On the recommendation of HPSC Panchkula vide their Memo No. RG

2/2009/2305 dated 03/05/2012, the Governor of Haryana is pleased to appoint the

Terms and conditions:-They are appointed purely on temporary and provisional basis.

These appointments are against temporary posts and their confirmation againstsubstantive posts shall be considered on the basis of their seniority and record ofservice as and when such post is available.

They shall have to take an oath of allegiance to the constitution of India.

They shall produce a certificate before joining the duties to the effect that theyhave one living wife/husband in case he/she is married. If they have not morethan one living wife/ husband, shall be eligible for appointment to the postoffered unless the Government after being satisfied that there are specialgrounds for doing so, exempt them from this condition.

They shall not be allowed to apply for any post outside that department for aperiod of at least five years.

They shall not claim seniority on the basis of this order. Their inter-, seniority willalso be decided in accordance with the department rules and instructions of theState Government later on.

7. They shall be on probation for a period of two years, the period of probation canbe extended for a further period not exceeding one year, if considered necessary.

In other matters, not specifically mentioned in this communication, they shall begoverned by the civil services Rules as applicable to Haryana GovernmentEmployees and such orders/ instructions as may be issued by the Governmentfrom time to time.

In case of reserved category candidates, the appointment is provisional and issubject to verification of the Scheduled Castes/ Scheduled tribes/ BackwardClass and ESM Category Certificate. If the verification reveals that the claim ofbelonging to SC/ST/BC and ESM, as the case may be is false, then their serviceswill be terminated forthwith without assigning any further reasons and withoutprejudice to such further action as may be taken under provisions of the IndianPenal Code for production of false certificate.

All the candidates who have been selected as Lecturer are hereby directed tosubmit their original certificates of academic qualification and other relevantcertificate with the concerned District Education Officer of their place of posting.DEO will ensure that the candidates duly issued by the Medical Board to theDistrict Education Officers. Only then he/she would be allowed to join asLecturer in respective schools of posting. District Education Officer will also givecharacter and antecedent verification forms to them and after filling the forms,the candidates would submit them to the DEO concerned immediately.

Those candidate who are already in Government job as Class-II officers need notsubmit a fresh Medical fitness report whereas others are directed to appearbefore the Medical Board as may be constituted by the Director General HealthServices, Haryana, Panchkula and Medical fitness report is the submitted in theoffice of the concerned District Education Officer before joining the place ofposting as Lecturer in respective Government Senior Secondary School.

They shall be governed by the Haryana State Education Lecturer School Cadre(Group-B) Service Rules, 1998.

If at any time during the course of their temporary appointment, any of theappointee desires to resign, they shall be required to give one month's clearnotice or forfeit, in lieu thereof, their salary including allowances etc. for onemonth or for the period by which the notice falls short of one month. Such anotice will be given to him/her by the Government also in the case it is proposedto terminate his/her services in lieu thereof the Government will be liable to payhim/her salary, including allowances for one month or for the period by whichthe notice falls short of one month.

No TA/DA will be admissible to the candidates for joining as Lecturer..

If he or she gets an appointment as Lecturer on the basis of his/her furnishingfalse/forged or fraudulent information/ facts which are detected later on, he/shewould be liable for termination of service without any notice.

16. If they are willing to accept this offer of appointment as Lecturer, HES-II (SchoolCadre) on the above terms and conditions, he/she should submit his/her joiningreport as per aforesaid directions.

This is an appeal filed by Sh. Sehdev Yadav, Block Education Officer,

Narnaund (Hisar), previously Principal, Govt. Girls Senior Secondary School

Hisar against the order dated 09.03.2012 passed by Director Secondary

Education (DSE), Haryana, Panchkula vide which a penalty of stoppage of one

grade increment without cumulative effect has been inflicted upon theincumbent.

Brief facts of the case are that the incumbent was chargesheeted under

Rule 8 of Haryana Civil Services (Punishment and Appeal), Rules 1987 vide

order No. 5/37-2011 HRG-I (I) dated 26.07.2011 on the following charges: -

That as per enquiry report dated 09.02.2011, submitted by Joint

Director, Directorate of Elementary Education, Haryana, Panchkula,

Shri Sehdev Yadav, being the Drawing and Disbursing Officer of

Government Primary School No. 7, Hisar in connivance with Smt.

Pushpa Rani, JBT Teacher, from 03.12.2007 to 30.07.2009 granted

short leave more than once in a day and 2/3 rd casual leaves in a day

to the said Pushpa Rani, whereas there is no such provision in the

relevant rules.

He replied to the said chargesheet on 29.09.2011 denying all the charges

levelled against him. Thereafter, DSE vide order dated 09.03.2012 imposed a

penalty of stoppage of one grade increment without cumulative effect upon the

incumbent. Hence, this appeal.

In the said appeal, it was stated that on five different dates in year 2008

and 2009, 2/ 3rd casual leaves were sanctioned. He further stated that when

these facts came to his notice, he converted the said 2/ 3 rd leaves into full

casual leave pertaining to the said different dates. The appeal was heard on

25.07.2012. During hearing, the incumbent reiterated the submissions made

in the appeal and requested to absolve him of the charges by reconsidering the

matter in the light of submissions made.

I have gone through the contents of file and chargesheet, reply thereof,

contents of the appeal and submissions made at the time of hearing. It is clear

that the incumbent has sanctioned short leaves and 2/ 3 rd casual leaves on

different dates and in different years of 2008 and 2009 against the Government

instructions dated 09.08.1965 and 22.10.1965 regarding grant of short leave

and late attendance, which has not been complied with at all. Hence, there is

no scintilla of doubt that absolute discretion has been used in the matter of

grant of half-day and two-third leaves.

Taking an overall view of the matter, the appeal is rejected, being devoid

of merit.

19. The managing committee shall abide by the provisions of Haryana School Education Rules 2003(amended) & R.T.E. Rules 2011 andamnedments it any thereafter. The Managing shall be liable for diciplinary action in case of violation of any provision of the rules.
