NPDES Stormwater Technical Advisory Committee (TAC)

REPORT OF MEETING

TUESDAY, MAY 20, 2008 10:00 A. M.

TOWN OF ATHERTON 1. INTRODUCTIONS, ANNOUNCEMENTS, ADOPTION OF MINUTES, AND REVISION TO AGENDA Self-introductions were made, the February meeting minutes were adopted as written, and the proposed agenda was

accepted as drafted. 2. PRESENTATIONS

a. Review and Approval of FY 2008/09 Countywide Program Budget – Matt Fabry reviewed the proposed budget line items and the current revenue projections. Matt included several new budget line items to better reflect what C/CAG actually charges to the Program. Matt will check with Rich Napier to verify whether $15,000 will be needed for Administration/Office Expenses. One concern expressed is that because CASQA’s comments on proposed new permits and regulations do not always reflect the views of the Program, it is unclear why the Program should be a member of CASQA and pay $7,500/year dues. Another concern expressed was that CASQA’s conferences are expensive and usually held in Southern California. It was pointed out that the TAC only agreed to join CASQA last year, and this decision could be rescinded. A representative from CASQA will be invited to an upcoming meeting to explain the benefits of being a CASQA member. The FY 2008/09 budget would pay for CASQA’s dues for calendar year 2009. It was suggested that the $75,000 per year for miscellaneous (litigation and permit renewal) and the funds unspent from this line item from previous years be earmarked as a litigation reserve. The other view expressed is that all of these funds are available as part of the Program’s fund balance. There was widespread support for showing that the proposed budget be balanced for next fiscal year. Agreed Outcome: Steve Tyler moved that the FY 2008/09 Countywide Program Budget be adopted with the Clean Estuary Project budget placeholder reduced by $22,658 (from $75,000 to $52,342) so that the proposed budget will be balanced. Cynthia Royer seconded the motion and it was adopted unanimously.

b. Status of Revising the Draft Municipal Regional Permit – Matt noted that the Water Board staff is working on responding to the comments it received on the Tentative Order, and it is planning to convene some stakeholder groups in June and July. There is expected to be a workshop in July, and the earliest that the permit would be adopted is in October. BASMAA managers have met with Tom Mumley, the Water Board’s Assistant Executive Officer, to discuss ideas for crafting a permit that provides flexibility with accountability. BASMAA is creating a couple of examples of how this can be done by using the construction inspection and public information and participation permit sections. Habte Kifle added that the Water Board staff is working on their individual sections of the permit. He is responsible for the municipal maintenance and the conditionally exempted discharges sections. Some of the comments received were more constructive than others. He liked comments that offered alternatives to what is being proposed in the permit. There needs to be give and take among all stakeholders in crafting the final draft permit.

c. Update on Grant for Sustainable, Green Streets and Parking Lot Projects – On May 8 C/CAG agreed to execute funding agreements to pay for the demonstration project grants for Brisbane, Daly City, Belmont, San Bruno, and Burlingame. The total cost of these grants was $1,044,000. C/CAG agreed to have a second round of call for projects next fiscal year that any municipality may apply for. The amount of funding available for the second round will be about one-half the amount that was available from the first round unless legislation is adopted that would extend the vehicle registration fees beyond its current termination date of December 31, 2008.

d. Update on Stormwater Litigation in Southern California – Fred Jarvis reported on a citizen’s lawsuit filed in March by

the Natural Water Resources Defense Council and the Santa Monica BayKeeper against the City of Malibu and Los Angeles County for allegedly violating its municipal stormwater NPDES permit. The plaintiffs believe that the city and county’s municipal stormwater caused or contributed to exceedances of water quality standards and failed to take the

steps necessary to report and correct the problems. A separate lawsuit was filed by the City of Arcadia and a number of other cities against the State Water Resources Control Board for not following the state water code’s requirements in adopting water quality objectives. A tentative trial court decision agrees that the Water Board did not evaluate a number of factors required by section 13241 of the California Water Code in adopting water quality objectives in the 1970s and subsequent Basin Plan amendments. Factors that are supposed to be considered include: what could reasonably be achieved through coordinated control of all factors that affect water quality, economic considerations, and the need for housing.

e. Low Impact Development Workshop – The California Coastal Commission, the Water Boards, U.C. Davis Extension, and Sea Grant of Southern California sponsored three low impact development workshops around the state last month. The workshop held in Oakland was attended by about 200 people. Low impact development is a unifying concept of how to build and has similarities to the broader pollution prevention concept that was popular in the 1980’s. One of the speakers reported that about one-half of the built environment that will exist in 2025 will not have existed in 2000. The Water Board Executive Officer Bruce Wolfe stated that stormwater should be used as a resource not as a waste. Stormwater can be used to enhance water supplies. Another speaker reported that it would be advisable to wait to go to the voters to raise property associated fees for flood control and stormwater until 2010 or later. Susan Gladstone the Water Board’s grant coordinator reported that there will be opportunities for municipalities to file for Proposition 84 stormwater grants toward the end of this year. There is widespread interest in inviting Ms. Gladstone to present grant information at a future TAC meeting.

f. Regional Water Quality Control Board – Habte Kifle reported that the Water Board staff is initiating its triennial review of the Basin Plan, and he distributed a summary of the issues that will be addressed during the next three years. The Water Board staff plans to update information in the Basin Plan about significant waterways, such as San Mateo County creeks, and their beneficial uses. Another important issue to follow will be the development of a narrative water quality objective for marine debris.

