Secretary’s LetterI suspect we are all eager to welcome fall’s cooler temperatures, but despite the scorching summer
heat, OCAPL’s membership supported and sweated through some fantastic summer events
including the sporting clays tournament.
The annual sporting clays tournament took place on August 31st at Silver Leaf Shotgun Sports in
Guthrie, Oklahoma. This was by far the largest tournament to date. We were able to accommodate
over 475 shooters! If you have the opportunity, please thank Darell Noblitt, Chair of the Sporting
Clays Committee, for the many hours he spent working to make this tournament a success.
The weather was more forgiving for the 40 or so fun loving landmen that made their way to Broken
Bow, Oklahoma this weekend. Amy Love, Chair of the Weekend Take-Off Committee, put together
a first class getaway to Beaver’s Bend Resort at Lake Broken Bow. Amidst the boat rides, cocktails
and cookouts, event participants were challenged and intrigued by lectures given by industry
experts, and as a result, received 11 AAPL continuing education credits.
OCAPL welcomed back its membership on September 10th. The luncheon featured Oklahoma
Corporation Commissioner, Dana Murphy. Dana highlighted some of the major changes that
have taken place at the commission this year for the over 200 landmen that were in attendance.
If you were unable to attend the luncheon, I would encourage you to review Dana’s power point
presentation which is available on the website’s Home page.
Keeping with tradition, there was not a guest speaker at the September evening meeting; however,
OCAPL was proud to host the University of Oklahoma Robert M. Zinke Energy Management

Program Alumni Reception. Steve Long, Director of Energy Management for OU, has
done an excellent job growing the program, and OCAPL is thrilled to support the next
generation of landmen.
Like the OUEM program, OCAPL is growing fast! In 2012 alone, we have added 370
first time members bringing our total membership to 1730 – a record high! Such growth
would not be possible without our biggest ambassadors, the membership, or without
our leadership team, the incredible volunteers that make up the OCAPL board. Please
take a moment to review the nomination report provided by the Nominating Committee
that, subject to final approval by the current Executive Committee, presents the slate of
Officers and Executive Committee Members who will lead OCAPL in 2013.
Thankfully OCAPL events do not end with the summer! The Girls Night Out “Wine
and Palette” event is scheduled for Thursday, September 20th. Additionally, OCAPL
is partnering with the University of Oklahoma’s Energy Management students to fight
hunger on Saturday, September 29th. There are still a few spots left, so volunteer to
serve at the Oklahoma Regional Food Bank today!
Mark your calendars for October 1st. The monthly luncheon will feature Oklahoma
Energy Secretary, C. Michael Ming, who will discuss the Oklahoma First Energy Plan,
and Mark Mathis, creator of the movie spOILed, will speak at the evening meeting. At
the request of our membership and in an attempt to better accommodate increasing
attendance, the board has decided to test an alternative evening meeting style wherein
cocktails and heavy appetizers will be served in lieu of a full dinner and theatre style
seating will replace the usual cabaret seating for the presentation. Your post-meeting
feedback is welcomed.

The American Association of Professional Landmen and the AAPL Educational Foundation invite you to attend a FREE Field Landman Seminar to be held at Willow Creek Golf & Country Club, 6501 S. Country Club Drive, Oklahoma City, OK on Thursday October 18th, starting at 5:00pm. The Trustees of the AAPL Educational Foundation initiated these events to provide a forum for field landmen to gather for education, networking, and good food, all at no cost to all AAPL Active Members and $50.00 to non-members attending. This program designed for Field Landmen to have the opportunity to register to become a member of the AAPL. The $50.00 registration fee covers this education class, happy hour, buffet dinner, plus your first year of membership dues. Please note: You can fill out your application prior to attending this seminar and bring it with you for processing.

HB2654: Creates the Energy Litigation Reform Act (Section 901-903 of Title 52) applying the standard of a reasonably prudent operator and providing the Production Revenue Standards Act as the exclusive remedy and amends 52 O.S. 2011, Section 87.1 as follows: the owner(s) of oil and gas rights in and under an unleased tract of land are a lessee to the extent of a 7/8 interest in and to the rights and a lessor to the extent of the remaining 1/8 interest unless and until the owner(s) elect not to participate under a pooling order issued by the Corporation Commission, at which time each owner will be considered a lessor and subject to the judicially recognized implied covenant to market.
SB 1189: Adds horizontal well unitizations to the list of locations that fit under the definition of associated common source of supply in the 2011 Shale Reservoir Development Act.
SB 1627: Creates the Oklahoma Energy Initiative Act. The measure states the objectives of the Initiative and allows it to receive assistance from any state agency or public entity to implement the Act. The bill also mandates that the Initiative be administered and governed by the eight-member Oklahoma Energy Initiative Board and outlines its responsibilities.
SB1665: amends the definitions of seismic exploration, operator, surface estate, and surface owner under the Seismic Exploration Regulation Act and stipulates that it is sufficient to send a notification of seismic exploration by mail to a surface estate owner’s last address shown in the records of the county clerk. The notice shall include a description of the surface estate as well as a specific provision regarding the amount of damages offered by the operator to the surface owner.
SB243: Amends provisions of the Seismic Exploration Regulation Act related to required notification procedures for surface estate owners. It requires seismic exploration operator applicants to file an affidavit within 90 days with the county clerk reporting the mailing of a notice and listing the surface owners which were not locatable. The measure requires an operator to provide notice to the surface owner at least 15 days prior to seismic exploration, and in the absence of an agreement, requires the two parties to make a good-faith effort to resolve reasonable damage issues.

Report of the Nominating Committee
The chairman of the nominating committee asked that notices be sent by e-mail to request nominations from the general membership for the 2013 OCAPL offices of Vice-President, Secretary and Treasurer.
In accordance with the OCAPL by-laws the chair, chosen by the President of OCAPL, appointed four active OCAPL members to serve on the nominating committee, along with the mandated committee members, the current Vice-President and first Past-President.
On August 29, 2012, the seven nominating committee members met. The committee received 27 ballots. Every nomination was reviewed and considered. The committee discussed each nominee and made a decision on each office to recommend to the President and the Executive Committee. The committee also discussed and recommendations made for the position of AAPL Director (2 year term starting July 1, 2013 through July 1, 2015) and four (4) OCAPL Executive Board Committee positions (see period of term for each recommendation below).
The result of the nomination process and the recommendation of the nominating committee for the 2013 Officers, AAPL Director and OCAPL Executive Board Committee positions are as follows:
