We must indicate that the Environmental Commission will stop its activity during the negotiations designed to resolve all environmental damages.

REPORT AND COMMENTS OF THE COMMISSION ON THE PROPOSAL OF AGREEMENT BETWEEN

TEXPBT AND PETROECUADOR

The production of service and consumption goods in natural areas, or areas historically developed by man, has caused damages to the ecosystem /words apparently missing in original/ considered its biotic aspect (flora and fauna), abiotic (soil, air and water) /illegible/ environmental study: human actions have decisive effects, which are beneficial for man and living beings.

In the specific case of the oil activity of Texaco and the Ecuadoran Government for 20 years in the Oriente area of Ecuador, both negative and positive effects were produced concerning various environmental factors. Beyond any study that may be performed, such as environmental audits, environmental diagnosis, etc., these are impossible to evaluate, because:

ecosystem of the Oriente area of Ecuador, so as to be able to establish fairly and clearly the actual impact of the effects of its activity for 20 years; it is inexplicable that Texaco, with its experience and under its technical re:;ponsibility, would have ever permitted such significant environmental damages to occur.

2. The former Cepe and Petroecuador have never conduce.ed an environmental audit of the oil activity that would have been able to define the true beneficial and negative emvironmental impact.

3. The government's colonization policy supported the increase of the numbers of farmers, with the consequent deforestation, without compensatory forestation and reforestation, loss of biodiversity, soil and water pollution, etc.

4. Thus, to some extent, the Ecuadoran Government, through the former Cepe and the current Petroecuador, is jointly responsible for the positive and negative environmental effects produced by the actions of Texaco in the Ecuadoran Oriente.

Four years after the stoppage of Texaco's activities, it seems improbable that the parties can agree, based on a technical document, whether we call it Environmental Audit or Diagnosis, basically because the environmental effects are evaluated from

. different viewpoints: the Ecuadoran Government in view of techniques developed in the '80s and applied in the country in the '90s, and Texaco based on the technology /available/ during oil activities in general, and Texaco's in particular.

5. It is fair to mention that most of the analyses of the oil activity have been denunciations by ecological groups, in many cases suffering from a high degree of technical uncertainties (as proven by the latest study conducted by Spanish technicians, which is now in the hands of U.P.A.), and which, in fact, have incited the Ecuadoran community against the oil industry in general, and against Texaco in particular.

6. In principle, these denunciations focus on the damages caused by Texaco's oil activities, due to the loss of forests and biodiversity, without taking into consideration that liThe farmers, attracted by the roads, and supported by the government's land policy, have used the streams, clearing vast regions of tropical forest and displacing the native inhabi tants. This process has contributed to the deforestation of almost 1,000,000 hectares a year in the Ecuadoran ,oriente ... 7. The preoccupation for, and absence of a solution for the oil pollution problem attributable to Texaco, have distracted attention from other environmental problems representing an even higher risk for the country, such as:

Air pollution by the use of lead tetraethy1ene in gasoline, which affects all Ecuadorans;

Indiscriminate use of DDT, including in medical campaigns designed to control malaria, dengue fever and paludism;

The contamination of all the rivers of the country with untreated used water, which is the direct cause of 80% of infant mortality by A.D.D. (Acute Diarrheic Diseases) ;

The lack of incentives for Ecuadoran peasants who emigrated to the big cities of the country, where they created extremely poor, or economically invisible quarters, t.oday called II suburban quarters, " with all the negative economic connotations for the country (Lucia Burgos. Socio-economic study of the marginal quarters of Quito. Project for the decontamination of the Machangara river. G. T. 2 - Municipality of QUITO, 1992), among many of today's problems.

B. ENVIRONMENTAL DAMAGES

In this context, the interests of the country dictate putting an end to a reality which, unfortunately, is being left without a solution. It is positive that the Government and Texaco begin their talks, as the only democratic way to reach an agreement, so that the latter may indemnify' or alleviate the negative environmental effects caused by its activity to the Ecuadoran population living in our Amazonian region.

In order to reach an agreement and have a basis for talks, in 1991 the parties, i.e. Texaco and Petroecuador contracted the company HBT of Canada to conduct an environmental audit.

The report of the audit was not accepted by Ecuador in principle, because the first report did not comply with the contractual terms, and because it contained typographical errors and anglicisms.

In our opinion, this audit, in addition to being incomplete concerning reference terms, established an extremely low amount for the compensation to Ecuador, i. e. US$ l3, 000,000.00 for environmental damages. According to the study, this amount should be shared according to the participation percentage of the parties, whereby Texaco should pay approximately US$ 5,000 1 000.00.

