Tinalakay sa Kapulungan ang Kautusang Panlungsod Bilang 1498-2007, Taunang Badyet para sa Taorig 2007 ng Sangguniang Panlungsod ng Lungsod ng Santa Rosa, Laguna na may kabuuang halagang Phpl,270,104,751.91.

Matapos talakayin at pag-aralan ang nasabing Taunang Badyet, iminungka~i ni Kgg. Kgd. Alejandro Y. Yu, na pinangalawahan ni Kgg. Kgd. Rolando ·S. Bagnes at buong pagkakaisang sinang-ayunan ng lahat ng dumalo sa pulong:

1.0 The annual amount of appropriations for Personal Services (PS) amounting to Php235,659,805.60 has not exceeded the PS-limitation since the city government's maximum allowable amount was Php266,805, 059.82 based on the computations illustrated in LBC No. 75, dated July 12, 2000. So it, is suggested to continue confirming with the rules an~;:t(/ations 011 PS-limitatio11 provided under Section 325 of RA 7160 a:; Local Code of 1991;

2.0 On Local Budget Preparation Form No. 153 (Personnel Schedule):

2. 1 Fi !ling up of vacant positions shall be made strictly in accordance with the civil sen,ice law, mies and regulations;

2.2 The Grant of "Step Increments" shall be given only to all employees who are appointed on a permanent status in the career and non-career services for every (3) years of continuous service in a gi.ven position as cited in DBM-CSC Joint Circular No. 2, S. 1991 (Amending Section 1, Rule 1 ofCSC-DBM JC No. 1 of 1990); thus, all elective officials of said municipality are disqualified from the grant of step increments because such merit is limited only to all regular appointive employees of both career and non-career service;

3.0 The annual amount appropriated for "Donations" amounting to Php80, 000, 000. 00 shall be spent subject to provisions of law prescribed under Section 335 of R.A. 7160 of the Local Code, which provides that:

"No public money or property shall be appropriated or applied for Religious or Private Purposes";

4. 0 The annual amount provided for Scholarship Program amounting to Php6,000,000.00 shall be spent solely as prescribed under 447(5)(xi) of

R.A. 7160 of the Local Code;

5. 0 That the annual amount appropriated for 5% Calamity Fund shall be subject to the prescribed rules and regulations provided under R.A. 8185 and DBM-DILG Joint Memorandum Circular No. I, ·dated March 20, 2003;

6. 0 That the annual amount "appropriated for the 20% Development Fund shall be in cm?formity with the Local Development Plan and the Annual Investment Plan of the said city government,. duly supported by an approved LDC Resolution as prescribed under MC No. 97-30 dated Feb. JO, 1997;

7. 0 Appropriation provided for Peace and Order Council in the amount of Php2,500, 000. 00 shall be implemented in accordance with R.A. No. 6975;

8. 0 Gender and Development othenvise known as "Gender Issues" became a statut01y requirement that must be complied with all local government units mandated under E.O. 273 in pursuant to the specific services that must be implemented for women in relation to the services stipulated in

R.A. 7160 of the Local Code and R.A. 7192 (Women in Development and Nation Building Act); and so it is suggested to mainstream local government programs and activities in the said annual budget;

9.0 Appropriations provided/or "Other Maintenance and Operating Expenses" under expense code 969 shall include only costs of services which cannot be classified under any other "account names"; and it shall in no case be utilized or used for payment of salaries or any other remunerations of personnel related to programs and projects authorized by law according to Book of Audit of Government Expenditures (Copyright 1993 & 1996);

Further that the same shall be subject to Sec. 335 of the code;

10. 0 It is further suggested that all Other Maintenance and Operating Expenses in the Office of the Mayor of the said local government unit under the expense code (969) shall be broken down in a more specific account names

prescribed by the COA Circular No. 2003-001 dated June 17, 2003;

1 I. 0 The amount of appropriated for Debt Servicing should conj orm with the provisions of law wherein the total amount appropriated thereto shall not exceed the 20% of the annual regular income of the city government;

12. 0 It is still encouraged to include the special provision of law provided under R.A. 8745, GAA of 1999, to wit: "Use of funds xxx and provided finally that no amount of IRA shall be use for study tour of Local Government Officials and Employees of LGU's;

13. 0 Provisions of Section 313 of R.A. 7160, otherwise known as the Local Government Code of 1991, on the operation of Public Utilities and Other Economic Enterprises shall be strictly complied with, which clearly states Lhat:

" ... Profits or income derived from the operation of public utilities and other economic enterprises, after deduction for the cost of improvement, repair and repair and other expenses of the public utility or economic enterprise concerned, shall first be applied for the return of the advances

or loans made therefore. Any excess shall form part of the general fund of the local government unit concerned". Moreover, Section 325(a) of the code provides that:

"x xx The appropriations for salaries, wages, representation and trans-portation allowances of officials and emplqyees of the public utilities and

economic ente,prises owned, operated, and maintained by the local government unit concerned shall be included in the annual budget or in the computation of the maximum amount for persqnal services. The appropriations for the personal sen,ices of such ecomonic enterprises shall be charged to their respective budgets"; (Underscoring supplied)

A copy of the FY 2007 Annual Budget of the City of SANTA ROSA is herewith returned with the stamp of reviewed in pursuant to R.A. 7160.

Compliance with all pertinent rules shall be the full re~ponsibility of the implementing Local Govemment Unit as expressly stated under Section 351 of R.A. 7160; and the review action made by the Finance Committee is not a grant of authority that would allow any item of appropriation that is ~pecifically prohibited by law.
