SUBJECT: Vacancy on Board of Directors

On March 11, 2019, Director Bill Stevens submitted his letter of resignation as a Director of

Zone 7. Director Stevens’ resignation created a vacancy on the Board of Directors for a

term that ends on June 30, 2022.

Government Code §1780 provides procedures for filling vacancies on the Board of

Directors. That section provides the Board of Directors with the opportunity to fill a

vacancy within sixty days of its occurrence. If the Board of Directors does not act to fill a

vacancy during that time, the Board of Supervisors of the County of Alameda has the

authority to fill the vacancy during the next 30 days. In either case, the individual appointed

to fill the vacancy will only serve until the next general district election, which will be in

March 2020. The individual elected at the March 2020 election would then serve for two

years, until the completion of Director Stevens’ original term in 2022, and could stand for

re-election in the June 2022 election.

At its March 20, 2019, Board meeting, the Board of Directors directed staff to post and

advertise a notice of vacancy soliciting applications for the vacant position on the Board of

Directors. The vacancy was advertised through the Zone 7 webpage, the Zone 7

eNewsletter, a press release and through the retailers. Applications were due on April 22,

2019, at 5:00 pm. Fourteen (14) applications were received and are attached to this report.

The Board will conduct interviews of the candidates and may consider selecting the most

qualified candidates to be appointed to the Zone 7 Board of Directors. The procedures to be

used are solely within the discretion of the Board of Directors.

RECOMMENDED ACTION:

Consider selecting the most qualified candidate and appointing him or her to the Zone 7 Water

Agency Board of Directors.

I want to be practical and see the State of California and Federal focus on reservoir size increase to take us out another 75+- years meeting ag and household expansion needs. I do not want to see Hetch Hechy closed.

Water quality is of immense activist priority to me. I disagree with the notion of by-pass tunnels to route runoff out of the Delta. That strategy leaves too much risk for us pumping more salt laden Delta water into our systems.

I curse the current trend towards more tiered pricing, the fake science limitations being placed on household use and some business operations, and geo-engineers dumping hydrolyzed aluminum oxide materials into our atmosphere globally, which we all officially pretend does not occur. I want water thoroughly tested with customer accessible emergency alerts and constant advisories when there are purity breaches.

I will not agree to any plan that mixes recycled sewer water back into our drinking water supply after osmosis treatment. I will agree to drink and approve recycled sewer water if it is obtained by a state of the art, reliable, water condensation - desalination plant (as opposed to osmosis plant).

The estimated size ± of the portfolio of properties in terms of today's values is $15-billion spread from Lake Tahoe to Santa Rosa to Santa Clara County. For this awesome service I provided the Savings & Loan industry they paid me $1,500 per month plus and car travel expenses for which I am grateful to have received! I became licensed also as General Building Contractor, a license currently held in reserve status. I worked on the staff of an independent South Bay Area real estate developer as research analyst for new projects. I always surrounded myself with highly skilled craftsmen when I was personally building, as I am not a skilled craftsman myself. I hold skilled craftspeople in very high esteem with great personal admiration for their talents and devotion to doing good work. Mid-1970's worked briefly with several regional and national real estate firms in Industrial, Commercial, and Residential Sales and Marketing Development. 1975 to present: Own and operate Rich Buckley Realty, a general real estate brokerage company and business sales and consulting in Livermore, CA: 1979 through 1984 earned MBA in Taxation from Cal State Hayward in evening program. My professional education and employment has involved developing models, including numerical simulation,

of how natural systems work, particularly processes related to energy supply. My petroleum systems

modeling includes flow through porous media and compaction due to lithostatic load. I have approximately

250 publications with approximately 14,000 citations according to Google Scholar. Unlike many scientists, I

have also managed multi-million dollar projects. A short summary of my education and work experience

follows:

generation and recovery of shale oil.

Consultant and Adjunct Professor at Stanford University, 2005-Present; Development of kinetic models of

natural petroleum generation and primary migration.

