SUBJECT: FISCAL YEAR ("FY") 2012 BUDGET (EM-3) (BF-1)
In response to your above subject request, please find the requested information from the Department of Environmental Management describing solid waste disposal fees, and the requested Lanai and Molokai solid waste programs and related supporting information. Responses are in the order and number as requested.
1) Confirm whether refuse disposal fees are being charged by the ton or by the pound. Please explain. (DC)
Refuse disposal fees are charged by the ton on the actual tonnage. For Central Maui and Molokai Landfill, the gross and tare weights are measured in pounds and the County's software application converts the weights to tons.
Lanai and Hana Landfill fees are charged the Interim Fee Schedule based upon the listed vehicle categories (No scale is currently located at these facilities).
Currently, no cash transactions occur at any of the County's landfills.

2) Provide a copy of the Memorandum of Understanding between the County of Maui and Lanai landowners (previously Castle & Cooke, Inc.) that provides for waiver of refuse disposal fees at the Lanai Landfill, as indicated on page 40 of Appendix B of the Mayor's proposed FY 2014 Budget (Ramseyer Rule Version). (GRH)
A copy of the MOU effective April 301h, 2009 between the County of Maui and Castle and
Cooke, LLC outlines the various provisions surrounding the fee waivers and landfill operations agreement.
3) Identify and describe all Solid Waste programs for Molokai. Include programs funded by the Highway Beautification and Disposal of Abandoned Vehicles Revolving Fund. (SC)
The identification and description of all Solid Waste programs on Molokai are as follows, as well as various attachments to assist with the descriptions of these programs.
a) Refuse collection. This is performed in cooperation with The Public Works Department, collecting from 500 residents curbside, and delivery to the Molokai Landfill.
b) Molokai Landfill located at Naiwa. The SWD receives and processes approximately 4,400 tons of refuse per year. Permit compliance requires:
• Daily and Intermediate cover application;
• Maintaining the soil cover systems;
• Litter, flagging, vector, and odor control;
• Surface Water Management
• Perimeter Gas Management;
• Leachate Management.
• Emergency response as required to remain in regulatory compliance.
c) Kalamaula Landfill (Closed Landfill). The SWD remains responsible for the maintaining and monitoring requirements per our Closure Plan with the State DOH. Maintenance requirements are:
• Final Cover repair and maintenance
• Erosion control
• Various monitoring requirements
• Surface Water Drainage.

d) Landfill Diversion programs. There are currently various diversion and recycling programs located on Molokai as described below. (Please note that portions of these programs may be affected by budget constraints.)
1) The Recycle Molokai Facility provides the following services via an onsite contractor (refer to the attached recycling flyer for the FY12 annual statistics):
• Manage all aspects of the HIS Certified Redemption Center at the landfill and at a mobile site in Kilohana;
• Accept, process, bale and market the following recyclables: cardboard, plastic, glass, newspaper, office paper, metal cans;
• Manage the Used Motor Oil Program;
• Manage the E-Cycling Program;
• Manage the small paint exchange and reusable book exchange.
2) Greenwaste Processing Operations at the Naiwa Landfill provides the community a location to dispose of all greenwaste. A contractor onsite accepts the greenwaste, grinds, and produces viable mulch for land and agricultural use.
• Manage all aspects of the Greenwaste Operations including: acceptance of the greenwaste from residents and commercial, chipping of all incoming materials and distributing the mulch.
• This program manages and diverts approximately 360 tons of greenwaste annually. The mulch produced from this program is offered to the Molokai community at no cost.
3) Molokai Metals Facility: Approximately 40% of the funding for this operation comes from the Highway Beautification and Disposal of Abandoned Vehicles funds. The remaining 60% comes from the SWD-Metals and Abandoned Vehicles fund. This program provides the following:
• The Metals Facility receives, processes, stores and ships out for recycling the following items: junk vehicles, abandoned vehicles, white goods, propane tanks, miscellaneous metal items, scrap metals, vehicle batteries and tires;
• The Metals Facility opens for "collection events" two to three times per year;
• Over the last three fiscal years, this facility has received and processed over 2.2 million pounds of metals and related materials, including more than 2,000 vehicles, 3,200 appliances, 8,000 tires, and 225 tons of scrap metal.

