Periodically, temporary applications are filed with the Board. Details of these applications can be made available at anytime to any interested parties by calling (416) 326-6732.

The following are applications for extra-provincial and public vehicle operating licenses filed under the Motor Vehicle Transport Act, 1987, and the Public Vehicles Act. All information pertaining to the applicant i.e. business plan, supporting evidence, etc. is on file at the Board and is available upon request.

Amending O. Reg. 404/12(ENERGY EFFICIENCY — APPLIANCES AND PRODUCTS)

1. (1) Subsection 2 (1) of Ontario Regulation 404/12 is amended by striking out “clause 15 (1) (a)” and substituting “section 15”. (2) Subsections 2 (1.1) and (1.2) of the Regulation are revoked. 2. The Regulation is amended by adding the following sections:Rolling incorporation of a foreign regulation that is revoked

2.1 If a standard or requirement set out in section 1 of a Schedule to this Regulation incorporates by reference a provision of a regulation from a jurisdiction outside Canada as it reads on the date the particular appliance or product is manufactured and the incorporated provision is revoked and not replaced by the date the appliance or product is manufactured, the provision as it read immediately before it was revoked continues to have effect for the purposes of this Regulation.Early compliance

2.2 (1) Despite section 2, for the purposes of section 15 of the Act, a person may apply a testing standard or an efficiency standard or requirement set out in section 1 of the applicable Schedule to this Regulation that would apply to an appliance or product if it were manufactured on a future date if the person complies with the following rules: 1. The person shall select a notional future date and apply both the testing standard and the efficiency standard or

requirement set out in section 1 of the applicable Schedule to this Regulation that would apply if the appliance or product were manufactured on the notional future date.

2. If a testing standard or an efficiency standard or requirement set out in section 1 of a Schedule to this Regulation incorporates a document by reference as of a fixed date, the person shall,

i. use the version of the incorporated document as it reads on the fixed date, and ii. apply the testing standard or the efficiency standard or requirement set out in the incorporated document that

would apply if the appliance or product were manufactured on the notional future date referred to in paragraph 1. 3. If a testing standard or an efficiency standard or requirement set out in section 1 of a Schedule to this Regulation

incorporates by reference a document as it reads on the date the particular appliance or product is manufactured the person shall,

i. use the version of the incorporated document that is in effect on the actual date the particular product or appliance is manufactured, and

ii. apply the testing standard or the efficiency standard or requirement set out in the incorporated standard that would apply if the appliance or product were manufactured on the notional future date referred to in paragraph 1.

(2) For greater certainty, early compliance under subsection (1) is not permitted if, (a) section 1 of the applicable Schedule to this Regulation does not provide for a testing standard and an efficiency

standard or requirement that would apply to the particular appliance or product on the notional future date selected under paragraph 1 of subsection (1); or

(b) an incorporated document does not set out either a testing standard or an efficiency standard or requirement that would apply to the particular appliance or product on the notional future date or the actual date, as the case may be.

3. Subsection 4 (1) of the Regulation is revoked and replaced with the following: 4. (1) A prescribed label referred to in clause 15 (1) (b) of the Act for an appliance or product must consist of either a label containing the registered trademark or symbol of an organization designated in subsection 3 (2) or (3), as applicable, or a label in the form provided by the Ministry.

Subparagraph 9.1 ii of section 1 of Schedule 1 to the Regulation is amended by striking out “as they read on the date of manufacture” at the end and substituting “as they read on the date the particular appliance or product is manufactured”. 5. (1) Paragraphs 4 to 7 of section 1 of Schedule 5 to the Regulation are revoked and the following substituted: 4. Lamp, regulated incandescent, excluding halogen, with a lumen output of at least 1,050 lumens but not more than

2,600 lumens: i. Date of manufacture: January 1, 2014 or later. ii. Testing standards: A. for lamp lumen output and wattage: IES LM-45-00, IESNA Approved Method for Electrical and

Photometric Measurements of General Service Incandescent Filament Lamps, except that the lamp must be tested at 120 volts regardless of its nominal voltage,

B. for life: IES LM-49-01, IESNA Approved Method for Life Testing of General Lighting Incandescent Filament Lamps, except that the lamp must be tested at 120 volts regardless of its nominal voltage, and

C. for colour rendering index (CRI): CIE 13.3-1995, Method of Measuring and Specifying Colour Rendering Properties of Light Sources.

