Dear SirThe impression prevails in some (Itlarters that water is

being diverted from the \'erde River and its tributaries inYavapai County, and utilized for irrigation purposes in de-rogation of the rights vested in the land owners under theSalt River project under the terms of the Kent Decree.

It is assumed that in the exercise of your duties as WaterCommissioner in executing al1d carrying out the provisionsof the Decree, you will desire to take such steps as appearnecessary in order to determine whether there is any basis forthis iml)ression, and to take appropriate corrective measures ifit is found that such are necessary.

As to the manner of carrying on such an investigationmy suggestions as to a proper procedure to follow are em-bodied in the following paragraphs

The report of Mr. 0. A. Turney covering investigationsmade by him and others in 1901, 1)urports to show tl1e approxi-mate location. (late of construction and capacity of the ditchestaking water for irrigation from the Verde River and the va-rious creeks which are tributary to it. It also shows thenames of the then owners of the land irrigated from theseditches, and the acreage irrigated. The description of thevarious tracts is not shown. The report further shows allnotices of appropriation of these waters, giving the date,amount, name of appropriator and reference to the countyrecords.

These data should be thoroughly checked on the groundand the description of the lands being.irrigated with the namesof the present owners secured. If the acreage to which water.is being applied has been enlarged. the. dates whea such. new:land was brought into cultivation from year to year should i)e

ascertained; also, as to both old and new lands whether waterhas been continuously used and if not the dates and lengthsof the periods when the land was not irrigated. So far aspossible the amounts of water actually used should be ascer-tamed. If the ditches themselves have been enlarged the dateand the increased capacity should be noted.

As to all notices of appropriation subsequent to Mr Tur-ney's report which are of record, the (late, name of parties,amount of water, purpose, and, so far as is shown, the landto which it is proposed the water shall be applied should beascertained. The names, locations and capacities of any newditches should be secured, together with the names of theowners, the description of the lands irrigated, the dates ofconstruction, the amounts of water diverted and the acreagebrought into cultivation from year to year.

If water has been appropriated for power purposes, asfull information as possible should be secured especially withreference to the disposition of the water after it has servedits purpose in the matter of power development.

Altogether, for the purposes in mind, it seems to methat it is desirable to secure as complete information as pos-sible relative to all notices of appropriation which are of re-cord and more particularly relative to all lands for the irriga-tion of which water is being diverted from the Verde Riverand its tributaries, inClU(liflg the description of the land, thelocation, date of construction and capacity of the ditches, to-getlier with information as to dates of enlargements and in-creased capacity the dates when additional acreages wereJ)rougllt into cultivation afl(l the facts as to whether the amountof water used or claimed has been applied to a reasonably con-tinuous use since the (late of appropriation.

GRANITE CREEK

Under normal con(litions the water in upper Granite Creekwill only reach the Verde River as underfiow, even if nonewere appropriate(l. After rains there is consi(lerabie run-offat times that does now reach the Verde. This will be entire-iv cut off if the plans of the Arizona Land & I rrigation Corn-l)afly mature, it is their intention to impound and store allflood waters of Granite and Willow Creeks by building damsacross 1)0th creeks, about five miles northeast of Prescott. Theyclaim they will have a storage capacity of 19,000 cu. ft., a suf-ficient amount to (leliver 1.5 acre feet to 10,000 acres that theycontemplate serving from their reservoirs. At present theyhave suspen(le(l work on account of financial troubles. Theyhad completed, before quitting work, a storage dam built ofconcrete, 7 feet high above the bed of creek in Granite Creek.Their engineer in charge claims that a sufficient flow of floodwater to make 6,000 acre feet has passed through their reser-voir site on Granite Creek from january 1st to September 1stof this year.

Mrs. Marshall Payne owns the SE 4, Sec. 12, T. 14 N.,R. 2 W. (called Granite Dells), 40 acres cultivated, first cul-tivation 1879, Supplie(I from two (litches out of Granite Creek,one on the East si(le, capacity 30 inches, the other on the VTestside, capacity 20 inches. Uses water most of the time.

ohu Branconia place is just below the mouth of 1W illowCreek on the West side of Granite Creek in the West half ofthe SE 4 and the East /2 of the SW 4 of Section 1, an(l theNorth j of the NW of Section 12, T. 14 N, R. 2 W. 35 acrescultivated, first cultivation 1868, capacity of ditch 30 inches.Uses water most of the time.