Although I have spent much of my career on fossil fuel extraction, I also know that there is very strong

evidence that accumulated CO2 emissions are having a significant effect on climate, so we need to convert as

quickly as practical to carbon-free energy sources. Similarly, although there are additional water sources that

can be developed to satisfy rising demand due to increasing population, conservation has to be an important

part of balancing supply and demand. We reduced our personal water usage by 40% when comparing 2014-

2018 to 2006-2012. Environmental effects must be an important consideration for how to structure energy

and water systems and how to educate consumers.

During the recent drought years, I studied water supply issues, including many Zone 7 publications. Part of my

interest involved public education about how weather and climate affect water supply in California. I

published a letter in the 2/2/17 issue of The Independent discussing the variability of California rainfall and the

impact of rising temperatures on transpiration and the storage of precipitation as snow in the Sierra Nevada.

Key to providing adequate water supply is storage capacity that can smooth the large variability of

precipitation. Plots of Livermore precipitation, which varies more than the California average, follow.

The over-riding issue demonstrated in these plots is that Zone 7 directors must take the long view—decades

long—if they are to fulfil their duty to assure adequate water supplies. The objective is to establish systems

that avoid crises and to minimize the number of decisions that are unduly influenced by public outcry during

crises. Furthermore, decisions must be soundly based on data.

I have the technical training to evaluate how recycling and desalination might be used in Zone 7 water supply

systems. Keeping in mind that no single solution is a panacea, I have studied both to some extent. As part of

my facility development activities for the National Ignition Facility, I oversaw the installation of an RO system

for optics processing. I have also followed a capacitive deionization project involving Stanford and LLNL.

Although the primary objective of RO is rejection of dissolved salts, organics are also rejected at ratios

dependent on their permeability in the membranes. I bring up organics, because future water supplies,

especially those depending on recycled water, must consider the removal of medicines and endocrine

disrupters from delivered water. I am also aware of public wariness of drinking recycled water directly, but

system designers must also understand that percolation of unpurified water into the aquifer does not solve

the problem for persistent chemicals. I know that Zone 7 is aware of these issues, and I merely say that I am

qualified to help derive and defend technically sound decisions on these issues.

An important aspect of Zone 7 water

is the use of aquifers as a multi-year

buffer system. Flow through porous

media has been part of my technical

work. Consequently, as part of my

interest in teaching science that

affects people’s lives through the

Livermore Science and Society Center,

I designed and built a water

percolation experiment as a multi-age

educational tool. In fact, it has

captured the interest of people from

preschoolers to adults. Key learnings

are the relations among surface area, drag forces and permeability

and the difference between permeability and porosity.

Aquifers and their contamination by human activities is also a concern. Leaking gasoline tanks are a heritage

issue, as is chlorinated solvent disposal by the Navy and LLNL at the current LLNL site. A TCE plume was just

discovered in downtown Livermore. But nitrate contamination from both animal and human waste is also an

issue. I recall a substantial nitrate concentration reported SE of the intersection of Greenville and Tesla from

an old chicken ranch, although I could not find that document now. My wife and I funded a water well at

Asbury United Methodist Church to reduce non-potable watering costs. That water well brought to the fore

the issue of contamination by septic tanks along Buena Vista, which made that well water non-potable but

great for keeping grass quite green without fertilizer. Similar issues have prompted annexations south of

Livermore to gain access to the sewer system.

Contamination of storage aquifers was also a recent issue for the conditional use permit of the Livermore oil

field, which I briefly touch on in my recent book, History and Geology of Livermore Oil. This controversy

combines the issues of basing decisions on data rather than emotions and on the thickness of the Livermore

gravels. Despite some poor operational procedures, no identified contamination had occurred according to

public information. Even if some had occurred, it would be minor compared to contamination at the LLNL site.

