MEMORIAL Life and Public Service of Dennis M. Weix Dennis M. Weix, 72, died on Monday, November 5, 2018 at ThedaCare Medical Center in Waupaca. Private graveside services were held at the Abbotsford Public Cemetery, with military honors provided by the Colby VFW Post No. 2227. Dennis was a member of the Marathon County Board from 2000-2006. He served on the Forestry, Recreation & Zoning Committee, as well as the Health Board during that time. Dennis was Clerk for the Village of Edgar from March, 1994 to August, 2008. He served as Abbotsford Clerk before that time. Dennis Weix is hereby honored and remembered for his faithful public service. NOW, THEREFORE, BE IT RESOLVED by the Marathon County Board of Supervisors that they enter this Memorial into the proceedings of the Board out of respect for the memory of Dennis M. Weix. A copy of this memorial shall be sent to his family with the sympathies of the Board. RESOLUTION # R-58-18

2019 ELDERLY AND DISABLED TRANSPORTATION (85.21) APPLICATION

WHEREAS, Section 85.21 of the Wisconsin Statutes authorizes the Wisconsin Department of Transportation to make grants to the counties of Wisconsin for the purpose of assisting them in providing specialized transportation services to the elderly and the disabled; and

WHEREAS, each grant must be matched with a local share of not less than 20% of the amount of the grant; and

WHEREAS, this body considers that the provision of specialized transportation services would improve and promote the maintenance of human dignity and self-sufficiency of the elderly and the disabled.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of the County of Marathon does ordain as follows:

1) Authorizes Rebecca Frisch, Director of Conservation, Planning, and Zoning, to prepare and submit to the Wisconsin Department of Transportation an application for assistance during 2019 under Section 85.21 of the Wisconsin Statutes, in conformance with the requirements issued by that Department.

2) Authorizes the obligation of funds in the amount of $65,798.00 in order to provide the required local match.

3) Authorizes Kurt Gibbs, County Board Chairperson, to execute a state aid contract with the Wisconsin Department of Transportation under Section 85.21 of the Wisconsin Statutes on behalf of Marathon County.

The video security system is warrented for the safety of the drivers and the passengers to facilitate any issues arising from complaints on the vehicles. 20 camera setups and the video storage equipment will be a part of this system.

The current bus shelters still being used by Metro Ride passengers were constructed before the ADA regulations and this funding would cover the cost of replacing 5 shelters with ADA compliant space and be solar lighted facilities.

NCHC paratransit services is public transportation for persons over 60 or persons with disabilities. Access to this service is limited to persons whose physical and mentals disability prevents them from riding the Metro Ride buses or the Metro Ride Paratransit Program. NCHC services were also designed to meet the needs of clients that live outside the Metro Ride Paratransit service area or those that are in need of door-through-door servcies who does not have other resources for transportation. The NCHC service area is all parts of Marathon County including the service area of Metro Ride Paratransit service. The overlap in service is based on NCHC providing door-through-door services county wide and Metro Ride providing curb-to-curb service in their area only.

RESOLUTION #R-59-18

ACCEPTANCE OF A LAND DONATION FROM THE WAUSAU AND MARATHON COUNTY PARKS FOUNDATION INC.

WHEREAS, the Wausau and Marathon County Park Foundation, Inc. (hereafter “Foundation”)

accepted a donation of 80 acres of land (hereinafter “the Property”) from Thomas and Joan Miller on December 31, 1986 with the condition the land be used for a public park or other similar use; and

WHEREAS, the Foundation has offered to donate to Marathon County the Property which is suitable for scenic, outdoor recreation, public hunting and fishing, water conservation and other multiple uses; and

WHEREAS, the Property is legally described as Government Lots Thirteen (13) and Fourteen (14) in Section Eighteen (18), Township Twenty-Nine (29) North, Range Nine (9) East: and

WHEREAS, the Marathon County Park Commission, Marathon County Forestry/Recreation

Committee and the Environmental Resources Committee desire to make use of the Property for the benefit of County taxpayers; and

WHEREAS, the attached Deed dated, January 2. 1987, conveying the Property to the

Foundation contains certain restrictions and conditions which create a reversionary clause and which run with the land; and

WHEREAS, Objective 5.2 of the 2018-2022 Marathon County Strategic Plan promotes sound

land use decisions that conserve and preserve natural resources in decisions with economic development and growth; and

WHEREAS, strategies “C and F” of the Strategic Plan are to acquire land for public park and

forest use to retain natural landscapes and protect natural resources, and; WHEREAS, this donation of land meets Outcome Measure 3 of the Strategic Plan of acquiring

an average of 320 acres of land per year for the Marathon County Parks and Forests system; and WHEREAS, Wis. Stats 59.52(19) and 27.05(2) allow for acceptance of donation of real property;