The John i)uke place is in the East of the NE V ofSection 1, T. 14 N. R. 2 W. on the East side of Granite Creek,capacity of (litch 90 inches, 50 acres cultivated, first cultiva-tion 1898.

The T. E. Campbell place at mouth of Granite Creek issituated on the N\'V % of the SW 4, and SW 4 of the NW/4 of Section 13, and the Last j/2 of the NE 4 of Section 14,

T. 12 2 W. There are signs of about 30 acres havingbeen cultivated on both sides of tIme creek. They claim last ir-m-igation in 1913. Water used on this ranch reaches the Verdewhen it is not iii use.

Section 35, T. 17 N. R, 2 W. furnish Prescott with domesticwater. The S. F. P. & P Railway haul a number of train loadsof water from here daily at times. In addition the Del RioDairy irrigate 140 acres ill tile S j of the SE 4 of Section22, and the W. of the NW of Section 26, and the NE4 of Section 27, T. 17 N. R, 2 W. 175 inches is tile total

amount flowing from these springs. This land was first cul-tivated in 1864 or 1865. These springs naturally flow into theVerde a few miles above the mouth of Granite creek.

VERDE RIVER

The first pernianent water rises ill the Verde about themouth of Granite Creek. Granite Creek now adds 75 inchesto tile Verde. About one mile below Granite Creek springsrise in North si(le of river i)ed to make total flow 875 inches.This is a permanent flow at this point. About a mile belowthe first ditch is taken out by T. E. Campbell to irrigate 32acres on the North side of the river in the NE 4 of Section 7,T. 17 N. R. 1 W. Capacity of tile ditch 110 inches, first cul-tivation in 1874 or 1875

The M. A. & R. F. Perkins place is tile next ranch irri-gated. It is situated in the S of Section 31, T 18 N. R. 2 E.They irrigate 75 acres, capacity of ditch 80 inches. This isflumed under the river a short way below the head and landirrigate(l on both sides ; first cultivation in 1864 or 1865.

David Armon, a squatter, is in Section 12, T. 17 N. R. 2F. He is cultivating 3 or 4 acres. First water March, 1914,capacity of ditch 10 inches. f)itch 2 miles long. Cost $400to build.

Rosindo Alvarez has 70 acres in Section 12, Township 17 N.R, 2 F. 9 acres irrigated, 7 more can be irrigated, first irriga-tion 1901 : capacity of (litch 40 ins. Water used au of the time.

August Thorbeck at month of Sycamore Creek on Eastside of Verde river, has two ditches that draw water from Sy-camore; one on North side, capacity 45 inches, irrigates 12acres the other one on South side, capacity 30 inches, irri-gates 5 acres, first cultivation 1880. Uses water most of theyear.

Tile Duff ditch, built by Dtiff about 1879. Capacity 150inches. Ordinary head used, 50 ins. This ditch supplies wa-ter for 42 acres out of 400 acres owned by Upper Verde Fruit& Orchard Co., on East side of Verde river ill Sec. 8 and 9,

The Sullivan ditch, l)Uilt by Dykster about 1896. Max.capacity 65 inches. ordinary head used 55 inches. This ditchsul)l)lies water for 50 acres out of 120 acres owned by VerdeFruit Co. on West side of Verde river in Sec. 8 and 9, T. 16 N.R. 3 F. In 1901 Turney's report, maxiniuni capacity 70inches. Served water to 50 acres.

The E. L. Jordan ditch, l)uilt by Tom Carrol about 1882.Maximum capacity 175 inches, ordinary head used 175 inches.This ditch supplies water for 50 acres out of 240 acres ownedI)y Verde Fruit Company on West side of Verde river in Sec-tion 8, T. 16 N. R. 3 E. There is a good deal of water wastedl)ack into the river from this ranch. Turney's report in 1901,maximum capacitY 150 inches, served water to 35 acres.

The W. A. Jordan ditch, built by Thompson about 1880,Maximum capacity 80 inches. Ordinary head used 55 ins.This ditch supplies water for 35 acres out of 150 owned byUpper Verde Fruit & Orchard Co. on the East side of Verderiver in Sec. 17, T. 16 N. R. 3 E., 15 acres of this land has beenput un(ler cultivation recently. Turney's report, 1901, max-iiiitiin capacity 90 inches served water to 20 acres.

