Kean Opening SpeechAs a nation, especially post 9/11, we have ackno wledge d the importance o f emerge ncypreparedness in minimizing th e impact of any disaster on people and property. Since9/11, the country, in both the pub lic and private sector, has taken significant measures toimprove secu rity and preparedness. Initially, our national focus was primarily on publicsector preparedness in terms of first responders, intelligence, m ilitary, transportation andth e like. Yet, when an event occurs, it is likely to severely impact the private sector giventhat businesses and other private sector organization ow n 85 percent of our countries 'infrastructure. The lessons learned from 9-11 hit hardest on those companies and theiremployees w ho were impacted (some of whom wil l be present today) as well as the firstresponders who so bravely tried to rescue and save lives that day. The lessons learnedhave led to significant changes in the way the private sector goes about preparedness andsafety of their employees and we will examine a few examples of what has been donethat is positive today.In other cases, where companies were not directly affected by 9-11, companies have alsoheard the call and signific antly improved their situations as we ll. Public/Private sectorpartnerships have been enhanced and others have sprung forw ard which w e will hearabout today from areas across the country. However, some measures of preparednessthat were recently described in several public surveys im ply that areas of weakness stillprevail . In addition, the recent fire in Chicago in a high rise where peop le w ere killeddemonstrates that issues still need to be addressed. The Conference Board recentlyconcluded that while "corporate security spending has clearly increased since 9/11, theincreases have been uneve nly distributed and is only 4 percent on average, w ithcom panies in the Northeast M etro region reporting the biggest increases". In a surveyconducted for Guardsmark, it was reported that "4 5 percent of the companies interviewed(over 800 people) are not conduc ting emergency drills".W e don't need these statistics alone to tell us what the current situation is like, but weknow through these examples and through the work that the Dept. of Homeland Securityhas been doing as well as our Commission staff in their 9-11 interview process, that therear e issues to exam ine in the area of preparedness. The Black out in NY and NJhighlighted this even further. And then there was a hurricane. It is the po in t of today 'shearing to exam ine the lessons learned about preparedness stem min g from the 9-11experience, hear about what is occurring in the private sector to improve preparednessan d continuity of business , and see what issues remain. The joint efforts between th eGovernment and the private sector to enhance the preparedness of our country will bediscussed along with standards for preparedness that are in the marketplace. W e believethat this discussion has been occurring at many leve ls around our country and we w illcontinue that discussion today and in the months ahead in hopes that the Commission canmake some recommendations in this area. A large part of this respon sibility wi ll directlyrest on the shoulders of the private sector com panies who form the basis of our economy

    and will continue to work on these issues. The point of the hearing is to assure th efamilies of the victims that th e lessons learned from that day will help improve thesecurity and safety of employees, such as their family members , in the future.

    Introduct ion Sally RegenhardClearly the experience of 9-11 ha s affected many people through-out the world, but noone is more affected than the families of those who lost relatives in the attack. Thecommission is here largely due to their efforts. We have been working with and talkingto th e families regularly since the Commission began its work and we will continue to doso. W e have a relationship that is productive , and I believe w e are all work ing towardsthe same end: to write the accurate story of Sept. 11 and to develop recommendationsthat will make the world safer from this kind of event in the future. Today's hearingfocuses on an area that one of the family members, Sally Regenhard, has taken to herheart. Her son, firefighter . . . . , died on Sept. 11. Sally did not let the story e nd there buthas gone to great lengths in remem brance of him to devote her life and her work toskyscra per safety issues and w ith M onica Ga brielle, whose husband , , died as we ll, theyhave formed the Skycraper S afety Campaign to uncover and reme dy issues related toevacuation and safety issues in high rise building. They have been instrumental ingetting the Colum bia U. Ev acuation Study off the ground and they are w orking w ith adistinguished Advisory Panel as well as leading interested parties through-out the countryto develop and implement changes to the fire and building codes based on lessons learnedfrom 9-11. W e are pleased to have Sally and Monica here with us today.     Questions fo r SallyDo you think the proposed fire code changes in NYC go far enough for the needsidentified f rom 9-11 and do you think they can be implem ented (particular ly th eenforcement piece)?W e understand the families gave letters to OSHA requesting an examination of thesituation at the W TC site, but the letters did not result in an exam ination by OSHA.What were the reasons given for this?If OSHA's standards relating to an evacuation p lan were give n en for ceab ility, could theybe a standard that would assist in skyscraper safety?What is the attitude of the Build ing Owners towards these changes and is it changing toaccept some of these changes?W e noticed that th e Skycraper Safety Campaign issued a press release after th e Chicagofire. Both the public and the private sectorshave collectively and independently initiated many actions that have enhanced thepossibility of safety in face of the threat of terrorism as well as other natura l hazards inou r country. While we cannot examine all of these initiatives, we do know that many arebeing espoused across the country.