Thus, on October 14, Minister Francisco Acosta submitted to the President of the Environmental Commission of the National Congress, Ledo, Eduardo Villaquiran Lebed, Texaco's proposal for

Environmental Repairs for the areas affected by the former Petroecuador - Texaco Consortium, as well as the Schedule of the Agreement Memorandum, and the final draft of the Proposal for Environmental Repairs.

The first document contains a proposal submitted by Texaco to Ecuador, and a second, issued jointly by Petroecuador and Texaco.

In the second proposal, the following alleviation environmental actions are listed:

• Repair and cleaning of oil-contaminated soil.

• Closing and cleaning of pools at well sites.

• Reinjection of production water in Aguarico, Atacapi and Yuca.

• Treatment of formation water.

• Solid waste treatment.

In addition, the following social compensation and indemnification measures are proposed:

• Nurseries for reforestation with native plants and trees and other types of vegetation.

• Fish-breeding installations.

• Farms for the breeding of native animals.

• Installation of medical dispensaries.

• Basic education centers.

• A program for satellite monitoring and technology transfer.

1. The problem of the compensation for the environmental damages caused by Texaco's activities is just one of the many Ecuador currently has. It must be noted that these activities have generated, and still generate foreign currency, and finance a large part of the national budget (which is a positive environmental effect); while other environmental problems still unsolved do not generate, in their development, any kind of profit for the national treasury. .

2. Due to all of the above, it is a historic necessity for the Environmental Commission of the National Congress to issue a decision on the problem which arose between Texaco and the Ecuadoran government; not only in order to dern<:mstrate the seriousness of the country, and to attract foreign investments, but also to compensate, actually and rapidly, the

inhabitants of the affected areas in the Ecuadoran Amazonian region.

3. Texaco's new proposal promises to alleviate, compensate and indemnify for negative effects, to the extent that Texaco assumes the entire cost, including those itoms in which Petroecuador has invested in the last four years, and which must be acknowledged.

4. Finally, we must stress that Texaco's new proposal concerns alleviation and compensations in the biotic, abiotic and socio-economic areas.

Therefore, it is our opinion that the National Congress, through the President of the Environmental Commission, should propose the following aspects:

• The Schedule of the Agreement Memorandum must b~ drawn up ln the imperative, and not in the conditional.

• The documents must refer to alleviations, indemnifications and compensations, and not to donations.

• Texaco's document must establish that the work and actions to be implemented shall comply with current Ecuadoran regulations and standards and, if the country does not have them, EPA or other acknowledged u.s. standards shall be applied.

• All alleviation work must be current use of water, soil, reasonable degree.

• The acceptance of the work shall not take place by the 15-day deadline, but by establishing provisional and final acceptance dates, according to Ecuadoran laws.

• The projects related to the community must be part of the total proposal. An atmosphere of consensus must be created, especially taking into consideration the inhabitants and authorities of the region.

• A detailed inventory must be drawn up, with the particularities of each place and each aspect to be agreed upon.

• In the agreement and/or treaty, both Ecuador and Texaco shall establish domicile, in the event of conflict, leaving open the possibility of filing lawsuits both in Ecuador and before United States courts.

• In the case of water reinjection, it shall be determined that the same geological stratum shall be restored, after

• A physico-chemical-bacteriological monitoring of water and soil shall be included, in order to ascertain the quality of the receiving bodies, especially in the area of 'influence in which fish breeding installations are introduced.

• The number and location of nurseries, fish breeding installations, and medical centers must be defined, depending on actual necessities and strategic location thereof.

• An activity calendar must be part of the agreement.

• Supervision must be entrusted to third parties, and not to Petroecuador or Texaco.

• Disputes shall be resolved with the intervention of a national or foreign independent consultant, previously selected by the parties from a list supplied by TEXPET, after being accepted by the Ecuadoran Government.

Congreso Nacional que presido, pone a su conocimiento el informe referente a los resultados obtenidos en la Sesion de trabajo efectuada el diajueves 13 de octubre del anD en cur so, entre los Miembros de la Comision, los representantes de PElROECUADOR y TEXACO, para tratar la "Propuesta del Convenio presentada por TEXPET y PETROECUADOR, para solucionar el danG ambiental y social en el Oriente Ecuatoriano ", provocado por la operacion del consorcio Petroecuador-Texaco.

Cabe senalar que la Com is ion de Medio Ambiente estara pendiente en el proceso de negociaciones que se desarrolle con el objeto de solucionar todos. aquellos danos provocados al medio ambiente.

Nunca se entrego a;.la compania Texaco un inventario de los recursos del ~osislema del oriente ecuatoriano, a fin de pader establecer con justicia y claridad el impacto real de las a[ectaciones que su actividad produjo durance 20 anos. siendo inexplicable que la Compania Texaco por su experiencia .1' dentro de su responsabilidad lecnica jamizs debio permitir que suceda tan significativo dana ecol6gico.