iii. Scope of application: a “regulated incandescent” lamp as defined in section 2 of this Schedule, other than a halogen lamp, with a lumen output of at least 1,050 lumens but not more than 2,600 lumens.

iv. Prescribed efficiency standard or requirement: A. lamp efficacy in lm/W: 1. for modified spectrum lamps: ≥ 75 per cent of the efficacy of a clear lamp with the same filament and

bulb shape and operating at the same voltage and power, and 2. for lamps other than modified spectrum lamps: ≥ 4.0357 × ln (lumen output) – 7.1345, B. life: ≥ 1,000 hours, and C. CRI: ≥ 80. 5. Lamp, regulated incandescent, halogen only, with a lumen output of at least 1,050 lumens but not more than 2,600

lumens: i. Date of manufacture: March 31, 2014 to December 31, 2014 inclusive. ii. Testing standards: A. for lamp lumen output and wattage: IES LM-45-00, IESNA Approved Method for Electrical and

iii. Scope of application: a “regulated incandescent” lamp as defined in section 2 of this Schedule if it is a halogen lamp, with a lumen output of at least 1,050 lumens but not more than 2,600 lumens.

iv. Prescribed efficiency standard or requirement: A. lamp efficacy in lm/W: 1. for modified spectrum lamps: ≥ 75 per cent of the efficacy of a clear lamp with the same filament and

bulb shape and operating at the same voltage and power, and 2. for lamps other than modified spectrum lamps: ≥ 4.0357 × ln (lumen output) – 7.1345, B. life: ≥ 1,000 hours, and C. CRI: ≥ 80. 6. Lamp, regulated incandescent, with a lumen output of at least 250 lumens but less than 1,050 lumens: i. Date of manufacture: December 31, 2014 or later. ii. Testing standards: A. for lamp lumen output and wattage: IES LM-45-00, IESNA Approved Method for Electrical and

Photometric Measurements of General Service Incandescent Filament Lamps, except that the lamp must be tested at 120 volts regardless of its nominal voltage,

B. for life: IES LM-49-01, IESNA Approved Method for Life Testing of General Lighting Incandescent Filament Lamps, except that the lamp must be tested at 120 volts regardless of its nominal voltage,

C. for colour rendering index (CRI): CIE 13.3-1995, Method of Measuring and Specifying Colour Rendering Properties of Light Sources.

iii. Scope of application: a “regulated incandescent” lamp as defined in section 2 of this Schedule, with a lumen output of at least 250 lumens but less than 1,050 lumens.

iv. Prescribed efficiency standard or requirement: A. lamp efficacy in lm/W: 1. for modified spectrum lamps: ≥ 75 per cent of the efficacy of a clear lamp with the same filament and

bulb shape, operated at the same rated voltage and wattage, and 2. for lamps other than modified spectrum lamps: ≥ 4.0357 × ln (lumen output) – 7.1345, B. life: ≥ 1,000 hours, and C. CRI: ≥ 80. (2) Section 2 of Schedule 5 to the Regulation is revoked and the following substituted: 2. In this Schedule,“coloured lamp” means a lamp that is marketed as a coloured lamp and that has a colour rendering index of less than 50,

as determined in accordance with CIE 13.3-1995, or a correlated colour temperature of less than 2,500 K or greater than 4,600 K;

“maximum wattage” has the same meaning as in the Federal Energy Efficiency Regulations (May 4, 2012 version);“modified spectrum lamp” means a lamp that, (a) is marketed as a modified spectrum lamp, (b) is not a coloured lamp, and

(c) when operated at its nominal voltage and nominal power, has a colour point that, on the 1931 chromaticity diagram described in CIE 15: 2004, Colorimetry, lies below the black-body locus and that is at least 4 MacAdam steps, as described in IES LM-16-1993, Practical Guide to Colorimetry of Light Sources, distant from the colour point of a clear lamp with the same filament and bulb shape and operating at the same nominal voltage and nominal power;