In contrast, the primary focus of Zone 7 is the central portion of the basin and the chain of lakes concept, with

a major concern being the salinity of the recharge water from the Delta. Pertinent here is the California

WaterFix project, which appears to be a step in the right direction. Although I have not studied it in detail, my

reading of documents with serious technical content indicates that it is beneficial to both the Delta

environment and our water supply.

My final major point is that while I may have tentative opinions on some issues related to Zone 7 operations, I

also believe that one should always re-examine those opinions based on new data. Furthermore, decisions

often must balance the positives and negatives of various aspects, and undue focus on only one aspect can

lead to a poor decision. I promise that if selected I would keep an open mind and consider all information

relevant to each decision.

ZONE 7 WATER AGENCY APPLICATION FOR APPOINTED DIRECTOR

STATEMENT OF INTEREST AND QUALIFICATIONS

I am applying for the position of appointed Director at the Zone 7 Water Agency because of my desire for public service in the capacity for which I am best qualified and most interested.

My family and I have lived in Pleasanton since June 1987. My wife, Laurie, and I have been actively involved in our local community since that time, in our work, at church, in our neighborhood, in our children’s schools, in support of youth sports, in adult sporting activities (e.g., tennis, biking) and in other aspects.

After graduating from U.C. Davis in 1975 with a Bachelor of Science degree in Civil Engineering, and spending one quarter in graduate school, I started as a junior civil engineer with Zone 7 on December 29, 1975. I spent 1976 and 1977 working for Zone 7 on various planning and design projects.

To attain additional professional experience, I worked at the Santa Clara Valley Water District, in San Jose, from January 1978 to October 1980. I worked on a number of important planning efforts, and as a civil designer on various large-scale pipeline projects that formed the beginning of the district’s in-county portion of the San Felipe Project.

Then, returning to Zone 7 as a Water Resources Engineer III (Associate Civil Engineer), I worked from October 20, 1980 until my last day on the job, on January 7, 2010. During this tenure, I worked as a lead engineer, supervisor and manager, on almost all aspects of Zone 7 business. This included engineering planning, engineering design, construction management, water operations, water facility maintenance, water quality, water conservation, treated and untreated water contract administration, retailer coordination, as the agency contact with the California Department of Health Services on the maintenance of Zone 7’s water supply permit, and as the agency contact with DWR and the State Water Contractors on key issues such as the State Water Bank (early 1990s) and the South Bay Aqueduct Enlargement and Improvement Project (2000s). See the attached resume for additional detail.

When Director Bill Stevens recently completed his years of distinguished service, it got me to thinking that I also now have an opportunity to provide a public service in this same capacity to our local community. It is something that I have thought about for quite some time, but now the opportunity is immediate. I look forward to serving Zone 7 as its newest Director.

Thank you very much for considering my application to appointment to the Zone 7 Water Agency Board of Directors. State water issues in general and water issues within the Zone 7 service area have been of particular interests to me for more than 20 years now and I have addressed the Board of Directors a number of times on a variety of issues over the years.

Initially my community-based interest in local water arose out of waste water disposal from a industrial laundry in Pleasanton that laundered clothing contaminated with nuclear materials that disposed of the waste water from washers into the City of Pleasanton municipal sewage treatment systems during the 1960s and 1970s.

That personal investigation grew into an intersection with concerns about plans during 1998 to 2000 for reverse osmosis treated sewage waste water to be injected into the aquifer beneath Tri-Valley cities. While this plan was primarily envisioned at the time as a method to expand sewage capacity by extracting water, years later the process is being considered at a possible tool to extend water supplies for the Zone 7 service district caused by recurring drought and anticipated results from climate change.