2. No se I/evo por parte de la &-Cepe y Petroecuador un monitoreo ambiental de fa actividad petrol era. que pueda definir /os wrdaderos impactos ambientales beneficos y negattvos.

3 .. Las politicas guhernamentales de colonizaaon propiciaron el aumento de colonos con consecuencias cqmo la deforestacion. sin una forestacion ...... relorestacion compensatoria. perdida de /a biodiversidad. contaminacion del sue/o, aguas, etc .

Es de justicia relatar que la mayoria de los amilisis ejecutados a la actividad petrolera han sido denuncias realizadas por grupos ecologistas. en muchos casos. cargados de gran grado de incertidumbre tecnica ( como 10 prueba el ultimo estudio realizado por tecnicos espaiioles , estudio que se halla en manos de la U.P A.) Y que de hecho han predispuesto a la comunidad ecuatoriana contra la actividad petrolera en general y de Texaco en particular.

6. Esas denuncias en principo se centran en los danos ocasionados por la actividad petrolera de la Texaco, por la perdida de bosques y biodiversidad. sin considerar que;. "Los colemos atraidos por los caminos y alentados por politicas gubername'iztaies de tierras 'han entrado a raudales. despejando vastas regiones de bosque tropical y desplazando a los habitantes indigenas. Este proceso ha contribuido a una deforestacion de casi 1.000.000 de hectareas al ano en el Oriente ecuatoriano ... De esa manera el 14 de octubre el Afinistro Francisco Acosta presento al Presidente de la Comision de J.fedio Ambiente del Congreso Nacional. Ledo .

. ~_ Eduardo Villaquiran Lebed. la propuesta de la Texaco de Reparacion Ambiental para las areas aJectadas en el Ex-Consorcio Petroecuador-Texaco. asi como el Esquema del Aiemorando de Com-enio y elBorrador final de la Propuesta para la Reparacion Medio Ambiental.

EI primer documento estahlece una propuesta presentada por Texaco a/ Ecuador y una segunda realizada conjuntamente entre Petroecuador y la Texaco.

En la segunda propuesta se listan las siguientes acciones de mitigacion ambiental:

• Reparacion y limpieza de suelas contaminados por hidrocarburas . • Cierre y depuracion de piscinas en las localizaciones de los pozos. • Reinyeccion de aguas de producciOn en Aguarico, Atacapi y Yuca. • Tratamiento de las aguas de formacion • Tratamiento de desechcs solides

CONCLUSIONES

1. EI problema de Ja compensaci6n de los danos ambientales ocasionados por las actividades de la compania Texaco es uno de los tantos que el Ecuador tienen

en la actualida~ebiendo anotarse que esas actividades generaron y generan ," . divisas que financiaron y financian gran parte del presupuesto naciona/ (lo

,cual es un impacto ambiental positivo); en tanto que ouos problemas ambientales aUn no resueltos no generan en su proceso ningtin tipo de ,~tilidad para el erario nacional.

2. Por todo 10 antes expuesto es una necesidad hist6rica que /a Comision de ~\{edio Ambiente del H. Congreso Nacional. se pronuncie sobre el problema ·suscitado entre la Texaco y el Gobierno del Ecuador!' no solo. para demosuar fa seriedad del pais y para atraer la inversion extranjera. si no para

_ compensar de forma real y Tapida a loshabitantes del bloque afectados en /a Amazonia del Ecuador.

3. La nueva propuesta de ]a Texaco propone mitigar, compensar e indemni:ar . los impactos negativos, Tealizados en la medida que la misma Texaco asuma . ]a totalidad del costo, inclusive aquel/os en que Petroecua~ haya hechb

inversio,!€s en los ultimos cuatro aiios, los mismos que tendrizn que ser reconocidos.

4. Finalmente debe recalcarse que la nueva propuesta de la Texaco alxuca mitigaciones y compensaciones en las areas: biotica, ahiOtica }' socio econ6mica.

De a/li que sea nuestro criterio que el Honorable Congreso NacionaL a trm-es del Presidente de la Comision de Medio Ambiente, proponga los siguientes aspectos:

• Ell caso de reinyeccion de aguas se determinara que se realizara el mismo manto geolOgico. previo su tratamiento.

• Se incluira el monitoreo fisico-quimico-bactereolOgico de Jas aguas y suelos. a fin de conacer la caIidad de los cuerpos receptores. especialmente en las zonas de influencia en las cuales se impiementen instalaciones piscicolas.

• Deberan definirse el nilmero y /ocaJizacion de viveros. j'nstalaciones piscicolas. centros medicos. deacuerdo a S1l verdad necesidad y uhicacion estrategica.