NOW, THEREFORE, BE IT RESOLVED that the County Board of Supervisors of the County of Marathon does ordain as follows:

1. Accept the Property, described above, subject to the restrictions and conditions contained on attached Deed, dated January 2, 1987, which create a reversionary clause and which will continue to run with the land;

2. That the County Forest blocking boundaries listed and described in Chapter 900 of Marathon County Forest Comprehensive Land Use Plan 2006 – 2020 be amended to include this property;

3. Direct the Property to be entered under Wis. Stats. 28.11 and be designated as County Forest Special Use Lands;

4. Delegate the supervision and management of the Property to the Forestry/Recreation Committee and the Wausau and Marathon County Parks, Recreation & Forestry Department;

BE IT FURTHER RESOLVED that the County Board of Supervisors hereby authorizes and directs the County Clerk to issue checks pursuant to this resolution and the Treasurer to honor said checks.

To: Marathon County Board of Supervisors From: Parks, Recreation & Forestry Department Date: December 18, 2018 Item: Land Donation - Discussion and Possible Action Accepting the Donation of Land

from the Parks Foundation to be Designated as a Special Use County Forest. The Wausau and Marathon County Parks Foundation currently owns 80 acres of

forest land in the Town of Easton. The land was donated to the Foundation in 1986 by Thomas and Joan Miller. A stipulation of the donation was that the land be used for a public park or similar public use. The property is fully wooded containing mixed hardwood, Aspen, Hemlock, Balsam Fir and White Pine. The property is bisected by Big Sandy Creek. In 2015 the Foundation conducted a timber sale on the front half of the property. The goal was to harvest the remaining timber on the back half of the property and utilize the proceeds from the timber sale to install a parking lot and build trails throughout the property. However crossing the creek has become an expensive and difficult obstacle.

It was the intention of the Foundation to donate the land to the County once the trails

and parking lot were installed. As a 501c3 the Foundation should not possess an asset such as land. The Foundation has voted to donate the land to the county forest system. The land will be designated a Special Use County Forest. This designation continues to keep the land open to the public for nature study, hiking, outdoor recreation, hunting and fishing, water conservation, scenic values, Forest Management and other multiple uses that are consistent with the County Forest Law, Section 28.11, Wisconsin Statutes.

The Forestry/Recreation Committee and the Parks Commission discussed and

reviewed the donation of the 80 acres to Marathon County during a joint meeting on October 2, 2018. The Committee and the Commission both unanimously recommended the acceptance of the donation of land from the Foundation and to designate the land as a Special Use County Forest to the Environmental Resources Committee. Both the Commission and the Committee did also request that staff reach out to the Joan and Thomas Miller family, if possible, to get their approval of the transfer of land. Thomas Miller passed away in 1999 but staff was able to speak with Joan Miller. I signed letter from Joan Miller is attached supporting the donation of the land to the County.

On November 1, 2018, the Environmental Resources Committee unanimously moved

to approve the acceptance of the donation of the land and to designate the land as a Special Use County Forest and forward it to the Human Resources, Finance and Property Committee. On December 3, 2018, HRFP unanimously passed a motion to also approve acceptance of the donation of land from the Wausau/Marathon County Parks Foundation and to designate the land as a Special Use County Forest to the County Board of Supervisors.

OPINION REGARDING REVERSIONARY CLAUSE 

 

You have requested an opinion regading my interpretation of a reversionary clause contained in 

the deed to 80 acres of property located in the Town of Easton.   

The property is transferred to the Grantee [Wausau and Marathon County Parks 

Foundation, inc.] for as long as the land is used by the Grantee for a public park or other 

similar public use.  If the property ceases to be used for a public park or similar use, the 

property shall revert to the Grantors [Thomas O. Miller and Joan C. Miller] or their 

children, if alive, at the time of reversion.  

For the reasons stated below, it is my opinion that Marathon County may accept this donation 

of property under the condition that it be used for a public park or other similar public purpose.  

However, the reversionary interest in the original deed, dated January 2, 1987, would run with the land 

and the county would be accepting the property under the same conditions (i.e. reversion to the original 

donors or their children).  The Commission and the county may choose to accept the gift “as is” or may 

choose to require the Foundation to clear the title before acceptance. 

The main concern is the language in the reversionary clause that establishes the condition “as 

long as the land is used by the Grantee for a public park or other similar public use.” Is the language so 

restrictive that only the Foundation is permitted to use the property?  The terms used by Dr. Miller in a 

letter, dated December 4, 1986, to the Marathon County Parks Director are instructive as to intent.  Dr. 

