Legislation
“A construction company has been prosecuted for breaching health and safety failings that endangered the lives of workers and residents ---------- They were prosecuted by the Health and Safety Executive and fined a total of £12,000, with costs of £1,494 after pleading guilty to offences under Regulation 28(1), 29(1), and 29(2) of the Construction (Design and Management) Regulations 2007”.
According to HSE, although only 5 per cent of British employees work in the construction industry, it accounts for 31 per cent of fatal injuries to employees and 10 per cent of reported major/specified injuries.
The Health and Safety at Work ACT - 1974. the use of the word ACT in the title means it is Statute Law. Therefore Employers and Employees, subcontractors and Franchises MUST comply.
Environmental
New sentencing guidelines came into force Tuesday 1 July 2014, increasing
the levels of fine likely to be imposed on those committing an
environmental crime.
Sentences for environmental offences were historically determined using a
combination of sentencing principles, related guidelines and preceding
court decisions.
The range of fines has been increased to reflect an offender's ability to pay.
The aim is to ensure fines have a real economic impact and provide a
stronger deterrent from re-offending.
