In response to the Covide-I9 pandemic the California Judicial Council enacted

temporary emergency rules to comply with State and local stay-at-home orders to mitigate the

transmission of the Covid-19 virus. Emergency Rule 4 was the adoption of a temporary

emergency statewide Covid-19 bail schedule on April 6,2020. This emergency bail schedule

reduced to $0 the amount of bail for many felony and misdemeanor offenses, while maintaining

the existing bail schedule for most of the violent, serious, sexual, and domestic violence

offenses. Reasons the emergency bail schedule was to limit the number of persons entering a

jail population to reduce the possibility of transmission of Covid-19 virus, and that the

California Department of Corrections and Rehabilitation was not accepting any new inmates.

In June 2020, in response to a change in public health orders, the Judicial Council acted

to repeal the temporary bail schedule set forth in Emergency Rule 4 effective June 20,2020.

I'he Judicial Council action provides lhal each Superior Court is authorized to maintain the

emergency bail schedule, return to the previously adopted bail schedule, or review and

potentially I'evise their bail schedule. Each court was directed to balance public safety and

continued personal protection measures necessary to mitigate the transmission of the Covid-19

virus. Courts around the Slate have taken different approaches, with some couHs maintaining

the emergency bail schedule, some returning to the preexisting bail schedule, and some adopting

8a hybrid bail schedule.

Following a discussion with the Mono County Sheriff. Mono County District Attorney

and the Superior Court Judges of Mono County, the Mono County Superior Court will adopt a

new bail schedule that will require bail for all of (he .serious, violent, sexual, and domestic

violence offenses listed in the Emergency Rule 4 bail schedule, and add additional oUcnscs for

14which bail will be required to protect the public safety, while limiting the number of pensons

brought into the jail population.

The felony offenses for which bail will be required effective June 20. 2020. are set forth

in Attachment "A." The misdemeanor offenses for which bail will be required are set forth in

19 Attachmenl "B.” Attachments "A” and “B” may be revised from time to lime as necessary to

protect public safety, and as necessary for the protection of jail staff and inmates from the

Covid-19 virus. The bail schedules set forth as Attachments ”A" and “B" hereby replace any

other bail schedule applicable to offenses that occur in the County of Mono. Any offense not

listed in the attached bail schedule shall have bail presumptively set in the amount of $0.00