Miller detailed his agreement to donate the property to the Foundation.  One of the terms was: “The 

land would revert back to me if the land is sold or traded off, or it is decided not to turn it into a park.”    

The donor went on to explain, “My family and I are excited about preserving this piece of land with its 

beautiful trees for Marathon County.  I am convinced that this is a unique and beautiful piece of land 

that in two more generations will be even more valuable.” 

In this case, the Foundation is not selling or trading the property for something of value.  The 

Foundation proposes to donate the property to Marathon County as a successor in interest.  In that 

sense, the Foundation proposes to continue the public purpose of using the land for a public park or 

similar public use.   

The county is authorized under Wis. Stats., §59.52(19), to accept donations, gifts or grants for 

any public governmental purpose within the powers of the county.  Furthermore, Wis. Stats., 

§59.52(6)(c), which governs transfers of property acquired by the county, indicates that the legislature 

has contemplated conditional donations.  The statute provides that the board may direct the clerk to 

lease, sell or convey county property, unless “donated and required to be held for a special purpose.” 

It should also be noted that Wis. Stats., §27.05, authorizes the county to acquire property for 

park purposes.  Subsec. (2) specifically authorizes the park commission to “accept in the name of the 

county grants, conveyances, and devises of land and donations of money of money for park purposes.”

In conclusion, it is my opinion that the commission and the County may accept the proffered 

donation, but if it does it will take the property with the reversionary clause attached.

APPROVING AN APPLICATION TO ACQUIRE STATE FUNDING THROUGH THE KNOWLES-NELSON STEWARDSHIP GRANT PROGRAM

WHEREAS, the Human Resources, Finance and Property Committee, Environmental Resources Committee and the

Forestry/Recreation Committee recommends approving an application to acquire funding through the Knowles-Nelson Stewardship Grant Program; and

WHEREAS, the landowner of 199.84 acres in Section 3, Township 30 North, Range 9 East, Town of Hewitt, Marathon County, Wisconsin has indicated they are interested in selling the property and is willing to work with the County on a transaction; and

WHEREAS, the County Board has the authority to acquire said property for the purpose of establishing County Forest land pursuant to SS. 28.10 Wis. Stats; and

WHEREAS, said Stewardship Grant Program may provide funding up to 50% of the acquisition price; and

WHEREAS, balance of funding is available from the Forestry Segregated Land Purchase and State Aid Accounts; and

WHEREAS, acquisition of this property would perpetually provide forest products to our local economy, revenues to the County, outdoor recreation opportunities to the public, and improve property administration on the County Forest; and

APPROVING AN APPLICATION TO ACQUIRE STATE FUNDING THROUGH THE KNOWLES-NELSON STEWARDSHIP GRANT PROGRAM

WHEREAS, the Human Resources, Finance and Property Committee, Environmental Resources Committee and the

Forestry/Recreation Committee recommends approving an application to acquire funding through the Knowles-Nelson Stewardship Grant Program; and

WHEREAS, the landowner of 200 acres in Sections 23 and 26, Township 30 North, Range 9 East, Town of Hewitt, Marathon County, Wisconsin has indicated they are interested in selling the property and is willing to work with the County on a transaction; and

WHEREAS, the County Board has the authority to acquire said property for the purpose of establishing County Forest land pursuant to SS. 28.10 Wis. Stats; and

WHEREAS, said Stewardship Grant Program may provide funding up to 50% of the acquisition price; and

WHEREAS, balance of funding would be determined at a later date and be approved by County Board resolution; and

WHEREAS, acquisition of this property would perpetually provide forest products to our local economy, revenues to the County, outdoor recreation opportunities to the public, and improve property administration on the County Forest; and

WHEREAS, Marathon County has lands enrolled in the Wisconsin County Forest Land Program commonly referred to as the Marathon County Forest; and WHEREAS, the Marathon County Forest Comprehensive Land Use Plan requires an annual work plan to be approved by the Marathon County Board of Supervisors to be eligible for certain grant funding per §28.11(5)(b), Wis. Stats.; and WHEREAS, the Forestry/Recreation Committee approved the 2019 Forestry Division Work Plan at its regular meeting held December 4, 2018; and WHEREAS, the Marathon County Board of Supervisors adopted the 2019 Wausau and Marathon County Parks, Recreation and Forestry Department Budget at its budget meeting November 15, 2018. Specific locations and details about timber harvests scheduled for the coming year can be obtained by contacting the County Parks, Recreation and Forestry Office.

