"1. That the 2nd party (employer) is ready and willing to pay to the 1st party (workman) a total sum 'of Rupees Two Thousand One Hundred only' as .follows: -

5. The Party I, the workman Shri Madukar Porob, is agreeable and willing: to .aCcept the above settlement though his claim is for reinstatement with full back wages, as he has already secured job elsewhere from 1982 onwards. Hence he is accepting the above settlement."

3. The Marmagoa Municipal Council filed its written state-ment in w:hich it is stated, in short, that Smt. Carmela Lobo secured high marks in the written test whilst the workmEill stood second and therefore, she was entitled to the said post. It is further submitted that when the recruitment Rules lay down that the appointment/promotion to a particular post is by 'Selection' it is open to the employer to aq.opt such norms as may be' considered appropriate for such selection including a written test. '

, 4. After rejOinder was filed by the Union, order was passed by my Ld .. Predecessor Dr. Coelho, on 27-9-1980', holding th,at Smt. Carmela Lobo was a necessary party to the dispute ailld so notice was given to her to' contest the daim.

5. Smt. Carmela Lobo, in her written statement, has stated that she had qualifying services as - U.D.C. and, therefore, had to be coIlS'idered for promotion to the post of Head Clerk Eilld since in the -written test she was adjudged the best, her promotion is legal, Eilld .has to be mailitained.

_ 6. Th~ UniOi!l filed its rejodnder to the written statemen:t of ,.Smt. Carmela' Lobo, maintaining the stand taken before

,7. When 'evidence was being recorded, both the parties approached the Tribunal and filed .an amicable settlement of the dispute praying that co:nsent award be passed and the reference disposed off accordingly.

8. 'The' terms of settlement are as follows: I

"1. The promotion of Shrli Vasant Naik to ,the post of Head Clerk will be regu:tarised with effect from 31-8-1977.

2. The basic pay of Shri. Vasant, S. Naik will be revised and his pay will be fixed in the time scale 425-700 as per the Rules w.e.f. 3-9-1977 alongwith all. financial benefits accrued thereby except during the 'period of reversion' to the post of D.D.C.

3. The seniority of Shri V. S. Naik" Head Clerk, will be fixed as per normal rules of seniority taking into account his ex-post factor regular.isation with effect from 31-8-1977:;, '
