MEMORANDUM OF AGREEMENT Bottom~up Budgeting(BuB) for CY 2016

The CITY OF SANTA ROSA with office address at the City Government Center Compound, Barangay Market Area, City of Santa Rosa, Laguna, herein represented by HON. ARLENE 8 . ARCiLLAS, in her capacity as City Mayor, herein referred to as "LGU";

Witnesseth:

WHEREAS, one of the thrusts of the Aquino Administration. is to reduce poverty from 26.5% in 2009 to 16.6% by 2015 of the Millennium Development Goal which is reflected in the Philippine Development Plan for 2011-2016;

WHEREAS, Executive Order No. 43 s 2011 involves the organization of Human Development and Poverty Reduction Cluster(HDPRC}, the Good Governance and Anti­Corruption Cluster(GGAC) and the Economic Development Cluster that shall implement the Bottom-up Budgeting(BuB);

WHEREAS, BuB ensures the inclusion of the funding requirements for the development needs of poor cities and municipalities in the budget proposals of participating National Government Agencies;

WHEREAS, the appropriatjon for 2016 BuB Projects shall be funded from the General Appropriations Act (GAA) for the year 2016 budget line item under Locally­Funded Projects: Implementation of Various Projects for LG Us;

WHEREAS, THE Department of Health Central Office had issued. Comprehensive Fund Release(CFR) for CY 2016 to the Regional Health Office No. 4A to fund priority health programs, projects and activities(PAPs) including the implementation of the poverty reduction projects of LGUs in Calabarzon under BuB; .

WHEREAS,, the total amount of Six Hundred Thousand Pesos(PG00,000.00) is intended for the City of Santa Rosa in the implementation of the following program/ projects as indicated in their approved Local Poverty Reducation Plan(LPRAP) and GAA for CY 2016: . .

WHEREAS, pursuant to Nationai'Budget Memorandum(NBM) no 121 dated MAtrch 18, 2014 section 4.4 and JMC No. 6, BuB projects may be implemented by LGUs provided they meet the eligibility standards, subject to the government procurement law, budgeting, accounting and auditing rules and regulations;

NOW, THEREFORE, in consideration of the foregoing premises and stipulations herein set forth, the Parties hereto agree and do hereby agree as follows:

A. RESPONSIBILITIES OF THE LGU:

1. Issue a Sangguniang Panglungsod Resolution authorizing the mayor on the Memorandum of Agreement with DOH-ROIVA;

2. Submit a Work and Financial Plan on the approved programs/activities based on the approved and endorsed LPRAP by the Local Poverty Reduction Action T eam(LPRAT) and Local Chief Executive; · ·

3. Implement the approved Work and Financial Plan (based on LPRAP project brief) and submit progress report on plan implementation;

4. Designate a Point Person or Coordinator who will oversee the implementation of the program activities;

5. Utilize the fund allotted for the BuB project with corresponding LGU counterpart as required under section 4.5 of NBM following the existing accounting and auditing rules and regulations;

6 . Submit corresponding fund utilization/liquidation reports to DOH -R0-4A within 10 days after the end of the agreed period of the project as provided under GOA Circular No. 94-013 dated December 13, 1994. No additional or succeeding fund transfer made hereto until previous fund transfers shall have been liquidated.

B. RESPONSIBILITIES OF THE DOH-R04A:

1. Provide technical assistance in the formulation of the Work ·and Financial Plan(WFP) on the specific activities of the program;

2 . Review and approve the WFP (with specific details on the activities, items and cost estimated by the Regional Director through the Regional BuB-TWG and concerned Program Coordinator;

3. Release the fund after the approval of the WFP and submission of required documents (SB Resoultion and signed MOA);

4. Through the regional BuB-TWG and program coordinator/s, shall monitor regularly the implementation of the project including its technical and financial aspects;

5. Ensure that funds will be utilized. and liquidated in accordance with the accounting and auditing rules and regulations;

C. FUND SCHEDULE

1. BuB funds based on GAA 2016 shall be released by DOH-CO to Regional Office 4A through the Comprehensive Fund Release(CFR) and are available until December 31, 2016;

2. The DOH through R04A shall transfer to eligible LG!J the amount of Six Hundred Thousand Pesos(P600,000.00) in the condition that funds will be deposited to LGU Trust Fund specific for BuB-LPRAP Health Projects.

D.AMENDMENTS

This MOA may be amended or revoked only upon mutual consent of both parties; provided that all amendments shall be C,)Vered by Supplemental Provisions signed by both parties which shall be incorporated by way of reference as integral parts of this MOA.
