MEMORANDUM OF AGREEMENT KNOW ALL MEN BY THESE PRESENTS:  The NATIONAL YOUTH COMMISSION (NYC), a government agency created and existing by virtue of Republic Act 8044 office at the 4 th flo or , Bookman Build ing, 373 Quezon Avenue, Quezon Cit y, her ein represented by its Chairperson and Chief Executive Officer, CHRISTOPHER LAWRENCE S. ARNUCO, hereinafter referred to as the FIRST PARTY ; And NAME OF DELEGATE, Filipino citizen with principal address at (add ress of th e de legate), herein be re ferr ed to as the SECOND PARTY; WITNESSETH WHEREAS, Sec. 10 (g) of Republic Act No. 8044 or otherwise known as the “Youth in Nation Building Act” mandates the National  Youth Commission to establish and maintain linkages with international youth and youth-serving organizations or institutions and counterpart agencies of foreign governments in order to facilitate and ensure the participation of the Filipino youth in international functions and affairs; WHEREAS, Sec. 10 (h) of R.A. 8044 likewise mandates the NYC to admin ister youth exc hange pr ograms as wel l as to moni tor and coordinate all foreign-sponsored youth programs and projects such as Ship for Sou th East Asian Yo uth Progr am and other s imilar excha nges and goodwill mission; WHEREAS, th e Japan Ea st As ia Ne twork of Ex ch ange fo r Students and You ths ( JENES YS) Programme is an annual exchange pro gr am that starte d in 2007 joint ly impl ement ed by the Nat ional  Youth Commission, Japan Information and Culture Center (JICC) of the  Japa nese Emb assy and the Japa n Inte rna tion al Coop erat ion Cent er (JICE); WHEREAS, the National Youth Commission is implementing the  JENESYS Pro gramme as one of its fo reign-spon sored you th exchang e programs;

MEMORANDUM OF AGREEMENT 

KNOW ALL MEN BY THESE PRESENTS:

 The NATIONAL YOUTH COMMISSION (NYC), a government agencycreated and existing by virtue of Republic Act 8044 office at the 4 th

floor, Bookman Building, 373 Quezon Avenue, Quezon City, hereinrepresented by its Chairperson and Chief Executive Officer,CHRISTOPHER LAWRENCE S. ARNUCO, hereinafter referred to asthe FIRST PARTY ;

And

NAME OF DELEGATE, Filipino citizen with principal address at(address of the delegate), herein be referred to as the SECONDPARTY;

WITNESSETH

WHEREAS, Sec. 10 (g) of Republic Act No. 8044 or otherwiseknown as the “Youth in Nation Building Act” mandates the National Youth Commission to establish and maintain linkages with internationalyouth and youth-serving organizations or institutions and counterpartagencies of foreign governments in order to facilitate and ensure theparticipation of the Filipino youth in international functions and affairs;

WHEREAS, Sec. 10 (h) of R.A. 8044 likewise mandates the NYCto administer youth exchange programs as well as to monitor andcoordinate all foreign-sponsored youth programs and projects such asShip for South East Asian Youth Program and other similar exchangesand goodwill mission;

WHEREAS, the Japan East Asia Network of Exchange for

Students and Youths (JENESYS) Programme is an annual exchangeprogram that started in 2007 jointly implemented by the National Youth Commission, Japan Information and Culture Center (JICC) of the  Japanese Embassy and the Japan International Cooperation Center(JICE);

WHEREAS, the National Youth Commission is implementing the JENESYS Programme as one of its foreign-sponsored youth exchangeprograms;

WHEREAS, name of delegate, as a beneficiary of this program,commits to voluntarily lend support and assistance to the National Youth Commission;

WHEREAS, both parties believe that the execution of thisMemorandum of Agreement will advance Filipino youth empowerment;

NOW, THEREFORE, RECOGNIZING the foregoing premises, theparties enter into this Memorandum of Agreement under the followingterms and conditions, to wit:

A. The First Party shall:

1. notify the Second Party of the implementation of projects and activities being undertaken in the area;

2. coordinate with the Second Party to assist the AreaOfficer or Regional Cluster Coordinator in undertakingactivities in the area such as but not limited topromotion, dissemination of NYC activities, programs,projects and policies;

3. include the Second Party in the roster of volunteersafter completion of forty (40) hours of volunteer workplus the entitlement of having the NYC Volunteer’sPassport including all the benefits which may beextended to all its holders;

4. issue to the Second Party a Certificate of CompletedParticipation for every task complied duly signed by theChairperson upon recommendation of the respectiveNYC Area Officer or Regional Cluster Coordinator andendorsement of the respective Division Chiefs of theSocial Marketing Division or the Regional YouthDevelopment Division, as the case maybe; and

5. provide the Second Party one (1) NYC Volunteer’sPassport which is non-transferrable.

B.The Second Party shall:

1. render at least not less than forty (40) hours of voluntary work by assisting the Area Officer orRegional Cluster Coordinator in the activities beingundertaken by the First Party;

2. assist the First Party thru coordination with its AreaOfficer or Regional Cluster Coordinator in undertakingactivities in the area such as but not limited topromotion, dissemination of NYC activities, programs,projects and policies ;

3. recommend to the Area Officer or Regional Coordinatorprojects and activities to be implemented in the area;

4. submit a policy output from the abovementionedprogram for Commission’s review and appropriateaction;

5. conduct or organize public fora on learnings that thedelegate had acquired from the said program that willbe of greater importance to the Filipino youth in thedelegate’s region immediately one month afterreturning from the activity or earlier whichever appliesfirst;

6. submit to the NYC at least two (2) policy papers out of the public forum discussion mentioned in item no.5immediately one month after returning from the activityor earlier whichever applies first;

7. recruit at least twenty (20) applicants from her regionfor 2012 NYC programs such as but not limited to YORP, TAYO, and etc; and

8. hold and maintain the NYC Volunteer’s Passport as herevidence for the number of hours of volunteer worksrendered which remains the property of NYC. The FirstParty may at anytime demand for its return. Anydamage to the said passport will be borne by theSecond Party in its monetary equivalent.

C. AMENDMENTS

 The terms and conditions contained herein may be amended andmodified in writing, duly signed, sealed and acknowledged by bothparties, which amendments or modifications shall be attached to theoriginal copy of this Agreement.

A. BREACH OF OBLIGATIONS

In the event that the Second Party fails to perform any of the

agreed covenants abovementioned, the Second Party shall reimbursethe individual monetary value of the expenses that the government of the Philippines spent for the program, through the NYC, or the value of our international counterpart has extended with 10% escalation,whichever is higher.

B. SEPARABILITY CLAUSE

If, for any reason or reasons, any part or provision of thisAgreement shall be held illegal or invalid, the other parts or provisions,which are not affected, shall continue to be in effect.

D. DURATION OF AGREEMENT

 This Agreement shall be effective upon signing hereof, shall remainin full force and effect and will be automatically terminated uponissuance of a Certification from the Area Officer or NYC regionalcoordinator without need of prior notice.