3. Administer the cutting and scaling of twenty-five timber sales on 1,722 acres established on County Forest Land with an estimated stumpage value of $1,173,428.11.

4. Allow forest succession to naturally convert some oak and aspen stands to hardwood. 5. Complete deer browse surveys at Big Eau Pleine Park and County forests to determine to

what extent tree regeneration is being affected. 6. Utilize a DNR Sustainable Forestry Grant if awarded to remove undesirable brush and

trees to allow for oak regeneration. 7. Classify habitat types on a minimum of 1000 acres.

8. Calculate allowable harvest levels out 20 and 30 years to ensure sustainability. 9. Evaluate 35-40 year-old aspen stands to determine feasibility of harvesting stands early to

improve age class distribution and stabilize harvest levels. 10. Issue approximately 20 firewood permits. 11. Evaluate release needs for all acres of red pine planted since 2002. Release plantations by

mechanical or herbicides as needed.

12. Continue to assist the Wisconsin Department of Natural Resources with an oak wilt study to confirm the frill-girdle-herbicide method to stop the disease from spreading through interconnected root systems.

13. Plant approximately 500 white spruce and red pine at two locations on the County forest. 14. Continue implementing the policy on annosum root rot disease requiring contractors to

spray conifer stumps with fungicide to prevent infection according to DNR recommendations.

15. Establish timber sales on selected park properties as directed. 16. Monitor timber sales for unauthorized timber removal using the video detection system. 17. Monitor, evaluate, and treat oak wilt pockets in Nine Mile and other Forest Units.

18. Monitor, evaluate, and treat invasive species on the forest. 19. Apply techniques that reduce the ash component in forest stands on County forest and

Park lands according to DNR recommendations due to Emerald Ash borer being found in the County for the first time in 2017.

B. Road, Trail, and Facility Construction and Maintenance:

1. Continue the contract with APHIS for beaver control. 2. Inspect county forest and park boundaries as needed to control encroaching uses from

neighboring private land owners. 3. Contract with professional land surveyors to complete surveys where needed to facilitate

administration between County Forest and private lands. 4. Mow 50 miles of hunter walking trails and associated wildlife openings.

5. Mow all forest road ditches in the County Forest. 6. Maintain pit toilets at Bitzke Nature Trail, Burma Road and Nine Mile Forest Units. 7. Continue to assist law enforcement for illegal tree stands, unauthorized motorized use,

and dumping on County Forest property. 8. Continue to assist law enforcement to enforce seasonal closures and ordinance violations

at Nine Mile and other Forest Units. 9. Resurface up to 3 miles of trails in Kronenwetter and Leathercamp Forest Units.

10. Maintain 6.48 miles of certified County Forest Roads. 11. Fabricate and install gates where needed. 12. Place granite on roads and trails in Forest Units to patch holes as needed. 13. Check the National Heritage Inventory Database (NHI) and the Wildlife Action Plan for

endangered resources on any project that occurs on the County Forest. 14. Complete a County Conservation Aids project at Scholfield Park that replaces two piers. 15. Complete a County Conservation Aids Project at DC Everest Park that replaces boat

planks and asphalt near the landing. 16. Replace culverts in Leathercamp, Kronenwetter, Nine Mile, and Burma Forest Units as

needed. 17. Continue mitigation of the 2010 flood using a FEMA grant at the Bern Forest Unit.

C. Land and Equipment: 1. Negotiate the purchase of additional lands to enter as County Forest that will improve

blocking, facilitate management that aligns with the Marathon County Strategic and County Forest Comprehensive Land Use Plans.

2. Accept a donation of 80 acres of Park Foundation property in the Town of Easton and enter the property under the County Forest Special Use designation.

3. Maintain all vehicles and equipment. D. Developed Recreation (Non-Motorized): 1. Participate in the planning, administration and approval of all trail construction,

expansions, relocations, and maintenance on County Forest Lands. 2. Monitor reconstruction of 2 km of the Nine Mile ski trail to improve trail profile and

surface characteristics. 3. Assist park facilities division in administering intensive recreation at Nine Mile. 4. Utilize volunteers to brush up to 20 km of ski trail. 5. Monitor the non-motorized recreation on County Forest Land.

E. Developed Recreation (Motorized):

1. Participate in the planning, administration, and approval of all trail construction, expansions, relocations, and maintenance on County Forest Lands.

2. Monitor and approve reconstruction of the Burma Road Forest ATV/UTV trails. 3. The Central Wisconsin Trailblazers ATV/UTV club will maintain 11 miles of ATV/UTV

trail in the Burma Road Forest to include brushing, grading, signing, and mowing. 4. Assess all trails and land in the Burma Road Forest to protect the resource from excessive

soil erosion and to prevent illegal off-trail use. 5. Volunteers will brush up to 30 miles of snowmobile trail on County Forest Land.