While serving on the Sierra Club local San Francisco Bay Chapter Water Committee and a the Vice Chair for Delta Issues on the Sierra Club California Water Committee I also help understand and develop ideas about what is now California Water Fix and the issue of constructing tunnels to circumvent transporting water intended for the State Water Project aroundthe Sacramento-San Joaquin River Delta. As the Zone 7 Water Agency receives sometimes as much as half the water distributed in the service district from sources that use the Delta as a conveyance, I was able to learn about the water cycles, the risks related to Delta conveyance and the Delta environment, as well as the challenges and costs to develop reliable and environmentally sound solutions.

There are also present concerns related to Delta water conveyance as a result of recent federal Executive Administration orders to speed up water decisions by federal biologists on the effects of the distribution of water. National Oceanic and Atmospheric Administration Fisheries who are drafting the new rules regarding salmon and other fish are not presently planning to havepublic involvement or comment.However, under the WIIN Act, water contractors have power to discuss and submit information to federal agencies developing the biological opinions.

I believe the Zone 7 Board of Directors is a political body that provides an intersection between the scientific analysis required to ensure our water supplies for present and future generations and to protect the Delta environment. While I understand that Zone 7 Water Agency does not directly make decisions on growth, that the mandate is to provide the necessary water supplies required by the service area, I believe the recent years-long drought and the incredible public effort to reduce water consumption indicates that there are possibilities for Zone 7 Water agency and the retail water service agencies to work together to reduce water consumption long-term. While science can provide options, it is politics and public values that can help make decisions.

One issue of primary importance is the issues of water rates. I understand that reduced usage may not necessarily lead to lower rates because of Zone 7 Water Agency additional mandates for advanced water treatment and building flood control facilities. I believe that a major effort to understand and tap into the public will that resulted from the years-long drought can bring together the factors of usage and facilities to arrive at reasonable water rates that are not overly cumbersome for present users, but also Permit Zone 7 Water Agency to plan for the future. I believe my history and community activities permit me to be a particular asset on the Zone 7 Board of Directors in this regard.

I have been living in Pleasanton, and working as Real Estate Broker since 2011. Before this, I was a

journalist for 15 years in charge of political and economic issues and am now a part time commentator in

AM 1450.

My community services began in 2012, shortly after my son started his school in Pleasanton Unified

School District (PUSD). In recent years, I volunteered over a hundred hour each year through nonprofit

organizations and local government committee to serve my communities. Here are some highlights of my

community service and leadership,

The founding president of Tri-Valley Asian Association (TVAA), a 501(c)(3) nonprofit

organization with a mission to build a bridge to connect Asian American community with

mainstream and in both directions;

A member of Economic Vitality Committee of City of Pleasanton for almost 4 years;

A member of Downtown Specific Task Force Plan in City of Pleasanton for 18 months;

A member of Local Control Advisory Committee (LCAC) in PUSD for almost 3 years, which

oversees the budget for special programs in PUSD; The VP of Education in Walnut Grove PTA;

Representative Captain for Measure I 1 in 2016;

As a team player, a passionate community leader, an expert in Real Estate, a former senior journalist

and a News Commentator in AM 1450 for global issues, I believe that there are many areas in which I can

bring values to the board. Here are just some of those values,

As a woman with international background and bilingual capability, I was a full-time

journalist for 15 years and now a commentator for local Radio station AM 1450.This

background would be helpful to help Zone 7 build a bridge with its current fast growing and

changing demographic community.

For example, Pleasanton Unified School District for the first time has Asian Student be the

NO. 1 and the largest student body in its history. Dublin has been one of the fastest-growing

cities in California. Asian population in Dublin becomes the 2nd largest and the fastest-

As a successful Real Estate Broker, I am able to access a large client base which take water

issues seriously and concern issues happen on daily bases. By advising draught tolerance

lawn and water conservation solutions, I would like to be the advocator for Zone 7 water

district to all of the buyers and sellers in this area.

My experience for budge control in LCAC committee will help contributing in Zone 7 water

district on similar issues too. For the past several years, LCAC in PUSD has helped enrich the

teacher’s training programs and install the Media center for Village High School.