Hunibert ditch built by Huinbert about 1898. Maxiniuincapacity 35 inches, ordinary head used 20 inches. This ditchsupplies water for 5 acres out of 160 owned by Upper VerdeFruit & Orchard Company on west side of Verde river in Sec-tions 20 an(l 21, T. 16 N. R. 3 E. More of this land was incultivation in the past l)efore being purchased by present own-ers. This laud is being used for tpwnsite and smelter site atClarkdale and all cultivation will most likely cease on it whensmelter is in operation. 1Vlaximuni capacity, Turney's reportin 1901, 300 ins. Water power in ditch at that time to raisewater to higher level, has been abandoned since then.

Allen Ditch, built by Allen & Wood about 1898, maximumcapacity 350 ins. Ordinary head used 200 ins. This ditch sill)-plies water for 320 acres out of 1580 owned and leased by Up-per Verde Fruit & Orchard Company on East side of Verderiver iii sections 15, 16, 17, 21 and 22. 35 acres in the N.of the SE 4 of Section 22 was first cultivated by F. Hawkinsby a private ditch in 1876. Maximumii capacity, Tnrney's re-l)ort in 1901, about 380 ins, served water to about 250 acres.

Hickey Ditch, built by Hickey about 1874, originallyheaded on East si(le of river and only served laud on East

side. Some years ago a large flood washed out their head.They went further up stream and took water out on \Vestside, taking in additional land amounting to 11 acres for FrankDelaney and 11 acres for B. Lugo in Section 22, then flumeingtinder the Verde river with a metal flume 23 ins, in diameterand irrigating 21 acres for Arthur Woods in Sec. 27, 20 acresfor Arthur Nichols in Section 35, 10 acres for Lina Reyes inSection 27, and 100 acres for C. D. Willard in Sections 26 and27.

Present maximum capacity of ditch 225 inches ordinaryhead, used 200 ins.

There is 240 acres belonging to Wm. Gray, Wallace Wil-lard and Mrs. Camer in Sections 1 and 12, T. 10 N. R. 3 E., thatcan be irrigated from this ditch. It is claimed by some thatwater has actually been used on part of this land from theHickey ditch. The old Rickey ditch that headed on the E?stside had a maximum capacity in 1901 of 400 ins, and servedfrom 125 to 200 acres of land on East side of river.

Cottonwood ditch was originally started by the govern-ment for the Indians in 1874, was taken over soon afterwardsby Carrol, Strahan and Willard, later enlarged and extendedto present length and capacity. Maximum capacity 1250 inhead, ordinary used 1000 ins, furnishing water for followingranches on Vest side of Verde river:

Turney's report, 1901, gives this ditch a maximum capa-city of 600 inches. Serves water to 610 acres.

Latimer's report, 1908, gives 576 acres served with waterby this ditch.

The Central \/er(le ditch was built about 1875. This ditchhead in tile river has been very poorly located. Last year thehead was changed up stream about four miles to about thesame location used years ago by the 01(1 Marr ditch, whereit is expected it will not l)e washed out so much. Farmers onland serve(l l)y this have been unal)le to make a living on theland for a number of years, some of them having land undercultivation under Verde Canal.

On July 30th I inspected the Central Verde ditch. Therewas no water running in it. The (litch was very much washedout and it WO1il(l take at least $1,200.00 to make repairs to keepthe water in the same. Capacity about 600 inches.

It is proposed when ditch is in shape to carry water to 930acres in addition to the 95 acres now using water. The largerpart of the land shows no evidence of ever having been irri-gated, what little has been irrigated was done so many yearsago.

Ralston and Tom Logan filedwith the County Recorder of Yavapai County a claim on 2,000inches of flow of Verde River for irrigation, stock and domesticpurposes, for agricultural, mining and milling or any otherbeneficial uses, to be (liverteci from the Verde River at a pointnear where this ditch heads. Most all these people are inter-ested in land under Central Verde Canal.

It now furnishes water for the following ranches on the\Vest side of the Verde river.

Turney in 1901 gives capacity of canal 1040 inches, serv-dig water to 1200 acres.