At our presentation to the Committee, you asked if we would like to update how the Fee Schedule reads to accurately describe how it is applied. We would like to examine the Fee Schedule to ensure that all waste streams are appropriately covered and propose modifications in the FY2015 Budget.

MEMOR.Al'IDUM OF UNDERSTANDING BETWEEN THE COUNTY OF MAUl
AND CASTLE & COOKE, INC.
This Memorandum of Understanding ("MOU") is executed on the respective date of the signatures of the parties shown hereafter, between the COUNTY OF MAUl (hereinafter "County") and CASTLE & COOKE, INC. (hereinafter "CASTLE & COOKE").
County and CASTLE & COOKE agree to the following in regard to the operation of the Lana'i sanitary landfill (hereinafter "Landfill"), and the transfer of ownership of the underlying real property from CASTLE & COOKE to County.
1. CASTLE & COOKE agrees lo provide County with landfill cover material at no cost to County, in an amount to be mutually agreed upon, but not less than 80 tons per week. County agrees to be responsible for the loading and transport of aU cover material provided, or for the cost thereof if loading and transport is performed by Castle & Cooke at County's request.
2. So long as CASTLE & COOKE is willing to provide landfill cover material at no cost to County, County agrees to allow CASTLE & COOKE to utilize the Landfill without payment of refhse disposal fees.
3. CASTLE & COOKE and County agree to prepare and execute, subject to Maui County Council approval, a dedication of the property underlying the Landfill from CASTLE & COOKE to County.
4. CASTLE & COOKE and County agree to negotiate and execute, subject to Maui County Council approval, the necessary documents for County to acquire, by purchase, dedication or otherwise, sufficient property from CASTLE & COOKE to construct a new sanitary landfill on Lana'i in the future.
5. CASTLE & COOKE and County agree to utilize their best efforts in effecting a timely completion of all land acquisition contemplated herein.
6. CASTLE & COOKE and County agree to utilize thei.r best efTmis in future negotiations for a new landfill site on Lana'i.
7. This Agreement shall be in effect so long as the County accepts refuse at the cunent Landfill, and CASTLE & COOKE offers to make available to the County, at no cost, cover material for maintenance of the current Landtill. The parties may cancel this Agreement, if mutually agreed upon, by executing a cancellation document in writing.
8. Upon cancellation of this Agreement, CASTLE & COOKE will no longer be obligated to provide landfill cover material at no cost to the County, and CASTLE & COOKE shall pay refuse disposal fees for its use of the Landfill.
TN WITNESS WT-IEREOF, the parties hereto have executed the Memorandum of Agreement on the dates below, to be effective as of April 30, 2009.

MOLOKA'I METALS PROGRAM
WHEN IS THE MOLOKA'I METALS FACILITY OPEN
The Moloka'i Metals Facility (MMF) opens for "collection events" throughout the year. There are two to three collection events each year, which will last from 4 to 6 weeks, hours same as Landfill during collection events.
Note: Most of the materials accepted in this program are not permitted to be disposed of in the landfill. Therefore, please store the metals and related materials you need to dispose of and bring them to the next available collection event.
WHERE To TAKE METALS
The MMF is located at the Moloka'i landfill off Maunaloa Highway. Stop at the landfill scalehouse to check in; then proceed as directed down to the MMF.

