From the Pastor, Fr. Anthony Mendoza

Can a Catholic Be a Good Federal Judge? The title to this column may seem to be a very strange question, but it has been raised implicitly by people who have questioned the appointment of devout Catholics as judges on federal courts. For example, in 2017 Amy Coney Barrett was appointed a judge on the 7th Circuit Court of Appeals. In her confirmation hearing, Senator Diane Feinstein asked her: “Why is it that so many of us on this side have this very uncomfortable feeling that dogma and law are two different things, and I think whatever a religion is, it has its own dogma. The law is totally different. And I think in your case, professor, when you read your speeches, the conclusion one draws is that the dogma lives loudly within you. And that’s of concern.” In that hearing, Senator Feinstein later said to Judge Barrett, “You’re controversial because many of us that have lived our lives as women really recognize the value of finally being able to control our reproductive systems,” she said. “And Roe entered into that, obviously.” Senator Feinstein, like many others, was insisting on a complete separation between law and religion. But a complete separation makes no sense, since some public laws should correspond to religious beliefs. For example, many religions teach that it is wrong to steal, and public laws also forbid stealing. That doesn’t mean that those laws are imposing religious beliefs on anybody! There are certain principles which go beyond religious beliefs, that is, the principles found in what is called the “Natural Law.” To put it briefly, the principles of the Natural Law are so basic to our human nature that anybody who reasons well should be able to understand and accept them. For example, even a thief should be able to reason that stealing is wrong, for he can see that it would be wrong for somebody to steal from him! In a similar way, even a professional killer should be able to reason that it is wrong to murder. Sadly, many people do not always reason well, even about principles as basic as stealing and the killing of human beings. Senator Feinstein’s later remark shows that she is concerned with maintaining the “right” of deliberately killing prenatal babies by abortion, in accordance with the Supreme Court decision Roe vs. Wade, which overthrew the legal precedents protecting unborn girls and boys. That seems to have been her concern in wanting a total separation between religion and laws. [https://www.catholicnewsagency.com/news/dogma-lives-loudly---amy-coney-barretts-2017-confirmation-hearing-sparked-controversy-64859] A similar concern was expressed by Senator Kamela Harris when she questioned Brian Buescher, who was nominated in 2018 to serve on a U.S. District Court. Senator Harris asked Buescher: “Were you aware that the Knights of Columbus opposed a woman’s right to choose when you joined the organization?” She went on to ask Buescher if he had “ever, in any way, assisted with or contributed to advocacy against women’s reproductive rights.” [https://www.firstthings.com/web-exclusives/2020/10/kamala-harriss-record-of-anti-catholic-bigotry] Of course “a woman’s right to choose” is a euphemism for abortion. The Knights of Columbus is a Catholic service and fraternal society which closely follows the teachings of the Catholic Church. Senator Harris was implying that membership in a society that follows Catholic teaching calls into question a person’s qualifications to be a federal judge. What is necessary to be a justice on the Supreme Court or other federal courts is for a person to correctly apply the Constitution and federal laws to cases. As the Constitution states, no religious test shall ever be required as a qualification to an office in the United States. But federal judges should certainly be able to affirm the principles of Natural Law that are found in the Constitution and federal laws, even when those same principles are found in certain religions.

POR EL VICARIO PARROQUIAL, P. PEDRO MERCADO, JR.

Ruth Bader Ginsburg