6. Monitor the snowmobile program on County Forest Land. 7. Monitor and enforce ordinances pertaining to the unauthorized motorized use

(ATV/UTV) on all County Forest Units. F. Wildlife Management: (Partially Grant funded)

1. Complete work identified in the DNR annual wildlife work plan. (See attached plan). 2. Mow flowage dikes, forest trails and select openings for brush control. 3. Seed select forest trails following timber sales to enhance wildlife habitat.

4. Improve forest opening condition through mechanical and chemical applications. 5. Cooperate with the DNR on identifying tag alder to shear in the Harrison-Hewitt and

Leather Camp Forest Units.

6. Cooperate with the Ruffed Grouse Society and the United States Fish and Wildlife Service on tag alder shearing in Harrison-Hewitt Forest Unit.

G. Administration and GIS:

1. Implement the 2006-2020 County Forest Comprehensive Land Use Plan. 2. Begin drafting the 2021-2035 County Forest Comprehensive Land Use Plan. 3. Develop and improve the Forestry Division portion on the Department’s web page. 4. Continue to work with the Forest Citizen’s Advisory Subcommittee for county forests to

address issues of concern including use conflicts at Nine Mile during the fall season, the sustainability of mountain biking, equestrian user needs, and the impact of forest management on hunting.

5. Amend the County Forest Comprehensive Land Use Plan to reflect ordinance, boundary, and policy changes.

6. Continue implementing marking guidelines, Best Management Practices for Invasive Species and Biomass Harvesting guidelines on the County Forest.

7. Attend the Annual DNR integrated planning meeting to evaluate, maintain, and improve the County/DNR partnership.

8. Develop interpretive displays explaining the benefits of sustainable forest management for display at recreation areas.

9. Monitor and administer all road use, land use, and other agreements/leases currently on County Forest Lands. Develop new agreements or leases when appropriate.

10. Implement and monitor third party Sustainable Forestry Initiative (SFI) forest certification on the Marathon County Forest.

11. Coordinate integration of the County Forest Comprehensive Land Use Plan with the Marathon County Comprehensive and Strategic Plans.

12. Continue to implement the DNR Wisconsin Forest Inventory Reporting System (WisFIRS).

13. Continue monitoring the effects of deer browsing on forest regeneration within the deer exclosures at Big Eau Pleine Park.

14. Follow the Bern Flowage emergency action plan, if required, due to flooding. 16. Review county zoning to ensure alignment with the County Forest Comprehensive Land

RESOLUTION NO. R-63-18

APPLICATION FOR COUNTY FOREST ACREAGE SHARE LOAN PAYMENT

WHEREAS, Counties having lands entered as “County Forest Lands”, under the provisions of Sec. 28.11(4)(b), Wis. Stats., annually receive from the state a non-interest bearing loan to be used for the purchase, development, preservation and maintenance of such lands; and

WHEREAS, said loan monies are repaid through a 20% severance tax on timber revenue coming from County Forest Lands unless a higher rate is mutually agreed to by the County and the department; and

WHEREAS, the current provisions of Sec. 28.11 (8)(b)1 make it possible for the County, at its option to receive not more than 50 cents per acre to meet the needs identified in its County Forest Comprehensive Land Use Plan. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of the County of Marathon, in consideration of meeting the needs identified in its County Forest Comprehensive Land Use Plan hereby request the Department of Natural Resources to provide the 2019 payment to the County on the basis of 50 cents for each acre of Marathon County Forest Lands; and

BE IT FURTHER ORDAINED AND RESOLVED that the Clerk is hereby authorized and directed to file this request with the Department of Natural Resources prior to December 31st preceding the year in which said payment is being requested to be made. Dated this 18th day of December, 2018.

A RESOLUTION AMENDING THE 2018 CAPITAL IMPROVEMENT BUDGET AND

THE 2018-2022 CAPITAL IMPROVEMENT PROGRAM TO FUND COUNTY HIGHWAY Z BRIDGE REPLACEMENT OVER THE EAU CLAIRE RIVER WHEREAS, the Board of Supervisors of Marathon County approved the 2018–2022 Capital

Improvement Program and Budget; and WHEREAS, the Capital Improvement Program is a dynamic process and subject, pursuant to