3. SUBCOMMITTEE REPORTS

PUBLIC INFORMATION/PARTICIPATION (PIP) – EVA JUSTIMBASTE Eva reported that the subcommittee met on May 13. The meeting was used to report on a Kids in Creeks workshop. Lynn Adams from the Pacifica Beach Coalition and recipient of a mini grant from the Program, spoke about her project to help organize beach clean ups. The subcommittee agreed on a list of promotional items and materials to order for the county fair. Information on the website redesign was discussed. The next meeting will be held on July 8. COMMERCIAL/INDUSTRIAL AND ILLICIT DISCHARGE (CII) – WARD DONNELLY Ward provided an update on the April meeting, and a summary of this meeting was included with the TAC agenda packet. NEW DEVELOPMENT (ND) – MATT FABRY Matt reported on the April field trip to visit stormwater treatment controls at the Sunset Circle Parking Lot along Lake

Merced and Old Mint Plaza in San Francisco. A summary of the field trip was included with the TAC agenda packet. MUNICIPAL GOVERNMENT MAINTENANCE ACTIVITIES The subcommittee has not met recently. An announcement regarding its June 26 workshop was distributed. PARKS MAINTENANCE AND IPM WORK GROUP – VERN BESSEY The work group met in April and a summary of the meeting was included in the TAC agenda packet. WATERSHED ASSESSMENT AND MONITORING (WAM) – FRANK MANDOLA The subcommittee has not met recently.

New Development Subcommittee Report Meeting Date: June 3, 2008

Subcommittee Action: The following was agreed to: 1. Approve the summary of the February Subcommittee meeting.

Other Information/Announcements: 1. FY 08-09 Budget: The TAC approved the budget at its May meeting. The budget is the same as for FY 07-08,

including a $75,000 contingency for the permit renewal and potential litigation. 2. Litigation: The National Resources Defense Council and the Santa Monica Baykeeper have sued the City of

Malibu and Los Angeles County for failure to report exceedance of the stormwater standards. They also allege that the State Water Resources Control Board failed to evaluate the Basin Plan requirements for certain factors, including reasonable achievements and economic considerations.

3. Leave of Absence: Laura Prickett will be away through December. Fred Jarvis will take over New Development Subcommittee support until Laura’s return in January.

4. Statewide Construction General Permit. The draft, revised permit is available and features a number of new requirements, including but not limited to numeric action levels and effluent limits, a risk-based approach, site soil characteristic monitoring, receiving water monitoring, new certification and training requirements, new notification and reporting requirements, and minimum BMPs. Adoption is anticipated in October 2008 and the permit would go into effect 100 days after it is adopted.

5. Soil Guidelines. The final soil guidelines have been posted on SMCWPPP’s website. The ACCWP is considering updating their soil specifications to include microbial inoculation.

6. Subcommittee Activities for FY 2008-09. Activities to occur in the next fiscal year include a new flyer on C.3 compliance for small projects and a green streets workshop. The subcommittee also discussed updating the guidebook of site design examples, performing a survey of municipalities on the implementation of stormwater new development and construction inspection requirements.

7. Construction Site Compliance Workshops. In an effort to reduce costs and increase cost-effectiveness, future SFEP workshops will likely be held less frequently, cost more, and will not include a field trip portion.

8. Statewide Water Efficient Landscaping Model Ordinance. The new model ordinance features detailed irrigation requirements for water conservation and encourages post-construction BMPs. Adoption of the ordinance is anticipated this summer. The ordinance will go into effect two years from the date of its adoption but municipalities are encouraged to adopt the ordinance when it is ready.

9. Municipal Regional Permit Update: BASMAA met recently with Water Board staff to discuss ways to increase flexibility in the draft MRP provisions for PIP and Construction while maintaining accountability. Small stakeholder meetings are planned in June, with larger workshops to be held in July. A revised draft permit is due in August, and hearings are preliminarily scheduled to occur in October.

10. Sustainable Green Streets and Parking Lots Work Group Update: Grants were awarded to the cities of Belmont, Brisbane, Burlingame, Daly City and San Bruno. The project consultant is on track with the Sustainable Green Streets and Parking Lots technical guidance. A draft is anticipated by the end of this month with final approval planned in July. An optional survey on each municipality’s development review practices was distributed.

11. BASMAA. The web-based Sizing Tool is scheduled for completion this summer. The tool will size vegetated swales, pervious paving, bioretention areas and infiltration trenches.

12. SMCWPPP Website Redesign Update: The new website is anticipated to launch in June. The website will feature a private, members-only portion with a message board.

13. Copper Gutters. The city of Menlo Park has decided to issue an advisory against the use of copper gutters and downspouts instead of forbidding their use.