“nominal wattage” has the same meaning as in the Federal Energy Efficiency Regulations (May 4, 2012 version);“regulated incandescent”, in respect of a lamp, means a lamp that, (a) provides light by heating a filament to incandescence, (b) is designed to provide a substantially uniform level of illuminance throughout an area, (c) is not designed for a particular function or purpose, (d) has a luminous flux of at least 250 lumens but not more than 2,600 lumens, (e) has a nominal voltage of at least 110 volts but not more than 130 volts, or a nominal voltage range that lies at least

partially between those voltages, (f) is screw-based, (g) is not a type of lamp listed in subsection 3 (1) or 3 (3), and (h) does not have any of the characteristics described in subsection 3 (2). 3. (1) For the purposes of this Schedule, a regulated incandescent lamp excludes any of the following types of lamps: 1. A reflector lamp: a lamp that falls under paragraph 3.1 of section 1 of this Schedule. 2. A three-way lamp: a lamp that is marketed as a three-way lamp and that employs two filaments, operated separately

and in combination, to provide three light levels. (2) For the purposes of this Schedule, a regulated incandescent lamp excludes a lamp with any of the following characteristics: 1. A lamp that has a G-shape, as specified in ANSI C78.20-2003 and ANSI C79.1-2002, with a diameter of 12.7 cm or

more. 2. A lamp that has a T-shape, as specified in ANSI C78.20-2003 and ANSI C79.1-2002, and a maximum nominal power

of 40 W or a length exceeding 25.4 cm. 3. A lamp that has a B, BA, CA, F, G16-½, G25, G30, S or M-14 shape or other similar shape, as specified in ANSI

C78.20-2003 and ANSI C79.1-2002, and a maximum nominal power of 40 W. 4. A lamp that has a screw base size of E5, E10, E11, E12, E17, E26/50×39, E26/53×39, E29/28, E29/53×39, E39, E39d,

EP39 or EX39, as specified in ANSI C81.61-2006. 5. A left-hand thread lamp with a base that screws into a lamp socket in a counter-clockwise direction. (3) For greater certainty, a regulated incandescent lamp excludes the following types of lamps: 1. A coloured lamp. 2. An appliance lamp: a lamp, including an oven lamp, a refrigerator lamp and a vacuum cleaner lamp, that is specifically

designed and marketed to operate in a household appliance and has a maximum wattage of 40 W. 3. An explosion resistant lamp: a lamp that is designed and certified to operate in a Class I, Division 1 or Class II,

Division 1 environment, as defined in CEI/IEC 60079-0 (2007), Explosive atmospheres – Part 0: Equipment – General Requirements.

4. A plant lamp: a lamp that contains a filter or coating to suppress light with wavelengths of less than 0.58 µm and that is marketed as a plant lamp.

5. A sign service lamp: a vacuum type or gas-filled lamp that has a sufficiently low bulb temperature to permit exposed outdoor use on high-speed flashing circuits and that is marketed as a sign service lamp.

6. A silver bowl lamp: a lamp that is marketed as a silver bowl lamp and that has a reflective coating applied directly to part of the bulb surface that reflects light toward the lamp base.

7. A traffic signal module: a “traffic signal module” as defined in the Federal Energy Efficiency Regulations (May 4, 2001 version).

8. A pedestrian module: a “pedestrian module” as defined in the Federal Energy Efficiency Regulations (May 4, 2001 version).

9. A submersible lamp: a lamp that meets the requirements of CSA Standard C22.2 No. 89-1976, Swimming-pool Luminaires, Submersible Luminaires and Accessories.

10. A rough service lamp: a lamp that is marketed as a rough service lamp and that has, i. a C-7A or C-11 filament, as described in IES’s Lighting Handbook, 9th ed., with at least five supports exclusive

of lead wires, ii. a C-17 filament, as described in IES’s Lighting Handbook, 9th ed., with eight supports exclusive of lead wires,

or iii. a C-22 filament, as described in IES’s Lighting Handbook, 9th ed., with 16 supports exclusive of lead wires. 11. A vibration service lamp: a lamp that, i. is marketed as a vibration service lamp, ii. has a maximum nominal power of 60 W, and iii. has a C-5, C-7A or C-9 filament configuration, as illustrated in figure 6.12 of IES’s Lighting Handbook, 9th ed.,

or a similar configuration, with less than five supports. 12. A shatter-resistant lamp: a lamp that has an external silicon, polytetrafluoroethylene or similar coating applied for the

purpose of resisting breakage and preventing glass from reaching the operating environment in the event of breakage and that is marketed as a shatter-resistant, shatter-proof or shatter-protected lamp.