Resolution R-89-91, to periodic review and/or amendment; and, WHEREAS, there is currently a Highway Bridge Project on County Highway Z that need to be

funded in the 2018 Capital Improvement Plan to be completed; and WHEREAS, the bridge project has Federal funds of $878.000 and $200,000 in Highway

department funds to complete the project; and WHEREAS, there is a request by the Highway department for the Capital Improvement Fund

to help pay a portion of the costs in the amount of $183,341 as a 2018 CIP project request; and

WHEREAS, the Human Resources, Finance & Property Committee has reviewed the request

and has recommended approval of the transfer from the 2018 Capital Improvement Fund in the amount of $183,341 to the Highway Fund to complete the project; and

WHEREAS, the Human Resources, Finance & Property Committee of the Board of

Supervisors of Marathon County recommends amendment of the 2018-2022 Capital Improvement Program and transfer the funds from the County’s 2018 Contingency Fund as follows:

1. Amend the 2018 CIP Project Improvement to add: the County’s share of the

County Highway Z Bridge over the Eau Claire River in the amount of $383,341 with a total costs of $1,261,341

2. Increase the 2018 CIP budget funding for the project of $183,341

3. Transfer funding of $ 183,341 from the 2018 CIP Fund to the Highway Fund

to complete the project.

RESOLUTION NO. R-66-18

APPROVAL OF INTERGOVERNMENTAL AGREEMENT WITH LANGLADE COUNTY TO PROVIDE LEGAL SERVICES FOR CHAP. 54/55 CASES AND EXPANSION OF POSITIONS IN CORPORATION

COUNSEL

WHEREAS, the Office of Corporation Counsel has identified an opportunity to assist Langlade County in processing Chapter 54/55 cases, which will include attorney time to consult with NCHC staff, prosecute cases and appeals, travel to court when necessary, and support staff time to draft pleadings, organize and manage case files, contact witnesses, coordinate with Langlade County Probate, and schedule court time, and

WHEREAS, the department submitted a proposal to County Administration and the Employee Resources Department for consideration and to reclassify a Full-time Assistant Corporation Counsel position (Pay Level C42) and create a full-time Paralegal position (Pay Level B32) and increase a .78 FTE Assistant Corporation Counsel positon to full-time, and

WHEREAS, County Administration supports and the Employee Resources Department has evaluated

the request, and calculated the cost based on the reclassification and increase of FTE time; and WHEREAS, this request from the Corporation Counsel’s Office was referred to the Human Resources,

Finance & Property Committee for review and recommendation; and WHEREAS, the Human Resources, Finance & Property Committee approved the request to reclassify a

full-time Assistant Corporation Counsel (Pay Level C42) and create a full-time Paralegal position (Pay Level B32) and increase a .78 FTE Assistant Corporation Counsel positon to full-time at their meeting on 12/3/2018, and recommends its adoption.

NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Marathon does ordain the following to be effective January 1, 2019:

(1) Approves Marathon County Corporation Counsel entering into an Intergovernmental Agreement to provide legal services on behalf of Langlade County as set forth above. (2) A. Reclassify a full-time Assistant Corporation Counsel (Pay Level C42) and create a full-time

Paralegal position (Pay Level B32). B. Increase a .78 FTE Assistant Corporation Counsel positon to full-time.

METROPOLITAN PLANNING COMMISSION BYLAWS  

   WHEREAS, the Marathon County Metropolitan Planning Commission has been established pursuant to §59.69 of the Wisconsin Statutes; and    WHEREAS, the membership of the Commission is currently comprised of 14 metro‐area communities, the Wisconsin Department of Transportation and the chair of Marathon County’s Infrastructure Committee; and    WHEREAS, the Marathon County Metropolitan Planning Commission functions as the federally designated Wausau Area Metropolitan Planning Organization (MPO).    WHEREAS, Marathon County staffs the Marathon County Metropolitan Planning Commission with staff from the Conservation, Planning, and Zoning Department.    WHEREAS, the Marathon County Metropolitan Planning Commission is a part of the organizational structure of Marathon County and any bylaw changes for the Marathon County Metropolitan Planning Commission needs to be approved by the County Board.    NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors for the County of Marathon does hereby approve the amendment to the Marathon County Metropolitan Planning Commission bylaws as attached.    Respectfully submitted this _____ day of December, 2018.

MARATHON COUNTY METROPOLITAN PLANNING COMMISSION

BYLAWS ARTICLE I - NAME Section 1. The name of this commission shall be the Marathon County Metropolitan Planning

Commission and hereinafter, shall be referred to as the Commission. ARTICLE II - PURPOSE AND GOALS Section 1. To the extent authorized by State Statutes, the Commission shall be an advisory

body to the Marathon County Board of Supervisors; the Executive Committee of the Marathon County Board of Supervisors; and to local units of government within the metropolitan planning area.