Latimer gives 1125 acres under cultivation in 1908. 1

Enterprise ditch, built in 1892, capacity about 150 inches,dry when iusl)ectcd. In addition to serving- water to a fewacres of Calloway's land that also gets water out of the Eu-reka, there are 740 acres of land lying on the east bank of theVerde River below the mouth of Beaver Creek that this ditchwas built to serve. From all appearances of ditch and landbelow Beaver Creek, water has never been used on the land.

Emaii ditch heads opp Camp Verde. serves water, to 320acres of land on east side of river. Ditch built in 1895, max-iinum capacity 250 inches. Ordinary head used 250 ins. ThePerkins and Sutten land in Section 16, also draws sonic waterfrom the Pioneer ditch of Clear Creek. The first irrbationof Perkins and Sutter land was under the Pioneer ditch in1868, the balance was just brought under cultivation after theEmaii ditch was built.

Turney's report in 1901 gives capacity of ditch 235 inches,340 acres served with water.

Walter Starks ditch on West side of Verde River headsjust al)ove the mouth of Clear Creek. It has been built in thelast year or so to irrigate a strip of lan(l containing 40 acresalong the west bank of the Verde River in Section 27, Town-ship 13 N. Range 5 East. that has been filed on under Home-stead entry by Walter Starke, May 6th, 1914. Ditch was (lrvwhen I crossed it. Will likely carry 50 inches of water.

The old iTackeil ranch nOW owned l)y Upper Verde Fruit& Orchard Company irrigates 40 acres in the SE 3/4 of Sec.31, and the SW 34 of Sec. 32, T. 16 N. R. 3 E. This draws wa-ter from a spring on upper side of ranch, flows 35 inchesstea(ly stream. At present tile ranch uses water in the (laytime and at night water flows into reservoir that suppliesClarkdale with water. I understand ranch will he abandonedwhen town needs all the water.

The low water flow of ileaver Creek has been given tovarious ranches by a Court Decree, entitled Mayhan vs.Schroeder, et al, No. 3583, final decree entered August 25,1906. This suit has determined the right of all the upperranches on Beaver Creek to water according to their priorityof settlement and acres cultivated. A commissioner is ap-l)Oiflted by the Court who distributes the water from the firstof May to October first. The balance of the year, the rancherstake water as they choose. Each ranch is allowed about 1inch per acre continuous flow.

The upper ranch on Beaver Creek is the old Casner placenow owned by Blome ail(l Bayles, decreed 18 acres 1883 wa-ter, 24 acres now under cultivation. As a matter of fact, Com-missioner never comes as far up creek as this place in shortwater time. This place draws water all the time, on southside of creek from 2 springs totalling 1 . inches of water irri-gating 19 acres of land; on north side of Beaver Creek theyhave a ditch with forest ranger, capacity 40 inches, Blome andBayles irrigate 5 acres and forest ranger 22 acres from same.Forest ranger is on Skagg's place that was decreed 15 acres of1889 water.

There are five Apache Indian settlements on the EastVerde irrigating from 2 to 5 acres at each place, located inSec. 34, T. 11 N., R. 9 E.; Secs. 3, 8 and 9, T. 10 N., R. 9 E.They have a special 1)ernlit by Forest Service giving thempossession of these lands. They raise corn and garden truck.

On July 22nd measured the Verde River at the riffels, 6miles below Camp Verde and found 3412 inches. The sameafternoon, Clear Creek measured 25 inches where it emptiedinto the Verde. During the night, Clear Creek raised to 3200inches and was in flood stage the next 3 or 4 days.

July 27th found mouth of Beaver Creek dry. All ditcheson Beaver were using all the water that could l)e diverted attheir heads, with and dams in Creek.

July 31st found Oak Creek at Verde running 4700 inches(some flood water. No ditch on Oak Creek al)le to use allthe water passing its head. I believe the Creek never goesdry at any place.

August 6th measured 260 inches in mouth of SycamoreCreek. This was tile low water flow.

The Asher ditch is the only ditch outside of McDowellreservation, located l)y John Asher February 4, 1895. Claims5000 inches of water. This ditch had maximum capacity of150 inches in September 1895, according to W. 11. Robinson'smeasurements of that date. Cultivated between 30 and 40acres irrnate none at present. Ditch now has iilaxiiuii in ca-pacitv of 50 inches and is used by five men irrigating a totalof 30 acres.