13. A bug lamp: a lamp that is marketed as a bug lamp and is designed to attract insects. 14. A black light lamp: a lamp that is marketed as a black light lamp and radiates predominantly ultraviolet light. 15. An infrared lamp: a lamp that is marketed as an infrared lamp and that emits more than 90 per cent of its radiation in

the 0.7 µm to 10 µm range of the electromagnetic spectrum.Commencement

GREENER DIESEL — RENEWABLE FUEL CONTENT REQUIREMENTS FOR PETROLEUM DIESEL FUEL

PART I INTERPRETATION AND APPLICATION

Interpretation

1. (1) In this Regulation, “bio-based diesel” means any liquid fuel that, (a) is suitable for use in a diesel engine, and (b) is derived from biological matter that is available on either a renewable or recurring basis; “blended diesel” means a combination of petroleum diesel and bio-based diesel; “compliance period” means, (a) the period of time beginning Apri1 1, 2014 and ending December 31, 2015, (b) the period of time beginning January 1, 2016 and ending December 31, 2016, or (c) after the period of time mentioned in clause (b), a calendar year;“facility” means, (a) a site, vehicle, vessel or other place where a fuel supplier undertakes the manufacture of petroleum diesel or the

blending of petroleum diesel with bio-based diesel, or (b) a site, vehicle, vessel or other place where petroleum diesel is received pursuant to an inter-refiner agreement;“fuel supplier” means a person who, in Ontario, (a) manufactures petroleum diesel or blends petroleum diesel with bio-based diesel and uses it or sells it at wholesale or

retail, (b) imports petroleum diesel or blended diesel and uses it or sells it at wholesale or retail, or (c) acquires petroleum diesel or blended diesel through an inter-refiner agreement and uses it or sells it at wholesale or

retail; “GHGenius model” means version 4.03a or, if a subsequent version is adopted by the Director, the subsequent version of the

spreadsheet model of that name, made available at one or more websites specified by the Director; “greenhouse gas intensity” means the greenhouse gas emissions attributable to a fuel quantified using the GHGenius model

and expressed in grams of carbon dioxide equivalent emissions per megajoule of energy;“import” means to import into Ontario from outside Ontario; “inter-refiner agreement” means an arrangement between refiners for the transfer of petroleum diesel or blended diesel, and

includes arrangements to purchase, sell or exchange petroleum diesel or blended diesel; “Northern Ontario” means all those parts of Ontario lying north and west of the Mattawa River, Lake Nipissing and the

French River, including the Territorial District of Manitoulin; “petroleum diesel” means a liquid petroleum fuel that, (a) is sold or represented as diesel fuel or as a fuel suitable for use in a diesel engine, (b) is subject to evaporation at atmospheric pressure, and (c) boils within the range of 130°C to 400°C;

“professional engineer” means a person who holds a licence, limited licence, provisional licence or temporary licence under the Professional Engineers Act.

(2) For the purposes of this Regulation, a volume of petroleum diesel or blended diesel is “placed in the Ontario market” if a fuel supplier, (a) manufactured and used it or sold it, at wholesale or retail, in Ontario; (b) imported it and used it or sold it, at wholesale or retail, in Ontario; or (c) acquired it in Ontario through an inter-refiner agreement and used it or sold it, at wholesale or retail, in Ontario. (3) For the purposes of this Regulation, petroleum diesel or blended diesel is not distributed if it is transferred from one refiner to another as the result of an inter-refiner agreement. (4) For the purposes of any calculations under this Regulation, if a volume of petroleum diesel or blended diesel is placed in the Ontario market more than once, only the fuel supplier that first placed it in the Ontario market shall account for it. Application

2. (1) Parts II, III and IV do not apply with respect to petroleum diesel or blended diesel that, (a) enters Ontario in the fuel tank of a vehicle and that is used to power that vehicle; or (b) is in transit through Ontario from a place outside Ontario to another place outside Ontario, if the fact of the transit can

be established by written evidence. (2) Other than clause 7 (2) (d) and section 8, Parts II, III and IV do not apply with respect to bio-based diesel, blended diesel or petroleum diesel that the fuel supplier reasonably expects, at the time of sale, will be used for the purposes of generating power in an aircraft or in a furnace or boiler to produce heat. (3) Other than section 8, Parts II, III and IV do not apply with respect to blended diesel or petroleum diesel that, (a) is manufactured for distribution outside Ontario or destined for distribution outside Ontario, if the fact of the

manufacturing for distribution outside Ontario can be established by written evidence; or (b) is imported to be used in Ontario in scientific research other than marketing research or studies of consumer preferences

relating to petroleum diesel or blended diesel, if the fact of the use for scientific research can be established by written evidence.