The objectives of this Commission shall be to promote public health, safety, convenience, and general welfare.

The Commission shall be concerned with studies and recommendations relating to activities including but not limited to land-use; natural resources; utilities; and transportation systems within the metropolitan planning area.

ARTICLE III - COMMISSION MEMBERSHIP Section 1. The members of the Commission shall be the chief elected officials of all the

municipalities or a designee as authorized in writing by the chief elected official within the urbanized area of the Metropolitan Planning Organization (MPO) boundary. The Towns of Mosinee, Rib Mountain, Stettin, Wausau, and Weston, Villages of Brokaw, Kronenwetter, Maine, Rothschild and Weston, Cities of Mosinee, Schofield and Wausau; a representative from the Wisconsin Department of Transportation; and a representative of the Marathon County Infrastructure Committee.

ARTICLE IV - TERM OF OFFICE Section 1. A member shall remain on the commission until a successor has been duly elected

or appointed, or until his/her death, resignation, disqualification, incapacity to serve, or removal in accordance with the law.

ARTICLE V - OFFICERS Section 1. The officers of the Commission shall be a Chairperson, a Vice-Chairperson and a

Secretary.

Section 2. Chairperson – The Chairperson shall preside over all meetings and may appoint

other members to represent the MPO on councils, committees, task forces, etc. or at meetings or other events, or to perform certain tasks.

Section 3. Vice Chairperson – In the event of the Chairperson’s absence or at his direction, the

Vice Chairperson shall assume the powers and duties of the Chairperson. Section 4. Secretary – The Director of the Marathon County Conservation, Planning, and

Zoning Department shall serve as the Secretary of the Commission. This will be an ex officio position. The Secretary shall provide or otherwise delegate staff services for the MPO, as needed, and will be responsible for taking summary minutes of the Commission’s proceedings and be the custodian of all records and documents of the Commission and MPO.

Section 5. Alternates – Upon written notice to the Chairperson, each member community may

appoint an alternate to its representative. That alternate member may serve as a full voting member during any meeting where that community’s representative is not in attendance. Proxy and absentee voting are not permitted.

Section 6. Appointment of Officers – The County Board Chairperson shall appoint the

Chairperson and Vice Chairperson of the Commission for a term of two years at the first regularly scheduled meeting after the spring elections in April of the even numbered years. The newly appointed Chairperson and Vice Chairperson shall take office immediately following the appointment. If an officer leaves their position as described in Article IV, Section 1, the County Board Chairperson shall appoint a replacement officer as soon as possible.

ARTICLE VI - MEETINGS Section 1. The Commission shall meet as required. Special meetings may be called by the

Chairperson, by petition of three (3) members of the Commission, or the Secretary. Section 2. Commission meetings shall be conducted in accordance with Robert's Rules of

Order; Newly Revised Edition and the Open Meetings Law of Wisconsin. Section 3. Commission meetings shall be open to the public. Section 4. In the absence of the Chairperson and the Vice Chairperson, the Secretary may

preside over that particular meeting. In the absence of all three officers the remaining members of the Commission may elect a person to preside over the meeting and assume the powers and duties of the Chairperson for that particular meeting.

ARTICLE VII - QUORUM Section 1. At any meeting of the Commission, a quorum shall consist of at least six (6)

members a majority of the total current membership of the Commission.

Section 2. Each member shall have all voting privileges and be entitled to one (1) vote. ARTICLE VIII - SUB-COMMITTEES Section 1. The Commission may create sub-committees to carry on the purposes and goals of

the Commission, and the Commission Chairperson shall designate the chairperson of those committees. Sub-committee meetings shall be governed by Article VI above.

Section 2. The Commission shall appoint a Technical Advisory Committee, made up of

technical transportation representatives to advise the Commission on transportation matters. The Technical Advisory Committee shall be composed of staff from the municipalities within the MPO planning boundary; representatives from the Wisconsin Department of Transportation; representatives from the Federal Highway Administration; a representative from the Wausau Area Chamber of Commerce; a representative from the North Central Wisconsin Regional Planning Commission (NCWRPC); a representative from the Wausau Area Transit System (WATS); a representative from the Central Wisconsin Airport (CWA); the Marathon County Highway Commissioner; and Conservation, Planning and Zoning Department Staff.

Section 3. The Commission shall appoint a Water Quality Management Technical Advisory

Committee, made up of technical water quality management representatives to advise the Commission on water quality management matters. The Water Quality Management Technical Advisory Committee shall be composed of staff from the municipalities within the 208 Sewer Service Area boundary (Towns of Mosinee and Rib Mountain, Villages of Kronenwetter, Maine, Rothschild and Weston, Cities of Mosinee, Schofield and Wausau), Town of Mosinee, representative from North Central Wisconsin Regional Planning Commission (NCWRPC), a representative from the Wisconsin Department of Transportation, and Marathon County Conservation, Planning and Zoning Department Staff.

