WHEREAS,the City's pursuit of the Seal of Good Local Governance (SGLG) hasbeen made highly attainable because of the full cooperation of the twenty-six (26)BarangayLocalGovernment Units (BLGUs)in consolidating not only the City Government'spolitical authority, but more importantly for functioning as the implementing componentsof its policies, plans, programs, projects and activities, as mandated under Section 384 ofRepublicAct No. 7160, otherwise known as the LocalGovernment Codeof 1991;

WHEREAS,it is imperative for the City Government to establish a localizedprogramthat would provide incentives to all barangays, taking into account their vital role andreciprocal responsibility in working hand-in-hand with the City Government towardsachieving the prestigious Seal of Good LocalGovernance;

NOW THEREFORE,on motion of City Councilor Jose Edmar J. Yumang, dulysecondedby City CouncilorsJoseOrlandoR,Acharonand LourdesF. Casabuena,be it -

RESOLVED,as it is hereby resolved,to enact this Ordinance:

AN ORDINANCEINSTITUTIONALIZINGTHE SEALOF GOOD BARANGAYGOVERNANCEPROGRAMIN GENERALSANTOSCITY, PROVIDINGPOLICIES,GUIDELINESAND FUNDSTHEREFOR,ANDFOROTHERPURPOSES

Be it enacted by the Sangguniang Panlungsod of General Santos City that:

Section 1. Short Tit/e. - This Ordinance shall be known as "The Seal of GoodBarangayGovernanceProgramOrdinanceof GeneralSantosCity";

a) Seal of Good Barangay Governance (SGBG) Program - refers to theinstitutionalized awards/incentive program espoused by the CityGovernment through this ordinance; it is distinctively designed torecognize, incentivize and inspire all barangays of General Santos City topractice a "culture of good performance" at all times, based on the criteriaherein provided.

Section 2. Definition of Terms.- As used in this Ordinance the following terms aredefined:

b) City Government - refers to the local administration or the LocalGovernment Unit of the City of GeneralSantos.

c) Barangay Local Government Units (BLGUs)- refer to the twenty-six (26)barangays comprising the administrative divisions of the City Governmentof General Santos; it is further subdivided into smaller areas called Puroks.

d) Purok - refers to the political subdivision of a barangay; it is a People'sOrganization led by a Purok President and assisted by other Purok officialsduly elected at large by residents of the Purok. It serves as the frontline ofbarangay-related programs and services, such as cleanliness, andbeautification drives, peace and order pursuits and others.

e) DILG - refers to the Department of the Interior and Local Governmentresponsible for promoting peace and order, ensuring public safety andstrengthening local government capability.

Section 3. Declaration of Policy. -The City Government of General Santos fullysubscribes to the Local Government Code principle of recognizing the vital role of thebarangays as the primary implementing components of its policies, plans, programs,projects and activities. Any successof the City Government in implementing its mandate isalways intertwined with the role and function of the barangays. Therefore, to give duerecognition to the barangays, it is hereby declared the policy to institutionalize the Seal ofGoodBarangayGovernanceas part of the regular awards and incentive agenda of the CityGovernment. This policy further carries the legal endowment of extending cash incentivesto the most distinguished and deserving barangays of the City worthy to be awardedunder the provisions of this Ordinance.

Section 4. Objectives. - This Ordinance is promulgated with the followingobjectives:

a.) To give a distinguishing accolade and cash award/incentive to deservingbarangays of the City in due recognition of their vital role as reciprocalpartners of the City Government in its quest for the achievement of theSeal of Good LocalGovernance;

b.) To inspire all barangays of the City to practice a "culture of goodperformance" at all times, in line with the DILG Memorandum Circular No.2019-44, dated March 15, 2019, and with the pertinent provisions ofRepublic Act No. 11292, otherwise known as "the Seal of Good LocalGovernanceAct of 2019";

c.) To continually incite all other barangays to better accomplish theirmandated functions, in line with the City's implementation of its policies,plans, programs, projects and activities that redound to good governance,which is a key to a sustainable development in the entire territorialjurisdiction of GeneralSantosCity.

a.) FinancialAdministration;b.) Disaster Preparedness;c.) Social Protection;d.) Peaceand Ordere.) Business-friendlinessand Competitiveness;f.) Environmental Management; andg.) Tourism, Culture and the Arts.

Section 5. The Seal of Good Barangay Governance (SGBG)Program. - The Sealof Good Barangay Governance is an institutionalized local program for all barangays ofGeneral Santos City highlighting their vital role in the City's achievement for the mostcoveted national award known as the "Seal of Good Local Governance." It is distinctivelydesigned to inspire all barangays to practice a "culture of good performance" at all times,thereby extending a corresponding monetary award/incentive to the winners basedon thefollowing areas of barangay administration, namely:

Passing the above-cited criteria forms the basis for the barangay's awarding of theSeal of Good Barangay Governance, and such other additional bonuses or emolumentsfrom the City Government.

Section 6. Scope/Coverage. - This Ordinance shall cover all the twenty-six (26)barangaysof GeneralSantosCity.

Section 7. Implementing Rules and Regulations. - The City Mayor's Office, incoordination with the DILG, and such other relevant City Government Departments andagencies, shall promulgate the Rulesand Regulationswithin sixty (60) days to implementthis Ordinance.

Section 8. Funding.- The amount necessaryfor the implementationof this Ordinanceshall be sourcedfrom the GeneralFundand/or SupplementalBudgetof the City Government,subject to the usualaccountingand auditing rulesand regulations.

Section 9. Suppletory clause. - The salient provisions of Republic Act No. 11292,otherwise known as "The Seal of Good Local Governance Act of 2019" and DILGMemorandum Circular No. 2019-44, dated March 15, 2019, and such other existingpertinent laws, insofar as applicable, shall be deemed suppletory to this Ordinance.

Section 10. Repealing Clause. - All previous ordinances, rules and regulationsinconsistentwith this Ordinanceshall be deemedrepealedor modifiedaccordingly.

Section 11. Separability Clause. If for any reason any part or provision of thisOrdinanceshall be held unconstitutionalor invalid, the other provisionshereof which are notaffectedthereby shall continue to be valid and in effect.

Section 12. Effectivity. - This Ordinanceshall take effect fifteen (15) days after itspublicationin a newspaperof generalcirculationwithin the City.

Enacted by the 19th Sangguniang Panlungsod, City of General Santos, on its 9thRegularSessionheld on October 01, 2019.