If I am selected to be an appointed board of director, I would like to work with our board together and

use my unique experience, skillset, community connections, and resources in my network to find the best

solution to turn challenges to opportunities.

I have sened 5 years on the East Bay Mud Citizens Advisory Committee back in the late 70searly 80s as an appointee of Walter McCIain who is their longest time director. I spent those 5years learning the water systems of the San Francisco Bay Area and more importantly of EBMU'swater system which services a lot of the area around us. I have strong interest in water, waterdistribution, water storage and what we are doing to improve our storage instead of letting greatrain water flow out the bay and into the ocean. I am not well enough versed on the peripheralcanal to make comment on that but it would be nice to find out exactly what is in store for uswith that as well as how it affects the ecological area as well as cost for the residents. Zone 7 Board Vacancy: Statement of Interest and Qualifications

My name is Niki Wente; I have been a resident of Alameda County my entire life, apart from college. I currently work for my family’s Livermore Valley-based, 136-year-old farming and winemaking business that relies on the resources of the Livermore Valley. Wine is 85% water, which makes this natural resource of huge importance to the success of the Livermore Valley wine region. In addition, my family operates a cattle and rangeland company that relies on annual rainfall, healthy streams and stock ponds to sustain our livestock.

I studied at the California Polytechnic State University in San Luis Obispo where I received my Bachelor of Science with an emphasis in agriculture studies—specifically soil and crop sciences. Since starting my career in agriculture, I have worked in many different regions across California: Livermore Valley, San Luis Obispo County, Napa, Sonoma, Lake County. I am now splitting time between my family’s vineyards in the Livermore Valley and the Arroyo Seco Appellation of Monterey County. Working in these different agricultural regions has provided me with the opportunity to learn about the struggles that different agricultural regions face when it comes to natural resources. Ground water basin management is critical; I have been very impressed with how Zone 7 compares to other regions—I would like to see that trend continue.

In my current role at Wente Vineyards, management of the environment is a primary focus. Wente Vineyards is a Certified California Sustainable Winegrowing Alliance vineyard and winery. This means that we work every year to reduce our carbon footprint, only apply fertilizer or fungicides when necessary using low impact additives, and actively pursue water conservation efforts through water reclamation, drip irrigation, drought tolerant rootstocks, aerial imaging, sap flow sensors, and ET modeling tools. As the leader of our sustainability efforts (and bi-yearly audit) across all our vineyards, a big part of my job is year over year improvements. In addition to agricultural involvement, my family has been highly involved in the community for generations, including: Development of the SLVAP, Innovation Tri Talley, Tri Talley Business Council, East Bay Economic Development Alliance, Downtown Livermore Redevelopment, Livermore Preforming Arts Center, Tri Valley Conservancy, and more. I care deeply about our community and because of literally growing up with an involved father and family, I bring a background to the issues the Livermore Valley is facing. Throughout the years, my family has supported both the environment and well-planned development, and I believe this is a sound policy for the future, while not sacrificing the valleys agricultural land, quality of life, and business vitality.

Currently serving on the Board of Directors of the Alameda County Resource Conservation District, I hope to further my education on local and state-wide projects for resource conservation and the challenges we are facing. I am very interested in our local resource conservation efforts, from creek restoration to building monarch habitats, and understanding the various reasons that we pursue any given project. I have learned a lot from

the various property owners on the board as well as the highly engaged and educated staff on ways we can help to conserve our natural resources.

My hope in applying to join the Zone 7 Board of Directors is that I may bring a unique perspective derived from the agricultural community that I have been involved with. I would like to create an environment in the community that stimulates economic vitality, enhances the quality of life, and makes agricultural businesses thrive, knowing that water and resource preservation is a big part of our future sustainablitiy. I am aware that my family’s business is a customer of Zone 7, and I plan to be as transparent as possible and seek advance on anything that might appear to be a conflict of interest, but at the same time I believe that it is extremely important for agriculture to have a voice.