PART II BLENDED DIESEL QUALITY STANDARDS

Quality standards for blended diesel

3. (1) No fuel supplier shall distribute blended diesel for use or sale in Ontario unless the blended diesel meets the standards set out in one of following documents: 1. Canadian General Standards Board (CGSB) document CAN/CGSB – 3.520-2011 – Automotive Diesel Fuel Containing

Low Levels of Biodiesel (B1-B5), as amended from time to time. 2. Canadian General Standards Board (CGSB) document CAN/CGSB – 3.522-2011 – Diesel Fuel Containing Biodiesel

(B6-B20), as amended from time to time. 3. Canadian General Standards Board (CGSB) document CAN/CGSB – 3.524-2011 – Biodiesel (B100) for Blending in

Middle Distillate Fuels, as amended from time to time. 4. Canadian General Standards Board (CGSB) document CAN/CGSB – 3.517-2013 – Diesel Fuel, as amended from

time to time. 5. American Society for Testing and Materials (ASTM) document ASTM – D6751-12 – Standard Specification for

Biodiesel Fuel Blend Stock B100 for Middle Distillate Fuels, as amended from time to time. 6. American Society for Testing and Materials (ASTM) document ASTM – D7467-13 – Standard Specification for

Diesel Fuel Oil, Biodiesel Blend (B6 to B20), as amended from time to time. 7. American Society for Testing and Materials (ASTM) document ASTM – D975-14 – Standard Specification for Diesel

Fuel Oils, as amended from time to time. 8. A set of standards and specifications that is considered by the Director to be equivalent to one of those set out in

paragraphs 1 to 7 and that is approved in writing by the Director before the distribution of the blended diesel. (2) If a fuel supplier seeks approval of a set of standards and specifications for the purposes of paragraph 8 of subsection (1), the fuel supplier shall provide the Director with whatever information, including methods and protocols for testing, that is required to satisfy the Director that the standards and specifications are equivalent to one of those set out in paragraphs 1 to 7 of subsection (1).

(3) Compliance with a standard mentioned in subsection (1) shall be determined in accordance with the test methods and requirements set out in the standard that is applied.

PART III MINIMUM BIO-BASED DIESEL CONTENT

Minimum bio-based diesel content

4. (1) Every fuel supplier shall ensure that the petroleum diesel and blended diesel that it places in the Ontario market for the compliance period beginning Apri1 1, 2014 and ending December 31, 2015 contains an Average Adjusted Volume of bio-based diesel of at least two per cent calculated in accordance with the compliance formula in subsection 6 (1). (2) Every fuel supplier shall ensure that the petroleum diesel and blended diesel that it places in the Ontario market for the compliance period beginning January 1, 2016 and ending December 31, 2016 contains an Average Adjusted Volume of bio-based diesel of at least three per cent calculated in accordance with the compliance formula in subsection 6 (2). (3) Every fuel supplier shall ensure that the petroleum diesel and blended diesel that it places in the Ontario market for each compliance period after the compliance period ending December 31, 2016 contains an Average Adjusted Volume of bio-based diesel of at least four per cent calculated in accordance with the compliance formula in subsection 6 (3).Rules for applying compliance formulas

5. (1) For the purposes of the formulas in subsections 6 (1) and (2), petroleum diesel that the fuel supplier distributed to, from or within Northern Ontario may be deducted from the total amount of petroleum diesel it placed in the Ontario market for the compliance periods beginning Apri1 1, 2014 and January 1, 2016, if the fuel supplier, (a) elects to deduct the amount in accordance with clause 7 (2) (c); and (b) can establish by written evidence that the petroleum diesel was distributed to, from or within Northern Ontario during

the relevant compliance period. (2) For the purposes of the formulas in section 6, a fuel supplier may transfer a portion of the volume of bio-based diesel that it placed in the Ontario market during a compliance period from its records and books of account to the records and books of account of another fuel supplier for the same compliance period. (3) In calculating “y” for the purposes of the formulas in section 6, the fuel supplier shall, (a) comply with any written directions by the Director made under subsection (4); (b) ensure that a professional engineer is of the opinion that, (i) the primary data used to calculate “y” are reasonable, and (ii) the calculation of “y” is correct. (4) The Director may issue written directions as to the manner in which the following types of data are to be input into the GHGenius model: (a) primary data, consisting of quantified values of products, materials or energy flows that enter and leave a production

process or activity, directly measured, calculated or obtained and based on specific original source measurements; and (b) secondary data, consisting of quantified values of products, materials or energy flows that enter and leave a production

process or activity, indirectly measured, calculated or obtained and not based on specific original source measurements.Compliance formulas

