2 I refer to paragraphs [17] to [30] of the affidavit of Bryan Webster affirmed

6 September 2017 and to the affidavit of Susanna Ford affirmed 6 September 2017

which set out details of the First Plaintiffs' communications with interested parties,

including ASIC, in relation to this application.

On 7 September 2017 at approximately 3.58pm, I received an email from Andrew

Tregear of ASIC attaching a letter from ASIC dated 7 September 2017.

ln the letter, ASIC informed the Plaintiffs that it does not propose to intervene in the

application or seek leave to appear at the hearing scheduled on 8 September 2017.

A copy of ASIC's letter to ABL dated 7 September 2017 is Annexure JTV'1.

ln the circumstances, ASIC considers that this is a matter properly left for the determination

of the Court and confirms that it does not propose to intervene in the application or seek

leave to appear at the hearing on 8 September 2Q17.

ASIC's decision is based on the principles set out in ASIC lnformation Sheet 180 AS/C's

approach to involvement in private court proceedings, including:

1. whether intervention is of strategic regulatory significance;

2. whether the benefits of intervention outweigh the costs of doing so;

3. whether issues specific to the case warrant intervention; and

4. whether alternatives are available, including appearing as amicus curiae or taking

action itself.

This letter should not be taken as an expression of support for, or opposition to, the orders

sought in the application to be heard.
