WELCOME TO THE 2015 BCAMI SYMPOSIUM

The 2015 BCAMI Symposium is the must-attend ADR conference in BC. This eclectic symposium will discuss the role and development of ADR in different industries, and discuss diverse topics, such as Collective Bargaining, Ethics, Natural Resources, Construction, Insurance, ODR, Med.-Arb., Family Law, Property Appraisal, Sports, Strata Corporations, and Access to Dispute Resolution. The 2015 BCAMI Symposium will provide ADR professionals with a valuable opportunity to interact with leading thinkers in the field, establish personal connections, and discuss current issues and developments. It will bring together lawyers, in-house counsel, arbitrators, mediators, HR professionals, corporate professionals and clients who use ADR services. Med-Arb combines well-established processes for conflict resolution into one hybrid process. It offers parties both the ability to obtain a definitive resolution of a particular dispute; and the flexibility to pursue consensual settlement prior to or during binding arbitration. This panel will stimulate thinking about the med-arb process, its advantages and limitations; probe the questions that dispute resolution professionals should explore with their clients when med-arb is considered; and discuss ethical and professional standards. Agriculture and natural resource development are some of the key activities that shape the natural, economic and social landscape of British Columbia. We often hear about opposing perspectives and dissatisfaction with how land use decisions are made, but rarely about how the process has unfolded. Effective and sustained engagement of stakeholders, First Nations, proponents and regulators in planning and land use decision-making are critical to advancing reconciliation of differences. The speakers in this panel will explore ideas and experiences on the use of a variety of engagement and ADR practices and lessons learnt in the areas of agriculture and natural resource management. People who bring in a third party intervenor - be it Mediator, Arbitrator, Facilitator - need more than simply having the professional "show up". They often have no idea how to proceed. Engaging with conflict is high context work; each situation is unique, and the more nuanced the dispute, the more important is the role of the professional in working with the client to design and tailor a process that will meet the user's needs. This creative aspect of our work is the subject of the panel, and you will hear perspectives from professionals in a wide range of practice, from academia to public to private sectors. Hands-on problem solving! Each table of participants will be given a scenario and with the assistance of a facilitator will discuss the ethical dilemma in the scenario. This panel examines the pitfalls and primary drivers of Strata Property Disputes. The panelists will examine the applicability of the Strata Property Contractor Arbitration Rules of Procedure, the reason for their creation, their effect on the organisation of the dispute and potential outcomes, while also addressing the risk and potential cost implications of ad hoc procedures. It’s difficult enough experiencing a property or bodily injury loss, but then having to fight to receive what you or your clients feel is a fair compensation simply adds “salt to the wound”. Whether you are in the insurance or legal industry or simply purchase insurance products, this lively panel discussion provides knowledge and insight as to how, why and when to choose mediation or arbitration as a catalyst to bring fairness and closure to the claim process. When we are under high levels of stress or in conflict our pulse increases, we feel overwhelmed and find it difficult to function. Our brains evolved in order to protect us from threats – whether our survival was threatened by a sabre tooth tiger or by an aggressive next door neighbor. Just when we need to think clearly our brains automatically de-activate those parts that we need for problem-solving. In this session Jean Greatbatch will help us understand the connection between the brain and conflict and how we can deal effectively with parties in conflict (including mediation, arbitration and litigation).