6. (1) The following formula shall be used to calculate whether a fuel supplier is in compliance with subsection 4 (1) for the compliance period beginning April 1, 2014 and ending December 31, 2015:

Average Adjusted Volume (expressed as a per cent) = [{A [(91.9-y)/27.6] + B – C} / (D + E – F)] × 100where, “A” is the volume of bio-based diesel that the fuel supplier placed in the Ontario market during the compliance period, “B” is the volume of bio-based diesel transferred from the records and books of account of other fuel suppliers under

subsection 5 (2), “C” is the volume of bio-based diesel transferred to the records and books of account of other fuel suppliers under subsection

5 (2), “D” is the volume of petroleum diesel that the fuel supplier placed in the Ontario market during the compliance period, “E” is the volume of blended diesel that the fuel supplier placed in the Ontario market during the compliance period,

“F” is the volume of petroleum diesel and blended diesel that the fuel supplier distributed to, from or within Northern Ontario during the compliance period if the fuel supplier has elected under subsection 5 (1),

“y” is the greenhouse gas intensity of the bio-based diesel that the fuel supplier placed in the Ontario market during the compliance period, calculated on a weighted average basis by volume.

(2) The following formula shall be used to calculate whether a fuel supplier is in compliance with subsection 4 (2) for the compliance period beginning January 1, 2016 and ending December 31, 2016:

5 (2), “D” is the volume of petroleum diesel that the fuel supplier placed in the Ontario market during the compliance period, “E” is the volume of blended diesel that the fuel supplier placed in the Ontario market during the compliance period, “F” is the volume of petroleum diesel and blended diesel that the fuel supplier distributed to, from or within Northern

Ontario during the compliance period if the fuel supplier has elected under subsection 5 (1), “y” is the greenhouse gas intensity of the bio-based diesel that the fuel supplier placed in the Ontario market during the

subsection 5 (2), “C” is the volume of bio-based diesel transferred to the records and books of account of other fuel suppliers under subsection

5 (2), “D” is the volume of petroleum diesel that the fuel supplier placed in the Ontario market during the compliance period, “E” is the volume of blended diesel that the fuel supplier placed in the Ontario market during the compliance period, “y” is the greenhouse gas intensity of the bio-based diesel that the fuel supplier placed in the Ontario market during the

compliance period, calculated on a weighted average basis by volume.

PART IV REPORTS AND RECORDS

Compliance reports

7. (1) On or before March 31 of the calendar year following a compliance period, every fuel supplier shall file a report with the Director respecting its compliance with this Regulation in the previous compliance period. (2) The report shall be in a form acceptable to the Director and shall contain, at a minimum, (a) information identifying the fuel supplier and the officer who submits the report; (b) the result of the calculation done under subsection 6 (1), (2) or (3), the values used in reaching that result and the

rationale for the use of the values used in the calculation; (c) in the case of a fuel supplier who elects to deduct petroleum diesel under subsection 5 (1), a statement to that effect; (d) in the case of a fuel supplier who placed bio-based diesel, blended diesel or petroleum diesel in the Ontario market

during a compliance period that the fuel supplier reasonably expected to be used for the purpose of generating power in an aircraft or in a furnace or boiler to produce heat, a statement to that effect and the volume of bio-based diesel, blended diesel or petroleum diesel that was sold for those purposes; and

(e) sufficient information to determine compliance with the requirements of this Regulation and to verify the calculation done under subsection 6 (1), (2) or (3).

