NOTICE IS HEREBY GIVEN, that at an election to be held in theseveral towns, villages, cities, wards and election districts of the Stateof Wisconsin, on Tuesday, April 3, 2018, the following question will besubmitted to a vote of the people pursuant to law:

2017 eNRolled JoiNt ReSolutioN 7

To amend section 1 of article VI, section 3 of article VI andsections 7 and 8 of article X; and to create section 17 of article XIVof the constitution; relating to: deleting from the constitution theoffice of state treasurer (second consideration).

Whereas, the 2015 legislature in regular session considered aproposed amendment to the constitution in 2015 Assembly JointResolution 5, which became 2015 Enrolled Joint Resolution 7, andagreed to it by a majority of the members elected to each of the twohouses, which proposed amendment reads as follows:

SectioN 1. Section 1 of article VI of the constitution is amendedto read: [Article VI] Section 1. The qualified electors of this state, atthe times and places of choosing the members of the legislature,shall in 1970 and every 4 years thereafter elect a secretary of state,treasurer and an attorney general who shall hold their offices for4 years 4-year terms.

SectioN 2. Section 3 of article VI of the constitution is amended toread: [Article VI] Section 3. The powers, duties, and compensationof the treasurer and attorney general shall be prescribed by law.

SectioN 3. Sections 7 and 8 of article X of the constitution areamended to read: [Article X] Section 7. The lieutenant governor,secretary of state, treasurer and attorney general, shall constitutea board of commissioners for the sale of the school and universitylands and for the investment of the funds arising therefrom. Any twoof said commissioners shall be a quorum for the transaction of allbusiness pertaining to the duties of their office.

Section 8. Provision shall be made by law for the sale of allschool and university lands after they shall have been appraised;and when any portion of such lands shall be sold and the purchasemoney shall not be paid at the time of the sale, the commissionersshall take security by mortgage upon the lands sold for the sumremaining unpaid, with seven per cent 7 percent interest thereon,payable annually at the office of the treasurer as provided by law. Thecommissioners shall be authorized to execute a good and sufficientconveyance to all purchasers of such lands, and to discharge anymortgages taken as security, when the sum due thereon shall havebeen paid. The commissioners shall have power to withhold fromsale any portion of such lands when they shall deem it expedient,and shall invest all moneys arising from the sale of such lands, aswell as all other university and school funds, in such manner as thelegislature shall provide, and shall give such security for the faithfulperformance of their duties as may be required by law.

SectioN 4. Section 17 of article XIV of the constitution is createdto read: [Article XIV] Section 17. The state treasurer holding officeon the date of ratification of the 2015-17 amendment providing forthe deletion of that office from the constitution shall continue to holdthat office until the first Monday of January in 2019. Any vacancyin the office occurring before that date shall be filled in the mannerprovided by law.

SectioN 5. Numbering of new provisions. If anotherconstitutional amendment ratified by the people creates the numberof any provision created in this joint resolution, the chief of thelegislative reference bureau shall determine the sequencing andthe numbering of the provisions whose numbers conflict and adjustany cross- references thereto.

Now, therefore, be it resolved by the senate, the assemblyconcurring, That the foregoing proposed amendment to theconstitution is agreed to by the 2017 legislature; and, be it further

Resolved, That the foregoing proposed amendment to theconstitution be submitted to a vote of the people at the election tobe held on the first Tuesday in April 2018; and, be it further

Resolved, That the question concerning ratification of theforegoing proposed amendment to the constitution be stated on theballot as follows:

QueStioN 1: “elimination of state treasurer. Shall sections1 and 3of article VI and sections 7 and 8of article X of the constitutionbe amended, and section 17 of article XIV of the constitution becreated, to eliminate the office of state treasurer from the constitutionand to replace the state treasurer with the lieutenant governor as amember of the Board of Commissioners of Public Lands?”

eXPlANAtoRY StAtemeNtArticle VI of the Wisconsin Constitution provides for the election

of a state treasurer every four years. Wis. Const. Art. VI, § 1. TheConstitution spells out only one duty for the Treasurer: to serve asone of three members on the Board of Commissioners of PublicLands, which is charged with the sale of school and universitylands and with the investment of funds arising from such sales.Wis. Const. Art. X, § 7. The other two members of that Board arethe Attorney General and Secretary of State.

The referendumquestion proposes to eliminate the constitutionaloffice of Treasurer. To fill the Treasurer’s position on the Board ofCommissioners of Public Lands, the Lieutenant Governor wouldserve as the third member of that Board.

A “yes” vote on this question would eliminate the constitutionaloffice of the Treasurer. It would replace the Treasurer with theLieutenant Governor as a member of the Board of Commissionersof Public Lands.

A “no” vote would retain the constitutional office of the Treasurerunder Article VI. The Treasurer would also continue to serve as amember of the Board of Commissioners of Public Lands.

BE IT RESOLVED, that the Outagamie CountyBoard of Supervisors does resolve to conduct a countywide advisory referendum, to be held with the spring2018 general election; that a concise statement of thequestion is given and that the question will state asfollows:

Question: Nonpartisan redistricting system. Do youfavor adoption of a nonpartisan system for redistrictingof legislative and congressional districts in Wisconsin?

BE IT FURTHER RESOLVED, the CorporationCounselprepareaNoticeofReferendumtobepublishedby the Outagamie County Clerk in accordance withstatutory requirements, and

BE IT STILL FURTHER RESOLVED this resolutionand the referendum be filed with the Outagamie CountyClerk no later than 70 days prior to the election at whichthe question will appear on the ballot, and

BE IT FINALLY RESOLVED, that the OutagamieCounty Clerk be directed to forward a copy of thisresolution to the Outagamie County CorporationCounsel and the Outagamie County Executive inaccordance with statutory requirements.

The question will appear on the ballot as follows:Question 1: Nonpartisan redistricting system.

Do you favor adoption of a nonpartisan system forredistricting of legislative and congressional districts inWisconsin?

EXPLANATIONA “yes” vote on the Question would result in the

electorate ofOutagamieCounty advising theWisconsinState Legislature to adopt a non-partisan system ofredistricting for legislative and congressional districtsin Wisconsin.

A “no” vote on the Question would result in theelectorate of Outagamie County taking no position onadoption of a non-partisan system of redistricting inWisconsin.

Stat. § 19.84, the Election Inspectors at eachpolling place will convene as the Local Canvassing Board for the purpose of conducting the local canvass pursuant to Wis.Stat. § 7.51. This meeting will be open to the public pursuant to Wis. Stat. §§ 19.81-89.The following notices is applicable for the Villages of Fremont and Iola, Cities of Clintonville, Marion, Waupaca andWeyauwegaNotice of Meeting of the Local and Municipal Board of CanvassersAt the close of voting on Election Day, pursuant to the provisions of Wis. Stat. § 19.84, the Election Inspectors will conveneas a joint meeting of the Local Board of Canvassers and the Municipal Board of Canvassers for the purpose of conductingthe local and municipal canvasses pursuant to Wis. Stat. §§7.51 and 7.53(1). This meeting will be open to the publicpursuant to Wis.
