered a resolution to approve additional paving of Highland Avenue that was not included in the grant. A motion was made by Councilmember Brewster, seconded by Councilmember James that the following resolution be passed:

Upon a vote, the resolution passed unanimously. Public Works Director Scruggs explained that a vehicle and dump body is not available as previously approved. Scruggs requested the purchase of a different vehicle and dump body that is more readily available, would add a minimal increase in cost, and be of better utilization for the department. A motion was made by Councilmember Brewster, seconded by Councilmember James that the following resolution be passed:

Numerous items will need to be destroyed rather than sold on GovDeals. A motion was made by Councilmember James, seconded by Councilmember Brewster that the following resolution be passed:

Upon a vote, the resolution passed unanimously. Mayor Harris reappointed Cynthia Ferguson to the Historic Zoning Commission (term expires 6-30-25); Debbie Hines and Carlie McEachern to the Loudon Regional Planning Commission (terms expire 6-30-25). Harris reappointed Amy Millsaps and Eddie Mejia to the Recreational Advisory Committee (terms expire 6-30-23) with unanimous Council approval. Harris reappointed Carlie McEachern to the Board of Directors of Loudon Utilities (term expires 6-30-24) with unanimous Council approval. Fire Chief Brubaker introduced two (2) part-time firefighters that had recently graduated from the academy. Haleigh Oody and Jonathan Dorsett have grown up in the community and received commendations from the trainers on how well they represented the City of Loudon while training at the academy. Recreation Director Harrell explained the progressive use of park facilities. Harrell said all facilities are now open with the exception of the playground equipment. The

playground causes concerns of proper cleaning between children. Food Truck Friday will be on Friday, July 3, 2020. Lions Club will be handling the Fourth of July Parade, but there will be no other festivities. Public Works Director Scruggs thanked Council for the purchase approvals. City Recorder Curtis said that she appreciated her first budget process and looks forward to the upcoming changes of experiencing paper to pavement. Councilmember Bivens stated that the Loudon County Solid Waste Disposal Commission has met. Santek is in the process of being purchased by Republic and this has ceased the contract negotiations until more information has been received. Councilmember Dixon reported that the Historic Zoning Commission approved metal roofing and signage downtown. In addition to the rezoning requests, the Planning Commission approved a site plan that could bring forty (40) jobs to town. Mayor Harris expressed employment anniversary congratulations to City of Loudon employees: Kent Russell (23 years), Meghan Hull (20 years), and Sam Harrison (16 years). Harris also congratulated LUB employees: Dave Birkholz (32 years), Travis Williams (21 years), Missy Cooley (14 years), Rodney Smallen (13 years), Jamie Miller (11 years), and Ty Ross (3 years). Councilmember Dixon gave June birthday wishes to City employees: Brian Jenkins, Mike Newman, Courtney Giles, Tracy Harris, Anthony Garner, Luke Martin, and Andrew Hughes; LUB employees: Nick Dixon, Dalton Giles, Mike Eblen, Chuck Hughes, Wayne Ketner, Jamie Miller, Brad Parks, Dawn Watson, and Ty Ross. Councilmember Brewster stated that an item was left off the agenda that was discussed at the workshop. Brewster made a motion to split the position of manager and hire a city manager/planner. Mayor Harris asked Attorney Frye to address the approved agenda. Frye stated that it was up to the Mayor if it could be added at this time. Harris asked for a second to add it to the agenda. Councilmember James made a second. Harris asked for a roll call vote to add the item to the agenda. The AYES were: Brewster, James, and Bivens; Dixon and Harris voted NAY. Harris declared that adding it to the agenda failed 3-2 requiring unanimous vote at this time to add the item. Brewster challenged the decision and requested the item to be on the next agenda. WHEREAS, The Loudon City Council supports attempts to improve community enhancement opportunities within the City of Loudon; and WHEREAS, The City of Loudon has indicated its intention to create new community entrance signage to the City of Loudon; and WHEREAS, The City of Loudon desires to apply for a Tennessee Tourism Enhancement Grant from the State of Tennessee, Department of Tourist Development for tourism development of new community entrance signage; and WHEREAS, The City of Loudon will commit to providing the necessary matching funds to satisfy the funding match required by the Tennessee Tourism Grant from the State of Tennessee, Department of Tourist Development for tourism development of new community entrance signage for the City of Loudon. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Loudon, Tennessee as follows:

Section 1. The Loudon City Council hereby authorizes submittal of an application for a Tennessee Tourism Enhancement Grant from the State of Tennessee, Department of Tourist Development to fund the proposed community entrance signage.