(3) The report filed under subsection (1) shall also contain the volume and greenhouse gas intensity, calculated on a weighted average basis by volume of the bio-based diesel contained in the blended diesel that the fuel supplier placed in the Ontario market during each quarter of the previous compliance period. Records

8. (1) Every fuel supplier shall keep at its principal place of business in Ontario records and books of account with respect to each of its facilities in Ontario and each of its transactions in Ontario involving the acquisition, blending, distribution, manufacture or use of petroleum diesel, bio-based diesel or blended diesel. (2) The records and books of account referred to in subsection (1) shall be in such form and contain such information as will enable the accurate determination of compliance with this Regulation, including, (a) the data collected and calculations done for the purposes of section 6, including the volumes and associated greenhouse

gas intensity values; (b) dated records of meter readings, bills of lading, invoices, sales receipts, records of payment and records of transaction

for volumes of bio-based diesel, blended diesel or petroleum diesel that are, (i) used, distributed or blended, (ii) transferred to or from another fuel supplier or facility, (iii) imported, or (iv) exported from Ontario; (c) identifying information about the fuel suppliers and facilities mentioned in subclause (b) (ii); (d) dated contracts, records of transfer, invoices and records of payment for volumes of bio-based diesel that are transferred

between fuel suppliers in Ontario; and (e) written evidence that the opinion required under clause 5 (3) (b) was obtained from a professional engineer. (3) Every fuel supplier required to keep business records and books of account under subsection (1) shall maintain every such record and book of account, as well as any other document necessary to verify the information in such record or book of account, for a period of seven years following the end of the relevant compliance period, unless written permission for their disposal is received from the Director.

Amending Reg. 720 of R.R.O. 1990(MANUFACTURERS’ LICENCES)

1. Regulation 720 of the Revised Regulations of Ontario, 1990 is amended by adding the following section: 3.2 (1) In this section,“farmers’ market” means a central location at which a group of persons who operate stalls or other food premises meet to sell

or offer for sale to consumers products that include, without being restricted to, farm products, baked goods and preserved foods, and at which a substantial number of the persons operating the stalls or other food premises are producers of farm products who are primarily selling or offering for sale their own products;

“production site” means property that is used by a manufacturer primarily for the alcoholic fermentation and production of Ontario wine;

“Vintners Quality Alliance wine” (VQA wine) has the same meaning as in the Vintners Quality Alliance Act, 1999. (2) If the holder of a manufacturer’s licence manufactures VQA wine and if the Registrar, under clause 3 (1) (e) of the Liquor Control Act, authorizes the manufacturer to sell the wine at an occasional extension of a winery retail store that the manufacturer owns and operates at its production site, where the extension is within a farmers’ market, the manufacturer’s licence is subject to the following conditions: 1. The manufacturer shall comply with any authorization of the Registrar relating to the store. 2. The municipality, if any, in which the farmers’ market is located has not advised the Registrar in writing that it objects

to the sale. 3. The manufacturer shall provide the Registrar with notice of the location and dates of the intended sales in advance. 4. The manufacturer shall ensure that its VQA wine offered for sale at the farmers’ market is transported from the

manufacturer’s store to the farmers’ market each day and any unsold product is returned to the manufacturer’s store by the end of the day.

5. The manufacturer shall ensure that any sampling that it conducts in conjunction with the sale is conducted in accordance with the guidelines on sampling set out in the document entitled “Sampling Guidelines for Liquor Manufacturers”, dated July 2012, published by the Registrar and available through the website of the Alcohol and Gaming Commission of Ontario.

6. The manufacturer shall ensure that any person involved in the sale or sampling of liquor holds a certificate demonstrating the successful completion of a server training course approved by the Board.

(3) The document incorporated by reference under paragraph 5 of subsection (2) includes amendments made to the document from time to time after Ontario Regulation 98/14 is made. (4) Nothing in this section authorizes the establishment or operation of farmers’ markets at which all or a substantial number of the products sold or offered for sale are VQA wines.Commencement

The Ontario Gazette is published every Saturday. Advertisements/notices must be received no later than 3 pm on Thursday, 9 days before publication of the issue in which they should appear. For weeks including Easter Monday, November 11th or a statutory holiday allow an extra day. Advertising rates and submission formats:

1) Please submit all notices in a Word.doc format to: [email protected]

2) For a first insertion electronically submitted the basic rate is $75 up to ¼ page.

3) For subsequent insertions of the same notice ordered at the same time the rate is $40 each.

4) Clients may confirm publication of a notice by visiting The Ontario Gazette web site at: www.ontario.ca/gazette or by viewing a printed copy at a local library.

Subscriptions:

The annual subscription rate is $126.50 + H.S.T. for 52 or 53 weekly issues beginning the first Saturday in January, payable in advance. In-year new subscriptions will be pro-rated for the first year. A new subscriber may order back issues of the Gazette at the single-copy rate as inventory permits.