Section 4. Such other Technical Advisory committees may be appointed on a temporary basis

by the Chairperson, which are deemed necessary to carry out the functions and responsibilities to the Commission. The Chairperson shall designate the chairperson of these committees.

ARTICLE IX - GENERAL Section 1. The Commission may cooperate with, and contribute or accept services from

Federal, State, or local agencies, public or semi-public agencies, private individuals, or corporations and may carry out such cooperative undertakings.

Section 2. The Marathon County Conservation, Planning and Zoning Department will be the

staff for the Commission. Section 3. To keep Marathon County’s Executive Committee informed of the Commission’s

activities, the Executive Committee will receive the yearly Unified Planning Work Program and budget.

Section 4. All Commission member communities shall pay a percentage of the local share necessary to fund the required Commission functions. The allocation of cost for each community shall be determined by a majority vote of the commission members. The allocation of costs will be represented in the annual Unified Planning Work Program.

ARTICLE X - AMENDMENTS Section 1. A majority vote of the Marathon County Executive Committee shall be required to

forward any amendment to these Bylaws to the Marathon County Board of Supervisors. A majority vote of the Marathon County Board of Supervisors shall be required to amend these Bylaws. Approval of the amendments by the Marathon County Board of Supervisors shall be obtained before the amendment is effective.

RESOLUTION R-68-18

RESOLUTION TO SUPPORT INCREASED COMPENSATION FOR DEFENSE COUNSEL ASSIGNED BY THE STATE PUBLIC DEFENDER

WHEREAS, both the United States Constitution and the Wisconsin State Constitution provide that persons 

accused of a crime have the right to a speedy, public trial by jury, the right to confront accusers, and the right to counsel, and 

WHEREAS, the United States Supreme Court established that the government must afford effective counsel to indigent defendants, and  

WHEREAS, the Wisconsin Office of the State Public Defender (SPD) is charged with the responsibility to provide effective counsel to indigent defendants. Where the SPD staff is unable to provide representation, due to conflict or other reasons, the SPD appoints private attorneys to provide effective representation. Nearly 40% of all SPD cases are appointed to private attorneys, and 

WHEREAS, the compensation rate for private bar appointed attorneys in Wisconsin is $40.00 per hour, and has not been increased since 1995.  The $40/hour rate is the lowest compensation rate in the nation, failing to cover an appointed attorney’s overhead costs. As a result of the nominal compensation rate, private attorneys are increasingly declining to accept SPD appointments, which is creating an increasing burden on the courts and Wisconsin Counties, and  

WHEREAS, financial costs to Counties are increasing as accused persons are being held in jail longer pending appointment of counsel and circuit court judges are being forced to appoint counsel at county expense, and 

WHEREAS, in addition to the financial costs to Counties, delayed appointments of counsel adversely affect the accused, lead to inefficiency for courts and law enforcement agencies, and delay justice and potential closure for crime victims, and  

WHEREAS, in May of 2018 the Wisconsin Supreme Court authorized an increase in the hourly rate for attorneys appointed by courts at county expense from $70.00/hr. to $100.00/hr., effective January 1st, 2020, and 

WHEREAS, the disparity created between the two rates, SPD $40.00/hr., County $100.00/hr., will cause private attorneys to refuse SPD cases, further exacerbating costs to the Counties, the accused, victims, and justice system stakeholders and  

NOW, THEREFORE, BE IT RESOLVED, that the Marathon County Board of Supervisors does hereby implore the State of Wisconsin to provide sufficient resources to the Office of the Public Defender to ensure the criminal justice system operates effectively and efficiently, including increasing the rate of reimbursement for private attorneys appointed by the Public Defender to a market rate that will ensure prompt appointment of counsel  and that cases are handled in a timely and efficient manner, by at minimum, increasing the  hourly rate paid to SPD appointed private attorneys to the same amount as those recently authorized by the Wisconsin Supreme Court.  

BE IT FURTHER RESOLVED, that the County Clerk is directed to send a copy of this resolution to the Governor, the Wisconsin Counties Association, the Wisconsin Towns Association, the League of Wisconsin Municipalities, all members of the State Legislature and to each Wisconsin County, and  

BE IT FURTHER RESOLVED that publication of this resolution may occur through posting in accordance with Section 985.02 of the Wisconsin Statutes.   Dated this _____ day of December, 2018.
