1 Open Letter From Retirees: After extensive hearings by the Judiciary Committee of the U.S. House of Representatives on the NFL’s compensation of retired players, congressional investigators concluded that: “The evidence suggests that the vast majority of players needing benefits did not receive them.” The investigators went on to note the irony in the operation of the NFL retirement system was that the NFL continued “to profit from these very same players who [were] denied benefits.” The failings of the retirement system were acknowledged as late as April of this year by the League in a letter to all retirees. The letter forthrightly expressed that increased benefits i n both pensions and programs were nee ded to make material differences in the well b eing of retirees. The new executive director of the former players’ union likewis e acknowledged that the present retirement system was inadequate for some retirees, stating that “when it comes to benefits for pre-1993 players the current system is not working.” As retirees, we must ask, why is there a gap, how big is the gap and how best can the gap be closed? The answers to these questi ons are necessary, as Mark Mur phy and Jerry Richardson explained, to do what’s “fair” and “right” by retirees. The problem arose because retiree rights and needs were not of foremost concern to the previous players’ union. The former executive director of the NFLPA publicly declared that neither he nor the union worked for retired players; retirees didn’t hire him and couldn’t fire him. It was the players, he made clear, who have the vote and paid his salary. The former union operated as if they owed no fiduciary duty to protect or promote the interests of retirees as a group. In the absence of a committed retiree advocate, the League awarded and increased benefits as it saw fit, creating a gap which consistently widened over time. In March of 2011, the existing collective bargaining agreement between the union and the League expired. The players decertified the union and in support of their claimed bona fide intention in doing so, declared that the NFLPA had renounced its status as a collective bargaining agent for all players. Consequently it explained that neither the NFLPA nor any of its members had the authority or autho rization to engage in collective bargaining discussions, grievance processing or any other activities associated with collective bargaining for players at either the club or league level. In order to emphasize the withdrawal of all such authority, on March 11 th , the NFLPA amended its by laws to prohibit it or its members from engaging in any form of collective bargaining with the NFL o r the NFL team owners or agen ts.