WHO MAY BRING IN METALS
Anyone may bring in metals and related materials to this facility when it is open. However, the fees charged depend on where the materials came from.
• From Homes: No charge for residents for metals, appliances and vehicles from your home.
• From Businesses: Fees may be charged for metals materials from businesses and agencies. Call the MMF 658-9029 for fees.
• Oversize, Farming, or Fishing Items: There may be fees for these items since they are not considered common household metals. Please call the MMF to find out if fees will apply.
• Separate related items from other waste and recyclables. Stop at the landfill scalehouse before proceeding to the MMF.
" All metal items must be taken into the MMF and checked in by the MMF staff. Please do not leave metals at any other area of the landfill.
*SPECIAl PREPARATION FOR VEHICLES
Bring in your junk vehicles to the MMF. Non-commercial vehicles are FREE.
Just follow these steps:
-+ Complete and bring in a Vehicle Acceptance form at the MMF for every vehicle. This form must be filled out completely and signed by the vehicle owner or resident where the vehicle was removed from. The vehicle will be refused at the MMF if this form is not complete and brought in with the vehicle. Forms are available at the MMF or online.
-+ Vehicle owners must complete and file a Statement of Junking form with the Department of Motor Vehicles & Licensing to change registration to 'Junk' (forms available at the DMVL office or online).
-+ Both forms are available online. Please go to www.mauicounty.gov/solidwaste, follow the links to "Metals and Abandoned Vehicles," then "Moloka'i Metals Facility."
NOTICE: Do NOT abandon your junk vehicle. It is very costly to pay abandoned vehicle charges, but it's free to bring in your own junk vehicle to the MMF to be scrapped.
OTICE REGARDING ABANDONED VEHIClES
Vehicles left abandoned on roadsides, in parking lots or on public property will be removed and impounded by the County's Abandoned Vehicles program.
Abandoning a vehicle is a criminal violation and is expensive. The owner PAYS. When a vehicle is abandoned, the owner will be:
1. Fined for abandoning a vehicle, typically about $160.00; AND
2. Charged for all costs for removal, storage, and disposal of the vehicle. Because of the high cost of removal and disposal on Moloka'i, those charges will be a minimum of $400 and may be as high as $800, or more.
Remember: It is very costly to pay abandoned vehicle charges, but it's free to bring in your own junk vehicle to the MMF to be scrapped.

Community Work Day Program (CWO), in partnership with Moloka'i residents and County of Maui, provides assistance during collection periods.
• Appliances & scrap from homes - assistance available to elderly and handicapped residents.
• Junk vehicles from homes - available for vehicles from homes only. A Vehicle Acceptance form must be completed, signed and submitted for EACH vehicle.

BRING IN: Vehicles*, Motorcycles*, Appliances, Vehicle Tires and Batteries, Propane Tanks, and Miscellaneous Metal items such as roofing, gutters, tubs, sinks, faucets, pipes, metal furniture, bicycles, mowers, engine parts, tools, fencing, and ferrous and non-ferrous Scrap Metals.
-+ Please separate your metals from all other waste and recyclable materials. Stop at the landfill scalehouse before proceeding to the Moloka'i Metals Facility (MMF).
-+ Take all metals to MMF staff only. NO drop-offs to other areas of the landfill.
-+ No charge for residents.
-+ There is a fee for materials from businesses and agencies.
*To SCRAP A VEHICLE:
~ A Vehicle Acceptance form must be submitted at the MMF with each and every car, truck, or motorcycle and the form must be filled out completely and signed by the owner or resident. The vehicle will be refused at the MMF if this form is not complete and brought in with the vehicle.
> Forms available at the MMF, at the Landfill, at Moloka'i Treasures, 658-0919 (located in the Meyers Bldg.), and online.
~ Vehicle owners should complete and file a Statement of Junking form with the Department of Motor Vehicles & Licensing to change registration to "Junk."

~ Both forms are available on line at the County's Solid Waste Division page; click on Metals & Abandoned Vehicles Section, then click on Moloka'i Metals Facility.

SUBJECT: FISCAL YEAR ("FY") 2014 BUDGET (EM-3) (BF-1)

At its meeting of April11, 2013, the Budget and Finance Committee discussed the rates and fees proposed by your Department. May I please request that you provide the following information in response to questions raised at the meeting:
1. Confirm whether refuse disposal fees are being charged by the ton or by the pound. Please explain. (DC)
2. Provide a copy ofthe Memorandum of Understanding between the County ofMaui and Lanai landowners (previously Castle & Cooke, Inc.) that provides for waiver of refuse disposal fees at the Lanai Landfill, as indicated on page 40 of Appendix B of the Mayor's proposed FY 2014 Budget (Ramseyer Rule Version). (GRH)
3. Identify and describe all Solid Waste programs for Molokai. Include programs funded by the Highway Beautification and Disposal of Abandoned Vehicles Revolving Fund. (SC)
May I further request that you transmit your response no later than Monday, April22, 2013, to enable the Committee to comprehensively evaluate the FY 2014 Budget.
